RECOMMENDATION:
Council hold a public hearing, review special permit request and take action.
Conditions proposed for the use permit as approved by the Planning Commission:
1. that the conditions of the Chief Building Inspector's memo of
December 17, 1984 and the City Engineer's memo of January 9, 1985 be met;
2. that the city receive written permission from the property owner,
Mr. Wurlitzer, for the location of the antenna on the roof of
1460 Burlingame Avenue to serve the property at 1462 Burlingame Avenue;
3. that a building permit be issued for installation, this permit to be
applied for and granted within 30 days following the effective date of
the special permit;
4. that all parts of the dish to serve 1462 Burlingame Avenue be wholly
located on the property owned by P1r. Wurlitzer at 1460 Burlingame Avenue
or permission be gained from all property owners affected; and
5. that this antenna shall be removed when the retail video use is terminated
at 1462 Burlingame Avenue.
Action Alternatives:
1. uphold the Planning Commission's action approving the special permit
as conditioned. This action should be taken by resolution recorded
with all affected properties.
2. reverse the Planning Commission's approval.
BACKGROUND:
As a part of a code enforcement action, Gary Andrieni representing Burlingame Home
Video made application for a rooftop dish antenna to serve his business at 1462
Burlingame Avenue. Because of existing buildings interfering with transmission signals,
the antenna was placed on the property line wall of 1460 Burlingame Avenue. The
antenna was placed without a building permit and violates four of the criteria
established in the municipal code (Code Sec. 18.18.060-1,3a,b,e) for review of antenna:
needs a building permit, exceeds 7 SF in area (antenna is 113 SF in area), installed
more than 5' above grade (the top of the antenna is 34' above grade) and visible from
the street (antenna can be seen from Burlingame Avenue and E1 Camino Real).

At their meeting of January 28, 1985 the Planning Commission held a public hearing
and reviewed the request for three special permits for this antenna (Planning
Commission minutes, January 28, 1985). The Commission voted 5-2 (Commissioners
Jacobs and Leahy dissenting) to approve the special permits for the antenna with
the conditions cited above. Only the applicant's representative testified at the
hearing. In their discussion the Planning Commissioners expressed concern about
the quality of the information about the antenna's location and installation
provided by the applicant, that the building permit must meet the conditions of the
City Engineer's memo, the view of the antenna from the west side of E1 Camino Real,
the size of this antenna is consistent with present technology. The applicant has
not sold any antennas in Burlingame, but has sold several in Hillsborough where
he complied with that town's regulation on installation; since the City Engineer
will require removal for inspection the antenna could be moved to another location
on the roof.

Discussion: the fact that this is a code enforcement item, antenna was

a building permit; concern that much of the information requested at
the study meeting had not been received.
Chm. Graham opened the public hearing. The applicant, Gary Andrieni
was present. Mr. Gilmore, his representative, told Commission that
manufacturer's technical data had been furnished, he felt the same
wind effect would apply on the ground or on the roof. There were no
audience comments and the public hearing was closed.
Commission discussion: how can we grant this use permit without all
pertinent information; the applicant has not abided by the city
ordinances, what is he advising his clients; suggest building permit
be clearly conditioned to meet city engineering standards; concern
about the size of this antenna when viewed from the west side of

size the city will be considering with present technology; applicant
advised he sells video equipment; the dish does not replace an antenna,
it brings in signals directly from a satellite and increases the
number of channels; he has not sold any in Burlingame but has put up
several in Hillsborough conforming to tha�t town's criteria; he does
his own invoicing, has installed some himself, some on contract.
Furth��r comment: this application violat�s three of the code criteria
for antennas, do not find this acceptable; have no problem with the
size, appears to be no worse than most antennas on homes in
Burlingame; since City Engineer will require removal and
reinstallation, location of the dish could be moved at that time.
C. Schwalm moved for approval of this special permit and for adoption

