Summary:
The applicant, Joseph Brattesani representing Colton Piano, is requesting a sign exception for sign area on
the secondary frontage at 1471 Burlingame Avenue, zoned C-1, Subarea A Burlingame Avenue
Commercial Area. This item came to the attention of the Planning Department as a code enforcement item.
The applicant changed the copy on an existing second floor sign at the rear of the building without
obtaining a sign permit. Planning and Building Department files indicate that there were no sign permits
or building permits ever issued for the installation or copy changes on this existing second floor sign.
The applicant is proposing to legitimize and change the copy on the existing sign installed without any City
permits (3' tall X 26' long, 78 SF in area) on the secondary frontage facing parking lot `K'. The copy of
the sign has been changed from `ACE REALTY' to `COLTON PIANO'. The applicant has submitted
photographs of the present change. The sign exception is required for 78 SF of sign area, where 30 SF
is the maximum allowed at the second floor (C.S. 22.14.030 and 22.14.060, a). The overall height of the
new sign will be 30' (20' is the maximum height allowed, a sign erected on a building placed higher than
the iirst floor is subject to its area being reduced by 60% when placed at the second floor level). There
are no other signs on the secondary frontage. All other sign code requirements have been met.
There are no changes proposed to the signs on the primary frontage (Burlingame Avenue). There are 3
existing signs on this tenant space where the code allows 3 signs. There are two awning signs
(18" x 7', 10.5 SF in azea) and (18" x 10', 15 SF in area), and one window sign' (1' x 19'-10", 19.8 SF

in area). The total amount of signage on this tenant's primary frontage is 45.3 SF, where the code allows
50 SF. Planning would also note that there were no sign permits issued for the installation of the signs on
the primary frontage; however, these signs comply with all sign code requirements.

The Chief Building Official, City Engineer and Fire Marshal had no comments.

In his letter of October 29, 1997 the applicant, Mr. Brattesani, noted that there has been a sign on the rear
of this building, at this location for 20 years. Staff would note there is no City record of when the original
sign was installed and a sign permit was not issued for the refacing of the existing sign.

Sign Exception for Sign Area on the Secondary Frontage 1471 Burlingame Avenue
Study Meeting:
At their meeting on November 24, 1997, the Planning Commission asked several questions regarding this
application (P.C. Minutes November 24, 1997). This property has two tenants on the first floor: 1471
Burlingame Avenue, Colton Piano and 1475 Burlingame Avenue, Primrose Tailor. The second floor of
the this building contains eight tenants, suites A-H. The following table provides information regarding
previous sign applications for the front of the building (please see attachments).

The following list provides information regarding previous building permits for sign installations on this
property (please see attachments).
1475 Burlingame Ave - Building permit issued on 6/3/97 for Nathan Paco, Attorney (2nd floor tenant).
This permit was for a sign on the primary frontage (3'-6" x 8', 28 SF in area).
1475 Burlingame Ave - Building permit issued on 11/27/74 for a sign on the primary frontage
(3' x 5', 15 SF in area). The building permit file does not provide the copy for the sign, but the name
on the inspection card is `Steward Title'.
1475 Burlingame Ave - Building permit issued on 2/18/72 for Ace Realty (2nd floor tenant). There were
no plans or description of location for this sign in the Building Dept. records. The inspection card does
not show a date for final inspection.
T'here were two more building permits issued on 8/23/71 and 8/2/71 for signs at 1475 Burlingame Avenue.
Both of them were issued to George Plissak, owner of the building. These permits also lacked information
regarding the size and location of the signs and dates for final inspections. Please note that there were no
sign or building permits issued for the installation of signs specifically at 1471 Burlingame Avenue,
currently occupied by Colton Piano. Planning would also note that the Planning and Building Dept. iiles
clearly indicate that there were no permits issued for any signs on the secondary frontage on this property.
Planning Commission asked staff to provide information regarding nonconforming signs and changing the
copy of a sign. C.S. 22.42.010 states that:
"no nonconforming sign shall be in any manner altered, reconstructed or moved without being made
to comply in all respects with the provisions of this title; provided, however, that nothing herein
shall prohibit the normal maintenance or repair of any such sign."

