Since there was no appeal to or suspension by the City Council, the February 14, 2000 Plaruiing
Commission approval of your conditional use permit application became effective February 23, 2000.
This application was for an existing food establishment classified as a Specialty Shop Food Establishment
in the Burlingame Avenue commercial area at 1453 Burlingame Avenue, zoned C-1, Subarea A,
Burlingame Avenue Commercial Area.
The February 14, 2000 minutes of the Planning Commission state your application v�as approved with
the following conditions:
1. that this business location, occupied by a specialty shop with 1,119 SF of on-site seating, may be
replaced by another specialty shop at the same location within the same or less leased square
footage subject to the conditions of this conditional use perrnit, or shali be allowed to change to
a different type of �food estab�ishment with a new conditional use permit; that if .�his specialty shop
food establishment �s changed to any other type of food establishment classification, this site shall
not return to specialty shop use;
2. that the 1,119 SF area of �on-site seating of the specialty shop shall be enlarged or extended to any
other areas within ti�e tenant space only by an amendment to this conditional use permit;
3. that this food establish�ent shall proaide trash receptacles as approved by the city consistent with
the streetscape unprovements and maintain atl trash receptacles at the entrances to the building and
at any additional locations approved �y the City Engineer and Fire Department;
4. that the applicant shall provide daiiy litter control along all frontages of the business and within
fifty (50) feet of all frontages of the business;�- .
5. that there shall be no food sales allowed at this location from a window or from any opening
within 10' of the property line;
6. that if this site is changed from any food establishment use to any retail or other use, a food
establishment shall not be replaced on this site and this conditional use permit shall become void;

7. that this food establishment may be open seven days a week from 7:00 a.m. to midnight, with a
maximum of 10 employees on site at any one time; and
8. that the project shall meet all the requirements of tlie LTniform, Building and Uniform Fire Codes,
1998 Edition, and as amended by the City of Burlingame.
The decision of the Council is a fmal administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within
90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.

C. Keighran moved approval of the consent calendar based on the facts in the staff reports, commissioners comments
and the findings in the staff reports with recommended conditions in the staff reports as amende� by stafftonight, by
resolution. The motion was seconded by C. Dreiling. Chair called for a voice vote on the motion and it passed 7-0.
Appeal procedures were advised.
The Commission began consideration of the consent calendar at 8:10 p.m. and concluded their action at 8:15 p.m
Chairman Luzuriaga called for a 10 minute break at 8:15 p.m. and reconvened at 8:25 p.m.
REGULAR CALENDAR
1541 LA MESA DRIVE, ZONED R 1- APPLICATION FOR HII,LSIDE AREA CONSTRUCTION PERMIT AND
DESIGN REVIEW FOR A FIRST AND SECOND STORY ADDITION. (KEITH BORRAL, APPLICANT AND
PROPERTY OWNERI
Reference staff report, 2.14.00, with attachments. City Planner and Commission discussed the report, reviewec� criteria
and Planning Department comments. Three conditions were suggested for consideration. Commissioner noted that
there was no landscape plan included and in this case the height of the trees should be shown, in hillside areas there
should be a tree height limitation because of view impacts. There were no further questions or comments for staff from
the commission.
Cha.irman Luzuriaga opened the public hearing. Keith Bona11, property owner, spoke tried to put up story poles, the
weather was bad and it was too dangerous, took pictures from the house where the people had expressed concern about
their view being blocked, they will be most affected by the Cyprus trees in the yard, would be glad to remove them if
they would assist with the cost; would be willing to put up story poles again but not sure that it will help people
understand the addition. Commission asked, looked at the plans and the second story seems well integrated but the
porch is small, could you expand the roof eave to cover it. Applicant's axchitect Noemi Avram, Gumbinger Associates,
60 W. Third Street, San Mateo, responded, the reviewer suggested adding the porch to emphasize the entry and break
the long facade, she felt the change was an improvement. Commission noted that the entry is not resolved on the right
side, could have a softer line. Architect noted proud of the way the entry was resolved, difficult problem because now
all one sees is the driveway, wanted to do without a massive staircase. Commission asked applicant if he wanted a
porch; originally wanted a sun room; Commission suggested that could hip the roof over the stairwell and get a vertical
element. The applicant had no further comments.