Commission discussion: of the 21 present employees, only 14 are on
site at one time; there are 12 on-site parking spaces; City Council's
desi e to retain warehouse facilities in the M-1 area and reluctance
to a ow more intense office use, this request is inconsistent with
plann ng objectives of the city, can find no compelling reason to
approv , it would be a significant change from warehouse to office.
Applica t advised existing parking spaces are marked and employees do
use them� they have explored other possibilities for the addition but
none wer feasible. Commission expressed concern about further loss
of landsc�ping; should stay with the 10� requir�ment to make the area
more attra�,tive; would not want to set a precedent by allowing the
variance to�`,landscape requirements; feel the 20$ office space
restriction �n the code was to prevent conversion of warehouses into
office, in this case will not be losing any warehouse space but will
be a3ding offi�e and losing landscaping.

Gary Andrieni r�presenting Burlingame Home Video is requesting a
special permit for a satellite dish antenna located on the roof of
1460 Burlingame Avenue which serves his retail video sales business at
1462 Burlingame Avenue. This dish was placed without a permit. In
its present location the antenna requires a special permit for
exceeaing � SF in area (antenna has an area of 113 SF), for being
installed more than 5' above grade (the top of antenna is 34' above
grade) and for being visible from the street. The antenna was also
installed without a building permit (Code Sec. 18.18.060-1, 3a,b,e).
City staff have reviwed this request. 'I'he Fire Chief (December 12,
1984 memo) had no comments. The Chief Building Inspector (December
17, 1984 memo> notes that the plans seem to indicate that the antenna
structure crosses property lines, that engineering plans and calcula-
tions are required before a building permit (which is also required)
can be issued. The City Engineer (January 9, 1985 memo) comments
plans seem to indicate antenna may be mounted across a property line,
building permit is needed including removal and reinstallation to
inspect the structural attachment, and there m3y be further comments
based on submittal to the Building Department.
In his letter of [�ovember 15, 1984 the applicant, Gary An3rieni, notes
that his landlord, Mr. Wurlitzer, gave him verbal permission to
install the antenna. The purpose of the antenna is to demonstrate to
potential customers the a3vantage of having their own satellite
antenna (a part of this business is antenna sales). He points out
that the placement of the antenna was determined by the location of
the Pacific Bell building (the antenna is located on property line
wall of 1460, 25' from property line). If the Pacific Bell buil3ing
had been lower, then the antenna could be placed further back from the
front property line.
Planning staff wrote two letters to the applicant (Towber, December
14, 1984 and January 4, 1985) relating to submittals and additional
information needed for the application. Some of these items were
provided. However, direct written consent by the property owner,
whether the cup of the antenna extends over property line, engineering
and wind load calculations for the precise location and type of
attachment and clarification of where the property line runs through
the wall on which the antenna is attached were not provided. Because
this installation was done in violation of the buil3ing code and
antenna ordinance, staff notes that the application will continue to
be reviewed by the Planning Commission whether the a3ditional
information required is submitted or not. Staff hopes that the
applicant will be able to answer some of these questions at the

(Code Chapter 18.18> since it was revised in November, 1983 staff has
included a copy of the ordinance in the packet. The criteria for
reviewing satellite dish antenna are clearly outlined in Co3e Sec.
18.18.060. The criteria in the ordinance clearly direct consideration
of the size, height and visibility from the street of the proposed
antenna.
In this application it should be noted that for proper reception the
antenna is not placed on the roof of the site requesting the special
permit; the antenna is off-premise on the roof of the adjacent tenant.
Both retail sites are owned by the same property owner, Mr. Wurlitzer.
Thus a use permit should note that the antenna is to serve 1462
Burlingame Avenue and to be located on the roof of 1460 Burlingame
Avenue and, if granted, the permit should be recorded with both
properties.
The Planning Commission should hold a public hearing. If affirmative
action is to be considered that action should be taken by resolution
identifying both properties, 1462 and 1460 Burlingame Avenue. At the
public hearing the following conditions shall be considered:
1. that the conditions of the Chief Building Inspector's memo of
December 17, 1984 and the City Engineer's memo of January 9, 1985
be met;

