Summary:
The applicant, Peet's Coffee and Tea, is requesting special permits
for take-out for the sale of brewed coffee and tea in a food
establishment at a new location at 1309 Burlingame Avenue. The
previous use of this site was the Burlingame Drug Company. The
applicants are transferring the food establishment designation from
Family Favorites Bakery, 256 Lorton Avenue to 1309 Burlingame Avenue
(letter dated May 4, 1994).
The applicant states in the application materials that the primary
function of this business is to sell at retail coffee beans and tea,
by the bag, and brewing hardware. The food establishment designation
allows Peet's Coffee and Tea to provide 8 stools and a counter at the
front of the store (see Floor Plan dated May 6, 1994, Sheet A1). The
hours of operation are proposed as 6:00 A.M. to 7: 00 P.M. , Monday
through Friday, 7:00 A.M. to 7:00 P.M. on Saturday and 7:00 A.M. to
6:00 P.M. on Sunday.
There will be 2 full time employees on site at all times,
per week, with no projected increase in 5 years. There
part time employees during the week and a projected numbe
time employees in 5 years. On weekends there will be 2
employees with no projected increase in 5 years.

During regular retail hours, 8:00 A.M. to 5:00 P.M., there is a
projected number of 80 customers with an increase to 130 in 5 years.
Weekend customers start at 70 during regular retail hours and
increase to 90 in 5 years. The projected maximum number of people
(employees and visitors) on site, at any one time, is 15.

No changes are being proposed to the structure.
Staff Comments•
The Chief Building Official stated in his May 9, 1994 memo that if
four or more employees work at once male and female restrooms are
required. The restrooms must be accessible to the physically
disabled.
The City Engineer stated in his May 9, 1994 memo that the applicant
shall police the area within a 100' radius of the business--and trash
receptacles must be approved by the City Engineer and shall be
installed and maintained by the applicant.
The Fire Marshal had no comments.
Study Meetinq:
At the May 23, 1994 Planning Commission meeting the Commissioners had
several questions (P.C. Minutes May 23, 1994).
Food establishment is defined in the zoning code as "a business which
sells any kind of food or drink at retail and which contains any
customer seating�� (C.S. 25.08.268). In contrast take-out service
"means a feature or characteristic of eating and drinking services,
including fast food restaurants, delicatessens and other similar food
services where food is pre-prepared or rapidly prepared, primarily
for consumption off the premises, and which encourages and allows
consumption of food and beverages outside of a building , such as in
outdoor seating areas where regular table service is not provided, in
vehicles parked on the premises or off the site" (C.S. 25.08.645).
This application is requesting both types of situations.
The City Attorney stated that the city has no laws that would
restrict the type of food served at a food establishment.
The project architect states in his May 31, 1994 response letter that
the area noted " not for leasing" is the adjacent tenants restrooms
which are accessed from that tenant space. That area is not a part
of this application.
The response letter outlines that male and female, disabled
accessible restrooms will be provided as discussed with the Chief
Building Official and trash receptacles will be placed at the front
and rear entries to the building. The seismic retrofit is currently
in progress and Peet's expects that this work will be completed prior
to the start of tenant improvements.

Peet's Coffee and Tea has expressed an interest in having outdoor
seating. They will apply for the appropriate permission from the
Engineering Department.
Two letters in support have been received. Gary Cohn, realtor for
Peet's Coffee, submitted a letter dated May 26, 1994. In this letter
he states on behalf of Peet's Coffee and Tea that the Planning
Commission take two separate actions, one on the new food
establishment and one on the take-out permit. If one request is
denied they don't want to see the other request be denied by
association.
The second letter from Mark Horton at Bon Appetit, 1325 Burlingame
Avenue, supports the project and feels that it will strengthen
business on the avenue.
Required Findinqs for a special Permit: - �
In order to grant a Special Permit the Planning Commission must f ind
that the following conditions exist on the property (Code Section
25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be
detrimental or injurious to property or improvements in the
vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in
accord with the Burlingame general plan and the purposes of this
title;
(c) the Planning Commission may impose such reasonable conditions or
restrictions as it deems necessary to secure the purposes of
this title and to assure operation of the use in a manner
compatible with the aesthetics, mass, bulk and character of
existing and potential uses on adjoining properties in the
general vicinity.
Planninq Commission Action: The Planning Commission should hold a
public hearing. Affirmative action should be taken by resolution.
The reasons for any action should be clearly stated. At the public
hearing the following condition should be considered:
Conditions:
l. that the project shall be designated a food establishment and
shall be built as shown on the plans submitted to the Planning
Department and date stamped, May 5, 1994 Site Plan and Floor
Plan;
2. that Peet's Coffee and Tea shall be open 6:00 A.M. to 7:00 P.M.
Monday through Friday, 7: oo A.M. to 7: 00 P.M. Saturdays and 7: 00
A.M. to 6:00 P.M. Sundays with a maximum of 2 full-time

