All conditions of approval as stated in all previous reviews of this project will apply to
this project.
NOTE: The approved use of the second floor salon was not definitively addressed in the
letter dated 11-19-2012 from U.S. Trust Services. Because the use of the salon space
has a direct effect on the health and safety for all of the tenants in this building, a
building permit application and complete plans must be submitted to either legalize or
remove the use of the second floor salon occupancy prior to submittal of the plans to
the Building Division for Building Code compliance plan check of Delfina restaurant. In
addition, prior to the issuance of the Certificate of Occupancy for any part of Delfina
restaurant the building owner must have obtained a building permit to either legalize or
remove the salon use and must be in the process of working diligently to obtain a Final
inspection for that tenant space.

, 3. lonfirm that the tenant currently occupying part of the second floor, accessed via a stairway at the
«of the building, will not occupy any part of this building.
There is no permit for a separafe tenant in this building, at fhe rear portion of the second floor. At
the pre-application meeting on June 11, 2012 this issue was raised and the City was informed that
the enfire second floor would be renovated with this tenant improvement. lncorporating
occupancy of the second floor with the tenant improvemenfs for this application would have made
unpermifted occupancy of the rear of the second floor a moot point. Because work, and
occupancy, without fhe required building permits raises health and safety concerns for occupants
of the entire building this issue must be addressed at this time.
omplete the occupant load table below, that accounts for all floor area in the tenant space, and
vide the table on the first page of the plans.
Please correct the occupant load tab/e as follows:

In addition, the square footage on the occupant load table and the information provided under
"Building Information" does not match. Revise the p/an so that the square footage of the tenant
space is the same in both tab/es.
19. lustrate compliance with the minimum plumbing fixture requirements described in the 2010 California

This new, full-service restaurant aims to provide a completely accessible ground floor. The second story dining
area is only a secondary area - the main dining experience occurs on the ground floor.
9. Special hardship considerations such as functional, structurai, and financial impacts on the feasibility of
the rOect: We believe the fiscal and spacial impact of installin an elevator to access a--800 square foot second floor
make this hardship request worth considering.
Any request for an unreasonable hardship must address all of the above listed criteria. Emphasis should
be placed on the elements that demonstrate the greatest need for the approval of an unreasonable

Conditional Use Permit for a new full service food establishment at
1444 Burlingame Avenue, zoned BAC, APN: 029-122-250
Staff Review: June 25, 2012
Any construction project in the City, regardless of size, shall comply with the City
NPDES permit to prevent stormwater pollution from construction activities. Project
proponent shall ensure all contractors implement Best Management Practices
(BMPs) during all phases of construction (including demolition).
When submitting plans for a building permit include a list of construction stormwater
pollution prevention BMPs as project notes and include them as a separate full size
pla_n sheet, preferably 2' x 3' or larger. Project proponent may use the attached
Construction Best Management Practices (BMPs) plan sheet to comply with this
requirement. Electronic file is available for download at
http://www.flowstobay.org/bs_construction. php
(Scroll about half-way down the page and click on Construction BMP Plan
Sheet).
For assistance please contact Stephen D. at 650-342-3727
Please route building plans through Environmental Compliance (WW) and
Stormwater (SW).
