CAMPER IN THE FRONT SETBACK AT 720 BURLIN AME AVENUE, ZONED R-1
RECOMMENDATION:
City Council should hold a public hearing and take action. Action
should be by resolution. The reasons for any action should be clearly
stated. (Action Alternatives and required Findings for a Variance are
attached at the end of the staff report.)
Conditions considered by the Planning Commission:
1. that the camper shell/top shall be parked in an 8' x 14� paved
area within the front setback, no closer to the front property
line than 3.5' so that it leaves a minimum area of 11� wide of
driveway clear from the street to the garage;
2. that the present hedge vegetation along the front and side
property line as well as fences shall be maintained to screen the
camper shell/top from view; and
3. that this variance shall expire in two years (May, 1992).
Plannina Commissivn Action
At their meeting on May 14, 1990 the Planning Commission held a public
hearing and voted to deny 4-3 (Commissioners Ellis, Jacobs and Graham
dissenting) the request to park a camper shell within the side and front
setback at 720 Burlingame Avenue, zoned R-1. In March, 1988, on appeal,
the City Council had granted a variance for two years to allow this
camper shell to be stored within the front and side setbacks on this
property. The two years had passed. The applicant is applying for a
new variance. Although noticed, the applicant was not present at the
hearing.
BACKGROUND•
Sophie and Pete Boubare, applicants and property owners, are requesting
a variance to the parking requirements in order to be allowed to store a
7'-9" tall camper shell in the front and side setback of their home at
720 Burlingame Avenue, zoned R-1 (Code Sec. 25.70.030-a). The driveway
is 11�-6" long. The camper sits on legs 3'-6" from the front property
line and 7� from the front wall of the house. The garage door is 6'-4"
tall, 1�-5" shorter than the camper when it is off the truck. A
�
variance is required because the zoning code does not allow inoperative
vehicles or campers to be stored in driveways or between a structure and
the front and side property lines in a single family zone.

ACTION ALTERNATIVES
1. City Council may vote in favor of an applicant�s request.
If the action is a variance, use permit, hillside area
construction permit, fence exception or sign exception, the
Council must make the findings as required by the code.
Findings must be particular to the given property and
request. Actions on use permits should be by resolution. A
majority of the Council members seated during the public
hearing must agree in order to pass an affirmative motion.
2. City Council may deny an applicant�s request. The reasons
for denial should be clearly stated for the record.
3. City Council may deny a request without prejudice. This
action should be used when the application made to .the City
Council is not the same as that heard by the `Planning
Commission; when a Planning Commission action has been
justifiably, with clear direction, denied without prejudice;
or when the proposed project raises questions or issues on
which the Council would like additional information or
additional design work before acting on a project.
Direction about additional information required to be given
to staff, applicant and Planning Commission should be made
very clear. Council should also direct whether any
subsequent hearing should be before the Council or the
Planning Commission.
VARIANCE FINDINGS
(a) there are exceptional or extraordinary circumstances or
conditions applicable to the property involved that do not
apply generally to property in the same district;
(b) the granting of the application is necessary for the
preservation and enjoyment of a substantial property right
of the applicant, and to prevent unreasonable property loss
or unnecessary hardship;
(c) the granting of the application will not be detrimental or
injurious to property or improvements in the vicinity and
will not be detrimental to the public health, safety,
general welfare or convenience;
(d) that the use of the property will be compatible with the
aesthetics, mass, bulk and character of existing and
potential uses of properties in the general vicinity.

