Conditional Use Permif Amendmenf
Item No.
Regular i4ction
Address: 1444 Burlingame Avenue Meeting Date: March 25, 2013
Request: Conditional Use Permit Amendment for changes to a previously approved new full service food
establishment (Pizzeria Delfina).
Applicants: Craig and Anne Stoll, Delfina APN: 029-122-250
Property Owner: Fred Schifferle, Wurlitzer Trust Lot Area: 9.971 SF
Architect: Patrick Flynn, Envelope Architecture + Design Zoning: BAC
General Plan: Burlingame Downtown Specific Plan: Burlingame Avenue Commercial District
Previous Use: Retail home goods store (Haven)
Proposed Use: Full service food establishment (Pizzeria Delfina)
Allowable Use: Full Service food establishment with approval of a Conditional Use Permit
Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15301 - Existing facilities, Class 1(a) of the CEQA Guidelines,
which states that interior or exterior alterations involving such things as interior partitions, plumbing, and
electrical conveyances are exempt from environmental review.
History: On June 18, 2012, the City Council adopted Ordinance 1878, which allows up to three additional full
service food establishments, two (2) within the 1400 block of Burlingame Avenue and one (1) on Primrose Road
north of Burlingame Avenue within the BAC zoning district, upon approval of a Conditional Use Permit.
On November 15, 2012, the City Council adopted Ordinance 1881, to eliminate the quota on the number of full
service food establishments within the Burlingame Avenue within the BAC zoning district.
On December 10, 2012, the Planning Commission approved an application for Conditional Use Permit for a new
full service food establishment (Pizzeria Delfina) and Commercial Design Review for changes to the exterior
faade of an existing commercial building at 1444 Burlingame Avenue (December 10, 2012 Planning
Commission Minutes attached). The applicant has not yet submitted an application for a building permit.
Proposed Revisions: The applicant is now requesting an Amendment to the approved Conditional Use Permit
for proposed changes to the previously approved new full service food establishment. The applicant is
proposing to increase the approved seating area on the mezzanine level by 91 SF taking the total on-site seating
area from 1,293 SF (approved) to 1,384 SF (proposed). The applicant is also proposing to remove the exterior
stairwell from the rear of the building. This change at the rear of the building does not trigger an amendment to
the approved Design Review because it is not visible from the public right of way. Please refer to the attached
letter and revised plans submitted by the applicant on March 1, 2013 and March 12, 2013, for an explanation of
the proposed changes.
Summary (based on plans submitted March 12, 2013): Piueria Delfina is proposing to operate a new full
service food establishment at 1444 Burlingame Avenue, zoned BAC. Pizzeria Delfina is a neighborhood pizzeria
that will serve lunch and dinner and that features Neapolitan inspired pizzas, seasonal antipasti, salads and
desserts. Currently, Delfina operates three restaurants in San Francisco, Pizzeria Delfina (in Pacific Heights and
the Mission) and Locanda (in the Mission).
The vacant tenant space, previously occupied by Haven (a retail home goods store) measures approximately
3,147 gross square feet. There is an existing salon at the rear of the building on the second floor that gets its
access from the parking lot at the rear of the property. The full service food establishment will contain customer
seating, a bar, restrooms, a kitchen and food storage. Approximately 1,384 SF of customer seating will be