employees at any one time and 5 part-time during the week and 5
part-time employees Qn the weekends;
3. that Peet's Coffee and Tea shall provide and maintain trash
receptacles at the front and rear entrances to the building and
any additional locations approved by the City Engineer and Fire
Department;
4 that a clear and accessible pathway shall be maintained to the
required disabled accessible, male and female restrooms; and
5. that the project shall meet all the requirements of the Uniform
Building and Uniform Fire Codes as amended by the City of
Burlingame.

Dear Ms Dreger:
As you requested, I am writing to respond to questions
raised by the Burlingame Planning Commission at the
23 May meeting.
1. The area noted "not for leasing" on the Site Plan
is currently leased by the adjacent tenant and is
not a part of the work proposed.
2. As requested by the City of Burlingame at the
4 May staff ineeting, separate-sex restrooms, both
handicap accessible, are planned. We have talked
with Fred Cullum, the building official, and are
investigating options for accommodating the
requirements.
3. The seismic retrofit is currently underway by the
building's owner. We expect the work will be
completed during June, and prior to the start of
tenant improvements r�y Feet's Coffee & Tea.
4. Trash receptacles will be placed at the front and
rear of the store, to serve both exits. Peet's
will be vigilant in fulfilling the expectations of
the City and Peet's' neighbors in managing its
trash.
5. Peet's would like to make use of permitted outdoor
seating. Three benches will allow customers to
enjoy their coffee outdoors on pleasant days.
Permission for seating within the public right of
way will be applied for through the Department of
Engineering.

6. Understanding the City's goals of making
convenient parking available to shoppers, Peet's

Per your request, I am submitting this letter on behalf of
Peet's Coffee, which is in regards to the items we discussed
Monday morning.
When the City of Burlingame Planning Commission considers
Peet's use permit application on June 13, 1994 please have them
consider this application as an application for two separate
permits. (Two permits are technically being requested, one for a
take-out permit and one for a restaurant use permit). Therefore
please have the commission make two separate votes when voting on
Peet's current application, (i.e. one vote for a take-out permit
and another vote on a restaurant use permit).

Peet'e Coffee & Tea is a stable, 28-year-old, Say Area company that
specializes in the retail sale of coffee beans and teae and hardware for
home brewing of theee beveraqea. Freshly brewed coffeea and teas are
available for takeout, as a courteay tv customers. Approximately 75
percent of eales are from the retail component (principally whole bean
coffees), and 25 percent are from beveragea.
Unlike many competitors, Peet's has always focused the businese on
retail eale of superior coffee beans roaeted in the Bay Area. The
design and appearance of the etore will reinforce its character as
calm, enduring neighborhood retail buainess, rather than a crowded
restaurant.

Peet's stores draw pedestrian traffic irom the eurrounding neighborhoods
and offer extended ehoppinq convenience to the district. Consequently,
Peet's stores have nominal impacte on traffic and parking. Bean
deliveries will be made once each day at the rear alley service door,
and other aupply deliveries are made lese frequently.
The project will not be detrimental to public safety, will not create a
nuisance or demand for law enforcement or fire protection eervices. All
our stores are eqvipped with security alarm eystems. No hazardous
materials, peste, or waste concerns will be introduced. Peet's is
careful to contain any waste generated by the operation. The atore will
be accessible as required by Title 24.

