Summary: An application for Design Review and Special Permit for an attached garage for a first floor addition to a single family dwelling was originally approved by the Planning Commission on February 12, 2007 (February 12, 2007 P.C. Minutes attached). A building permit was issued on April 4, 2007, and the project is ready to be finaled. During the final inspection by the Planning Division, it was noted that one window was removed from the first floor towards the rear of the right side elevation and that many of the original double hung windows on the second story had been replaced with simulated true divided light, wood casement windows with three dimensional wood mullions. The applicant submitted building elevations and a letter, date stamped April 4, 2008, describing these changes. The design of the first floor addition, other than the removal of a window on the first floor towards the rear of the right side elevation and the replacement of many of the original double hung windows on the second story with simulated true divided light, wood casement windows with three dimensional wood mullions, remains unchanged. A copy of the originally approved and proposed elevations (date stamped April 4, 2008) are included for your review. Planning staff would note that because of this minor revisions, it was determined that the project could be reviewed by the Commission as an FYI item. If the Commission feels there is a need for more study, this item may be placed on an action calendar for a second review and/or public hearing with direction to the applicant. We've decided to replace some of the windows on the second floor and chose grill patterns for them that are different than that which was submitted on January 10 of 2007. In addition, a small window on the first floor has been omitted from the rear elevation (please see sheet A3.3). This application was for a first floor addition at 1538 Burlingame Avenue, zoned R-1. The February 12, 2007, minutes of the Planning Commission state your application was approved with the following conditions: that the project shall be built as shown on the plans submitted to the Planning Department date stamped January 31, 2007, sheet A3.3 and date stamped January 10, 2007, sheets A1.1 through A3.2, A3.4 and A3.5, and that any changes to building materials, exterior finishes, footprint or floor area of the building shall require an amendment to this permit; 2. that the conditions of the Chief Building Official's November 27, 2007 memo, the City Engineer's November 27, 2007 memo, the Fire Marshal's November 28, 2007 memo, the Recycling Specialist's November 27, 2007 memo, and the NPDES Coordinator's November 27, 2007 memo shall be met; th�t �f the stn�ctu._re is demolished or the env�lope ch�ngecl �t a l�ter date the both the reax setback variance and FAR variance as well as any other exceptions to the code granted here will become void; 4. that demolition or removal of the existing structures and any grading or earth moving on the site shall not occur until a building permit has been issued and such site work shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 5. that any changes to the size or envelope of the basement, first or second floors, or garage, which would include adding or enlarging a dormer(s), moving or changing windows and architectural features or changing the roof height or pitch, shall be subject to Planning Commission review; 6. that prior to scheduling the frasning inspection the project architect or residential designer, or another architect or residential design professional, shall provide an architectural certification that the architectural details shown in the approved design which should be evident at framing, such as window locations and bays, are built as shown on the approved plans; architectural certification documenting framing compliance with approved design shall be submitted to the Building Division before the final framing inspection shall be scheduled. �� Register online for the City of Burlingame list serve at «�ww.burlin�ame.ora �. February 23, 2007 1358 Burlingame Avenue Page 2 7. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof ridge and provide certification of that height to the Building Department; 8. that prior to final inspection, Planning Department staff will inspect and note compliance of the architectural details (trim materials, window type, etc.) to verify that the proj ect has been built according to the approved Plarming and Building plans; 9. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination and installed on the portions of the roof not visible from the street; and that these venting details shall be included and approved in the construction plans before a Building permit is issued; 10. that the proj ect shall meet all the requirements of the California Building and Uniform Fire Codes, 2001 Edition, as amended by the City of Burlingame; 11. that the proj ect shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall require a demolition permit; and 12. that the applicant shall comply with Ordinance 1503, the City of Burlingame 5torm Water Management and Discharge Control Ordinance. Reimbursement of the unused portion of the design review deposit has been processed and will be mailed to the property owner under separate cover. All site improvements and construction work will require separate application to the Building Department. This approval is valid for one year during which time a building permit must be issued. One extension of up to one year may be considered by the Planning Commission if application is made before the end of the first year. The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or federal law. Chair Brownrigg noted that, since he was required to recuse himself from item 1 a, he would divide the consent calendar into two actions. Osterling noted that the story poles were installed at 1501 Los Montes and none of the neighbors had commented that their views were affected, he then moved to approve items lb, 1538 Burlingame Avenue, and lc, 1501 Los Montes, on the consent calendar based on the facts in each staff report, commissioners comments and the findings in the staff reports with recommended conditions in the staff report and by resolution. The motion was seconded by C. Auran. Chair Brownrigg called for a voice vote on the motion and it passed 5-0-2 (Cers. Cauchi, Vistica absent). Appeal procedures were advised. C. Auran noted that he was at the site today and spoke to the neighbors who had written the letter asking to review plans. They discussed the driveway, window placement, hours of construction, and told him that because of their better understanding and review of the plans, and with the assurance that the project would be built to the plans submitted and to be approved, they would withdraw their objection. Vice Chair Deal called for a motion. C. Auran moved approval of the consent calendar based on the facts in the staff report, commissioners comments and the findings in the staff report with recommended conditions in the staff report and by resolution. The motion was seconded by C. Terrones. Vice Chair Deal called for a voice vote on the motion and it passed 4-0-1-2 (C. Brownrigg abstaining; Cers. Cauchi, Vistica absent).