provided as part of the food establishment (1,042 SF within the tenant space and 342 SF on the patio at the rear
of the existing building) (see Floor Plan, sheet a2.00). The applicant was approved forthe following applications
Condiiional Use Permit Amendment
on December 12, 2012:
1444 Burlingame Avenue
■ Conditional Use Permit for a new full service food establishment (Piueria Delfina) in the BAC Zoning
District with 1,293 SF of on-site seating area (951 SF within the tenant space and 342 SF on the patio at
the rear of the existing building) (CS 25.32.070); and
■ Commercial Design Review for changes to the front faade of an existing commercial storefront in the
BAC Zoning District (CS 25.32.045).
The applicant is currently requesting the following application:
■ Conditional Use Permit Amendment for changes to a new full service food establishment (Pizzeria
Delfina) in the BAC Zoning District with 1,384 SF of on-site seating area (1,042 SF within the tenant
space and 342 SF on the patio at the rear of the existing building) (CS 25.32.070).
A full service food establishment is defined as a business which sells food prepared indoors on the premise with
a full menu and provides an indoor seating area of at least 250 SF. Operating criteria for a full service food
establishment include most or all of the following: served by waiters to seated customers and where payment is
made at the end of the meal; presence of a full commercial kitchen and commercial dishwasher; and food is
served on ceramic plates with metal flatware and cloth napkins. The proposed food establishment meets all of
these operating criteria.
The applicant anticipates there will be 33 full-time and 6 part-time employees on weekdays and weekends,
before 5 pm and 34 full-time and 7 part-time employees after 5 pm. At opening, the applicant projects a total of
135 customers per day before 5:00 pm and 180 customers after 5:00 pm. In five years, the applicant projects
that the number of customers is expected to increase to 144 people before 5:00 pm and 200 people after 5:00
pm. A maximum of 256 people are expected on site at any one time, including the owner, employees and
customers. The food establishment will be open Sunday through Thursday from 11:30 am to 10:00 pm and on
Fridays and Saturdays from 11:30 am to 11:00 pm.
With this application, the applicant is proposing alterations to the front faade of the existing commercial
building. This project is subject to Commercial Design Review because it includes changes to the faade of a
storefront located in the BAC zoning district. Please refer to sheet a4.00 for a side-by-side comparison of the
existing and proposed building elevations. The existing building faade is made up of a variety of materials
including stucco, painted wood windows and entry door, a copper base trim and a clay tile roof. The applicant is
proposing new concrete tile along the base of the building, new stain-grade wood operable windows and entry
doors and a new retractable awning along the front elevation. The existing building faade, which is primarily
stucco, will remain and be repainted and the existing second level windows, wood columns and clay tile roof will
also remain.
Personal and retail services on the first floor in the Burlingame Avenue Commercial Area are exempt from
vehicle parking requirements as set forth in code section 25.36.040 (d). In the Burlingame Avenue Commercial
Area, a food establishment is considered to be a retail use for parking purposes. Therefore, since there is no
intensification of use proposed with this application (retail to retail), no additional on-site parking is required (10
parking spaces proposed on-site).

