(650) 69fi-7200 Since there was no appeal to or suspension by the City Council, the November 23, 1998 Planning Commission approval of your side setback variance became effective December 7, 1998. This application was to allow a new hot tub at 1129 Bernal Avenue, zoned R-1. The November 23, 1998 minutes of the Planning Commission state your application was approved with the following conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped November 16, 1998; 2. that the conditions of the Chief Building Official's October 13, 1998 memo and the City Engineer's October 13, 1998 memo shall be met; 3. that the side property line fence shall be continued to the rear property line for aesthetic purposes or that the Senior Landscape Inspector shall review and approve any landscaping proposed to substitute for a privacy fence extended to rear property line, taking into consideration the need to gain access to the side of the neighboring garage for maintenance; and 4. that the project shall meet all the requirements of the California Building and Fire Codes, 1995 edition, as amended by the City of Burlingame; ,, December 16, 1998 1129 Bernal Avenue page -2- All site improvements and construction work will require separate application to the Building Department. This approval is valid for one year during which time a building permit must be issued. One extension of up to one year may be considered by the Planning Commission if application is made before the end of the first year. The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.