18.18.010 Definition. An "antenna" is any composition of wood, metal
or wire, which together with its necessary supports is constructed for the
purpose of receiving or transmitting electronic signals. (Ord. 948 § 1(part);
December 20, 1971, as amended by Ord. 1258 § 1(part); October 3, 1983).
18.18.020 Permit required for installation. No antenna, except those
deiined as exempt in Section 18.18.030, shall be built, installed, placed or
maintained upon any location within the city without obtaining a building
permit. For the purposes of this code, such antennas are considered struc-
tures. (Ord. 948 § 1(part); December 20, 1971, as amended by Ord. 1258
§ 1 (part); October 3, 1983).
18.18.030 Exempt devices. Devices of inetal and wire for the reception
of radio or televised signals which are placed or attached to a building and of
a height not in excess of fifteen feet above the roof of a building are exempt
from the requirements of this chapter for a building permit or engineering
report. (Ord. 948 § 1(part); Decernber 20, 1971, as amended by Ord. 1258
§ 1 (part); October 3, 1983).
18.18.040 Engineering report required. Prior to the issuance of a permit
for the construction of any antenna where the gross weight of all of its
included parts exceeds five hundred pounds or where the gross height above
the ground, when built upon the ground, exceeds thirty-five feet above
ground level, or where the gross height above the roof, when built upon a
building, exceeds fifteen feet above a roof, the building offcial shall require
that a plan and engineering calculations for wind load, bracing and founda-
tion be prepared by a licensed civil or structural engineer. Such plans and
specifications shall be prepared to meet or exceed the applicable require-
ments for such construction as set forth in the Chapter 18.08 of this code as
adopted or as it may subsequently be amended. (Ord. 948 § 1(part); Decem-
ber 20, 1971, as amended by Ord. 1258 § 1(part); October 3, 1983).
` 18.18.050 Height limitations. (a) The height of any antenna shall be
r� measured from the ground level of the site upon which it is placed or con-
structed to the topmost extension of the device. On any site which has a
slope which results in a difference in elevation between the front property

line and the rear property line of more than fve percent, the assumed
ground level shall be the average of the two elevations.
(b) The permitted height shall be limited to that applicable to a struc-
ture within the zoning classification of the site.
(c) Antenna may exceed the height set forth in subsection (b) of this
section with a special permit pursuant to Chapter 25.16 of this code.
(d) Nothing in this title shall be construed to permit the erection, in-
stallation, building or maintenance of any antenna which exceeds in height
the limits prescribed by any federal statute or by any law of the state of
California, or by any order, rule or regulation of the Federal Aviation
Agency, or other federal or state regulatory agency empowered to make such
order, rule or regulation. (Ord. 948 § 1(part); December 20, 1971, as

I refer to my application for a permit for the installation
of the Satellite antenna above my business premises at 1462 Burlingame
Ave., Burlingame. May landlord Mr. Worlitzer has given me verbal
consent to have the installation done.
This antenna is used for demonstrating home Satellite systems
and the vast amaunt of programne entertainment.
The placement of this antenna was inf luenced by the extreme
height of the Pacific Bell (AT+T) building next door. To explain the
technical ramifications I refer yau to the illustration, Fig. 1
of the Satellite placement situation servicinq Nor.th America.
L�,�e to geographical location of 1462 Burlingame Ave. in respect
to the above technical data, it was necessary to place the antenna within
25ft of the Burlingame Ave. frontage.
This affords aur antenna system a full sauth easterly to saurth
westerly traverse at an angle of 43 .
Had the Pacific Bell building not been so high the placement of the
antenna cauld have been further back from the Burlingame Ave. frontage.
I appreciate the cities emphasis on the esthetics and will endevaur
to balance the ordinance and the satisfactary function of the equipment to
mutual interest.

