Taylor declared the public hearing closed and asked the pleasure of Commission. C. Jacobs suggested Mrs. Azzaria might consider adding a room for her boys onto one area remote from the rest of the house. The applicant told her that after spending $20,000 renovating the house it would be financiall,y impossible to afford any more additions. She expl«ined that the trailer was for storage and has been there for approximately eight months. It will be removed to Redding in two vaeeks. C. Kindig remar•Ked it was not his impression the neighbors were objecting to the home for the elderly, but to the trailer parked in back, noise and the swimming pool. C. Sine related some research he had done. The initial building permit was issued in 1929 and it included a double garage. Later the rumpus room was built with no record of u building permit. P1rs. Azzaria made subsi,antial renovations to comply �vith State requirements when she moved in. The Commissioner said he had been at the site on Saturday or Sunday and could not see inside the rumpus room. Fie had concern with the possibility of adapting it to a mother-in-law apartment. At the time of his inspection the mobile home t�as not connected to electricity or water. Fle spoke from personal experience in sayinc► that Mrs. Azzaria has done an excellent iob taking care of the elderly. The problem appears to be with the boys and/or their friends creating unnecessary disturbances. It was his contention the problem of cars parking on the street could be handled quite simply by calling the police. � G. P. Swan explained that lacking an or�portunity to make inspections, staff had followed up on a telephcne complaint. �lo written complaints had been received. The C. P. had contacted Mrs. Azzaria by letter on March 3, 1977 requesting an application be submitted for the continued use of the accessory building. C. Kindig was told that the swimming pool is not being used, but it is filled. The Commissioner had some concern about the reported mosquitos. C. Mink remarked on his opposition to accessory buildings for many years. He then moved denial of this special permit. Second C. Swan reviewed this item, stating that 10 feet of Qroperty would be added to the developed property at 50 Edwards Court. Presently there is a 10 foot wide sideyard next to the office/warehouse building. With this parcel map the sideyard would become 20 feet wide. Replying to C. Stivan requested comments from John Benzian, Attorney, Properties Department and Bill Smidt, City Manager, both of National Car Rental System, Inc.,with regard to car rental information and the purpose of their application to upgrade the pr�esent facilities and add on the storage lot. John Qenzian stated that in 1972 they had established their Bay Area headquarters operations at 40 Edwards Court, developing approximately 3.5 acres. It has been outgrown in terms of parking for their cars. He explained they were also appearing before Commission to gain approval for the resale of vehicles in the M-1 District. C. A. Coleman requested comments from the applicants as to the dollar volume. �1r. Benzian said Pdational ooes the majority of its business at the airport. From a sales tax standpoint, on a quarterly basis, the state tax should result in taxes to Burlingame of some��here between $15-30,000 per quarter for rental cars. In turnover of resale vehicles there might be additional sales tax credii�ed to Bur7ingame. Bill Smidt discussed the subject of taxes. In view of the way National's cars are licensed, a portion of the rental tax is credited back to 40 Edwards Court, 6urlingame and then back to the City. Regarding collection of the tax on the resale of individual car sales, he said that recently the state passed a law making retail agencies and leasing agencies responsible for collecting the sales tax on the sale of vehicles to an individual. A portion of that tax will come to the City which Mr. Smidt believed was 1°6. At the present selling rate of about 25 cars per month in.Burling,ame at retail, assur�ing an average cost of $4,000, the rate to Burlingame would be about $40.00 a car. The expected incr�ease in the fleet would, of course, increase the sale,s:tax. P1r. Smidt told C. Page 2 February 28, 1977 Before accepting withdrawal, Chm. Taylor asked Mr. Marks for comments. Fillmore C. Marks told Corrrnission he felt this area was one of the finest business parks in the city, and noted this one block only has office buildings on it. He restated his opinion as expressed in his letter that an apartment house at that location would be out of place. Chm. Tayl�r suggested Mr. Marks attend the meeting of the Ad Hoc Committee.to Recommend a Housing Element on Tuesday evening, March 1 since his remarks might be more appropriately received by that Committee; P�r. P�arks appeared interested in doing so. C. Jacobs indicated her understanding of Mr. Marks' concern but wished him to recognize there was nothing Commission could do as long as the building were constructed according to code regula�ions. Mr. Marks suggested an emergency ordinance, and stated there vras a possibility they would lose their tenant, Alcoa, if the apartment house were built. At this point in the meeting Chm. Taylor recognized in the audience Mr. Les Simonds, farrner t�ayor. C. P. Swan requested Commission action bn this reques� to withdraw. C. Swan referred to memorandum dated 2/25/77 from the Director of Public Works r'�commending that Commission approve this tentative map subject to the street and utili�y improvements being completed prior to filing of the final map. This property is in one o4�Jnership; a 2-story house is under construction on Lot G and the Farley residence at 1915 Carmelita Avenue is located on Lot 7. This new t�ntative map would create Parcel A with 70' of frontage and Parcel L Hrith 80' of frontage. Secy. Sine read i�jto the record a letter dated February 28, 1977 from Mr. and Mrs. Robert D. Shafer, 100� Bernal Avenue, expressing their thanks to Commission, staff and Mr. Farley for their handling of this property and preservation of the creek area. Replying to Chm. Taylor, C.E. Kirkup stated this tentative par�el map ��vas ready for consideration subject to the conditions as stated in his memorandum. Mr. Farley indicated his understanding of the required improvements. ;ie told C. )acobs the ditch coming from Carmelita would be filled in when the sidewalk is completed on that side. This had been put in for a tvater line which has since been completed in Bernal. C. Sine questioned a loaded contractor's truck wl�ich has been parked on the street for some time and was told by ��1r. Farley that it would be moved this week. C. Jacobs determined from the applicant that the fence on Bernal would be brought down to five feet to conforrn to code requirements. Chm. Taylor asked for audience comments in favor; there were none. Dan Powell of 1009 Drake Avenue spoke in opposition, requesting additional information. He was assured there would be no additional parcels; there is a house on one parcel no�,r and one under construction on the second parcel. This map is merely to create t�yo parcels of approximately the same size; the house under construction does not encroach on the creek. There being no further audience comments, Chm. Taylor declared the public hearing cTosed. There was some discussion concerning location of sewer•lines. C. E. Y.irkup recommended, if at all possible, that a sewer be constructed in Bernal Avenue to serve Parcel A so that the se�ver main in the easement co�ald be abandor�ed as well as the easement. Further, if the easement is not abandoned, Engineering ���ould require tf�e fence encroaching on the easement be relocated. Mr. Kirkup told C. Mink moved approval of this tentative parcel map for resubdivision with the follov�ing conditions: the fence across the sewer easement be removed; curb, gutter, sidewalks, street and utility improvements be completed to the satisfaction of the Director of Public Works before filing the final parcel map. Second C. Cistulli and approved on unanimous roll call vote. C. E. Y.irkup noted that since improvements are required this map will go to City Council at their next meeting, March 7, 1977. C. Jacobs thanked Mr. Farley for his cooperation in this matter. 2. TENTATIVE PARCEL MAP, QEING A RESUBDIVISION OF LOTS 2a, 2C, 3A, 3B and 3D, BLOCK 3, TOIJN OF BURLINGAME (APN 029-223-010/020/100/110/120) AT 33 PARK ROAD, ZONED R-3, BY �1M. A. BARTLETT FOR TED FARLEY C. P. Swan referenced 2/25/77 memorandum received from the Directo;� of Public Works ��hich describes this resubdivision of five parcels into three parcels. Parcel 3 does not have access to Park Road and easements ���ould be required for Parcel 3 access to Park Road through Parcels 1 and 2. Mr. Swan stated that in his opinion easements should provide access to each of the individual living units ��hich would be built at a future date, and sl�ould be wide enough to orovide access to a garage. The Director of Public bJorks would require new se�•Jer laterals as well as new water services at the time of development. It was recommended