Since there was no appeal to or suspension by the City Council, the March 25, 2013, Planning
Commission approval of your application for Conditional Use Permit Amendment became effective
April 4, 2013. This application was for changes to a previously approved, new full service food
establishment (Pizzeria Delfina) at 1444 Burlingame Avenue, zoned BAC.
The March 25, 2013, minutes of the Planning Commission state your application was approved with
the following conditions:
that the project shall be built as shown on the plans submitted to the Planning Division date
stamped March 12, 2013, sheets a0.00 through a4.00;
2. that this business location shall only be occupied by a full service food establishment, with
1,384 SF of seating area, and may not change its food establishment classification to a
limited food service food establishment, bar or specialty food shop food establishment;
3. that the 1,384 SF area of on-site seating of the full service food establishment shall be
enlarged or extended to any other areas within the tenant space only by an amendment to
this conditional use permit;

that this food establishment shall provide trash receptacle(s) as approved by the city
consistent with the streetscape improvements and maintain all trash receptacle(s) at the
entrances to the building and at any additional locations as approved by the City Engineer
and Fire Department;
that the business shall provide litter control and sidewalk cleaning along all frontages of the
business and within fifty (50) feet of all frontages of the business;
that an amendment to this conditional use permit shall be required for delivery of prepared
food from this premise;

7. that there shall be no food sales allowed at this location from a window or from any opening
within 10' of the property line;
8. that any seating on the sidewalk outside shall conform to the requirements of any
encroachment permit issued by the city;
9. that the conditions of the Chief Building Official's March 13, 2013, March 7, 2013, November
20, November 5 and June 29, 2012 memos, the Parks Supervisor's June 26, 2012 memo,
the City Engineer's July 10, 2012 memo, the Fire Marshall's March 7, 2013 and June 25,
2012 memos, and the Stormwater Coordinator's June 20, 2012 memo shall be met;
10. that the project shall meet all the requirements of the California Building Code and California
Fire Code, 2010 edition, as amended by the City of Burlingame, and that failure to comply
with these conditions or any change to the business or use on the site which would affect
any of these conditions shall require an amendment to this use permit;
11. that any changes to the size or envelope of building, which would include changing or
adding exterior walls or parapet walls, shall require an amendment to this permit;
12. that any changes to building materials, exterior finishes, windows, architectural features, roof
height or pitch, and amount or type of hardscape materials shall be subject to Planning
Division or Planning Commission review (FYI or amendment to be determined by Planning
staf�;
13. that demolition or removal of the existing structures and any grading or earth moving on the
site shall not occur until a building permit has been issued and such site work shall be
required to comply with all the regulations of the Bay Area Air Quality Management District;
14. that prior to issuance of a building permit for construction of the project, the project
construction plans shall be modified to include a cover sheet listing all conditions of approval
adopted by the Planning Commission, or City Council on appeal; which shall remain a part
of all sets of approved plans throughout the construction process. Compliance with all
conditions of approval is required; the conditions of approval shall not be modified or
changed without the approval of the Planning Commission, or City Council on appeal;
15. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to
submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;
16. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water
Management and Discharge Control Ordinance;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION

17. that prior to scheduling the framing inspection, the project architect, engineer or other
licensed professional shall provide architectural certification that the architectural details
such as window locations and bays are built as shown on the approved plans; if there is no
licensed professional involved in the project, the property owner or contractor shall provide
the certification under penalty of perjury. Certifications shall be submitted to the Building
Department; and
18. that prior to final inspection, Planning Division staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the project has been
built according to the approved Planning and Building plans.
All site improvements and construction work will require separate application to the Building
Department. This approval is valid for one year during which time a building permit must be issued.
An extension of up to one year may be considered by the Planning Commission if application is
made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure
Section 1 G94.6. If you wish to challenge the decision in a court of competent jurisdiction, you must
do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or
federal law.

1. Based on the 2010 CBC the occupant load table specifies an occupant load of
18 for the second floor dining. On the second floor the seating plan shows
seating for 24. Revise the seating plan to show seating for no more than 18
persons.
2. The maximum travel distance allowed for one exit from the second floor dining
is 75 feet. The distance from the farthest point on the second floor to the nearest
exit is 85 feet. On the plans either show that the travel distance has been reduced
to 75 feet or less or that a second exit will be provided from the second floor.
3. Revise the plans to show that the stairway from the second floor dining is 48"
in width (does not need to be clear width) per 2010 CBC 1007.3 Ex. #2.
NOTE: A written response to the items noted here and plans that specifically
address these items must be re-submitted before this project can move forward
for Planning Commission action.

NOTE: The approved use of the second floor salon was not definitively addressed in the
letter dated 11-19-2012 from U.S. Trust Services. Because the use of the salon space
has a direct effect on the health and safety for all of the tenants in this building, a
building permit application and complete plans must be submitted to either legalize or
remove the use-of the-seeond floor salon occupancy prior to submittaF of-the plans to --- —
the Building Division for Building Code compiiance plan check of Delfina restaurant. In
addition, prior to the issuance of the Certificate of Occupancy for any part of Delfina
restaurant the building owner must have obtained a building permit to either legalize or
remove the salon use and must be in the process of working diligently to obtain a Final
inspection for that tenant space.

There is no permit for a separafe tenant in this building, at the rear portion of the second floor. Af
the pre-applicafion meefing on June 11, 2012 this issue was raised and the City was informed that
ihe entire second floor would be renovated with this fenant improvement. Incorporating
occupancy of the second floor wifh fhe tenant improvemenfs for this applicafion would have made
unpermitfed occupancy of the rear of the second floor a moot point. Because work, and
occupancy, wifhout the required building permits raises healfh and safety concerns for occupants
of the enfira building fhis issue must be addressed at fhis iime.

California Resideniial Code (where applicable), 2010 Califomia Mechanical Code, 2010 California
Electrical Code, and 2010 California Plumbing Code, including all amendments as adopted in

The buiiding shall be equipped with an approved NFPA 13 Sprinkler System throughout.
Sprinkler drawings shall be submitted and approved by the Centrai County Fire
Department prior to installation. The system shall be electronically monitored by an
approved central receiving station.
The applicant shall ensure proper drainage in accordance with the City of Burlingame
Engineering Standards is available for the fire sprinkler main drain and inspector test on
the building plumbing drawings. These items may drain directly to landscape or in the
sewer with an air gap.
The fire protection underground shail be submitted and approved by the Burlingame
Building Department prior to installation. - -- ---
The fire sprinkler system will not be approved by the Central County Fire
Department until the fire protection underground has been submitted and
approved by the Burlingame Building Department.

Any construction project in the City, regardless of size, shall comply with the City
NPDES permit to prevent stormwater pollution from construction activities. Project
proponent shall ensure all contractors implement Best Management Practices
(BMPs) during all phases of construction (including demolition).
When submitting plans for a building permit include a list of construction stormwater
pollution prevention BMPs as project notes and include them as a separate full size
plan sheet, preferably 2' x 3' or larger. Project proponent may use the attached
Construction Best Management Practices (BMPs) plan sheet to comply with this