To Whom It May Concern,
We respectfully submit the included drawings to amend our previously approved Conditional Use Permit
and Commercial Design Review application. The drawings have been updated to reflect the following
changes:
Exterior
- The entry-door segment of the facade along Burlingame Avenue has been recessed 2'0". By recessing
the whole opening we believe it increases the prominence of that entry opening.
- The window sill height of the south window on the Burlingame Avenue facade has been lowered to
align with the window to the north. The sill, initially, was higher to accommodate for a built-in
banquette on that front facade. That banquette was removed from the proposed scope of work and
we would like to lower it to create a more balanced facade.
- The rear window adjacent to the rear door has been enlarged because we've added a server station at
the rear of the restaurant to service take-out customers.
- The stair, deck and new door on the second floor at the rear of the restaurant has been removed from
the proposed scope of work.
In teior
- There have been a number of interior wall reconfigurations on the first floor, mainly due to continued
design discussions with the client and clarification of electrical requirements for the new electrical
service for the building.
- The second-floor dining area has been slightly enlarged, the storage area has been decreased in size.
The total mezzanine area has not changed.

Conditional Use Permit Application
Pizzeria Delfina, Burliname
1. Explain why the proposed use at the proposed location will not be detrimental or injurious to
property or improvements in the vicinity or to public health, safety, general welfare or convenience.
Use or features as proposed will not be detrimental or injurious to property or improvements in the
vicinity or to public health, safety, general welfare, or convenience. See below for detailed
information.
Public health
The presence of Pizzeria Delfina will not have a negative impact on the public health of Burlingame
residents, as outlined below.
• All of Pizzeria Delfina's employees are required to maintain very high levels of personal
hygiene and cleanliness in the restaurant. For example, all employees must take off their
aprons when they enter the restrooms, wash hands frequently, and pick up trash in and
around the restaurant. Additionally, all managers are required to have State of California
ServSafe certifications and all employees are required to have a Food Handler's Certificate.
• Garbage will be stored on the back patio in bins issued by an approved garbage disposal
company. Garbage will be stored out of public sight and picked up daily. The bins will be
washed out daily after garbage pick-up.
• Pizzeria Delfina will recycle all recyclable materials and compost all compostable materials
(in accordance with the laws of Burlingame). All recycling and compost will be picked up
daily.
• Grease will be stored in 50-gallon covered drums that are provided for the purpose of
storage. The grease will be picked up twice weekly by a company that converts the used
grease into biodiesel.
• Pizzeria Delfiina does not dispose of any chemicals and strives to buy all eco-sensitive
cleaning products.
• An exterminator will be contracted and retained and will visit the restaurant on a monthly
basis or more frequently, if necessary.
• Pizzeria Delfina will not dispose of any materials into the sewer system. The kitchen will be
outfitted with grease traps designed for the restaurant's equipment.
• There should be no negative impact to Burlingame's air quality as a result of Pizzeria
Delfina's business.
Public safety
The presence of Pizzeria Delfina will not have a negative impact on the public safety of Burlingame
residents, as outlined below.
• It is anticipated that Pizzeria Delfina will have a lively atmosphere similar to that of its other
locations; however, the restaurant will be fully outfitted with the proper sound proofing
,-, _...'-..,
` . _
materials. The restaurant plans on offering outdoor dining in the front and back of the
restaurant (20 seats in front, 12 seats in back), which will provide a pleasant venue for
alfresco dining. Additionally, the outdoor dining spaces will enhance the restaurant's ability
to serve the neighborhood more efficiently as the additional dining areas will provide
expanded seating capacity and thus reduce wait times for tables. Pizzeria Delfina will
operate the outdoor dining space in a manner that minimizes noise and does not
significantly disturb the privacy or affect the livability of the adjoining or surrounding
residences. Pizzeria Delfina is committed to operating responsibly and being a good
neighbor to residents and other tenants in the area.
• Pizzeria Delfina will be fully outfitted with smoke alarms, sprinklers, and an ANSUL system.
• The management does not anticipate any issues related to increased congestion in the town
in the form of driving traffic or loitering.
• For information related to the storage of hazardous and flammable materials, please refer
to information in the Public Health section above.
General welfare
Pizzeria Delfina's mission is to create a consistently craveable experience through delicious food,
honest connections and shared respect. The service will be warm and casual and the ambience will
be relaxed, creating a dining environment perfectly suitable for families with children. The
restaurant will be fully outfitted with adequate space for stroller parking and clean and safe infant
and toddler seating. With a variety of kid-friendly food at affordable prices (currently no menu item
is above $20 and the average check is approximately $21), Pizzeria Delfina will be a wonderful
addition to the neighborhood for people of a variety of ages and lifestyles.
In accordance with the City of Burlingame's policy and goals for conservation, Pizzeria Delfina is
committed to operating in a manner that is environmentally friendly. Examples include the
following:
• Purchasing responsibly farmed and raised produce, meat, fish, and dairy
• Developing relationships with and purchasing from farmers and suppliers with sustainable
practices
• Cooking with farm-to-table ingredients
• Recycling and composting, when possible
• Using compostable to-go containers
• Purchasing eco-sensitive cleaning supplies
• Utilizing a grease disposal company that converts used grease into biodiesel
Additionally, the Pizzeria Delfina management team and their architect and design team will
consider energy and water conservation as they make decisions regarding the build-out and design
of the restaurant (i.e., energy efficient light fixtures and kitchen equipment).

