RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND SIDE SETBACK VARIANCE
RESO-67-98
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a Categorical Exemption has been proposed and application has been made for a Side
setback variance for a new hot tub at 1129 Bernal Aven�ie+ zoned R-1, Charles & S.D. Eigenbrot.

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
November 23� 1998 , at which time it reviewed and considered the staff report and all other written
materials and testimony presented at saicl hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption, per
CEQA Article 19, Section 15303, construction and location of new, small facilities or structures -(e)
accessory (appurtenant) structures includ:ng garages, carports, patios, swimming pools and fences is hereby
approved.
2. Said side setback variance is approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such side setback variance are as set forth in the minutes and recording of
said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

that the project shall be built as shown on the plans submitted to the Planning Deparnnent
date stamped November 16, 1998;
that the conditions of the Chief Building Official's October 13, 1998 memo and the City
Engineer's October 13, 1998 memo shall be met;
3. that the side property line fence shall be continued to the rear property line for aesthetic
purposes or that the Senior Landscape Inspector shall review and approve any
landscaping proposed to substitute for a privacy fence extended to rear property line,
taking into consideration th� need to gain access to the side of the neighboring garage for
maintenance; and
4. that the project shall meet all the requirements of the California Building and Fire Codes,
1995 edition, as amended by the City of Burlingame;
