Applicant and Property Owner: Angus Gavin General Plan: Low Density Residential APN: 025-224-150 Lot Area: 16,942 SF Zoning: R-1 Environmental Review Status: The project is Categorically Exempt from review pursuant to the California Environmental Quality Act (CEQA), per Section 15303 (a), which states that construction of a limited number of new, small facilities or structures including one single family residence or a second dwelling unit in a residential zone is exempt from environmental review. In urbanized areas, up to three single-family residences maybe constructed or converted under this exemption. August 12, 2013, Regular Action Meeting: At the Planning Commission RegularAction meeting on August 12, 2013, the Commission had several questions and comments regarding the proposed landscape screening between the subject property and the neighboring properties on Drake Avenue and regarding the proposed railing for the wooden walkway along the right side of the house. It voted to continue the item to the Regular Action Calendar when the plans have been revised as directed (August 12, 2013, Planning Commission Minutes). The applicant submitted a response letter and revised plans on August 14, 2013, and e-mail correspondence with the neighbors on August 15, 2013, to address the Planning Commission's comments. The response letter from the applicant identifies all changes made to the proposed project. Please refer to the copy of the August 12, 2013 Planning Commission minutes included in the staff report forthe list of Planning Commission questions and comments. Project Description: The applicant is proposing to demolish an existing single story house with an attached garage and to build a new, two-story single family dwelling with an attached garage. The proposed house and attached garage will have a total floor area of 4,545 SF (0.27 FAR) where 6,521 SF (0.38 FAR) is the maximum allowed (including covered porch and chimney exemptions). The proposed project is 1,976 SF below the maximum allowed FAR. The new single family dwelling will contain five bedrooms. Three parking spaces, two of which must be covered, are required and provided on site in the attached garage. One uncovered space is provided in the driveway. The applicant has submitted an application for a Parking Variance for not providing the required 24' back up area from the attached garage due to the location of an existing, protected size Oak tree that will remain on the property (approximately 19' to existing protected size Oak tree proposed). All other Zoning Code requirements have been met. The applicant is requesting the following applications: ■ Design Review for a new, two-story single family dwelling and attached garage (C.S. 25.57.010); ■ Special Permit for an attached two-car garage (CS 25.26.035, (a)); and ■ Parking Variance for not providing the required 24' back up area from the attached garage (approximately 19' to Oak tree proposed) (CS 25.70.030 (b)). CS 25.26.075 ' The standard requirements for front setback to an attached garage do not apply in this instance because the main portion of the lot is set so far back and is not visible from the street. 2 (0.32 x 16,942 SF) + 1,100 SF = 6,521 SF (0.38 FAR) Staff Comments: See attached memos from the City Engineer, Chief Building Official, Parks Supervisor, Fire Marshal and Stormwater Coordinator. Design Review Study Meeting: At the Planning Commission Design Review Study meeting on July 22, 2013, the Commission had several questions and comments regarding the proposed project and voted to place this item on the Regular Action Calendar (see attached July 22, 2013 Planning Commission Minutes). The applicant submitted revised plans on July 26, 2013 and a response letter on July 31, 2013, to address the Planning Commission's comments. The response letter from the applicant identifies all changes made to the proposed project. Please refer to the copy of the July 22, 2013 Planning Commission minutes included in the staff report for the list of Planning Commission questions and comments. Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the Council on April 20, 1998 are outlined as follows: 1 2 3 4 5 Compatibility of the architectural style with that of the existing character of the neighborhood; Respect for the parking and garage patterns in the neighborhood; Architectural style and mass and bulk of structure; Interface of the proposed structure with the structures on adjacent properties; and Landscaping and its proportion to mass and bulk of structural components. 2 Design Review, Special Permit and Parking Variance 1521 Cabrillo Avenue Findings for a Special Permit: In order to grant a Special Permit for an attached garage, the Planning Commission must find that the following conditions exist on the property (Code Section 25.51.020 a-d): (a) The blend of mass, scale and dominant structural characteristics of the new construction or addition are consistent with the existing structure's design and with the existing street and neighborhood; (b) the variety of roof line, facade, exterior finish materials and elevations of the proposed new structure or addition are consistent with the existing structure, street and neighborhood; (c) the proposed project is consistent with the residential design guidelines adopted by the city; and (d) removal of any trees located within the footprint of any new structure or addition is necessary and is consistent with the city's reforestation requirements, and the mitigation for the removal that is proposed is appropriate. Planning Commission Action: The Planning Commission should conduct a public hearing on the application, and consider public testimony and the analysis contained within the staff report. Action should include specific findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any action should be stated clearly for the record. At the public hearing the following conditions should be considered: that the project shall be built as shown on the plans submitted to the Planning Division date stamped August 14, 2013 sheets A.1 through G.1, L1.0, L2.0 and Partial Topographic Map; 2. that any changes to building materials, exterior finishes, windows, architectural features, roof height or pitch, and amount or type of hardscape materials shall be subject to Planning Division or Planning Commission review (FYI or amendment to be determined by Planning staf�; 3. that any changes to the size or envelope of the basement, first or second floors, or garage, which would include adding or enlarging a dormer(s), shall require an amendment to this permit; 4. that the conditions of the City Engineer's April 1, 2013 memo, the Chief Building Official's March 7, 2013 memo, the Parks Supervisor's June 28, 2013 and March 12, 2013 memos, the Fire Marshal's July 1, 2013 and March 4, 2013 memos, and the Stormwater Coordinator's June 25, 2013 and March 5, 2013 memos shall be met; 5. that the property owner shall be responsible for implementing and maintaining all tree protection measures as defined in the arborist report prepared by Mayne Tree Expert Company, Inc., dated February 27, 2013; 6. that if the structure is demolished or the envelope changed at a later date the Parking Variance as well as any other exceptions to the code granted here will become void; 7. that any recycling containers, debris boxes or dumpsters for the construction project shall be placed upon the private property, if feasible, as determined by the Community Development Director; 8. that demolition for removal of the existing structures and any grading or earth moving on the site shall not occur until a building permit has been issued and such site work shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 9. that prior to issuance of a building permit for construction of the project, the project construction plans shall be modified to include a cover sheet listing all conditions of approval adopted by the Planning Commission, or City Council on appeal; which shall remain a part of all sets of approved plans 3 Design Review, Specia/ Permit and Parking Variance 1521 Cabrillo Avenue throughout the construction process. Compliance with all conditions of approval is required; the conditions of approval shall not be modified or changed without the approval of the Planning Commission, or City Council on appeal; 10. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination and installed on the portions of the roof not visible from the street; and that these venting details shall be included and approved in the construction plans before a Building permit is issued; 11. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall require a demolition permit; 12. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2010 Edition, as amended by the City of Burlingame; THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION: 13. that prior to scheduling the foundation inspection, a licensed surveyor shall locate the property corners, set the building footprint and certify the first floor elevation of the new structure(s) based on the elevation at the top of the form boards per the approved plans; this survey shall be accepted by the City Engineer; 14. that prior to scheduling the framing inspection the project architect or residential designer, or another architect or residential design professional, shall provide an architectural certification that the architectural details shown in the approved design which should be evident at framing, such as window locations and bays, are built as shown on the approved plans; architectural certification documenting framing compliance with approved design shall be submitted to the Building Division before the final framing inspection shall be scheduled; 15. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof ridge and provide certification of that height to the Building Division; and 16. that prior to final inspection, Planning Division staff will inspect and note compliance of the architectural details (trim materials, window type, etc.) to verify that the project has been built according to the approved Planning and Building plans. Associate Planner Strohmeier presented the report, reviewed criteria and staff comments. Sixteen (16) conditions were suggested for consideration. There were no questions of staff. Chair Sargent opened the public hearing. James Chu represented the applicant: Revised plan per Commission suggestions at the last meeting. Have had the opportunity to talk to the neighbors. Their concerns are mostly with the trees. We told them we have not yet decided which species, size or location. Can suggest a Condition of Approval that trees will be planted to provide some privacy screening to mitigate the issue. Eric/Applicant represented the property owner: To address the privacy concerns, have reduced the amount of windows on the main bedroom. Will have obscured glass on the second story where the stairwell is, and where the bedroom is. Going to include a hedge on the side yard where the PG&E easement is but has not determined exactly which species. Commission questions and comments: ■ Over last three weeks why hasn't the neighbor been spoken to? (Eric/Applicant: Spoke after the meeting here. Tried to meet with the neighbors last week, and they have had his contact information the entire time. The neighbor who is most concerned with the privacy was away at the time that he had available to physically visit the property.) ■ Is the PG&E easement the entire setback area? Will it be possible to plant a hedge there? (Eric/Applicant: Along the walkway there is an area for planters, on the side next to the fence.) ■ How tall is the hedge planned to be? What should we and the neighbors expect it to look like? (Eric/Applicant: It is expected to work to protect their privacy. Does not have an actual height worked out yet. It has to work for this property too so it does not obscure too much light. Their property is at an upslope so they get a view down into the property regardless. We will try to make that a view of a hedge rather than a person.) ■ OK with direction from PG&E on what can and cannot be done in that area? (Eric/Applicant: We only have a certain area we can build in. Will go up as high as allowed. Cannot plant in the actual easement area.) CITY OF BURLINGAME PLANN/NG COMMISSION — Unapproved Minutes August 12, 2013 ■ How high can the hedge go there? (Eric/Applicant: Lines are about 12 feet up or so.) ■ Above the front porch looks like material changed from shake to siding. It looks good, but it has not been called out on the drawings. (Chu: Will look into it. It is changing). ■ On the floor plan it shows the larger front porch. On the site plan there is a wooden walkway along the right-hand side. (Chu: Correct, it is four feet wide.) Will there need to be a railing there? It would look good to have a railing there based on the elevation shown for the front. (Chu: Yes there will be a rail. It will be designed by the landscape architect, probably wood). It would be a good idea to have a detail of the railing since it will be part of the design of the house. ■ Will the hedge on the left side be potted or in the ground? (Chu: It will be in the ground.) ■ Bamboo would be a great solution. It grows tall and straight, and provides a lot of screening. PG&E is probably OK with it. But look into the proper way to plant it, as it can be invasive. ■ Can one go from the porch to the deck? Or do you have to go around? (Chu: Can go between the columns.) ■ Concerned about the landscaping. We're told there will be screening planting but don't know where it is and what it will be. Looking at the plan and the utility easement, it looks like the easement is about five feet in from the fence line. If it turns out there can't be planting there, there will need to be planting where the plans currently show a path. It may need to be reversed. Looks like it could work but not sure what we would be approving at this point. ■ The revised porch is shown on site plan, but not on the landscape plan. The site plan shows a roof, but doesn't indicate whether the wood deck is at the same level as the porch. (Chu: The wood deck is at the same level as the porch.) ■ (Chu: The homeowner is willing to meet with the neighbors and go over to their back yards to see the area, and in particular the void where they can see the house. Thinks directly behind that area is where the shrub or privacy screening will be planted.) ■ (Eric/Applicant: The neighbor's concern is with privacy into her back yard. The obscured glass will take care of the bulk of the concern, and we're planning on putting shrubs against that fence either way. We'll make the shrubs as high as we need to.) ■ There has not been hard and fast coordination with PG&E to what can or cannot be planted, and where. Not sure how that will get reworked. Have also heard that there is concern with the hedge not being too tall so that light is able to come into the subject property. Not sure what the commitment to the landscape plan is here. ■ (Chu: Suggest come back as an FYI for changes to the landscape plan.) ■ Will the FYI be what the applicant is proposing or what the neighbor has signed off on? (Chu: Hopefully both. The neighbor has brought a photograph of the tree she wants. We haven't committed to that, but it is something we can look at.) ■ An FYI will not have a public notice. If we want to call it up for review there will be a public notice. There will need to be shown some form of commitment from the neighbors saying they have seen the FYI and concur, have concerns or object. If we don't know if the neighbors have seen it and they have not received public notices, we don't know if they're in agreement. ■ Could require as a Condition of Approval that the FYI include a letter from the neighbor indicating whether they support it. ■ (Guinan: The process for the FYI is that it comes to the Commission, and if it is not what was intended or satisfactory to the desires of the approved project, it would then be called up and noticed by staff for a formal hearing. Proposal here is to address that for this particular item by having the FYI include a letter from the neighbor indicating that the parties had met and they had agreed to a particular species of tree, where it will be planted, and how high. If that is submitted it would obviate the necessity to call it up for a hearing.) ■ There were a couple of neighbors who had the concerns (1532 and 1540 Drake Avenue). You should talk to both of them. (Eric/Applicant: We talked to them after the last meeting, but have not talked to them since. Gave out contact information and had two days last week available to visit, but did not talk to them.) � C/TY OF BURLINGAME PLANN/NG COMMISSION — Unapproved Minutes August 12, 2013 Public comments: Linda Ryan, 1532 Drake Avenue, spoke: ■ Has been available to discuss — was only out of town last week. ■ 1532 Drake slopes back. Has provided a panoramic picture. • Appears the applicant has not planned the landscaping on our side. I've gone on the internet and visited nurseries to determine what to plant. ■ We're concerned about privacy. Whoever buys the house will appreciate the privacy. It does not need to be a monster tree, but there are plenty of lovely evergreen shrubs that could create a privacy hedge. ■ There will be plenty of sun, even with a 15-foot tree. ■ Appreciate the obscured glass in the windows. ■ Just wants a specific answer to the landscaping before it gets approved. Doesn't want to see a only little 8-foot shrub. Just wants to make sure there will be some height. Chris McCrum, 1540 Drake Avenue, spoke: Appreciates the changes to the windows but the planting is important. The neighbors will need to live with the outcome after the house has been completed and sold. There were no further comments and the public hearing was closed. Commission comments: • Privacy is often an issue, but can only do so much because of the sizes of setbacks. Applicant has said they will commit to providing landscaping in the easement, so we have been focusing on that. • Likes house and the changes that were made, but the landscaping has not been worked out. Afraid if it comes back as an FYI there will be fewer options — things come in as an FYI but things are already built and cannot be undone, so it is more difficult resolve later than sooner. • The condition is a side yard up against back yards, not back yards up against each other, so the setbacks are different between the properties. The new house will be closer to the property line than if it was a back yard. So it is important to resolve because it is a unique situation. • Feels the item should be continued because the applicant has not had a chance to meet with the neighbors. Wants to address the concerns now. • Could work to the applicant's benefit because an FYI can always be called up, which would delay the review to the next meeting after that. Any of the neighbors could call the FYI up for a public hearing, and it can't be heard at that meeting. • Applicant has committed to doing a good job, but once it is built they will sell it and will be gone. No prejudice to that, the new owner moves in and inherits whatever happens. There needs to be harmony with the neighbors. • Not sure if there will be agreement, but need to have a proposal. It would be great if there can be agreement and know that PG&E was OK with it. • Also wants to show integration of the deck with the house and the railings on the elevation. We have issues with the proposed design and it's impact on our privacy. We have gotten a copy of the architects plans and have studied both the house and the landscape designs. From our backyard and deck the window in bedroom #4 and the staircase window will take away all our privacy. The landscape design plan does not include any privacy screening plants and trees behind us. We have included a panoramic colored photograph view from our deck to show how our privacy is being compromised. In order too limit the impact on our privacy we ask for the following changes. 