Dear Mr. Andrieni:
In the review of your special permit application to allow the disch antenna on
top of the building at 1460 Burlingame Avenue to remain the following questions
have come up:
1. Your roof plan seems to show that the antenna is mounted very close to
the property line between 1454 and 1460 Burlingame Avenue and perhaps even on
the roof of the structure at 1454 Burlingame Avenue. Please clarify the
exact location of the satellite dish with respect to property lines. Does
the dish, in fact, extend over property line?
2. The property owner's consent to the application is still missing. Verbal
consent is not adequate.
3. More detailed information on the antenna itself would be helpful in order
to understand the bulk, shape, color, type of mount and appearance of the
antenna. Perhaps photographs could also be provided.
4. Please show the antenna on the elevation drawing of Home Video and
Coiffeur Ambassador.
Please provide this information by 5:00 P.M., December 20, 1985 in order
to include it in the next Planning Commission packet.

to clarify the lor_ation and description of your proposed roo-f-top dish
antenna. As of this time v�te have not heard from you; therefore, your
application will be forw�rded to trie members of the Planning Commission
"as is" for study.
We suggest that you definitely plan cn a�ttending the st�dy session for your
project on January 14, 19�5 at 7:30 P.M. since the Commission may request .
additional information beyond what staff has req��ested. You will have only
one week following the study session to submit the requested information
before the next packet goes out to Commission members for review prior
to the public hearing, as is the normal procedure for a Special Permit
application.
A copy of our last letter to you listing the specific information requested
is enclosed for your convenience. Please call us at 342-8931 if you have

Staff/Commission discussion: if this ordinance is not adopted,
existing nonconforming uses could remain if the use is continuous;
Fire Chief has stated he had few concerns if nonflammable solvent were
used; Fire Department makes an inspection each year of all industrial
businesses.
Chm. Graham opened the public hearing. James Jackson, attorney
representing Marmora Terrell and Nancy Kurkjian, property owners of
the Adeline Market site, spoke in favor: their request for a code
amendment had been made to City Council and Council referred it to the
Planning Commission; felt a dry cleaning establishment would be a good
addition to the Adeline Market area and found that the One Hour
Martinizing people do processing on site; understand flammable liquid
usage is outlawed in California; would suggest the ordinance be
amended to allow dry cleaning plants in C-1 but only with a special
use permit, in that manner Commission could review each operation on
its own merits and consi3er individual neighborhood concerns; it
appears the city has six plants in the C-1 zone at present; would like
the opportunity to come back to Commission for this use in the C-1
zone. There were no further audience comments and the public hearing
was closed.
Commission comment: this is heavier type of use than other uses in
C-1, feel it should stay in C-2 unless the city revi�ws other C-2 uses
also, am not aware there is a public demand for this use in C-l.
C. Taylor moved that the Planning Commission recommend to the City
Council no change in the C-1 district ordinance. Second C. Schwalm.
Comment on the motion: have seen no comoelling information to suggest
the ordinance should be changed; amendment appears to be 3esigned for
the benefit of one property owner; such a significant change should be
supported by more interest and a public need demonstrated. The
difference between C-1 and C-2 was discussed; C-1 is retail/service,
the service given directly; C-2 involves making the product and
providing the service; major difference between the two seems to be
number of employees, a C-2 use in C-1 would have greatzr parking
impact on the retail area.
Motion approved 5-2 on roll call vote, Cers Giomi and Leahy
dissenting. Staff will forward Commission's recommendation to
Council.
8. REQUEST FOR EXTENSION OF THE JA�VUARY 23� 1984 SPECIAL PERMIT
AMENDMENT TO ALLOW A SWIMMING POOL ADDITION 'I'O THE BURLINGAME
ATHLETIC CLUB AT 888 HINCKLEY ROAD; BY KENN EDWARDS
CP L�lonroe reviewed the item; request for extension has been made
because the applicant has not yet received financing for the project.
Ref. staff report, 1/14/84; applicant's letter, 12/19/84; Commission
