structures provided the addition will not result in an increase of more than 10,000 SF in areas where all public
services and facilities are available and the area in which the project is located is not environmentally sensitive.
Summary: The existing one-story house, with a detached two-car garage, contains 2,233 SF (0.26 FAR) of floor
area and has three bedrooms. The applicant is proposing to add 465 SF to the first floor, including a new kitchen,
breakfast room and family room, and build a new second story. The proposed second story addition would total
1,302 SF. With the proposed addition, the floor area will increase from 2,233 SF (0.26 FAR) to 3,970 SF (0.47
FAR) where 4,218 SF (0.50 FAR) is the maximum allowed. The proposed project is 248 SF below the
maximum allowed FAR.
With this project, the number of bedrooms will increase from three to four. One covered (10' x 20') and one
uncovered (9' x 20') parking spaces are required for the proposed four-bedroom house. The existing detached
two-car garage (18'-6" x 20'-3" clear interior dimensions) meets the covered parking requirement. One uncovered
parking space (9' x 20' dimensions) is provided in the driveway. All other zoning code requirements have been
met. The following applications are required:

Design Review Study Meeting: At the Planning Commission design review study meeting on March 27, 2006,
the Commission noted that the architect had done a great job with the design and integrating the second floor and
the Commissioners asked that the roof over the porte cochere be lowered to help reduce the massing (March
27,2006 Planning Commission Minutes). The Commission moved to place this item on the consent calendar
after the architect has responded to their comment concerning the porte cochere. The applicant submitted revised
elevations (pages A3.0 and A3.1) to address the Commission's comment concerning the porte cochere on March
28, 2006.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on Apri120, 1998 are outlined as follows:

Architectural style and mass and bulk of structure;
Interface of the proposed structure with the structures on adjacent properties; and
Landscaping and its proportion to mass and bulk of structural components.
Design Review Findings: Based on the findings stated in the attached minutes of the Planning Commission's
March 27, 2006, design review study meeting, that the architect has done a great job with the design and
integrating the second floor, and that with the lowering of the roof over the porte cochere the addition is
compatible with the mass and bulk in the neighborhood, the project is found to be compatible with the

requirements of the City's five design review guidelines.

Required Findings for a Special Permit: In order to grant a special permit for height, the Planning Commission
must find that the following conditions exist on the property (Code Section 25.51.020 a-d):
(a) The blend of mass, scale and dominant structural characteristics of the new construction or addition are
consistent with the existing structure's design and with the existing street and neighborhood;
(b) the variety of roof line, facade, exterior finish materials and elevations of the proposed new structure or
addition are consistent with the existing structure, street and neighborhood;
(c) the proposed project is consistent with the residential design guidelines adopted by the city; and
(d) removal of any trees located within the footprint of any new structure or addition is necessary and is
consistent with the city's reforestation requirements, and the mitigation for the removal that is proposed is
appropriate.
Special Permit Findings for Height: Based on the findings stated in the attached minutes of the Planning
Commissions March 27, 2006 design review study meeting, that the area exceeding 30'-0" in height measures
194.6 SF in area at the center of the roof, that the existing first floor finished floor is 2'-0" above adjacent grade,
that the proposed roof pitch on the second floor addition is designed to match the existing roof pitch, and that the
proposed 31'-7" height enhances the architectural style of the building, the project is found to be compatible with
the special permit criteria listed above.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action
should be by resolution and include findings made for design review and special permit for height, and the
reasons for any action should be clearly stated. At the public hearing the following conditions should be
considered:
that the project shall be built as shown on the plans submitted to the Planning Department date stamped
March 28, 2006, sheets A3.0 and A3.1, and March 6, 2006 sheets A0.0 — A2.1 and boundary and
topographic survey; and that any changes to the footprint or floor area of the building shall require an
amendment to this permit; and that all windows shall be simulated true divided light windows with three
dimensional wood mullions;
2. that any changes to the size or envelope of the first or second floors, which would include adding or
enlarging a dormer(s), moving or changing windows and architectural features or changing the roof
height or pitch, shall be subject to design review;
3. that prior to scheduling the framing inspection, the project architect, engineer or other licensed
professional shall provide architectural certification that the architectural details such as window
locations and bays are built as shown on the approved plans; if there is no licensed professional involved
in the project, the property owner or contractor shall provide the certification under penalty of perjury;
certifications shall be submitted to the Building Department;
4. that prior to final inspection, Planning Department staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the proj ect has been built according
to the approved Planning and Building plans;

5. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination and
installed on the portions of the roof not visible from the street; and that these venting details shall be
included and approved in the construction plans before a Building permit is issued;
6. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof
ridge and provide certification of that height to the Building Department;
7. that the conditions of the Chief Building Official's and Fire Marshal's January 26, 2006 memos, the City
Engineer's January 27, 2006 memo, and the Recycling Specialist's and NPDES Coordinators January 30,
2006 memos shall be met;
that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction Plan
and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall
require a demolition permit;
9. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management
and Discharge Control Ordinance; and
10. that the proj ect shall meet all the requirements of the California Building Code and California Fire Code,
2001 edition, as amended by the City of Burlingame.