Convenience
Pizzeria Delfina will offer a shared lot behind the restaurant and street parking in the front. We do
not expect the restaurant to generate any issues related to the current flow of traffic in downtown
Burlingame.
2. How will the proposed use be located and conducted in accordance with the Burlingame General
Plan and Zoning Ordinance
As stated in the general plan designation, "It is the purpose of this chapter to encourage and
maintain the current mixture of retail, personal service, and restaurant uses which keep the heart of
the downtown ively." Pizzeria Delfina is a bustling neighborhood pizzeria with a focus on the
neighborhood within which it resides. We believe that Pizzeria Delfina will fit in nicely with the
current tenant mix of Burlingame Avenue and will contribute to the liveliness of the area with its
family-oriented ambience, attentive yet relaxed service, and approachable food. The outdoor
seating in the front will attract passersby and shoppers for a delicious and casual meal of pizzas,
salads, and wine. With an established brand and reputation, the opening of Pizzeria Delfina in
Burlingame will generate buzz in the culinary community. Given its popularity in San Francisco and
proximity to the Burlingame CalTrain, it is expected that the new location will attract patrons from
within the township of Burlingame and its surrounding areas as well as from residents of San
Francisco and other parts of the Bay Area. The strong demand will help to ensure Pizzeria Delfina's
success as a new addition to the community as well as attract more shoppers and diners to
downtown Burlingame, increasing retail sales and food/beverage consumption. Additionally, the
opening of Pizzeria Delfina will provide between 30 and 40 new, secure jobs for local residents.
We have no reason to believe that the features as proposed will adversely affect the property or
neighborhood and believe that they will comply with the applicable provisions of Burlingame
General Plan and Zoning Ordinance, as well as further enhance the surrounding area.
3. How will the proposed project be compatible with the aesthetics, mass, bulk and character of the
existing and potential uses on adjoining properties in the general vicinity?
The proposed project complements the variety of existing uses of the neighboring properties. Most
of the building's structure will remain unchanged with the exception of exterior facade changes at
the sidewalk level and at the rear of the property. Looking towards the improvements associated
with the now-approved Burlingame Avenue Streetscape Project, the proposed facade changes aim
to open the restaurant to the life of the sidewalk. The proposal employs a similar tactic that
neighboring dining establishments use by providing large openings at the pedestrian level and
sidewalk dining. At the rear of the property, we are proposing a patio area renovation that will
provide exterior, shaded seating. The rear yard/patio is currently landscaped in a manner that does
not make efficient use of the space, and we also seek to create a better connection to the parking
lot that is located behind the restaurant.

To whom this may concern,
We, Craig and Anne Stoll, the founders and owners of Delfina, Pizzeria Delfma (in
Pacific Heights and the Mission), and Locanda, are excited to be opening our first
restaurant outside of San Francisco. We plan to open our third Pizzeria Delfina location
at 1444 Burlingame Avenue in downtown Burlingame. Below, please find information
regarding our business, mission and core values, biographies, and a sample menu.
Business Overview
A critically acclaimed and proven concept, Pizzeria Delfina is a bustling, neighborhood
pizzeria that has helped to define the San Francisco pizzeria experience. The food at
Pizzeria Delfina is inspired by my (Craig Stoll) memories of New York-style pies from
my youth combined with the best pizzerias of Naples. The restaurant in Burlingame will
be housed in a beautiful but functional storefront with sidewalk tables surrounded by
eager crowds waiting for seats. The menu will feature Neapolitan inspired, thin crust
pizzas, as well as a tempting array of seasonal antipasti, salads, piatti del giorno (daily
specials), and a small selection of desserts including organic housemade gelato, all
produced on site in our brand new commercial kitchen. The food is Italian in spirit,
using local, seasonal, and sustainable ingredients offered by Bay Area farmers, ranchers,
fisherman, and producers we have known for years. Food sales represent approximately
70% of the restaurants total sales.
To complement the food offerings, a beverage program will include thirty carefully
selected and well-rounded Southern Italian wines all under $50, half of which will be
available by the glass or on tap. We champion small producers who make wines that
reflect their particular terroir and express a winemaker's passion. A diverse selection of
small batch beers will follow suit with a focus on California artisan producers. Diners
will be served by an energetic team with disarming warmth and a thorough understanding
of the food and wine, hired for their natural hospitality and true love of the business.
Beverage sales represent approximately 30% of the restaurants total sales.
The space will offer approximately 80 seats in the indoor and outdoor dining spaces. The
majority of these seats, at least 50, occupying more than 20 square feet, will be indoors.
Pizzeria Delfina's design will represent our interpretation of the best of Neapolitan
pizzerias, which are at once simple, urban, and functional with a warm, inviting Italian
feel. Diners will encounter staff-selected music, enthusiasm, and passion. Beauty in
functionality follows from the design through the service to the food, which will be
served on ceramic, green-banded plates and eaten with stainless steel flatware (washed in
a commercial dishwasher). Staff, including the host and wait staff with whom our guests
interact during their meal, will know the name of the farm where our oregano is grown,
the significance of the double zero flour used in our pizza crust and how to make the
perfect cappuccino. From the time that the guest is greeted at the door by our host to the
time they pay their bill at the end of their meal, Pizzeria Delfina will, in every aspect,
speak the language of authenticity - real food made by real people.

