Since there was no appeal to or suspension by the City Council, the September 14, 1998 Planning
Commission approval of your front setback, parking and declining height envelope variances became
effective September 23, 1998. This application was to allow for a first and second floor addition subject
to design review at 508 Howard Avenue, zoned R-1.
The September 14, 1998 minutes of the Planning Commission state your application was approved with
the following conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Department
date stamped August 17, 1998 Sheets 1-4 and Existing Site Plan, Floor Plans and
Building Elevations Sheets 1 and 2;
2. t�at any changes to the size or envelope of the first or second floors, which would
include expanding the footprint or floor area of the structure, replacing or relocating a
window (s), adding a dormer (s) or changing the roof height or pitch, shall be subject
to design review;
3. that prior to issuance of a building permit amendment for the proposed addition the
property owner shall submit a landscape plan listing plant materials, container sizes and
irrigation to the Senior Landscape Inspector for approval and these approved plants and
irrigation shall be installed prior to scheduling the final inspection and issuing the
occupancy permit on the work on the house; and
4. that the project shall meet all the requirements of the California Building and Fire Codes,
1995 edition, as amended by the City of Burlingame.
Reunbursement of the unspent portion of your design review deposit has been processed and will be
mailed to you under separate cover.

All site improvements and construction work will require separate application to the Building
Depaztment. This approval is valid for one year during which time a building permit must be issued.
One extension of up to one year may be considered by the Planning Commission if application is made
before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure
Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must
do so within 90 days of the date of the decision unless a shorter time is required pursuant
to state or federal law.