SPECIAL PERMIT APPLICATION
1. Explain whv the blend of mass, scale and dominant structural
characteristics of the new construction or addition are consistent with
the existinq structure's desiqn and with the existinq street and
neiqhborhood?
The proposed addition replicates and reinforces the dominant
characteristics of the existing structure: new roof lines are either direct
extensions of existing ones or, where new roofs are introduced they
feature the same steep 15:12 slope of the existing ones. The proposed
addition increases the height of the building by adding a second story
over part of the structure. With the exception of the neighbor to the
North, all adjacent properties are 2-story structures and almost all
houses in the neighborhood currently have 2 stories. Impact on the
neighbor to the North is mitigated because the driveway runs along the
Northern property line while the house itself is set back by about 15',
except where the proposed porte cochere spans over the driveway. The
proposed addition respects all setback regulations and also conforms to
the declining height envelope restriction. The variety in the roof line
further helps to reduce the overall bulk of the proposed addition and
creates a building that is very consistent in mass and scale with other
structures in the neighborhood.
2. Exqlain how the variety of roof line, fa�ade, exterior finish materials and
elevations of the proposed new structure or addition are consistent with
the existinq structure, street and neiqhborhood.
The proposed new roof line consists of a main gable roof and a series oi
smaller scale secondary gables as well as one large shed roof dormer.
The variety in the roof line follows a pattern present in the existing
structure and in many houses on Burlingame Avenue. The variety in the
roof line also helps to reduce the bulk of the building and adds interest
to the facade. The exterior finish material of the existing structure as
well as of the addition is stucco, which is the most commonly used
exterior finish material in the neighborhood. All existing and new
windows have divided lites, another common found element in the
neighborhood. The overall appearance of the proposed project is very
consistent with the built context of the neighborhood and will not change
the character of the neighborhood.
3. How will the proposed qroiect be consistent with the residential
quidelines adopted bv the citv?
The proposed project will be consistent with the residential guidelines
adopted by the city in the following ways:
1. The proposed project features stylistic elements commonly found in
many houses in the neighborhood including a roof line composed of
several gables, windows with divided lites, and stucco as exterior finish�ECEIVED

material. The proposed project is a horizontal plus second story addition
and would create a structure no larger than most structures in the
neighborhood.
2. The proposed project meets the city parking requirements and will not
increase the number of cars parked on the street.
3. The proposed project respects and reinforces the style of the existing
structure. The new addition preserves the existing steep roof slope,
continues the use of narrow, divided lites casement style windows, and
also uses stucco as the exterior siding material.
4. The proposed project not only respects all setback requirements as
well conforms to the declining height envelope, but further presents a
varied roof line to reduce the bulk of the structure and its impact on
adjacent properties.
5. The landscaping of the front yard will not be affected by the proposed
project. In the back yard the proposed project includes the removal of
one large willow tree and the reconfiguration of outdoor patios and
steps. The scale of outdoor spaces and the selection of building
materials for such spaces shall create a direct and harmonious
relationship between indoor and outdoor areas, man-made and natural
elements.
4. Explain how the removal of anv trees within the footqrint of anv new
structure or addition is necessary and is consistent with the city's
reforestation requirements. What mitiqation is proposed for the removal
of anv trees? Explain why this mitiqation is appropriate.
This proposal includes the removal of one large willow (48" diameter)
located in the back yard of the property. The reason for the removal is
the poor health of the tree. The city arborist has inspected the tree and
a tree removal permit has been approved. Based on the calculated FAR,
four landscape trees are required on the property. Besides the willow to
be removed there are presently at least four other qualifying landscape
trees on the property (1 Japanese maple, 2 birches, 1 oak), which are to
remain.

1) All construction must comply with the 2001 California Building Codes (CBC),
the Burlingame Municipal and Zoning Codes, and all other State and Federal
requirements.
2) Provide fully dimensioned plans.
3) Provide a legend that indicates the existing walls, walls to be demolished, and
new walls.
4) According to the City of Burlingame Municipal code "when additions,
alterations or repairs within any twelve-month period exceed fifty percent of
the current replacement value of an existing building or structure, as
determined by the building official, such building or structure shall be made in
its entirety to conform with the requirements for new buildings or structures."
Therefore, this building must comply with the 2001 California Building Code
for new structures.
5) Comply with the new, 2005 California Energy Efficiency Standards for low-rise
residential buildings. Go to http:llwww.energy.ca.qov/title24 for publications
and details.
6) Rooms that can be used for sleeping purposes must have at least one window
or door that complies with the egress requirements.
7) Provide guardrails at all landings. NOTE: All landings more than 30" in height

