S�B�E=T: Special Encroachment Permit - Rector Cadillac, 1010 Cadillac Way
Recommendation.
It is requested Council approve the attached Special Encraochment Permit request to use City
lands adjacent to Rector Cadillac for the new car dealership in accordance with the attached
plans and application. It is subject to the following conditions:
1. That the planting strip area adjacent to the sidewalk be 2' minimum in
width and be irrigated.
2. That the Park Department approve all planting and irrigation.
3. That the requested wall height be 16" minimum.,
4. That this Special Encroachment permit shall supercede existing lease agreement.
5. Cost of the special Rermit to be $1200 per year prorated effective the date Of
this Special Encroachment permit.
6. That the Beautification Commission review and approve any tree removals for this
permit.
7. That a State Encroachment Permit if required, be obtained by the applicant prior
to the start of construction.
8. That all work shall conform to qlans dated April 10, 1986, except as modified
above.
9. That insurance naming the City as additional insured be provided to the City
Attorney's satasfaction. �
Background.
Rector Cadillac has requested use of City lands up to the sidewalk areas for nlanting,
a fence tyoe wall and parking area for vehicles at that dealership. The purpose of the
wall is to help prevent theft off the lot and to give a planting area in front of the wall
to allow the area to look more attractive.
The applicant has requested the installation of this wall and the removal of the existing
eucalyptus trees fronting Rollins Road as a part of this permit. As indicated in the
conditions above, staff suggests that the tree removal issue be brought before the
Beautification Commission for their review and approval.

The City has an existing lease agreement with Rector Cadillac for a portion of the City
lands between the Rector Cadillac property line and the back of sidewalk. This lease
was authorized in 1968 and has had a yearly cost of $600. The conditions above pronose
that the lease be terminated and replaced by the Special Encroachment permit. Since the
area is aporoximately twice that of the previous lease, staff suggests that it would be
appropriate to allow the use of the entire area to be $1200 per year.
The applicant's request was for an 8" to 24" variable heioht wall. In review of the
applicant's request, staff has conditioned the permit that it be at least two blocks or
16" high to ensure that the vehicles which oark behind the wall do not extend over the wall
and into the planting strip area. Staff has also increased the requested planting area from
12" as originally submitted, to 2' minimum as conditioned above. The applicant has no ob-
jection to these changes. Other details of the exact construction and clearances around the
trees, if they are not allowed to be removed and around existing utility facilities and traf-
fic signal controller cabinets, will be worked out with the applicant prior to construction.
This permit will be issued subject to the standard conditions that it is revokable at anv
time by the City and that it is up to the applicant to maintain the wall and all facilities
within the City area in a manner acceptable to the City of Burlingame.

and subject to all of the terms, conditions and restrictions set forth
herein, permission is hereby granted to use City street right-of-way to
install plantinq, irriqation concrete block wall and automobile parking for new car
dealership, said area fronting both Broadway and Rollins Road.

General Provisions
1. Definition; Revocability. The term "encroachment" is used
in this permit to mean any structure or object of any kind or character
which is placed in, under, or over, any nortion of the right-of-way of
the City of Burlingame. This permit is revocable onsiXty (b0i days
notice.
2. Acceptance of provisions. It is understood and agreed by
the permittee tnat the doing of any work under this permit shall consti-
tute an acceptance of the provisions.
3. No precedent established. This permit is granted with the
understanding that this action is not to be considered as establishing
any precedent on the question of the expediency of oermitting any
� certain kind of encroachment to be erected within rights-of-way of the
City of Burlingame.

4. Notice prior to startin work. Before starting work on
which an inspection is required, or whenever stated on the face of this
permit, the permittee shall notify the Director of Public Works or
other designated employee of the City. Such notice shall be given at
least three (3) days in advance of the date work is to begin.
5. Permit on premises. This permit shall be kept at the site
of the work and must be shown to any representative of the City, or
any law enforcement officer on demand.
6. Protection of traffic. Adequate provision shall be made
for the protection of the public. All work shall be planned and
carried out so that there will be the least possible inconvenience to
the public.
7. Storage of material. No material shall be stored on the
City right-of-way.
8. Clean up. Upon completion of the work, all brush, timber,
scrap and material shall be entirely removed and the right-of-way left
in as presentable a condition as before work started.
9. Standards of construction. All work shall conform to
recognized standards of construction.
10. Supervision of City. All the work shall be done subject
to the supervision of, and to the satisfaction of, the City.
11. Future moving of installation. It is understood by the
perr.iittee that whenever construction, reconstruction or maintenance
, work on the right-of-way may require, the installation orovided for
herein shall, upon request of the City, be immediately removed by and
at the sole expense of the permittee.
12. Liability for damages. The permittee is responsible for
all liability for personal injury or property damage which may arise
out of work herein permitted, or which may arise out of failure on the
permittee's part to perform his obligations under this oermit in
respect to maintenance. In the event any claim of such liability is
made against the City, or any department, officer, or employee thereof,
permittee shall defend, indemnify and hold :them, and each of them,
harmless f rom such claim. Permits shall provide evidence of insurance satisfactory
to the City Attorney. All such insurance shall be primary and name the City as an ad-
ditional insured.. 13. Careof drdindae. If the work herein contemplated shall
interfere with the established drainage, ample provision shall be made
by the permittee to provide for it as may be directed by City.

14. Location plan. Upon completion of the work under this permit,
the permittee shall furnish a plan to the City showing location in detail.
15. Maintenance. The permittee agrees, by the accpetance of this
permit, to exercise reasonable care to maintain properly an encroachment
placed by it in the City right-of-way, and to exercise reasonable care in
inspecting and immediately repairing and making good any injury to any
portion of the right-of-way which occurs as a result of the maintenance
of the encroachment in the right-of-way, or as a result of work done under
this permit, including any and all injury to the right-of-way which would
not have occurred had such work not been done or such encroachment not
placed therein. Maintenance shall include any damage that may be caused
by roots of City trees.
16. Commencement of work. This permit shall be void unless the
work herein contemplated shall have been completed before January 15, 1986.
17. Recording. This permit shall be recorded by the City Clerk

with the County Recorder o£ the County of San Mateo.
18. Conditions. This permit is subject to the following conditions:
