RECOMMENDATION•
City Council should hold a public hearing and take action. Affirmative
action should be by resolution and include supportive findings. The
reasons for any action should be clearly stated for the record. (Action
alternatives and findings for a Hillside Area Construction Permit are
included at the end of the staff report.)
Conditions considered by the Planning Commission:
1. that the addition and alterations shall conform to the plans
submitted to the Planning Department and date stamped June 1,
1993, Sheets A-1 through A-5;
2. that the finish material used on both the flat and sloping
portions of the roof shall be nonreflective and be approved by the
Chief Building Official and City Planner prior to installation;
3. that the highest point on the new roof of the remodeled house
shall not exceed elevation 531' and that the framing shall be
surveyed to confirm this elevation and the survey accepted by the
City Engineer before the final framing inspection is called for
and the roofing material is attached;
4. that the comment made by the Chief Building Official in his memo
of June 7, 1993 shall be met; and
5. that the project shall meet all the requirements of the Uniform
Building and Uniform Fire Codes as amended by the City of
Burlingame.
Planning Commission Action
Planning Commission held a public hearing on July 12, 1993 and voted 7-0
to deny the hillside area construction permit request for a 1106.5 SF
second floor addition and a 114.6 SF first floor addition at 2760
Burlingview Drive. Previously the applicant had submitted a project for
a substantially larger, new house to be built on the site. That project
was continued by the Planning Commission because of view impact on a
neighbor across the street. There was also some concern expressed about
the views of the next door neighbor across the rear of the lot. The

applicant chose to withdraw the new house proposal and submitted instead
the current proposal to remodel the existing house. In their action on
the remodel proposal the commissioners noted that the redesign solved one
view problem across the street (by shifting the second story addition to
the other side of the structure) and now another neighbor is impacted;
they noted that it is difficult to satisfy everyone.
BACKGROUND•
James Chu, architect, is requesting a hillside area construction permit
in order to add a second floor (1106.5 SF) and add 114.6 SF on the first
floor of the single story house at 2760 Burlingview Drive, zoned R-1.
All other zoning requirements are met by the project.
Neighbors within 100' were notified of the proposed remodel and two,
Terry McAloon, 2759 Burlingview, and Daniel and Mary Erwin, 2753
Burlingview, called the project up for review by the Planning Commission.
Both of these properties are across the street from the project site.
The applicant has placed a wooden structure which outlines the proposed
second story addition on the existing roof.

ACTION ALTERNATIVES
1. City Council may vote in favor of an applicant's request..
If the action is a variance, use permit, hillside area
construction permit, fence exception or sign exception, the
Council must make the findings as required by the code.
Findings must be particular to the:,given property and
request. Actions on use permits should.be by resolution. A
majority of the Council members seated during the public
hearing must agree in order to pass an affirmative motion.
2. City Council may deny an applicant�s request. The reasons
for denial should be clearly stated for the record.
3. City Council may deny a request without prejudice. This
action should be used when the application made to the City
Council is not the same as that heard by the Planning
Commission; when a Planning Commission action has been
justifiably, with clear direction, denied without prejudice;
or when the proposed project raises questions or issues on
which the Council would like additional information or
additional design work before acting on a project.
Direction about additional information required to be given
to staff, applicant and Planning Commission should be made
very clear. Council should also direct whether any
subsequent hearing should be before the Council or the
Planning Commission.
HILLSIDE AREA CONSTRUCTION PERMIT FINDINGS
Code Sec. 25.61.060: Review by the planning commission or city
council shall be based upon the obstruction by the construction of
the existing distant views of nearby properties. Emphasis shall be
given to the obstruction of distant views from habitable areas
within a dwelling unit.

City Attorney's memo of July 14 recommended council deny two claims for alleged injuries
from an accident on January 4 with a fire truck.

Finance Director recommended approval of Warrants 27442 - 27905, duly audited, in the
amount of $1,422,621.93 and Payroll Checks 57325 - 58056 for the month of June 1993 in
the amount of $1,075,978.02.
Councilwoman O'Mahony moved approval of the remainder of the Consent Calendar. Seconded by
Councilwoman Knight and carried unanimously.
COUNCIL COMMITTEE REPORTS
Legislative Committee: Councilwoman Knight reported on discussion of AB 13, smoking controls,
which may allow some local control. Mayor told of ineeting he attended at which there was an
ashtray on every table, this meeting lasted well over an hour and no one present smoked.
Train Station: Councilwoman O'Mahony had attended a planning session on the celebration of the
100th anniversary of our Burlingame Avenue Train Station; the actual anniversary date is in October
but the celebration will be held the day before the community picnic in 1994.
Convention Bureau: Councilman Lembi was impressed with activities under the new director; there
is an increase in the sales effort.
NEW BUSINESS -
1992-93 SIDEWALK MAINTENANCE - CP 9115 (B) - EXTEND CONTRACT AMOUNT
Public Works Director reviewed the memo of July 19 which recommended council approve
extending the contract cost to $233,000. This job was awarded to Floyd Construction in December
1992 for the amount of $167,561, considerably below estimated cost; work has proceeded
satisfactorily and staff has extended the amount of work needed up to the 25 percent increase staff is
allowed to make without council approval. Sufficient funds were budgeted to cover this extension.
Councilwoman O'Mahony moved approval of extending the contract with Floyd Construction to
$233,000. Seconded by Councilman Pagliaro, carried unanimously.

Reference staff report, 7/12/93, with attachments. CP Monroe reviewed
details of the request, staff comments, required findings. Five
conditions were suggested for consideration at the public hearing.
Chm. Deal opened the public hearing. James Chu, project designer, was
present. He commented: they are proposing a second story addition,
trying not to block any neighbor's view, there is no addition on the
side which will affect the neighbor across the street, view of trees
and sky from the breakfast area of the neighbors at 2753 Burlingview
will be affected. �
There were no audience comments in favor. Dan Erwin, 2753 Burlingview
Drive, spoke in opposition: he has lived here for seven

Staff Comments: The Chief Building Official comments in his memo
dated June 7, 1993, that the solarium is to have an openable window
area equivalent to 5� of the floor area in the "eating" and kitchen
areas. He also commented that complete Title 24 energy calculations
are required for plan check. The City Engineer and the Fire Marshal
had no comments. Planning staff would note that the applicant
installed poles to outline the extent of the new second floor
addition on the north-east side of the existing structure. With

this subsequent project the applicant formally withdrew his
previous request for new construction on this site.

RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and
application has been made for a hillside area construction permit for
a second story addition and first floor alterations to the existing
dwelling at 2760 Burlinctview Drive (APN 027-224-170), (Property

WHEREAS, the Planning Commission held a public hearing on

Staff Comments: The Fire Marshal commented in his March 3, 1993
memo; that the house is to be protected by an automatic fire
sprinkler system (BMC 17.04.070). The City Engineer commented in
his March 15, 1993 memo: that the driveway expansion must meet
separation from adjacent driveways so at building permit stage
there will need to be increments of 22' -0" on the street for street
parking spaces. The Chief Building Official had no comments.

construction of the existing distant views of nearby properties.
Emphasis shall be given to the obstruction of distant views from
habitable areas within a dwelling unit (Code Sec. 25.61.060).
Planninq Commission Action: The Planning Commission should hold a
public hearing. Affirmative action should be taken by resolution.
The reasons for any action should be clearly stated. At the public
hearing the following condition should be considered:
conclitions :
1. that the addition as built shall conform to the plans
submitted to the Planning Department and date stamped March 4,
1993, Sheets A1, A2, A3, A4, A5, and A6;
2. that the finish material used on both the flat and sloping
portions of the roof shall be nonreflective as approved by the
Chief Building Inspector and City Planner;
3. that the highest point on the new roof of the remodeled house
shall not exceed elevation 527.4 from an average top of curb
elevation of 513.4, and that the framing shall be surveyed to
confirm this elevation and the survey accepted by the City
Engineer before the final framing inspection is called for and
the roofing material is attached;
4. that the conditions set forth in the City Engineer's memo of
March 15, 1993 shall be met as well as the conditions set
forth in the Fire Marshal's memo of March 8, 1993; and
5. that the project shall meet all the requirements of the
Uniform Building and Uniform Fire Codes as amended by the City
of Burlingame.

Commission that: �
1. On the basis of the Initial Study and the documents submitted
and reviewed, and comments received and addressed by this commission, it
is hereby found that there is no substantial evidence that the project
set forth above will have a significant effect on the environment, and a
categorical exemption, Sec. 15303, New construction or conversion of
small structures Class 3(a), is hereby approved.
2. Said hillside area construction permit is approved, subject to
the conditions set forth in Exhibit "A" attached hereto. Findings for
such hillside area construction permit are as set forth in the minutes
and recording of said meeting.
3. It is further directed that a certified copy of this resolution
be recorded in the official records of the County of San Mateo.
