Dear Ms. Chang and Mr. Yang,
The Planning Division has reviewed your request for a new accessory dwelling unit and
determined that the proposed project, which includes a new detached accessory dwelling unit
located at the rear of the lot, complies with the requirements set forth in Burlingame Municipal
Code Chapter 25.59 (Accessory Dwelling Units). The legal status of your new detached
accessory living unit at 1115 Bernal Avenue, zoned R-1, is subject to the following conditions of
approval:
that the project shall be built as shown on the plans submitted to the Planning Division
and date stamped August 11, 2020; with required window revisions made at the time
of Building permit to eliminate any windows within three feet of the side or rear
property IineS;
2. that prior to issuance of a building permit for the new accessory dwelling unit, a deed
restriction shall be filed with the County Recorder. The deed restriction shall state that
the accessory dwelling unit shall not be sold separately from any part of the property
on which it is located; and that it is restricted to the standards specified in the
Accessory Dwelling Unit municipal code provision 25.59;

6. that the accessory dwelling unit permits may be revoked on any one or more of the
following grounds:
a. The accessory dwelling unit requirements are not being met; or
b. The accessory dwelling unit is no longer used for residential purposes; or
c. The parking required is no longer provided; or
d. The primary single family dwelling on the site is purposely demolished.
This approval is valid for one year during which time a building permit must be issued. An
extension of up to one year may be considered by the Community Development Director if
application is made before the end of the first year.
The decision of the Community Development Director is a final administrative decision pursuant to
Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of
competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter
time is required pursuant to state or federal law.

1. ADU (Code Section 25.57.010)
The existing house is single story with an attached garage. Proposed detached ADU is 294 SF of
enclosed living space and 143 SF of trellis = total of 437 SF, where 850 SF is the maximum allowed.
Planner notes that although the proposed attached trellis structures are supported and attached to the ADU
structure with tension rods (and do not have supports extending to the ground), these structures extend more
than 4 feet from the face of the building. The space beneath these structures has been included in the ADU
calculations as if the trellises have supports that extend to the ground and, under current zoning code
regulations, the areas beneath the trellises could be walled and made into living space that is part of the
ADU.
2. Setbacks (Code Section 25.26.072)
Proposed detached ADU located in the rear 30% of the lot and is exempt from setbacks to the side and
rear property line. The ADU meets the required 4 foot setback to any other structures on the lot.
3. Lot Coverage and Floor Area Ratio and Landscaping
Proposed ADU is 850 SF or less (437 SF proposed) and is therefore exempt from lot coverage and
floor area calculations. All decking is shown to be 30 inches or less and is not considered a structure
or counted in lot coverage
4. ADU Height
• Height of proposed flat roof is 10'-9" from grade with a 9'-0" plate height from grade, where a maximum
building height is 16'-0' and maximum plate height is 9'-0".
5. Parking (Code Section 25.70.030)
■ Property is located within 0.5 miles of a Caltrans bus stop (EI Camino) and therefore the ADU is exempt
from parking requirements. Existing house is 4 bedrooms (taken from 2016 Building permit. Attached
garage is large enough to provide two covered spaces (18' x 18') and it appears that 2 uncovered spaces
are in the driveway leading to the garage, but parking is not being evaluated because the ADU does not
require parking.
6. Accessory Structure Requirements (Code Section 25.60.010)
► All proposed glazing in windows/doors must be 3 feet from property lines or a CUP is required; as
drawn the nano-wall is /ess than 2 feet from the rear property line. Please revise plans to meet this
requirement at the time of the Building Permit OR you must apply for a CUP at this time. A CUP
requires public hearings, fees, an approximately 8 weeks to process. Approval of a CUP is not
guaranteed.
