I/A
All conditions of approval as stated in all previous reviews of this project will apply to
this project.
NOTE: The approved use of the second fioor salon was not definitively addressed in the
letter dated 11-19-2012 from U.S. Trust Services. Because the use of the salon space
has a direct effect on the health and safety for all of the tenants in this building, a
building permit application and complete plans must be submitted to either legalize or
remove the use of the second floor salon occupancy prior to submittal of the plans to
the Building Division for Building Code compliance plan check of Delfina restaurant. In
addition, prior to the issuance of the Certificate of Occupancy for any part of Delfina
restaurant the building owner must have obtained a building permit to either legalize or
remove the salon use and must be in the process of working diligently to obtain a Final
inspection for that tenant space.

onfirm that the tenant currently occupying part of the second floor, accessed via a stairway at the

There is no permit for a separate tenant in this building, at the rear portion of fhe second floor. At
the pre-application meefing on June 11, 2012 this issue was raised and the City was informed fhat
the entire second floor would be renovated wifh this tenant improvement. Incorporating
occupancy of the second floor with the tenant improvements for this application would have made
unpermitfed occupancy of the rear of the second floor a moot poinf. Because work, and
occupancy, without the required building permits raises health and safety concerns for occupanfs
of the enfire building fhis issue must be addressed at fhis time.

UNREASONABLE HARDSHIP REQUEST - ACCESSIBILITY IN AN EXISTING BUILDING

is made. Disproportionate is one element that must be established to qualify. The following information
must be provided to assist with your request.

3. Cost of roposed access features $ 100,000 equal to or more than item 4 below)
4. 20% of construction cost $ 80,000
5. Proposed fully compiying new accessibility features which will be gained:
Two new fully accessible building entrances and means of egress will be added. Two new accessible

7. List existing non-complying accessibility features:
The main building entry does not meet current code. The (e) accessible parking space does not meet current
code. The (e) mezzanine level is currently not accessible.
8. The nature of the use of the facility under construction and its availability to persons with disabilities:
This new, full-service restaurant aims to provide a completely accessible ground floor. The second story din
area is only a secondary area - the main dining experience occurs on the ground floor.
9. Special hardship considerations such as functional, structurai, and financial impacts on the feasibility of
th2 pOjeCt: We believe the fiscal and spacial impact of installing an elevator to access a--800 square foot second floor
make this hardship request worth considering.
Any request for an unreasonable hardship must address all of the above listed criteria. Emphasis should
be placed on the elements that demonstrate the greatest need for the approval of an unreasonable
hardship. All details of any unreasonable hardship finding wiil be recorded and kept on file bv the Citv.
