Matthews 335A East Fourth Avenue San Mateo, CA 94401 Dear Mr. Matthews, Since there was no appeal to or suspension by the City Council, the March 24, 2003 Planning Commission approval of your application for a fence exception for height became effective April 7, 2003. This application was to allow for construction of two new 6'-2" tall pillars and a 6'-0" tall wrought iron gate at the driveway entrance to the site at 1532 Burlingame Avenue, zoned R-1. The March 24, 2003 minutes of the Planning Commission state your application was approved with the following conditions: l . that the pillars and wrought iron gate at the entrance driveway shall be built as shown on the plans submitted to the Planning Department date stamped March 10, 2003, sheet A-1; and that the pillars at either side of the driveway gate shall not exceed 6'-2" in height and the wrought iron gate shall not exceed 6-0" in height, as measured from highest adjacent grade; 2. that the wrought iron gate at the driveway entrance shall be remotely operated by an electric motor activated from a motor vehicle and that an electrical permit from the Building Department shall be issued prior to installation of the electric gate; 3. that the conditions of the Chief Building Official's and Fire Marshal's March 17, 2003 memos, and the City Engineer's March 19, 2003 memo shall be met; and 4. that the project shall meet all the requirements of the California Building and Fire Codes, 2001 edition, as amended by the City of Burlingame. All site improvements and construction work will require separate application to the Building Department. This approval is valid for one year during which time a building permit must be issued. One extension of up to one year may be considered by the Planning Commission if application is made before the end of the first year. April 8, 2003 1532 Burlingame Avenue page 2 The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.
