Dear Mr. Beale,
Since there was no appeal to or suspension by the City Council, the January 14, 2002 Planning Cornmission
approval of your application for a conditional use permit became effective January 23, 2002. This application
was to allow for an existing food establishment at 1448 Burlingame Avenue, zoned C-1, Subarea A, Burlingame
Avenue Commercial Area.
The January 14, 2002 minutes of the Planning Commission state your application was approved with the
following conditions:
1. that this business location occupied by a full service food establishment, with 2,180 SF of on-site seating
(1,089 SF - ls` floor; 837 SF - 2"d floor; 254 SF - outdooi Yutio) may change its food establishment
classification only to a limited food service or bar upon approval of a conditional use permit for the
establishment change; the criteria for the new classification shall be met in order for a change to be
approved;
2. that the 2,180 SF area of on-site seating, including the first floor, second floor or outdoor patio seating
areas, of the full service food establishment shall be enlarged or extended to any other areas within the
tenant space only by an amendment to this conditional use permit;
that this food establishment shall provide trash receptacles as approved by the city consistent with the
streetscape improvements and maintain all trash receptacles at the entrances to the building and at any
additional locations approved by the City Engineer and Fire Department;
4. that the applicant shall provide daily litter control along all frontages of the business and within fifty (50)
feet of all frontages of the business, including the parking lot to the rear of the site;

5. that an amendment to this conditional use permit shall be required for delivery of prepared food from this
premise;
6. that there shall be no food sales allowed at this location from a window or from any opening within 10' of
the property line;
7. that if this site is changed from any food establishment use to any retail or other use, a food establishment
shall not be replaced on this site and this conditional use permit shall become void;
that this full service food establishment may be open seven days a week from 11 a.m. to 2:00 a.m., with a
maximum of 30 employees on site at any one time, including the business owner and manager; and
9. that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes, 1998
Edition, and as amended by the City of Burlingame.
All site improvements and construction work will require separate application to the Building Department. This
approval is valid for one year during which time a building permit must be issued. One extension of up to one
year may be considered by the Planning Commission if application is made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days
of the date of the decision unless a shorter time is required pursuant to state or federal law.

I am in receipt of your January 28, 2013 letter (attached) requesting early demolition of interior
improvements on the property located at 1448 Burlingame Avenue in advance of issuance of a
Building Permit for the new tenant improvements. Pursuant to Burlingame Municipal Code
§18.07.065(c); your request is hereby granted, pursuant to the following findings:
The project is Categorically Exempt from environmental Review under the California
Environmental Quality Act (CEQA). All project entitlements have been granted by the City of
Burlingame, pursuant to Title 25 of the Burlingame Municipal Code. On January 14, 2002, the
Burlingame Planning Commission approved a conditional use permit for the operation of a full-
service food establishment on the premises. On November 26, 2012 an application for Minor
Design Review was approved by the Community Development Director for exterior
improvements related to the operation of a new full-service food establishment at the location.
2. You have adequately demonstrated that special circumstances exist to warrant early
demolition, in that:
a. Demolition of the existing interior of the premises is warranted in an effort to reduce the
potential for mold to occur as a result of a variety of roof leaks that exist in the building,
and to prevent further damage to the structure of the building. You note that there is to
be no demolition of the exterior of the Burlingame Avenue fa�ade of the structure, but
that the concrete block "cooler" at the rear of the building will be demolished to provide
a location for debris boxes and truck parking that will not interfere with public parking at
the rear of the property.
3. An application for a Building Permit (Plan Check B12-0467) was submitted to the Community
Development Department - Building Division on December 28, 2012. Initial Plan Check
correction notes have been generated by most reviewing City departments.
In the event that a Building Permit is not issued within ninety (90) days following issuance of a
Demolition Permit for existing site improvements, the property owner shall be required to remove all
debris from the site and secure the property to the satisfaction of the Community Development

Director within sixty (60) days following notification by this department of a failure to obtain a Building
Permit within the stated time frame.

Request for Early Demolition
Dear Bill,
Per our recent conversations regarding the project referenced above, this letter shall
serve as our request for the issuance of a Demolition Permit prior issuance of the official
Building Permit for the project.
Per Municipal Code Section 18.07.065 Section 303 Amended — Issuance:
The project is Categorically Exempt from CEQA. With respect to Title 25 (Zoning
Code) the project received Design review approval for the Burlingame Avenue
fa�ade improvements. It has come to our attention that the new exit stairs from
the second floor dining area (required by both the building division and fire
division) will require minor in house design review. We would expect approval for
these stairs in the near future.
Special Circumstances: it is our desire to perform interior finishes demolition in
order to prevent mold from occurring due to a variety of roof leaks that have
taken place in the building. These leaks have damaged a variety of the interior
finishes and removal would not only provide needed insight as to the condition of
the substrate but prevent further damage from occurring. In addition, we should
point out that no demolition of the Burlingame Avenue fa�ade items to be
replaced would occur until the subsequent building permit is issued. We would,
however, request that we be allowed to also demolish the concrete block "cooler"
which occurs at the rear of the building as planned for the overall construction.
The demolition of the "cooler" area will allow a location for debris boxes and
some truck parking so as not to interfere with the parking area at the rear of the
building.
3. Our office has prepared the necessary plans for the project for which the
demolition is intended.

4. Our office has submitted the plans for the initial plan check for permit submittal to
both the city building division and the county health department. We expect that
our plan check comments should be ready sometime later this week or early next
week.
We believe that the issuance of an early demolition permit will not be detrimental to the
health, safety and welfare of the general public and will ensure the safety, security and
cleanliness of the property.
It should also be emphasized that the vast majority of the demolition occurs within the
building envelope.
I trust the foregoing will meet with your approval. Please do not hesitate to contact me