Please let this letter serve as a formal request to change our
permit application from strictly "take-out" to a permit for both
take-out and restaurant use. The property owner of 256 Lorton
Avenue, where Family Favorites Bakery is located, is willing to
transfer their "customer seating rights" to Peet's Coffee & Tea.
Their letter is enclosed.
The vast majority of Peet's' sales are of coffee beans for
home use, rather than coffee beverages for take-out or on-site
consumption. As a convenience to the customers who wish to
purchase a cup of coffee and drink it on-site, we would like to
be able to offer a few stools and a small counter area where
patrons can relax for a moment while they drink their coffee.
We foresee only a nominal increase in the total number of
customers and employees expected in the store at any one time.
We will probably make minor changes to the storefront entry
location to provide not only a nicer appearance, but also easier
access and circulation, especially for customers with strollers
or wheelchairs.

AND TAKE OUT PERMIT AND NEW FOOD ESTABLISHMENT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application
has been made for special permits for a new food establishment at 1309
Burlinaame Avenue. APN 029-202-070; propertv owner: Gurdial Johal 1304
Burlingame Avenue; and
WHEREAS, said matters were heard by the Planning Commission of the
City of Burlingame on June 13, 1994 , at which time it reviewed and
considered the staff report and all other written materials and testimony
presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning
Commission that:
1. On the basis of the Initial Study and the documen�-s submitted
and reviewed, and comments received and addressed by this commission, it
is hereby found that there is no substantial evidence that the project
set forth above will have a significant effect on the environment, and
categorical exemption Section 15301 - Existing Facilities, Class 1(a)
Interior or exterior alterations involving such things as interior
partitions, plumbing, and electrical conveyances is hereby approved.
2. Said special permits are approved subject to the conditions set

Summary: The applicant is requesting special permits for take-out
for the sale of brewed coffee and tea in a food establishment at a
new location at 1309 Burlingame Avenue. The previous use of this
site was the Burlingame Drug Company. The applicants are
transferring the food establishment designation from Family
Favorites Bakery, 256 Lorton Avenue to 1309 Burlingame Avenue.
Enclosed is a letter, dated 5/4/94 from the property owner of 256
Lorton Avenue and the owner of the bakery stating their intentions
to relinquish rights to havinq a food establishment at the Lorton
location. The letter has two conditions; first that the
transference of the customer seating rights be given only to Peet's
Coffee and Tea (this applicant) and second, if Peet's Coffees'
special permits are denied by the Planning Commission the seating
rights will remain at the Family Favorites location, 256 Lorton
Avenue.
The applicant states in the application materials that the primary
function of this business is to retail coffee beans and tea, by the
bag, and brewing hardware. The food establishment designation
allows Peet's Coffee and Tea to provide 8 stools at the front of
the store (see Floor Plan dated May 6, 1994, Sheet A1), along a
bar/counter, for customer convenience. The hours of operation are
proposed as 6:00 A.M. to 7:00 P.M., Monday through Friday, 7:00
A.M. to 7:00 P.M. on Saturday and 7:00 A.M. to 6:00 P.M. on Sunday.

TARE-OUT PERXIT 1309 BURLINGAME AVENUE
There will be 2 full time employees on site at all times, seven
days per week, with no projected increase in 5 years. There will
be 5 part time employees during the week and a projected number of
7 part time employees in 5 years. On weekends there will be 2 part
time employees with no projected increase in 5 years.
During regular retail hours, 8:00 A.M. to 5:00 P.M. , there is a
projected number of 80 customers with an increase to 130 in 5
years. Weekend customers start at 70 during regular retail hours
and increase to 90 in 5 years. The projected maximum number of
people (employees and visitors) on site, at any one time, is 15.

No changes are being proposed to the structure.
Meets all other zoninq code requirements.
Staff Comments: The Chief Building Official stated in his May 9,
1994 memo that if four or more employees work at once male and
female restrooms are required. The restrooms must be accessible to
the physically disabled.
The City Engineer stated in his May 9, 1994 memo that the applicant
shall police the area within a 100' radius of the business and
trash receptacles must be approved by the City Engineer and shall
be installed and maintained by the applicant.
The Fire Marshal had no comments.
