Applicants: Craig and Anne Stoll, Delfina APN: 029-122-250 Property Owner: Fred Schifferle, Wurlitzer Trust Lot Area: 9.971 SF Architect: Patrick Flynn, Envelope Architecture + Design Zoning: BAC General Plan: Burlingame Downtown Specific Plan: Burlingame Avenue Commercial District Previous Use: Retail home goods store (Haven) Proposed Use: Full service food establishment (Pizzeria Delfina) Allowable Use: Full Service food establishment with approval of a Conditional Use Permit Environmental Review Status: The project is Categorically Exempt from review pursuant to the California Environmental Quality Act (CEQA), per Section 15301 - Existing facilities, Class 1(a) of the CEQA Guidelines, which states that interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances are exempt from environmental review. History: On June 18, 2012, the City Council adopted Ordinance 1878, which allows up to three additional full service food establishments, two (2) within the 1400 block of Burlingame Avenue and one (1) on Primrose Road north of Burlingame Avenue within the BAC zoning district, upon approval of a Conditional Use Permit. On November 15, 2012, the City Council adopted Ordinance 1881, to eliminate the quota on the number of full service food establishments within the Burlingame Avenue within the BAC zoning district. On December 10, 2012, the Planning Commission approved an application for Conditional Use Permit for a new full service food establishment (Pizzeria Delfina) and Commercial Design Review for changes to the exterior fa�ade of an existing commercial building at 1444 Burlingame Avenue (December 10, 2012 Planning Commission Minutes attached). The applicant has not yet submitted an application for a building permit. Proposed Revisions: The applicant is now requesting an Amendment to the approved Conditional Use Permit for proposed changes to the previously approved new full service food establishment. The applicant is proposing to increase the approved seating area on the mezzanine level by 91 SF taking the total on-site seating area from 1,293 SF (approved) to 1,384 SF (proposed). The applicant is also proposing to remove the exterior stairwell from the rear of the building. This change at the rear of the building does not trigger an amendment to the approved Design Review because it is not visible from the public right of way. Please refer to the attached letter and revised plans submitted by the applicant on March 1, 2013 and March 12, 2013, for an explanation of the proposed changes. Summary (based on plans submitted March 12, 2013): Piueria Delfina is proposing to operate a new full service food establishment at 1444 Burlingame Avenue, zoned BAC. Pizzeria Delfina is a neighborhood pizzeria that will serve lunch and dinner and that features Neapolitan inspired pizzas, seasonal antipasti, salads and desserts. Currently, Delfina operates three restaurants in San Francisco, Pizzeria Delfina (in Pacific Heights and the Mission) and Locanda (in the Mission). The vacant tenant space, previously occupied by Haven (a retail home goods store) measures approximately 3,147 gross square feet. There is an existing salon at the rear of the building on the second floor that gets its access from the parking lot at the rear of the property. The full service food establishment will contain customer seating, a bar, restrooms, a kitchen and food storage. Approximately 1,384 SF of customer seating will be provided as part of the food establishment (1,042 SF within the tenant space and 342 SF on the patio at the rear of the existing building) (see Floor Plan, sheet a2.00). The applicant was approved forthe following applications Condiiional Use Permit Amendment on December 12, 2012: 1444 Burlingame Avenue ■ Conditional Use Permit for a new full service food establishment (Piueria Delfina) in the BAC Zoning District with 1,293 SF of on-site seating area (951 SF within the tenant space and 342 SF on the patio at the rear of the existing building) (CS 25.32.070); and ■ Commercial Design Review for changes to the front fa�ade of an existing commercial storefront in the BAC Zoning District (CS 25.32.045). The applicant is currently requesting the following application: ■ Conditional Use Permit Amendment for changes to a new full service food establishment (Pizzeria Delfina) in the BAC Zoning District with 1,384 SF of on-site seating area (1,042 SF within the tenant space and 342 SF on the patio at the rear of the existing building) (CS 25.32.070). A full service food establishment is defined as a business which sells food prepared indoors on the premise with a full menu and provides an indoor seating area of at least 250 SF. Operating criteria for a full service food establishment include most or all of the following: served by waiters to seated customers and where payment is made at the end of the meal; presence of a full commercial kitchen and commercial dishwasher; and food is served on ceramic plates with metal flatware and cloth napkins. The proposed food establishment meets all of these operating criteria. The applicant anticipates there will be 33 full-time and 6 part-time employees on weekdays and weekends, before 5 pm and 34 full-time and 7 part-time employees after 5 pm. At opening, the applicant projects a total of 135 customers per day before 5:00 pm and 180 customers after 5:00 pm. In five years, the applicant projects that the number of customers is expected to increase to 144 people before 5:00 pm and 200 people after 5:00 pm. A maximum of 256 people are expected on site at any one time, including the owner, employees and customers. The food establishment will be open Sunday through Thursday