Ortiz 1529 Burlingame Avenue Burlingame, CA. 94010 Dear Mr. Ortiz: S-ince there was no appeal to or suspension by the City Council, we wish to advise the October 13, 1982 Planning Commission approval of your Special Permit application became effective November 2, 1982. This application was to allow construction of a 775 square foot detached garage-storage structure at 1529 Burlingame Avenue. The October 13, 1982 minutes of the Planning Commission state the permit was approved "subject to the requirements of the Chief Building Inspector's memo of September 15, 1982 and the Fire Marshal's memo of September 7, 1982. All site improvements and construction work will require separate application to the Building Department. ROLL CALL Present: Absent: Commissioners Garcia, Giomi, Graham, Leahy, Harvey Commissioners Cistulli, Mink (excused) Staff Present: City Planner Margaret Monroe; City Attorney Jerome F. Coleman; City Engineer Frank C. Erbacher MINUTES - The September 27, 1982 minutes were unanimously approved and adopted with the following correction: Item #3, page 3, last paragraph, line 3, change "over 21" to "under 21". � AGENDA - Chm. Harvey advised that Mike Harvey, the applicant, Items #2 and #3, had requested a continuance until a full Commission was present. These items will be continued to the meeting of October 25, 1982. ITEMS FOR ACTION 1. SPECIAL PERMIT TO CONSTRUCT A 775 SF DETACHED GARAGE-STORAGE STRUCTURE AT 1529 BURLINGA�1E AVENUE, BY JESSIE ORTIZ CP Monroe reviewed this application to construct a garage and storage structure in the rear yard of the home at 1529 Burlingame Avenue, zoned R-1. Reference staff report dated 10/5/82; Project Application & CEQA Assessment received 8/31/82; aerial photo- graph; September 15, 1982 memo from the Chief Building Inspector; 9/7/82 memo from the Fire Marshal; "no comments" memo dated 9/13/82 from the City Engineer; August 31, 1982 letter from the applicant; petition in support signed by 12 residents in the area; and plans date stamped September 1, 1982. CP advised of a correction in the staff report and project assessment: the requested structure is 775 SF, not 750 SF; storage portion of the building is 355 SF, which is 10.8% of the gross square footage of the dwelling unit. She discussed details of the request and code requirements; staff review and comments; and applicant's justification for this particular structure. Planning staff recommended approval. Jessie Ortiz, the applicant, was present. He was informed of the absence of two Commissioners and the need for four votes to approve his request. He opted to hold the hearing this evening. Chm. Harvey then opened the public hearing. There were no audience comments and the hearing was declared closed. Commission discussion: a special permit is required because the accessory building exceeds 500 SF and the siorage portion of the dwelling exceeds 10% of the gross square footage of the dwelling unit; all other code requirements are met; applicant confirmed he has only three closets, one in each bedroom, that he had no objection to the Fire hlarshal's requirement that he change the redwood siding to stucco, and that he would not be using any previous slab for this new structure. C. Giomi moved for approval of a 775 SF garage-storage structure in the rear of the lot at 1529 Burlingame Avenue subject to the requirements of the Chief Building Inspector's memo of September 15, 1982 and the Fire Marshal's memo of September 7, 1982. Second C. Graham; motion approved unanimously on roll call vote. Appeal procedures were advised. 2. SIGN EXCEPTION - 1007 ROLLINS ROAD - MIKE HARVEY (PROPERTY Ot�NER AND APPLICANT) 3. SIGN EXCEPTION - 1025 ROLLINS ROAD - MIKE HARVEY (PROPERTY OWNER AND APPLICANT)_ Items 2 and 3 continued to the meeting of October 25, 1982 at the request of the applicant. 4. REQUEST FOR SIX MONTH CONDOMINIUM PERMIT AND TENTATIVE SUBDIVISION MAP EXTENSION FOR A 4-UNIT CONDOMINIUM PROJECT AT 27 EL CAMINO REAL CE Erbacher recomnended approval of a six month extension for this project currently under construction. Reference City Engineer's September 29, 1982 memo and letter from Barry G. Smith, AIA, Carrasco & Smith. C. Graham moved to approved a six month extension of the condominium permit and to recommend City Council approve a six month extension of the tentative subdivision map. Second C. Leahy; all aye vaice vote. ITEM FOR STUDY 5. SPECIAL PERMIT TO OPERATE A SNACK BAR AT 801 MAHLER ROAD CP Monroe noted the updated map indicating coffee shops/delis in the M-1 Dist'rict and that this snack bar would be the third such business on Mahler Road. Paul Lee, the applicant, was present for the study session. Commission requests: substantiation from the applicant of the need for this operation when there are already two coffee shops on the same street and two others in close proximity. It was pointed out this snack bar might be considered a restaurant as there are three tables shown on the � plans. Item set for hearing on October 25, 1982. CITY PLANNER REPORT CP reported on City Council actions at its October 4, 1982 meeting: - Reviewed Owen Bay Plaza office park application, 477 Airport Boulevard, approved by the Planning Commission. Council expressed concern about bulk and height and moved to send this project back to the Planning Commission with revised plans. Revised plans with two alternatives have been received by Planning staff and the applicant has requested public hearing at the October.25 P.C. meeting. Staff advised it is understood the revised project will go back to the Council following Corrrnission's review. Staff further advised the developer has been requested to provide the Commission with a Phase I landscape plan. Commission agreed to hear the revised project at its October 25, 1982 meeting. Staff was requested to indicate in the staff report what Council's concerns were and what guidelines , for review were established. - Council agreed, at the request of Mr. Davis, to schedule the appeal hearing for Davis Banquet and Party Center, 1450 Rollins Road on November 1, 1982; three conditions were attached to this agreement.