1. Structural: Window in bedroom # 4 be reduced in size, frosted or elevated above direct view of our deck. We'd also like the staircase window reduced in size, frosted and/or elevated so that there is not a direct view across to us. 2. Landscape: We like a 20-30', fast growing evergreen tree put right in front of Bedroom# 4's window to give year round privacy. Our tree is deciduous so most of the year that tree gives no privacy. And we ask that a large tree is installed so that we don't have to wait 5-6 years to get have privacy. For ex. A California Pepper tree grows 25-40ft and can be purchased in 24" box containers for instant height. Both of these modifications would provide an effective privacy screen for our backyard and our family. We look forward to working with the developer and designer to make sure the value of our property and it's privacy is maintained. There are 5 trees that could be impacted by this proposed work. The lot is unique as it is along a creek with a small cottage across the creek. The 3 live oaks, Quercus agrifolia, are in very close proximity to the proposed demolition, construction, and landscaping. The creek may also present tree problems during demolition and construction. To protect the trunks during all phases of the construction, wrap trunks with 2 to 3 layers of the orange snow fence. Place 2x4s around trunks and wrap them with more orange fencing. Anather protection procedure would be to leave all hardscape during demolition and construction and leave this partion of construction until last. During work, care must be taken to not injure roots that have grown in contact with the existing foundation and for ones that may have grown under the asphalt and concrete hardscape. When the house and foundation are removed and also when the hardscape is removed, have the roots inspected so that any other root protection methods can be recommended. One method of root preservation, when roots are buried or covered, is to design an aeration system. This system, generally, is made with perforated PVC pipe interconnected with daylight at both ends. This system can be used for drainage and/or fertilizing, etc. Aeration systems can be placed in the base rock prior to asphalt, concrete, or pavers being placed. For a fill area, the pipes shauld be placed in gravel-filled trenches covered with filter fabric. By keeping construction in basically the same footprint, the trees should not be significantly impacted. The root zone of this old mature tree is covered with asphait, concrete, or homes. This, over many years, has resulted in tree stress as there are few leaves. The existing hardscape is to be removed and replaced with a paver system. i recommend having the tree fertilized when the root zone is exposed and an aeration system installed below the pavers. I also recommend pruning of the tree during demolition to remove larger deadwood and reduce heavier end weight. Wrap trunk prior to any work. Tree #2: 21.0-inch diameter Coast Live Oak left of the house, next to the fence. This tree appears healthy but has some included bark at the branch crotches. Be careful of roots during house and foundation removal and also during construction. Wrap trunk prior to any work. Tree #3: 32.4-inch diameter leaning {45°) Coast Live Oak behind the existing house. Old pruning wound has some decay. Raising and leveling the area around this tree is proposed as well as a retaining wall toward the creek; this will bury tt�e roots. To help offset this impact, install an aeration system that wili help drain this area and help with oxygen entering into the root zone. This system can be designed onsite with the contractor. Tree #4: 24-inch (est.) diameter Monterey Pine, Pinus radiata, across creek, covered with ivy. The tree is next to the existing cottage. This tree has pine pitch canker on several branch tips. This disease progresses slowly but eventually wil� kill the tree. 1 recommend removal of this tree. Be careful when removing to avoid stream bank damage and damage to the native buckeyes, Aesculus californica. This care should also apply to removal of the cottage. Tree #5: A group of Black Acacia, Acacia melanoxylon, across the creek, near the creek edge. They are not native, but do stabilize the stream bank and provide screen to the school. These t�ees are generally looked at as "weed trees" and a main source of pollen. THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION: 13. that prior to scheduling the foundation inspection, a licensed surveyor shall locate the property corners, set the building footprint and certify the first floor elevation of the new structure(s) based on the elevation at the top of the form boards per the approved plans; this survey shall be accepted by the City Engineer; 14. that prior to scheduling the framing inspection the project architect or residential designer, or another architect or residential design professional, shall provide an architectural certification that the architectural details shown in the approved design which should be evident at framing, such as window locations and bays, are built as shown on the approved plans; architectural certification documenting framing compliance with approved design shall be submitted to the Building Division before the final framing inspection shall be scheduled; 15. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof ridge and provide certification of that height to the Building Division; and 16. that prior to final inspection, Planning Division staff will inspect and note compliance of the architectural details (trim materials, window type, etc.) to verify that the project has been built according to the approved Planning and Building plans. .