Biographies
Craig Stoll, Chef/Owner, Delfina Restaurant Group
James Beard Award Winner and critically acclaimed chef, Craig Stoll, might be a New
York native and a San Franciscan at heart, but it's his love and respect for soulful Italian
cooking that has come to define him. After graduating from the Culinary Institute of
America and working through some of San Francisco's finest restaurants, Craig was
awarded a scholarship to attend the ICIF cooking school in Torino, Italy. There it was an
externship at Tuscany's one-Michelin-star restaurant Da Delfina that paved his vision. He
returned to San Francisco and in 1998, along with his wife Annie Stoll, opened Delfina, a
relatively casual 50-seat restaurant located in the still up-and-coming Mission District,
serving rustic Italian food infused with San Francisco's local and sustainable values.
Delfina quickly became a major dining destination, bringing people from all over to try
Craig's cooking including signature dishes like the Fresh Grilled Calamari, Insalata di
Campo and Spaghetti and demanding the restaurant's expansion to 85-seats. This
ultimately garnered him a place as one of Food & Wine's "Best New Chefs" in 2001. In
2005, the Stolls opened the Pizzeria Delfina next door, following up with a second
location in Pacific Heights in 2009. In 2010, Craig won the award for Best Chef: Pacific
from the James Beard Foundation. And now with the 2011 debut of their fourth
restaurant, Locanda, an upscale Roman Osteria & Bar complete with artisanal cocktails,
Craig has solidified his reputation as one of the country's most dynamic and influential
chefs. A die-hard Mission District resident, Craig continues to live in the heart of it all
with his wife Annie and their daughter Lucy.
Annie Stoll, Owner, Delfina Restaurant Group
A San Francisco restaurateur and hospitality icon, Annie Stoll's passion for good service
has long been the perfect complement to her husband Craig's passion in the kitchen.
After honing her front of the house skills at some of the city's top restaurants, Annie met
Craig while working at restaurants across the street from each other in Mill Valley. They
soon left to open Delfina, eloping weeks after opening its doors in 1998. Since then, she
has secured the reputation for the Delfina style service that perfectly reflects its food:
casual and urban, with a friendly but professional sophistication leading it to a 2003
"Best Waitstaff' Award by San Francisco Magazine. Annie has overseen the hiring,
training and management of all front-of house staff at the subsequent openings of
Pizzeria Delfina on 18`h in 2005, Pizzeria Delfina on California Street in 2008 and their
most recent Osteria Locanda in 2011.

1. Based on the 2010 CBC the occupant load table specifies an occupant load of
18 for the second floor dining. On the second floor the seating plan shows
seating for 24. Revise the seating plan to show seating for no more than 18
persons.
2. The maximum travel distance allowed for one exit from the second floor dining
is 75 feet. The distance from the farthest point on the second floor to the nearest
exit is 85 feet. On the plans either show that the travel distance has been reduced
to 75 feet or less or that a second exit will be provided from the second floor.
3. Revise the plans to show that the stairway from the second floor dining is 48"
in width (does not need to be clear width) per 2010 CBC 1007.3 Ex. #2.
NOTE: A written response to the items noted here and plans that specifically
address these items must be re-submitted before this project can move forward

