Request: A 543 SF detached accessory structure (garage and office with a toilet and shower)
with covered porch (52 SF) is proposed to be built between the main dwelling structure and the
rear property line. Three special permits are required for: 1) windows within 6' of property
line where 10' is required; 2) a toilet and shower where the code allows water and sewer
connections only with a special permit; and 3) a home office in the accessory structure which
requires a special permit for the use (CS 25.60.010 i,j,m).

CEQA Status: Article 19. Categorically Exempt per Section: 15303 - Class 3- construction
and location of limited numbers of new, small facilities or structures including (e) accessory
(appurtenant) structures including garages.
Summary: The applicant is requesting three special permits to build a 543 SF detached garage
at the rear of the lot at 400 Howard Avenue, zoned R-1. The garage with office will be placed
in the rear northwest corner of the lot. The garage portion of the accessory structure is 288 SF
(12'-6" X 23'-0") and can store one vehicle to code (10' X 20' required). The office portion
is 255 SF. There is also an attached covered porch of 52 SF. The total structure with porch
is 595 SF. A concrete patio connects the office to the house. The main dwelling is two stories
and has two bedrooms. The first floor has 1,039 SF and the second 476 SF for a total of 1,515
SF. Lot coverage will be 35% (1,655 SF) with the new accessory structure and existing house
(40 % lot coverage is allowed at 1, 895 SF).
The proposed structure and use requires three special permits.
A. Windows are proposed along the front of the office portion of the structure. These
windows are from 6'-0" to 13'-0" from the property line. Windows within 10'-0" of the
property line require a special permit.
B. A toilet, shower and sink are proposed in the office. Any water and sewer
connections that contain a shower and toilet require a special permit.
C. The proposed use for a portion of the structure is for an office as a home occupation.
The application has applied for a home occupation with this special permit application
(Refer to Home Occupation Permit Application). When any portion of an accessory
structure will be used for a home occupation.a special permit is required.

The City Engineer, and Fire Marshal had no comments. The Chief Building Inspector indicated

Uniform Plumbing Code.

Study Meeting:
Planning Commission reviewed this item at their September 11, 1995 meeting. The commission
asked why a home occupation for a graphic artist needed a bath room with a shower. The
applicant noted in their September 15, 1995 letter that the toilet and shower would be a
convenience for the property owners since there is only one upstairs bath in the house. Both
property owners use the shower in the morning and it is difficult to get ready to leave the house
at the same time. The property owners also noted that one bathroom for an owner starting a

family is difiicult. The additional bathroom would allow the property owners to expand the use
of their property.
The commission asked about the wording in the special permit application #1. The sentence
should be reworded to "We are requesting a special permit be granted for...".
Two windows for the ofiice in the accessory structure are located within 10' of the property line.
The commission asked if these windows could be relocated to avoid requiring a special permit.
In his letter the applicant indicates that the windows will be the only source of natural light for
the home ofiice. They are located in the center of the structure to provide the most light for the
office. The neighbors to the west (404 Howard Avenue) who are closest to the proposed office
have submitted a letter in support of the project.
The commission reviewed the 5' wall sunounding the property and wondered how it would fit
in with the character of the neighborhood. In designing the wall the applicant reviewed
neighboring Meditenanean/Spanish style residences in the area. He has included copies of
photographs of similar walls within a five mile radius of 400 Howard Avenue. The neighbor
to the north (209 Stanley Road) has submitted a letter in favor of the stucco wall, which they feel
will enhance their property.
Required Findings for a Special Permit:
In order to grant a Special Permit the Planning Commission must find that the following
conditions exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to
property or improvements in the vicinity, and will not be detrimental to the public
health, safety, general welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the
Burlingame General Plan and the purposes of this title; and
(c) the Planning Commission may impose such reasonable conditions or restrictions as it
deems necessary to secure the purposes of this title and to assure operation of the use in
a manner compatible with the aesthetics, mass, bulk and character of existing and
potential uses on adjoining properties in the general vicinity.
Planning Commission Action:
The Planning Commission should hold a public hearing. Affirmative action should be taken by
resolution and should include findings. The reasons for any action should be clearly stated. At
the public hearing the following conditions should be considered:

that the project shall be built as shown on the plans submitted to the Planning Department
date stamped August 4, 1995 Sheet 1 Site Plan and Elevations with a maximum size of

255 SF for the office portion of the structure, and there shall never be a kitchen area or
cooking unit in the accessory structure;
2. that the conditions of the Chief Building Inspector's August 7, 1995 memo (the minimum
waste line size from the bathroom in the ofiice shall be 3", a sewer lateral test shall be
required per City Ordinance, and the shower must be sized so that a 30" circle sha11 iit
inside the pan curb, per the Uniform Plumbing Code) shall be met;
3. that the 543 SF accessory structure shall be used for vehicle storage (288 SF) and as an
office (255 SF) only, and shall not be expanded without another special permit, and shall
never be used as residential living area; any change in use other than vehicle storage or
office shall require application to the Planning Commission for a special permit;
4. that the detached garage with office and bath shall never be used, rented, or converted
into a second dwelling unit;
5. that there shall be no encroachment of any structures, equipment, or appliances into the
10' X 20' required vehicle parking area; and
6. that the project shall meet all the requirements of the Uniform Building and Uniform Fire
Codes as amended by the City of Burlingame. .