Sign Exception for Sign Area on the Secondary Frontage 1471 Burlingame Avenue
A sign permit is not required for normal maintenance and repair which does not result in a change or
alteration in the size, shape, illumination, or text of the sign (C.S. 22.08.030). A sign permit is required
for any sign to be erected, moved, altered, changed, repaired, replaced, suspended, or attached to a
building (C.S. 22.06.020). A sign permit is also required if a sign installed was placed without the City's
knowledge. In this case a sign is treated as if it were a new installation and would need a sign permit, sign
exception if necessary, and a retroactive building permit.
Required Findings for Sign Exception:
In order to grant a Sign Exception relating to height, area, location or number of signs the Planning
Commission must apply the following circumstances (Code Section 25.06.110 a-b):
(a) any exception granted shall be subject to such conditions as will assure that the adjustment thereby
authorized shall not constitute a grant of special privilege inconsistent with the limitations upon other
properties in the vicinity and the district in which the subject property is situate; and
(b) because of special circumstances applicable to the subject property, including size, shape, topography,
street frontage, locafion or surrounding land use; the size or height of the building on which the sign
is to be located; the classiiication of the street or highway on which the sign is located or designed
primarily to be viewed from, the strict application of zoning regulations is found to deprive subject
property of the privileges enjoyed by other properties in the vicinity and under identical zone
classification.
Planning Commission Action:
The Planning Commission should hold a public hearing. Afiirmative action should include findings made
for the sign exception requested. Reasons for any action should be clearly stated. At the public hearing
the following conditions should be considered:
1. that the project shall be built as shown on the photographs/plans submitted to the Planning Department
and date stamped October 29, 1997 (photographs) and November 12, 1997 (8'h" x 11 ") with copy for
Colton Piano's and shall apply for a building permit within 30 days of approval;
2. that any change to the copy, size, or location of the sign on the secondary frontage shall require an
amendment to this sign exception; and
3. that this project shall meet all the requirements of the California Building and Fire Codes, 1995
Edition, as amended by the City of Burlingame.

I wanted to write a quick note to give you some background infoi�nation in regards to the
"Colton Piano" sign located on the rear of the building at 1471 Burlingame Ave.
According to our landlord, the sign has been up in the same position for over twenty
years. It was first installed by the former landlard, Ace Realty. Appro�mately five
months ago, I noticed that the face of the sign, which consisted of three plastic panels, was
bowing, that the sign appeared to be bent. I discussed this with the landlord, because I
was concerned about the safety of the sign, as the panels did not appear to be secure. He
suggested that I replace the face of the sign with one which read Colton Piano. Of course,
this was done at our own expense. I can supply you with a copy of the invoice showing
our payment of $1200 for the replacement of the face of the sign. Enclosed are pictures of
the sign both before and after the work was done. As you can see, neither the size nor the
position of the sign was altered. Please consider our request to allow the sign to remain
on the premises as it has for over twenty years. If you have any questions feel free to call

Summary:
The applicant, Joseph Brattesani representing Colton Piano, is requesting a sign exception for sign area
on the secondary frontage at 1471 Burlingame Avenue, zoned C-1, Subarea A Burlingame Avenue
Commercial Area. This item came to the attention of the Planning Department as a code enforcement
item. The applicant changed the copy on an existing second floor sign at the rear of the building
without obtaining a sign permit. Planning and Building Department files indicate that there were no sign
permits or building permits ever issued for this existing second floor sign.
The applicant is proposing to change the copy on the existing nonconforming sign (3' tall X 26' long,
78 SF in area) on the secondary frontage facing parking lot `K'. The copy of the sign has been changed
from `ACE REALTY' to `COLTON PIANO'. The applicant has submitted photographs of the change.
The sign exception is required for 78 SF of sign azea, where 30 SF is the maximum allowed at the
second floor (C.S. 22.14.030 and 22.14.060, a). The overall height of the new sign will be 30' (20'
is the maximum allowed, except that a sign erected on a building may be placed higher than the first
floor subject to its area being reduced by 60% when placed at the second floor level). There are no
other signs on the secondary frontage. All other sign code requirements have been met.
There are no changes proposed to the signs on the primary frontage (Burlingame Avenue). There are
3 existing signs where the code allows 3 signs. There are two awning signs (18" x 7', 10.5 SF in area)

and (18" x 10', 15 SF in area), and one window sign' (1' x 19'-10", 19.8 SF in area). The window
sign is considered one sign since the separation between each component is less than the area of the
adjoining component. The total amount of signage on the primary frontage is 45.3 SF, where the code
allows 50 SF. Planning would also note that there were no sign permits issued for the installation of
the signs on the primary frontage. These signs comply with all sign code requirements.

The Chief Building Official, City Engineer and Fire Marshal had no comments.

In his letter of October 29, 1997 the applicant, Mr. Brattesani, noted that there has been a sign on the
rear of this building, at this location for 20 years. Staff would note that a sign permit was not issued
for the refacing of the existing sign.