1) Any construction project in the City, regardless of size, shall comply with the City
NPDES permit requirement to prevent stormwater pollution including but not
limited to ensuring that all contractors implement construction Best Management
Practices (BMPs) and erosion and sediment control measures during ALL phases
of the construction project (including demolition). Include appropriate stormwater
BMPs as Project Notes. These BMPs include but are not limited to the following:
� Store, handle, and dispose of construction materials and wastes properly
to prevent contact and contamination of stormwater;
• Control and prevent the discharge of all potential pollutants, including
pavement cutting wastes, paints, concrete, petroleum products, chemicals,
wash water or sediments, and non-stormwater discharges to storm drains
and watercourses;
• Use sediment controls or filtration to remove sediment when dewatering
site and obtain all necessary permits;
• Avoid cleaning, fueling, or maintaining vehicles on-site except in a
designated area where wash water is contained and treated;
• Protect adjacent properties and undisturbed areas from construction
impacts using vegetative buffer strips, sediment barriers or filters, dikes,
mulching, or other measures as appropriate;
• Perform clearing and earth moving activities only during dry weather;
• Limit and time application of pesticides and fertilizers to prevent polluted
runoff;
• Limit construction access routes and stabilize designated access points;
• Avoid tracking dirt or other materials off-site; clean off-site paved areas
and sidewalks using dry sweeping method;

RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for
desiQn review and special permit for height for a first and second story addition at 1541
Burlingame Avenue, zoned R-1, Karen and Jake Odden, property owners, APN: 028-285-180;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
April 10, 2006, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is no
substantial evidence that the project set forth above will have a significant effect on the
environment, and categorical exemption, per CEQA Article 19. Categorically Exempt per
Section: 15301 Class 1(e)(2) - additions to existing structures provided the addition will
not result in an increase of more than 10,000 SF in areas where all public services and
facilities are available and the area in which the project is located is not environmentally
sensitive.
2. Said design review and special permit are approved, subject to the conditions set forth in
Exhibit "A" attached hereto. Findings for design review and special permit are as set
forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official

1. that the project shall be built as shown on the plans submitted to the Planning Department date
stamped March 28, 2006, sheets A3.0 and A3.1, and March 6, 2006 sheets A0.0 — A2.1 and
boundary and topographic survey; and that any changes to the footprint or floor area of the
building shall require an amendment to this permit; and that all windows shall be simulated true
divided light windows with three dimensional wood mullions;
2. that any changes to the size or envelope of the first or second floors, which would include
adding or enlarging a dormer(s), moving or changing windows and architectural features or
changing the roof height or pitch, shall be subject to design review;
3. that prior to scheduling the framing inspection, the project architect, engineer or other licensed
professional shall provide architectural certification that the architectural details such as
window locations and bays are built as shown on the approved plans; if there is no licensed
professional involved in the project, the property owner or contractor shall provide the
certification under penalty of perjury; certifications shall be submitted to the Building
Department;
4. that prior to final inspection, Planning Department staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the project has been built
according to the approved Planning and Building plans;
5. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street; and that these
venting details shall be included and approved in the construction plans before a Building
permit is issued;
6. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of
the roof ridge and provide certification of that height to the Building Department;
7. that the conditions of the Chief Building Official's and Fire Marshal's January 26, 2006 memos,
the City Engineer's January 27, 2006 memo, and the Recycling Specialist's and NPDES
Coordinators January 30, 2006 memos shall be met;
8. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to
submit a Waste Reduction Plan and meet recycling requirements; any partial or full demolition
of a structure, interior or exterior, shall require a demolition permit;
9. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water
Management and Discharge Control Ordinance; and
10. that the project shall meet all the requirements of the California Building Code and California
Fire Code, 2001 edition, as amended by the City of Burlingame.

Summary: The existing one-story house, with a detached two-car garage, contains 2,233 SF (0.26 FAR) of floor
area and has three bedrooms. The applicant is proposing to add 465 SF to the first floor, including a new kitchen,
breakfast room and family room, and build a new second story. The proposed second story addition would total
1,302 SF. With the proposed addition, the floor area will increase from 2,233 SF (0.26 FAR) to 3,970 SF (0.47
FAR) where 4,218 SF (0.50 FAR) is the maximum allowed. The proposed project is 248 SF below the
maximum allowed FAR.
With this project, the number of bedrooms will increase from three to four. One covered (10' x 20') and one
uncovered (9' x 20') parking spaces are required for the proposed four-bedroom house. The existing detached
two-car garage (18'-6" x 20'-3" clear interior dimensions) meets the covered parking requirement. One uncovered
parking space (9' x 20' dimensions) is provided in the driveway. All other zoning code requirements have been
met. The following applications are required:
