The gazebo/patio shelter exceeds 50 SF and has windows within 10' of property line requiring two special permits (C.S. 25.60.010 n and C.S. 25.60.010 i). Summary: The applicant is requesting special permits for an existing 9'-11,�," X il'-10�" (118 SF) gazebo located in the rear yard at 1481 Benito Avenue, zoned R-1. The gazebo exceeds the 50 SF inaximum allowed for a patio shelter and requires a special permit. The property line wall is solid but all other walls have glazing which begins at 2'-0" from the property line. Windows on accessory structures within 10' of the property line require a special permit. All other accessory structure code requirements have been met. The recent floor area ratio calculations do not apply to the gazebo since it is not a project that qualifies as new construction. New construction includes construction of a new primary dwelling; additions to existing residences that increase the gross floor area by more than 50� of the existing floor area; or a remodel that removes more than 50� of the linear length of bearing and interior partition walls. Staff Comments: The Fire Marshal, Chief Building Official, and City Engineer had no comments. Required Findinqs for a Special Permit: In order to grant a Special Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): � SPSCIAL PSRXITS 1481 Benito Avenue (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planninq Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution. The reasons for any action should be clearly stated. At the public hearing the following condition should be considered: Conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped May 24, 1993 Sheet 1- Site Plan, Section, Floor Plan, and North Elevation; and 2. that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. It is an unheated structure that will allow us to enjoy the serenity of our backyard in a structure that allows great visibility whiie blocking out the wind. The glazing around greatly e�ends the amount of days that the gazebo can be comfortably used. The gazebo has only one sma11 light and it is positioned well up within the exposed ceiling. This is not a starage shed or any area intended to be used as a workroom. The structure is very sma11 and will not effect the public's health, safety or general welfa.re. 2. The zone is R-1 and accessory structures are an allowed use which conforms to the Burlingame General Plan and Zoning Ordinance. 3. The gazebo is a sma11 accessory structure which is part of the rear garden environment. Many homes in the area have detached garages or much larger accessory structures within the rear yard. The gazebo is compatible with the mass, bulk and use in the general vicinity. RESOLUTION APPROVING CATEGORICAL EXEMPTION AND SPECIAL PERMITS RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for special permits for an existing gazebo at 1481 Benito Avenue (APN 027-182-030�; (property owner: Hans R. and He_lene M. Hatschek. 1481 Benito Avenue, Burlingame, CA 94010 ); and WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on July 12, 1993 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. CP Monroe reviewed details of the request and required findings. Two conditions were suggested for consideration at the public hearing. Chm. Galligan opened the public hearing. David Constantino, representing the property owners, Hans and Helene Hatschek, was present. He distributed a booklet addressing this special permit application. No permits have been received for the improvements, he had two inspections of the property by building inspectors, there were a few minor discrepancies in installation of the water heater and furnace, they have replaced the window on property line with a one hour fire wall, owner states the gazebo will have little effect on adjacent properties, structure is very small and will not be detrimental to the environmentthmany homes ave larger accessor 1 struc of the rear garden yards. Y tures in their rear Mr. Constantino visited the neighbor at 1485 Benito directly to the north of subject property, this neighbor wrote a letter (July 12, 1993) which is included in the booklet submitted and states the gazebo has never had an impact on their property, it is screened by a fence and thick shrubbery. Mr. Constantino noted there are photos included in the booklet to illustrate these remarks.