that Commission approve the tentative map s.ubject to conditions that access be prohibited to El Camino Rea.l�, and that access easements be granted to Parcel 3 across Parcels 1 and 2. . Chm: Taylor requested review of this particular property by the C. P. C.P. Swan stated this vacant land is composed of f�ive lots, two fronting on E1 Camino Real and three •fronting on Park Road. There had been an application for a project with one building and a tentative map had been approved to combine all five lots into one parcel. The f�nal parcel map was never adopt�d. This ne�v map is to combine the lots into three parcels because zoning regulations limit each parcel to having one residential building. The applicants have a design in mind whereby one residential building would be located on each of these three parcels. The C.E. had recommended there be no access to E1 Camino. Mr. Swan noted that Commission packet included a letter from Fire Chief Fricke regarding townhouse type condominiums. In the opinion of the Fire Dept. this type of project should be classified as Group H(apartment house) occupancy. Tonight's application, ho�vever, is simply consideration of the tentative parcel map. C. E. Kirkup explained that tentative parcel map procedure is to approve the lot configuration with P.C. requiring conditions, if any, which should be placed on the final map. In response to the question, could apartments be built on each lot, staff replied yes but in order to issue a building permit there must be a location on a particular parcel. The parcel map must be approved first. The C. E. pointed out that in this particular case, since there are five lots at present, the applicants could not build across lot lines. C. Kindig suggested Commission condition the tentative parcel map with a requirement for easements. Mr. Singer told the P.C. their attorney was working on all cross easements necessary but they had not thouc�ht this would be necessary for tonight's meeting. C. Sine sug�ested continuing this item to the next study meeting in P�arch if the applicants felt they had adequate time to do so. Mr. Farley indicated it was their plan to submit full plans for the March 14 nieeting. C. Kindig thought Commission could continue the map to March 14 and plans could be heard f.or study at the same time. C. h1ink determined there were two existing curb� cuts on E1 Camino Real, and C. E. Kirkup carnnented that according to code the driveways on E1 Camino must be closed before establishing net� driveways. Discussion continued regarding procedure after which Chm. Taylor announced this tentative parcel map would be continued to the meeting of March 14, 1977. T0: Wayne Swan, City Planner� Re: �Parcel Map - 1030 Bernal This parcel map is a resubdivision of Lot 6 and 7 of Block 33 of the Easton Addition No. 2. The Planning Commission had previously denied a parcel map subdividing Lot 6 into two (2) 50 foot lots. The new tentative map divides Lot•6 and 7 into an 30 foot and a 70 foot lot. The street improvements do not extend for the full frontage along Bernal Avenue and a condition of approval of the tentative map should require the installation of curbs, gutter, sidewalk and half-street pavement for their entire frontage. There are some existing trees at the southwest property line and the sidewalk improvements will be stopped short and A.C. walkway installed to connect the new sidewalk to the existing roadway. The area map prepared by your Department for the previous parcel map ap- plication should be included for the Planning Commission's reference. That location map shows the.creek cutting through Parce] "A,", however, the building being constructed on Parcel "A" does not encroach onto the creek any longer and has been set back and is sited very nicely on Parcel "A." Water mains are in Bernal Avenue and are adequate to serve this development. The sanitary sewer main is in an alley to the rear of the property and the applicant proposes to extend the main to serve Parcel "A." It would be our recommendation if at all possible, that the sewer not be extended but instead, a sewer constructed in Bernal Avenue to serve Parcel "A." We could then abandon the sewer main in the easement, as well as easement. Presently there is a fence encroaching onto the easement and if the easement is not abandoned, the fence should be relocated. � In summary, we recommend that the Planning Commission approve the tentative parcel map subject to the street and utility improvements to be completed prior filing of the final map. � /�� c�il� -� Ralph E.