from 11:30 am to 10:00 pm and on Fridays and Saturdays from 11:30 am to 11:00 pm. With this application, the applicant is proposing alterations to the front fa�ade of the existing commercial building. This project is subject to Commercial Design Review because it includes changes to the fa�ade of a storefront located in the BAC zoning district. Please refer to sheet a4.00 for a side-by-side comparison of the existing and proposed building elevations. The existing building fa�ade is made up of a variety of materials including stucco, painted wood windows and entry door, a copper base trim and a clay tile roof. The applicant is proposing new concrete tile along the base of the building, new stain-grade wood operable windows and entry doors and a new retractable awning along the front elevation. The existing building fa�ade, which is primarily stucco, will remain and be repainted and the existing second level windows, wood columns and clay tile roof will also remain. Personal and retail services on the first floor in the Burlingame Avenue Commercial Area are exempt from vehicle parking requirements as set forth in code section 25.36.040 (d). In the Burlingame Avenue Commercial Area, a food establishment is considered to be a retail use for parking purposes. Therefore, since there is no intensification of use proposed with this application (retail to retail), no additional on-site parking is required (10 parking spaces proposed on-site). Required Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit for a full service food establishment, the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) (b) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planning Commission Action: The Planning Commission should conduct a public hearing on the application, and consider public testimony and the analysis contained within the staff report. Action should include specific findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any action should be stated clearly for the record. At the public hearing the following conditions should be considered: that the project shall be built as shown on the plans submitted to the Planning Division date stamped March 12, 2013, sheets a0.00 through a4.00.; 2 3 4 that this business location shall only be occupied by a full service food establishment, with 1,384 SF of seating area, and may not change its food establishment classification to a limited food service food establishment, bar or specialty food shop food establishment; that the 1,384 SF area of on-site seating of the full service food establishment shall be enlarged or extended to any other areas within the tenant space only by an amendment to this conditional use permit; that this food establishment shall provide trash receptacle(s) as approved by the city consistent with the streetscape improvements and maintain all trash receptacle(s) at the entrances to the building and at any 3 Conditional Use Permit Amendment 1444 Bur/ingame Avenue additional locations as approved by the City Engineer and Fire Department; 5. that the business shall provide litter control and sidewalk cleaning along all frontages of the business and within fifty (50) feet of all frontages of the business; 6. that an amendment to this conditional use permit shall be required for delivery of prepared food from this premise; 7. that there shall be no food sales allowed at this location from a window or from any opening within 10' of the property line; 8. that any seating on the sidewalk outside shall conform to the requirements of any encroachment permit issued by the city; 9. that the conditions of the Chief Building Official's March 13, 2013, March 7, 2013, November 20, November 5 and June 29, 2012 memos, the Parks Supervisor's June 26, 2012 memo, the City Engineer's July 10, 2012 memo, the Fire Marshall's March 7, 2013 and June 25, 2012 memos, and the Stormwater Coordinator's June 20, 2012 memo shall be met; 10. that the project shall meet all the requirements of the California Building Code and California Fire Code, 2010 edition, as amended by the City of Burlingame, and that failure to comply with these conditions or any change to the business or use on the site which would affect any of these conditions shall require an amendment to this use permit; 11. that any changes to the size or envelope of building, which would include changing or adding exterior walls or parapet walls, shall require an amendment to this permit; 12. that any changes to building materials, exterior finishes, windows, architectural features, roof height or pitch, �nd amount or type of hardscape materials shall be subject to Planning Division or Planning Commission review (FYI or amendment to be determined by Planning staf�; 13. that demolition or removal of the existing structures and any grading or earth moving on the site shall not occur until a building permit has been issued and such site work shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 14. that prior to issuance of a building permit for construction of the project, the project construction plans shall be modified to include a cover sheet listing all conditions of approval adopted by the Planning Commission, or City Council on appeal; which shall remain a part of all sets of approved plans throughout the construction process. Compliance with all conditions of approval is required; the conditions of approval shall not be modified or changed without the approval of the Planning Commission, or City Council on appeal; 15. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall require a demolition permit; 16. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management and Discharge Control Ordinance; THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION: 17. that prior to scheduling the framing inspection, the project architect, engineer or other licensed professional shall provide architectural certification that the architectural details such as window locations and bays are built as shown on the approved plans; if there is no licensed professional involved in the 4 Conditional Use Permit Amendment 1444 Burlingame Avenue project, the property owner or contractor shall provide the certification under penalty of perjury. The drawings have been updated to reflect the following changes: Exterior - The entry-door segment of the facade along Burlingame Avenue has been recessed 2'0". By recessing the whole opening we believe it increases the prominence of that entry opening. - The window sill height of the south window on the Burlingame Avenue facade has been lowered to align with the window to the north. The sill, initially, was higher to accommodate for a built-in banquette on that front facade. That banquette was removed from the proposed scope of work and we would like to lower it to create a more balanced facade. - The rear window adjacent to the rear door has been enlarged because we've added a server station at the rear of the restaurant to service take-out customers. - The stair, deck and new door on the second floor at the rear of the restaurant has been removed from the proposed scope of work. Public health The presence of Pizzeria Delfina will not have a negative impact on the public health of Burlingame residents, as outlined below. • All of Pizzeria Delfina's employees are required to maintain very high levels of personal hygiene and cleanliness in the restaurant. For example, all employees must take off their aprons when they enter the restrooms, wash hands frequently, and pick up trash in and around the restaurant. Additionally, all managers are required to have State of California ServSafe certifications and all employees are required to have a Food Handler's Certificate. • Garbage will be stored on the back patio in bins issued by an approved garbage disposal company. Garbage will be stored out of public sight and picked up daily. The bins will be washed out daily after garbage pick-up. • Pizzeria Delfina will recycle all recyclable materials and compost all compostable materials (in accordance with the laws of Burlingame). All recycling and compost will be picked up daily. • Grease will be stored in 50-gallon covered drums that are provided for the purpose of storage. The grease will be picked up twice weekly by a company that converts the used grease into biodiesel. • Pizzeria Delfiina does not dispose of any chemicals and strives to buy all eco-sensitive cleaning products. • An exterminator will be contracted and retained and will visit the restaurant on a monthly basis or more frequently, if necessary. • Pizzeria Delfina will not dispose of any materials into the sewer system. The kitchen will be outfitted with grease traps designed for the restaurant's equipment. • There should be no negative impact to Burlingame's air quality as a result of Pizzeria Delfina's business. Public safety The presence of Pizzeria Delfina will not have a negative impact on the public safety of Burlingame residents, as outlined below. • It is anticipated that Pizzeria Delfina will have a lively atmosphere similar to that of its other locations; however, the restaurant will be fully outfitted with the proper sound proofing ,-, _...'-..,� ` . _ � materials. The restaurant plans on offering outdoor dining in the front and back of the restaurant (20 seats in front, 12 seats in back), which will provide a pleasant venue for alfresco dining. Additionally, the outdoor dining spaces will enhance the restaurant's ability to serve the neighborhood more efficiently as the additional dining areas will provide expanded seating capacity and thus reduce wait times for tables. Pizzeria Delfina will operate the outdoor dining space in a manner that minimizes noise and does not significantly disturb the privacy or affect the livability of the adjoining or surrounding residences. Pizzeria Delfina is committed to operating responsibly and being a good neighbor to residents and other tenants in the area. • Pizzeria Delfina will be fully outfitted with smoke alarms, sprinklers, and an ANSUL system. • The management does not anticipate any issues related to increased congestion in the town in the form of driving traffic or loitering. • For information related to the storage of hazardous and flammable materials, please refer to information in the Public Health section above. General welfare Pizzeria Delfina's mission is to create a consistently craveable experience through delicious food, honest connections and shared respect. The service will be warm and casual and the ambience will be relaxed, creating a dining environment perfectly suitable for families with children. The restaurant will be fully outfitted with adequate space for stroller parking and clean and safe infant and toddler seating. With a variety of kid-friendly food at affordable prices (currently no menu item is above $20 and the average check is approximately $21), Pizzeria Delfina will be a wonderful addition to the neighborhood for people of a variety of ages and lifestyles. In accordance with the City of Burlingame's policy and goals for conservation, Pizzeria Delfina is committed to operating in a manner that is environmentally friendly. After graduating from the Culinary Institute of America and working through some of San Francisco's finest restaurants, Craig was awarded a scholarship to attend the ICIF cooking school in Torino, Italy.