issue I: Stucco Wall
We are proposing a 5 ft. stucco wall to be constructed at our corner home on two sides, the North and the East.
The stucco wa11 plan has been researched by us through many architectural references from the Burlingame Library,
and along witli neighborhood dxives to see other stucco walls that are attached to Mediterranean/Spanlsh sryle
homes. In response to the chara.cter of this wall with our Burlingame neighborhood we have found other houses
with the Mediterranean/Spanish style to ha.ve beautiful stucco wa.11s. We are presenting to you these pictures along
with the addresses of these homes that are within a 5-mile radius of us. We are also submitting to you a letter from
the neighbors who presenily reside on the North side property line. The proposed wall on the North side of our
properry is the only other house tha.t will be direc 1 effected. This house is also a Mediterranean/Spanish style
home. These neighbors see this as an increase in their property value as well and welcome the cha.nce to use the
wall to grow indigenous vines and roses. Please see attached letter. There is also approximately 18 inches on the
city side of the proposed wall on our East side. We will utilize this 18 inches with landscaping of our own with vines
and roses.
Issue 2:
Also addressed in a letter written by our neighbors on the West side of us, we are addressing the issue of installing
��indows wlthin 10 ft. of the property line and perpendicular to the West. Our plans include three windows that will
face South uid inward to our yard. These windows wlll be the only source of natural light for our home office. Our
business incorporates drafting uid realistic design wh.ich requires good natural light. The proposed windows face
our house and should not infringe on our neighbors priwacy as they have agreed in their letter. Actually the windows
in our existing house are closer to our West side property line than the proposed new structure windows would be.
Mr. and Mrs. Nott have lived in their home for over 20 years and have no plans to move.
Issue 3:
We are proposing a bathroom be installed into the home offfce. Going back and forth to the house, upstairs to the
second floor on a rainy day to the rest room would be an inconvenience. The plumbing wIll also a11ow us to have
a coffee maker and fresh water in the office at all times. A shower stall in this proposed bath will greatly allow us
better use of our morning time. Currently my wife and I both take morning showers before we start work My wife
is a contractor and must be ready to go to a clients o�ce each workday morning. By letting her use the house show
er and me using the office shower we will both be better prepared for the start of a work da.y. We are in the process
of trying to start a family and wlth one bathroom trying to get three people ready for work will be difficult. 'Mvs extra
shower would a11ow my wife to bath our child and herself and get ready for the day while I use the office shower.
Summary:
The general plan desig�iates property as low density reside�itial and allows for home occupation with a spe�ial per-
mit since our business does not have on site visitors we see no contlict with the general plan. We are constructing
the garage a�id office for our owrl use to continue our home-based business which we have conducted from home
for the last 10 years. 2 of the 10 being in our current home at 400 Howard Ave.
Since tlie proposed structure a�id use fully complies with the general plan, aoning ordinances, bullding codes and
is not detrimental ta the public hea.th, safety, general welfare or convenieiice, we would llke to request approval of
the special permit for use of windows, rest room, stucco wall and home occupation.

Presently our property at 400 Howard Avenue has a 325 sq. ft., non-conforming hobby room and 283 sq. ft. non-conforming
carport. We propose to remove these two non-conforming structures and replace them with two new slightly smaller siructures "
which conform with all of Burlingame's ordinances.
To fully comply, we are requesting a special perinit re-granted for, 25.60.010:

The proposed accessory structures (255 sq. ft. home ofiice and 288 sq. ft. detached garage) will conform to all set backs, height
requirements, floor area ratios, coverage's, and other applicabl� building codes. We see no adverse effects to public health,
safety or welfare. The detached garage will allow the home to have direct access to the yard and improves the current driveway
_ situation bX_moving it furtlier. from .Xhe.corner. The 255 sq. f� home office will allout _us-to relocate our computer-equipmeni.and
graphic design desks from our second bedroom allowing us to have a 2-bedroom house again. Our graphic and marketing design
business is a small husband and wife operation. This type of business does not interfere with the general p�blic. Our clients are
Corporate companies. Meetings and discussions take place over the phone or at their place of business.
We are proposing a bathroom be installed into the home office. Going back and forth to the house, upstairs to the second floor
on a rainy day to the rest room would be an inconvenience. The plumbing will also allow us to have a coffee maker and fresh
water in the office at all times.
The proposed windows on the south elevation of the structure (which is perpendicular to the property line) are importaut to us in
order to obtain good natural light in the office. Our business incorporate drafdng and realistic design which requires good natural
light. The proposed windows face our house and should not infiinge on our neighbors privacy. Actually the windows in our
existing house are closer to the property line than the proposed structure windows.

future conversions will require city approvals for plan and conversions.

The CITY OF BURLINGAME PLANNING COMMI38ION announces the
