Categorically Exempt per Section: 15303 - construction and location of new, small facilities or structures - (e) accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences. History: On August 28, 2000, the Planning Commission approved an application for design review for a second story addition at this site. A building permit was issued in September, 2001 and construction is almost complete. Summary: The applicant is requesting a fence exception for two new 6'-2" tall pillars and a 6-0" tall wrought iron gate at the driveway entrance to the site. The pillars will be located six inches behind the front property line and measure 1'-8" x F-8". The pillars will have a stucco exterior and the gate will be wrought iron. The applicant notes that the new gate will be replacing an existing 5'-6" tall gate previously located at the driveway entrance. The R-1 District fence regulations apply to the proposed pillars and driveway gate. A fence located within the front setback is limited to 5'-0" in height. The following application is required: • Fence exception for height for two new pillars and a driveway gate along the front property line (6-2" height proposed for the pillars, 6-0" proposed for the wrought iron gate, 5'-0" maximum height allowed) (CS 25.78.020, 1). Staff Comments: See attached. Planning staff would note that the site plan also shows two smaller pillars and a gate at the walkway entrance to the house. The walkway pillar and gate design will match the proposed driveway pillar and gate design and will not exceed 5'-0" in height. Fence Exception 1532 Burlingame Avenue Required Findings for a Fence Exception: In order to grant a fence exception for height, the applicant must show and the Planning Commission must find the following exist (CS 25.78.050): 1. that there are exceptional circumstances; 2. that there is no public hazard; 3. that neighboring properties will not be materially damaged; and 4. that the regulations cause unnecessary hardship upon the petitioner. Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be made by resolution and should include findings made for the requested fence exception. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: 1. that the pillars and wrought iron gate at the entrance driveway shall be built as shown on the plans submitted to the Planning Department date stamped March 10, 2003, sheet A-1; and that the pillars at either side of the driveway gate shall not exceed 6-2" in height and the wrought iron gate shall not exceed 6-0" in height, as measured from highest adjacent grade; 2. that the conditions of the City Engineer's and Fire Marshal's March 17, 2003 memos shall be met; and 3. that the project shall meet all the requirements of the California Building and Fire Codes, 2001 edition, as amended by the City of Burlingame. Margaret M on -------------- City Planner ,Y, PU ICE (Please refer to other side) RESOLUTION APPROVING CATEGORICAL EXEMPTION AND FENCE EXCEPTION RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a fence exception for height for two new 6'-2" tall pillars and a 6'-0" tall wrought iron gate at the driveway entrance to the site at 1532 Burlingame Avenue, zoned R-1, Robert and Jessica Fellows, properly owners, APN: 028-283-080; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on March 24, 2003, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section 15303 - construction and location of new, small facilities or structures - (e) accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences, is hereby approved. 2. Said fence exception is approved, subject to the conditions set forth in Exhibit "A" attached hereto.