6. PARKING VARIANCE TO PARK A CAMPER IN THE FRONT SETBACK AT
720 BURLINGAME AVENUE, ZONED R-1
Reference staff report, 5/14/90, with attachments. CP Monroe
reviewed details of the request, variance granted in 1988 with a
two year time limit, Planning Commission action. Three conditions
were suggested for consideration at the public hearing.
CP reviewed code regulations regarding parking of inoperative
vehicles and CA noted the city has had inquiries about this

particular vehicle ever since the previous variance was granted.
Staff further advised Condition #3 includes a time limit so that
the variance will not run permanently with the land.
Chm. Graham opened the public hearing. Applicants, Sophie and Pete
Boubare, were not present. There were no audience comments and the
public hearing was closed. Staff advised applicants had been
noticed of the hearing and were sent a copy of the staff report
with attachments, they did attend the meeting two years ago.
C. Mink moved for denial of the application, seconded by C.
Galligan and approved on a 4-3 roll call vote, Cers Ellis, Jacobs
and Graham voting no. Appeal procedures were advised. Staff will
call applicants in the morning.

SUBJECT: VARIANCE TO PARK A CAMPER IN THE FRONT SETBACK AT
720 BURLINGAME AVENUE ZONED R-1
Sophie and Pete Boubare, property owners, are requesting a variance
in order to continue to park a 7�-9" tall camper shell in the front
setback of their house at 720 Burlingame Avenue, zoned R-1 (Code
Sec. 25.70.030-a). The driveway is 11�-6" long. The camper sits
on the driveway apron at the side property line about 3. 5� behind
the front property line. The garage door is 6'-4", 1�-5" shorter
than the camper shell when it is sitting on the ground. There is
about 7� between the face of the house and the camper shell. This
area is used for access to the side yard.
On March 21, 1988 the City Council granted a variance for this
camper shell to remain in the front setback for two years. It had
been stored in the front setback since 1973. However, the variance
had a two year time limit set on it and it expired in March, 1990.
Mr. and Mrs. Boubare have requested a second variance so that they
may continue to store the camper in the front setback. They
initiated this request.
The minutes and staff report from the previous review are attached.
The present request is identical to that of 1988 except that this
action is not a result of code enforcement.
Findinas for a Variance
In order to grant a variance the Planning Commission must find tY�at
the following conditions exist on the property (Code Sec. 25.54.020
a-d).
(a) there are exceptional or extraordinary circumstances or
conditions applicable to the property involved that do not
apply generally to property in the same district;
(b) the granting of the application is necessary for the
preservation and enjoyment of a substantial property right
of the applicant, and to prevent unreasonable property loss

will not be detrimental to the public health, safety,
general welfare or convenience;

In order to approve an application for a variance, the Planning
Commissivn is required to m�ke findings (Code Section 25.54.020

Garage is too small to store camper. Have has it since 1973, it seemed to be
OK to store it there but then a new law was passed a few years ago the prohibited
storage of that location in 1988. The city granted us a two year variance.

We are retired, it is too expensive for us to pay to have it stored elsewhere and too

Dear Mr. Ellis:
We are the owners of the residence at 720 Burlingame Avenue, where we have had our
camper shell stored along side of your home, setback, clearing the garage and
walkway since 1973. In 1988, Ordinance #1355 required us to apply for a variance to
allow the recreational vehicle to be parked within the front yard (setback).
The camper is difficult to put in the garage, too large, and will not fit inside.
We cannot put it in the backyard because of no access, it does not obstruct the
garage access and doesn't create any safety problems to anyone.
We are retired, on a fixed income, and it would create a hardship for us to pay for
storage as well as it being an inconvenience for us.
We are asking for your assistance in granting an extension of the 1988 variance for
at least 5 years. We would appreciate your prompt attention concerning this matter
and invite you to come and inspect the property and to speak with our neighbors for
any rebuttal.

CAMPER TOP IN FRONT SETBACK AT 720 BURLINGAh1E
AVENUE
City Planner reviewed her memo of March 11 in which she
recommended council hold public hearing and take action. The
Boubares are requesting a variance in order to continue to park
their camper top in the front setback of their home at 720
Burlingame Avenue. Based on a recent code amendment inoperative
vehicles including camper tops may not be parked between the
structure and front or side property lines. The camper top is
presently placed 3.5 feet behind the front property line at the
side property line on a driveway apron. It does not block the
garage. The garage door has a height of a little over 6 feet and
the camper top has a height of over 7 and one half feet. There
is seven feet between the camper top and the face of the garage
leaving room to access the side yard. The Planning Commission
voted twice on this item with five members seated. It takes a
majority of the total commission, or four votes to pass a motion.
The first motion was for denial and was defeated on 2-3 vote; the
second motion was to grant the variance with conditions and was
also defeated on 3-2 vote (4 affirmative yotes required).
City Planner also noted a letter received in opposition to the
variance from Mr. Durr at 851 Burlingame Avenue. She noted that
it was suggested that this variance run with the land for a
period of five years.
Mayor Pagliaro op�ned the public honi-.lnp.
Marion Church, 804 Burlingame Avenue, spoke in favor of the
variance, noting the Boubares are fine neighbors and that you can
hardly see the camper.
Mr. Boubare presented several letters in favor from neighbors and
requested approval. He responded to council questions as to the
use of the camper and the possibility of other storage places.
Mayor Pagliaro closed the public hearing.
Councilwoman Barton viewed the property ar.d noted that some
people park these campers in their driveway and then can't use
their garage; since neighbors approve of the variance, she had no
problem with approval.
Councilman Amstrup noted that the camper is hard to see but he
would like a shorter time period for the variance, perhaps two
years rather than five years.
Other council members agreed with the shorter time period and
noted perhaps Mr. Boubare could find another storage place in
that time.
Councilman Mangini moved approval of the variance with staff
recommended condition number one and that the variance shall
expire in two years. Seconded by Councilwoman Barton, carried
unanimously 4-0 by voice vote.

RECOMMENDATION:
City Council should hold a public hearing and take action.
Commission considered two conditions for this variance:
1. that the camper shell/top shall be parked in an 8' x 14 � area
within the front setback, no closer to the front property line
than 3.5� and so that it leaves a minimum of 11� of driveway
clear from the street to the garage door; and
2. that this variance shall expire in five years (March, 1993).
Action Alternatives:
1. The City Council can grant this variance by resolution allowing
the applicant to continue to park the camper top in his front
setback until March, 1993. Planning Commission denied this
alternative on a 3-2 vote, rules require four votes for an
approval.
2. City Council can deny this variance request requiring the
applicant to remove the camper top from the front setback.
Planning Commission denied this alternative on a 2-3 vote, four
votes are necessary for formal action on a motion.
3. City Council can deny without prejudice this variance request.
If this alternative is pursued Council should give clear
direction to the applicant, Planning Commission and staff about
what items of the project should be addressed further.
BACKGROUND•
Mr. and Mrs. Boubare requested a variance in order to continue to
park their camper top in the front setback of their home at 720
Burlingame Avenue, zoned R-1 (Code Sec. 25.70.030-a). Based on a
recent code amendment inoperative vehicles including camper tops
may not be parked between the structure and front or side property
lines.
The camper top is presently placed 35' behind the front property
line at the side property line, on a driveway apron. It does not
block access to the garage; there is about 24' in length and

11'-9" in width of driveway open for access to the existing one
car garage. The garage door has a height of 6'-4" and the camper
top a height, from the ground, of 7�-9". The camper top is placed
so that there is 7� between it and the face of the garage, leaving
room to access the side yard.
Plannina Commission Action
The Planning Commission held a public hearing and voted twice on
this item. Five members were seated, it takes a majority of the
total Commission or four votes to pass a motion. The first motion
was one to deny the variance which was defeated on a 2-3
(Commissioners Ellis, H.Graham, S.Graham dissenting) vote. The
second motion was to grant the variance with staff�s suggested
conditions; this, too, was defeated 3-2 (Commissioners Giomi and
Jacobs dissenting, Commissioners Garcia and Harrison absent).
Commission discussion addressed the fact that there was no
grandfathering under this new ordinance; it costs money to store
these inoperative vehicles off site; if approved as conditioned
the variance would run with the land for five years even if the
present owners moved; intent of the ordinance was discussed re:
clean up appearance but not affect life styles of people who had
been parking such items in their front setbacks for years; this
camper top looks like lot coverage since it creates mass and bulk
in the front setback; others noted that they passed the property
regularly and never noticed the camper top; the camper top on or
off the truck will not fit in the garage, it would look worse to
have the camper top on the truck and the truck parked on the
garage apron; neighbors are not complaining.

