NSTTFIC&TION
The property for which the attached variance is being applied for,
is located at the southwest corner of the northern terminus of Broadway
at the foot of the overpass approach to Baqshore. This particular parcel
is observed by all entering or leaving Burlingame by Broad�ay and is one
pareel that is necessaril9 viewed by all using the overpass to the free-
aray. �►s a result of its location it is to the interest of the city and
all the residents that it be improved and beautified. �►t the present
time this particular parcel is being used as a storage lot for building
material� and its elevation is some several feet below the adjoining
property.
In recent years the construction of gasoline service stations is
done with the thought of attractiveness and it is the policy of the
various oil companies maintaining these stations to beautify them with
proper appointments and to maintain them in a most clean and orderly
fashion. This property is ideal.ly located for a gasoline service
station due to its proximity to th e Bayshore FreewBy and its contiguous
position to the approaches thereto. The construction therefore of a
gasoline service station on this particular property will not only
beautiPy the approach to Broadv�ay, Burlin.game but will be a convenience
to residents of Broad�►ay, Burlingame going to and leaving Bayahore
Fre ewsy.
It is the intention of the applicant to construct an outstanding
service station on this p arcel oi' property and in this connection to
show his good faith he has engaged a licensed architect to prepare pre-
liminary drawings of proposed station to be located oa this land, in the
event this application is favorably acted upon by your Honorable Com-
mission and Council. �► copy of these drawir�s is attached hereto ior
your review and consideration. This applicant can assure both your
Coa�nission and Council that any structure erected on this property for
the purpose of conducting a gasoline service station will be of first
class nature, one in keeping with the approach to Broadway, Burlingame,
and that it will be maintained in a clean and orderly fashion. It is
also the intention of your applicant to landscape that part of the proper-
ty not necessary for use as a�asoline station to add to the beauty of
the approach to Broadwa�, Burlingame.
It is respectfully submitted by your applicant that a benefit will
be received by the city should this application be granted and request is
made for your favorable consideration of this application for variance.

to use a portion of State property to provide an in�ress and egress to

Daniel J. �reedon, attorney representir.� the applicant, advised that permission
for a variar_ce must first be obtained from the City Council and thereafter �n
�pplication be made to the State llivision of �iighvrays for permission to use
a portion of State Highv�ray property to provide an ingress and egress to the
proposed �asoline service station.
The City Clerk read ttivo letters received in protest to the proposed construction.
In a letter dated July 13, 1954, from Antonio and iviaddalona Zaro, a protest U�as
entered that entrance of further �asoline stations in the area may lead to
sevQre and destructive competition. In a letter dated July 9, 1954, a protest
vJas received from the Eurlingame Shore Land Co. advising that a buildin� permit
has been granted to the�Union Oi1 Co to construct a gasoline station on the
eoutheast corner of Indu�trial 1-Vay and the BaysYioro Service Road and if a
vuriance ti^�ere �ranted to the foregoin� property, it ti,rould be in con.flict with
the City�s existing ordinance prohibiting more than one service station within
a distance oi' 490 feet.
Cyrus i���cP.2illan, attorney representin� the Burlin�ame Shore Land Co., requosted
the Council to conf orm to re�ulations provided in the zoning ordinance by
denying the application.
P,Ir. Creedon, upon being questioned by the Council, �avo assurance that the
gasoline station ti�ould be operated and maintained by a reputable firm and the
structure and the landscape desi�ned so as to be an asset to the City of
Burlingame.
Councilman T:iorgan thereafter moved that the Council concur �aith the recommenda-
ti on of t he Planni ng Commi s si on �nd tha t the vAri ance be grante d, ���i th the
stipulation that the applicant obtain permission from the State Division of
Highv�nys to use a portion of state property for the purpose of providing an
ingress and egross to the proposod ��soline station. The mot-ion V�as seconded
by Councilman Love un d unanimously carried.
