Chairman Sine announced a puhlic hearing on the application of
Anthony Nanni, 1233 Nadina Street, San t-lateo, for variance to remodel
vacant store area to tcoo bedroo^1, one and one-half bath apartment in
an existing building at 216 Howard Avenue.
(Lot 17, Block 40, Lyon and Hoag Suhclivision--Zone R-1 (first resi-
dential)
The apolicant's letter of justification dated December 14, 1970,
explained that existing improvements consist of two one-bedroom units
on the second story of the building, with entry on Channing noad,
and vacant store on ground floor, plus three-car detached garage.
The communication stated that it is proposed to restore the building
to confor;� �,aith the general neighborhood appearance by changing the
entry to Channing Road and removing cement on Ilo,aard Avenue to pro-
vide for landsca�inc�. . � .
Enlarged photographs of the existing building, plot plan and floor
plans of the proposed unit were filed.
�ir. Nanni, upon recognition by the Cnair, reported that the area
formerly used as a grocery store has heen vacant for some ::lonths,
that the t�•�o anartment units on the secon3 story are occupiecl and
addition of a third unit c•�ill permit residential use.of the entire
build ing.
The City Planner, in response to the Chair, reported that the builc�inc�
was char.ged fro-n a single-fa*mily d��elling to :;�ir:ecl apartnent and co:;�-
mercial usc ;aithout benefit of permit, that soMe years after the con-
version, tiie City a�proved a variance for extension of tne grocery
store to the entire lo�aer level and that the store onerate.� successfully
until faced with cornpetition of the Safeway Store in the �f7oodlake Com-
plex.
The City Planner stated that a letter directed tothe City �ianager
recently requesting that the property not be permitted to be used for
commercial purposes caas referre� to his attention, that he insnected
the property, had an opportunity to discuss the situation with thc
o•.aner, wlio nade tYie decision to place the property on the market, an��
that the subject application is the result. ,
The City Planner referrec3 to non-conforming residential units on the
second story, stating that. it is questionable that the city coul3
force their removal at �his late date.

P�ir. James Russell, Russell Realty Comnany, 1445 Burlinc�ame Avenue,
statecl that he re��resentcd the ocaner in atterioting to loeate a pur-
ehaser for the property and that efforts wer.e unsuccess£ul until t'�e
�decision �aas :*�ade to request the city's ap�rov�l to conversion to
apartr.ient use. PZr. Russell stated t}iat the location is not conducive
to a successful corlmercial operation, iahereas a residential buildinc�

� will conform to the nei7�5or:iood pattern.
Mr. R.C. Snurgeon, owner/occupant 210 Fio�•�ard Avenue, advised that,
in addition to his resi��ence, :�e o�-ms t,1e d�r�elling ir,irnediately
adjacent to the subject property. Reporting that he had co�nmunicated
with the City :�Ianager requesting that the commercial use be abolished
ancl the building returned to single-family use, P•�r. Spurgeon statecl
that he could fincl no reason to object to the proposed conversion to
apartment.
Comments in opposition were heard from:
Mr. G.C. Cook, 117 Channing Road, Russell E. Snyder, 137 Stanley Road,
;ir. Angelo Dellacasa, 141 Victoria Road. �
The protestants objected to "spot zoning," statea the low-rental
apartments attract undesirable tenants and that existing utility instal-
lations are inadequate to service ��-���� --`e_family density.
There were no further com.ments froM the floor.
The hearing was declared concluded.
During a period of Cor;tn:ission comrnent, refernnce was made to staff
reports inc�icating t_nat tlle building is structurally sound; there
was agreeMent that van�alism c•rould result if the lo�aer level re^�ained
vaeant anci that the proposecl irnnrovement would apnear to be the only
practical methol of remedying an unsightly situation�and assuring
proper maintenance of the pro�erty.
A motion introduced by Cor•.�.missioner Taylor and secoride:� by Commissioner
Norberg to approve the application of Anthony Nanni, 1233 Nadina Street,
San '�Iateo, for variance to remodel the lo�aer floor of tne building
at 216 Ho:•�ar1 ?lvenue to an additional apartment,• on the condition that
cement in the setl�ack on Ho;aard Avenue be removed and the area landscapecl.
was carried unani�ously on roll call.
The applicant was inform�d the variance would be effective Tuesday,
Januai�y 5, 1970, if not appealed.