NOTE: The approved use of the second floor salon was not definitively addressed in the
letter dated 11-19-2012 from U.S. Trust Services. Because the use of the salon space
has a direct effect on the health and safety for all of the tenants in this building, a
building permit application and complete plans must be submitted to either legalize or
remove the use of the second floor salon occupancy prior to submittal of the plans to
the Building Division for Building Code compliance plan check of Delfina restaurant. In
addition, prior to the issuance of the Certificate of Occupancy for any part of Delfina
restaurant the building owner must have obtained a building permit to either legalize or
remove the salon use and must be in the process of working diligently to obtain a Final
inspection for that tenant space.

onfirm that the tenant currently occupying part of the second floor, accessed via a stairway at the
r of the building, will not occupy any part of this building.
There is no permit for a separate tenant in this building, at fhe rear portion of the second f/oor. At
the pre-applicafion meeting on June 11, 2012 this issue was raised and the City was informed that
the enfire second floor wou/d be renovafed with fhis tenant improvement. Incorporating
occupancy of the second floor with the tenant improvements for this applicafion wou/d have made
unpermitted occupancy of the rear of the second floor a moot point. Because work, and
occupancy, without the required building permits raises hea/th and safety concerns for occupants
of the entire building this issue must be addressed at this time.

This new, full-service restaurant aims to provide a completely accessible ground floor. The second story dining
area is only a secondary area - the main dining experience occurs on the ground floor.
9. Special hardship considerations such as functional, structural, and financial impacts on the feasibility of
the fOeCt: We believe the fiscal and spacial impad of installin an elevator to access a-800 square foot second floor
make this hardship request worth considering.
Any request for an unreasonable hardship must address all of the above listed criteria. Emphasis should
be placed on the elements that demonstrate the greatest need for the approval of an unreasonable

Ilustrate compliance with the minimum plumbing fixture requirements described in the 2010
California Plumbing Code, Chapter 4, Tabie 4-1 Minimum Plumbing Facilities and Table A-
Occupant Load Factor.
NOTE: The estimated occupant load for this tenant space is at least 146 occupants. Therefore,
the minimum plumbng fixtures are: Water closets — 2 male and 2 female; Urinals — 1;
vatories — 1 male and 1 female.
0 ow compliance with all accessibility regulations found in the 2010 CBC for existing buildings
including:
a. Accessible paths of travel
b. A level landing must be provided on each side of the door at all required entrances and
exits.
c. Accessible countertops
d. Accessible bathrooms
e. Accessible parking
NOTES:
1. Specify a required accessible seating area at each dining experience.
(e.g. Main dining, bar area, exterior dining at the front, exterior dining at
the rear, etc.)
2. Provide a Hardship Request if accessibility cannot be provided at the
second floor dining area.
3. Provide details for the required maneuvering clearances, slope, and
cross slope at all entrances and exits, including the gates at the rear

4. Provide details for the accessible curb cut at the parking space access
aisle in the rear.
5. Indicate that the bar area (counter height > 34") will comply with the 2010
CBC §1104B.5 #4.
6. Because the Waitstation will function as the Office area provide details
on the plans which show that it will meet the accessibility requirements of
the 2010 CBC.
21) Please Note: Architects are advised to specify construction dimensions for accessible features
that are below the maximum and above the minimum dimension required as construction
tolerances generally do not apply to accessible features. See Califomia Access Compliance
anual — Interpretive Regulation 11 B-8.
rovide an exit plan showing required widths and the paths of travel.
NOTES:
1. Because the gates at the rear are part of the second means of egress
system for the restaurant they must swing in the direction of travel.
2. The required second exit must be continuous and accessible from the
Exit to the public way or the a safe dispersal area. Either define the
accessible path to the public right of way or define the accessible path
and the safe dispersal area that complies with the 2010 CBC.
In Assembly occupancies specify aisle widths that comply with 2010 CBC §1028.9.
2r Specify the total number of parking spaces on site
NOTE: A written response to the items noted here and plans that specifically
address items 2, 3, 4, 6, 13, 14, 16, 17, 18, 19, 20, 22, 23, and 24 must be re-
