Reference staff report, 04.09.01, with attachments. Planner Keylon presented the report, reviewed criteria
and Planning Department comments. Five conditions were suggested for consideration. Commission had
no questions of staff.
Chairman Luzuriaga opened the public hearing. Dave Howell , 2825 Hillside Drive, the applicant and
architect, explained that he followed the Planning Commission's directions from the last meeting. He added
definition and roof articulation to the design. He stepped the wall down to try to keep it as low as practical.
Commission asked if the windows at the bedrooms were French casement windows? The applicant replied
that yes, they were French casement windows and some were egress windows. The Commission asked that
these be labeled on the plans in the future. C. Luzuriaga closed the public hearing.
C. Keighran moved to approve the request for design review for a first and second story addition and the
special permit for height since it enhances the architecture of the house, which will be an asset to the
neighborhood. The applicant reduced the plate height, which helps reduce the bulk and mass. C. Keighran
moved to approve the application, by resolution, with the following conditions: 1) that the project shall be
built as shown on the plans submitted to the Planning Department date stamped March 19, 2001, sheets 1
through 9, and that any changes to the footprint or floor area of the building shall require and amendment
to this permit; 2) that any changes to the size or envelope of the basement, first or second floors, which
would include changing plate heights, adding or enlarging a dormer(s), moving or changing windows and
architectural features or changing the roof height or pitch, shall be subject to design review; 3) that the
conditions of the City Engineer's February 20, 2001, memo shall be met; 4) that the project shall comply
with the proposed demolition and construction recycling ordinance recently approved by the City Council;
and 5) that the project shall meet all the requirements of the California Building Code and California Fire
Code, 1998 edition, as amended by the City of Burlingame. C. Vistica seconded the motion.

CEQA Status: Article 19. Categorically Exempt per Section: 15301 Class 1-(e) additions to existing
structures provided the addition will not result in an increase of more than 50% of the floor area of the
structures before the addition.
Summary: The existing house is single-story with a detached garage. The applicant is proposing first
and second story additions and a special permit for height. With the proposed additions, the floor area
will be 2907 SF (0.59 FAR) where 3084 SF (0.62 FAR) is the maximum allowed. The height of the
proposed structure is 30'-8", where a special permit is required for a height between 30'-0" and 36'-0".
With the proposed additions, the number of bedrooms will increase from 2 to 4. A single covered
parking space is required by code and a single existing, non-conforming parking space (11'-3" x 19') is
provided in the detached garage. If two covered parking spaces are required in the future, existing floor
area would have to be eliminated to accommodate a two-car garage or an F.A.R. variance would have
to be granted. All other zoning code requirements have been met. The applicant is requesting the

March 12, 2001 Design Review Study Meeting: At the Planning Commission design review study
meeting on March 12, 2001, the Commission commented that the height of the structure should be
extended to eliminate any flat portions of roof. The Commission would support a special permit for
this extended height if it benefits the architectural style and design. Commission suggested that the
second story plate line be redesigned to resolve the "layer cake" look of the current proposal and to
blend the second story addition into the first floor. They noted that the plate line on sections of the
second story could be dropped and that some change to the perimeter walls may be required to improve
the design (March 12, 2001, Planning Commission Minutes). The Commission moved to place this
item on the regular action calendar with direction to the applicant that these items be addressed.
The applicant submitted revised plans, dated March 19, 2001, in response the Commission's
suggestions. The following changes were made to the proposed structure:
• the flat portion of the roof has been removed and the height has been increased by 0'-11 ", from 29'-
9" to 30'-8"; this change requires a special permit;
• the plate height for bedrooms #2 and #3, at the front (west) elevation of the second story addition,
has been reduced from 8'-6" to 7'-6";
• the plate height for the bathrooms on the north and south elevations of the second story addition
has been reduced from 8'-6" to 6'-6"; and
• the plate height at the rear (north) elevation of the second story addition has been reduced from 8'-
6" to 8'-1"

Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted
by the Council on Apri120, 1998 are outlined as follows:
1. Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Findings for a Special Permit: In order to grant a special permit for height, the Planning Commission
must find that the following conditions exist on the property (Code Section 25.51.020 a-d):
(a) The blend of mass, scale and dominant structural characteristics of the new construction or
addition are consistent with the existing structure's design and with the existing street and
neighborhood;
(b) the variety of roof line, facade, exterior finish materials and elevations of the proposed new
structure or addition are consistent with the existing structure, street and neighborhood;
(c) the proposed project is consistent with the residential design guidelines adopted by the city; and
(d) removal of any trees located within the footprint of any new structure or addition is necessary
and is consistent with the city's reforestation requirements, and the mitigation for the removal
that is proposed is appropriate.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should be by resolution and include findings made for design review and a special permit, and
the reasons for any action should be clearly stated. At the public hearing the following conditions
should be considered:
1. that the project shall be built as shown on the plans submitted to the Planning Department date
stamped March 19, 2001, sheets 1 through 9, and that any changes to the footprint or floor area
of the building shall require and amendment to this permit;
2. that any changes to the size or envelope of the basement, first or second floors, which would
include changing plate heights, adding or enlarging a dormer(s), moving or changing windows

RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for desi�n
review and a special permit for hei�ht for a first and second story addition at 1480 Benito Avenue, zoned R-1,
Crai� and Denise Fawcett, propertv owners, APN:027-172-230;
WI�REAS, said matters were heard by the Planning Commission of the City of Burlingame on April
9, 2001, at which time it reviewed and considered the staff report and all other written materials and testimony
presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19, Section 15303, Class 3, construction and location of limited numbers of new, small
facilities or structures including (a) single-family residences not in conjunction with the building of two or
more such units is hereby approved.
2. Said design review and special permit are approved, subject to the conditions set forth in
Exhibit "A" attached hereto. Findings for such design review and special pernut are as set forth in the minutes
and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

Chairman Luzuriaga opened the public comment. Dave Howell, 2825 Hillside Drive, project designer, was
available for questions.
Commissioners noted that this is good design, would comment on the flat roof, it should be eliminated, the
area which would extend above height limit is only about 3%z feet wide, roof might only need to be about
a foot higher to eliminate flat area, qualifies for special permit for design; from rear looks like building has
flat top, nice articulation, walls step in and out, but the second story plate line and roof peaks need a little
work; extending the roof would be true to the style of the architecture; need some aggressive work done
with plate lines, could be less than 8'-6" on most of top floor, some at 7'-6", might mean some of the roof
comes down to the first floor; it is still a layer cake look that needs to be resolved, maybe lower plate on one
side of a room, not whole room; this may impact perimeter walls on plan to accommodate changes.
The applicant noted that he was trying to stay within all code requirements and noted that from the street
it would not be apparent that there is a flat roof. There were no other comments from the floor and the
public hearing was closed.
Commissioners noted that this project will require some work but feel designer understands what needs to
be done. C. Dreiling made a motion to place this item on the regular action calendar on March 26, 2001,
provided that the following revisions have been made and plan checked: that the flat portion of the roof be
eliminated and a special permit for height be considered to keep design in true Tudor style; need some work
done on the second floor plate lines, some sections of roof could extend down to first floor; may need to
change perimeter walls on plan to accommodate roof changes. This motion was seconded by C. Osterling.
Chairman Luzuriaga called for a vote on the motion to place this item on the regular action calendar on
March 26, 2001, if plans have been revised as directed and staff has time to plan check them. The motion
passed 7-0. The Planning Commission's action is advisory and not appealable. This item concluded at 9:45
p.m.

project architect, summarized the project and was available for questions. Albert�S�hilaimon, 1424 Castillo
Avenue, applicant, was also available for questions.
Commission noted that this is a tough project, working with existing,�touse that now has a plain fa�ade, but
the existing design does hark back to the 20's and 30's; with the addition, will become a modern tract style
house; garage is attached, but there is no way to enter the house from the garage, is virtually detached
anyway, why deviate from the pattern of the neighborhood.

NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19, Section 15303, Class 3, construction and location of limited numbers of new, small
facilities or structures including (a) single-family residences not in conjunction with the building of two or
more such units is hereby approved.
2. Said design review and special permit are approved, subject to the conditions set forth in
Exhibit "A" attached hereto. Findings for such design review and special permit are as set forth in the
minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

l. that the project shall be built as shown on the plans submitted to the Planning Department
date stamped March 19, 2001, sheets 1 through 9, and that any changes to the footprint or
floor area of the building shall require and amendment to this permit;
2. that any changes to the size or envelope of the basement, first or second floors, which would
include adding or enlarging a dormer(s), moving or changing windows and architectural
features or changing the roof height or pitch, shall be subject to design review;
3. that the conditions of the City Engineer's February 20, 2001, memo shall be met;
4. that the project shall comply with the proposed demolition and construction recycling
ordinance recently approved by the City Council;
5. that the project shall meet all the requirements of the California Building Code and
California Fire Code, 1998 edition, as amended by the City of Burlingame.