Staff confirmed there is no grandfathering with Ordinance 1355,
Restricting Parking and Storage of Inoperative Vehicles, Vehicle
Parts, Boats and Campers; there is space for storage of such
vehicles in the Burlingame area, but it costs money; if approved
this variance will run with the land for five years even if the
present property owners move; it cannot run with a person but the
city can put a time limit on it.
Chm. Giomi opened the public hearing. Pete Boubare, applicant,
advised the camper will not fit inside the garage, his neighbors
have not complained, the expense of storing it somewhere else is
prohibitive, there is no way to enlarge the garage door, inside
height of the garage might be 4" more than the height of the door;
they did use the camper every other month, not so often now; he
leaves the camper on the truck during summer to travel to Lake
Tahoe but takes it off in winter, not wanting to travel with it
because of the snow and winds. Commission noted variance approval
cannot be supported by a finding of financial hardship, this could
set a precedent; there is a need to find a reason why the camper
cannot be put on the truck.
There were no audience comments and the public hearing was closed.
Commission comment: the ordinance was designed to clean up parking
in setbacks but don't believe the intention was to interfere with
life styles of people who have been parking vehicles in setbacks
for many years, that is a hardship by itself; agree people have
the right to use their property but most people find a way to put
boats/campers in their backyards, have a problem with parking
inoperative vehicles in the front setback, this camper shell looks

Pete and Sophie Boubare are requesting a variance in order to park
their camper top in the front setback of their house at 720
Burlingame Avenue, zoned R-1 (Code Sec. 25.70.030-a). The camper
is presently placed 3.5� behind the front property line at the
side property line. The camper top sits on the driveway apron.
There is 11�-9" left in the driveway between the front landscaping
curb and the camper for a car to use to gain access to the garage.
The garage door is about 6'-4" and the high point on the camper
when it is sitting on the ground is 7�-9". There is about 7'
between the rear of the camper shell and the wall of the house.
This area can be used to gain access to the 4.5' side yard.
Staff Review
City staff have reviewed this request. The Fire Marshal (February
1, 1988 memo) and the City Engineer (February 1, 1988 memo) had no
comments. Planning staff would note that this item comes before
the Commission as enforcement of the new code section prohibiting
parking in the front setback except in driveways. Staff would
note some corrections to the applicant�s dimensions. The camper
is 3.5' behind the front property line. It is about 16� behind
the curb on the street. A warning notice was sent to the
applicants and they responded duly �by making application for a
variance.
Auplicants' Letter
In their letter of January 18, 1988 the applicants state they have
owned this camper since 1973. They retired in 1979 but since
operating costs have gone up so much they are not able to use the
camper as much as they used to. The camper is parked in their
driveway, on their property line.
In addressing the reasons for granting a variance, they state the
exceptional circumstances are that it would be too difficult to
get the camper into the garage, can�t put the camper in the
backyard, it doesn�t block access to the garage and it does not
cause a safety problem. This is a two bedroom house.
PlanninQ Commission Action
The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution. The reasons for any action

should be clearly stated. At the public hearing the following
conditions should be considered:
1. that the camper shell/top shall be parked in an 8' x 14�
area within the front setback, no closer to the front
property line than 3.5� and so that it leaves a minimum of

OFDINANCE RESTRICTING PARKING APdD STORAGE OF
INOPERATIVE VEHICLES, VEHICLE PARTS, BOATS APdD
CAMPERS

The CITY COUNCIL of the CITY OF BURLINGAME does
ORDAIN as follows:
Section 1. Subsections 25.70.030 (a) and (b) of the
Burlingame Municipal Code are amended to read as follows:
"25.70.030 Reauirement for particular uses. (a)
Single-Family Dwellings. There shall be at least one nermanently
maintained garage or covered carport for each single-family
dwelling with the further requirement that any single-family
awellings hereafter constructed which contain three or more
bedrooms shall provide garage or carport space for at least two
vehicles. No existing single-family dwelling which contains two
or more bedrooms and less than two garages or carports of legal
d�:mensions shall be enlarged or remodeled by the addition of one
or more bedrooms unless at least two aarage or carport spaces of
such dimensions are provided, except that the requirement for
additional carport or garage space may be waived for such enlarge-
ments of existing dwellings:
(1) 4dhere a driveway of sufficient dimensions,
measured for the legally established front setback line to an
existing garage, will accommodate the prescribed number of auto-
mobiles; in such a case, tandem parking will be permitted; or
(2) Where the existing garage is not less than
eighteen feet wide and twenty feet in length.
A vehicle shall not be parked between a structure
and the front or side property line except in a garage, driveway,
or other approved parking.
Inoperative vehicles, vehicle parts, boats and campers
(as defined by Section 243 of the Vehicle Code) shall not be
stored or parked in driveways, or between a structure and front
or side property lines.

Condominiums.
(1) There shall be at lcast one and one-half
permanently maintained parking spaces on the same lot with the
buildinq for cach dwelling unit .in thc Uuilding.
(2) For each dwellinq unit containing two bedrooms,

(3) For each dwelling containing three or more
bedrooms, there shall be provided at least two and one-half
parking spaces.
Eighty percent of the total required parking spaces
shall be covered or within a garage or carport. Parking spaces
shall not be situated in the front or side setback areas. A
vehicle shall not be parked between a structure and the front �
or side property line except in a garage, driveway, or other
approved parking.

RESOLUTION GRANTING PARKING VARIANCE
720 Burlinaame Avenue
RESOLVED, by the City Council of the City of
Burlingame that:
WHEREAS, application was made to the Planning
Commission of the City of Burlingame by Sophie and Pete
Boubare for a parking variance to allow a camper top to be
parked in the front setback at 720 Burlingame Avenue; and
WHEREAS, said application was heard by the
Planning Commission of the City of Burlingame on May 14,
1990, said hearing being properly noticed as required by
law; and
WHEREAS, the permit was denied by the Planning
Commission, a timely appeal filed by the applicants, and a
public hearing upon said appeal scheduled and held by the
City Council on June 4, 1990:
NOW, THEREFORE, IT IS ORDERED AND DETERMINED by
the City Council of the City of Burlingame:
l. That the following findings of fact are made
regarding said application:
(a) The application of Sophie and Pete Boubare is to
allow the parking of a.camper top in the front setback of
720 Burlingame Avenue.
(b) The depth of the driveway and the size of the
garage create exceptional and extraordinary circumstances
and conditions applicable to the property involved that do

not apply generally to other properties in the district; the
granting of the variance is necessary for the preservation
and enjoyment of a substantial property right and to prevent
unreasonable hardship.
2. The granting of the variance applied for will be
in the interests of the health and welfare of the persons
using said property, of the City of Burlingame, and, subject
to the conditions hereinafter set forth, will be in
conformity with reasonable and orderly use of the property.
3. The decision of the Planning Commission is hereby
reversed and a variance to park a camper shell in the front
setback of 720 Burlingame Avenue is approved, subject to the
conditions set forth in Exhibit "A" attached hereto.
4. It is further directed that a certified copy of
this resolution be recorded in the official records of the
County of San Mateo.
