Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15301 (e)(2), which states that additions to existing structures
are exempt from environmental review, provided the addition will not result in an increase of more than 10,000
SF in areas where all public services and facilities are available and the area in which the project is located is not
environmentally sensitive.
Background: This project was originally approved by the Planning Commission as a Consent Calendar Item on
August 22, 2016. The applicant did not apply for a building permit and the Planning approval expired. There
were no changes suggested by the Commission for the project at the Design Review Study meeting on August
8, 2016 (refer to the attached August 8 and August 22, 2016 Planning Commission Minutes).
The proposed project is the same as that which was approved by the Planning Commission in 2016, therefore
staff is bringing this application forward as a Regular Action item. If the Planning Commission wishes to discuss
this item further, this meeting can serve as a design review study meeting and the item can be continued to a
future hearing date for final action.
Project Description: The existing one-story house with an attached one-car garage contains 1,435 SF of floor
area and has two bedrooms. The applicant is proposing a 284 SF first floor addition and a new 806 SF second
story. The proposed project would increase the total floor area to 2,395 SF (0.48 FAR), where 2,700 SF (0.54
FAR) is the maximum allowed.
With this application, the number of bedrooms will increase from finro to four. Two parking spaces, one ofwhich
must be covered, are required on-site. One covered parking space is provided in the existing attached garage
(9'-2" x 20'-4" clear interior dimensions); one uncovered parking space (9' x 20') is provided in the driveway. All
other Zoning Code requirements have been met. The applicant is requesting the following application:

Summary of Proposed Exterior Materials:
• Windows: Aluminum clad wood with simulated true divided lites.

• Siding: Stucco with wood siding on gables.
• Roof: Composition shingle.
• Other: Wood knee braces, stucco mold wood trim at windows and doors, wood porch columns and
railing.
Staff Comments: None.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on April 20, 1998 are outlined as follows:
1. Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;

4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Suggested Findings for Design Review: That the architectural style, mass and bulk of the addition (featuring
gable and hip roofs, composition shingle roofing, proportional plate heights, stucco and horizontal siding, roof
eave braces, and aluminum clad wood windows with wood trim) is compatible with the existing house and
character of the neighborhood and that the windows and architectural elements of the proposed structure are
placed so that the structure respects the interface with the structures on adjacent properties. For these reasons,
the project may be found to be compatible with the requirements of the City's five design review criteria.
Planning Commission Action: The Planning Commission should conduct a public hearing on the application,
and consider public testimony and the analysis contained within the staff report. Action should include specific
findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning
Commission. The reasons for any action should be stated clearly for the record. At the public hearing the
following conditions should be considered:
that the project shall be built as shown on the plans submitted to the Planning Division date stamped
February 9, 2021, sheets A-1 through A-6 and L-1;
2. that any changes to building materials, exterior finishes, windows, architectural features, roof height or
pitch, and amount or type of hardscape materials shall be subject to Planning Division or Planning
Commission review (FYI or amendment to be determined by Planning staff);
3. that any changes to the size or envelope of the first or second floors, or garage, which would include
adding or enlarging a dormer(s), shall require an amendment to this permit;
4. that the conditions of the Building Division's February 23, 2021 memo, the Parks Division's February 23,
2021 memo, the Engineering Division's February 17, 2021 memo, and the Stormwater Division's
February 24, 2021 memo shall be met;
5. that any recycling containers, debris boxes or dumpsters for the construction project shall be placed
upon the private property, if feasible, as determined by the Community Development Director;
6. that demolition or removal of the existing structures and any grading or earth moving on the site shall not
occur until a building permit has been issued and such site work shall be required to comply with all the
regulations of the Bay Area Air Quality Management District;
7. that prior to issuance of a building permit for construction of the project, the project construction plans
shall be modified to include a cover sheet listing all conditions of approval adopted by the Planning
Commission, or City Council on appeal; which shall remain a part of all sets of approved plans
throughout the construction process. Compliance with all conditions of approval is required; the
conditions of approval shall not be modified or changed without the approval of the Planning
Commission, or City Council on appeal;
8. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination
and installed on the portions of the roof not visible from the street; and that these venting details shall be
included and approved in the construction plans before a Building permit is issued;
9. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan
and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall
require a demolition permit;

10. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, in
effect at time of building permit submittal, as amended by the City of Burlingame;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION PROCESS PRIOR
TO THE INSPECTIONS NOTED IN EACH CONDITION:
11. that prior to scheduling the framing inspection the applicant shall provide a certification by the project
architect or residential designer, or another architect or residential design professional, that
demonstrates that the project falls at or below the maximum approved floor area ratio for the property;
12. prior to scheduling the framing inspection the project architect or residential designer, or another
architect or residential design professional, shall provide an architectural certification that the
architectural details shown in the approved design which should be evident at framing, such as window
locations and bays, are built as shown on the approved plans; architectural certification documenting
framing compliance with approved design shall be submitted to the Building Division before the final
framing inspection shall be scheduled;
13. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof
ridge and provide certification of that height to the Building Division; and
14. that prior to final inspection, Planning Division staff will inspect and note compliance of the architectural
details (trim materials, window type, etc.) to verify that the project has been built according to the
approved Planning and Building plans.

RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a Categorical Exemption has been prepared and application has been made for Desiqn
Review for a first and second story addition to an existinq sinqle-familv dwellinq at 509 Burlinaame
Avenue, Zoned R-1, Brian Ament and Sara Ponzio, propertv owners, APN: 029-254-040;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on March
22, 2021, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this Commission, it is hereby found that there is no substantial evidence
that the project set forth above will have a significant effect on the environment, and categorical
exemption, per CEQA Section 15301 (e)(2), which states that additions to existing structures
are exempt from environmental review, provided the addition will not result in an increase of
more than 10,000 SF in areas where all public services and facilities are available and the area

2. Said Design Review is approved subject to the conditions set forth in Exhibit "A" attached

Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15301 (e)(2), which states that additions to existing structures
are exempt from environmental review, provided the addition will not result in an increase of more than 10,000
SF in areas where all public services and facilities are available and the area in which the project is located is not
environmentally sensitive.
Project Description: The existing one-story house with an attached one-car garage contains 1,435 SF of floor
area and has two bedrooms. The applicant is proposing a 284 SF first floor addition and a new 806 SF second
story. The proposed project would increase the total floor area to 2,395 SF (0.48 FAR), where 2,700 SF (0.54
FAR) is the maximum allowed. The project is 305 SF below the maximum allowable floor area.
With this application, the number of bedrooms will increase from two to four. Two parking spaces, one of which
must be covered, are required on-site. One covered parking space is provided in the existing attached garage
(9'-2" x 20'-4" clear interior dimensions); one uncovered parking space (9' x 20') is provided in the driveway. All
other Zoning Code requirements have been met. The applicant is requesting the following application:

Design Review Study Meeting: At the Planning Commission design review study meeting on August 8, 2016,
the Commission asked several questions about the project which were answered by the applicant. Since there
were no changes suggested for the project, the Commission voted to place this item on the consent calendar
(please refer to the attached August 8, 2016 Planning Commission Minutes).
The applicant submitted a letter, dated August 12, 2016, summarizing his responses to the Commission's
questions from the design review study meeting. The applicant notes that a wooden handrail will be added at
the rear deck, which will be shown on the building permit submittal plans.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on April 20, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Suggested Findings for Design Review: That the architectural style, mass and bulk of the addition (featuring
gable and hip roofs, composition shingle roofing, proportional plate heights, stucco and horizontal siding, roof
eave braces, and aluminum clad wood windows with wood trim) is compatible with the existing house and
character of the neighborhood and that the windows and architectural elements of the proposed structure are
placed so that the structure respects the intertace with the structures on adjacent properties, therefore the
project may be found to be compatible with the requirements of the City's five design review criteria.
Planning Commission Action: The Planning Commission should conduct a public hearing on the
application, and consider public testimony and the analysis contained within the staff report. Action should
include specific findings supporting the Planning Commission's decision, and should be affirmed by
resolution of the Planning Commission. The reasons for any action should be stated clearly for the record. At
the public hearing the following conditions should be considered:
that the project shall be built as shown on the plans submitted to the Planning Division date stamped July
29, 2016, sheets A-1 through A-6 and L-1;

2. that any changes to building materials, exterior finishes, windows, architectural features, roof height or
pitch, and amount or type of hardscape materials shall be subject to Planning Division or Planning
Commission review (FYI or amendment to be determined by Planning staffl;
3. that any changes to the size or envelope of the first or second floors, or garage, which would include
adding or enlarging a dormer(s), shall require an amendment to this permit;
4. that the conditions of the Building Division's July 5, 2016 memo, the Parks Division's July 7, 2016 memo,
the Engineering Division's July 12, 2016 memo, and the Stormwater Division's July 6, 2016 memo shall
be met;
5. that any recycling containers, debris boxes or dumpsters for the construction project shall be placed
upon the private property, if feasible, as determined by the Community Development Director;
6. that demolition or removal of the existing structures and any grading or earth moving on the site shall not
occur until a building permit has been issued and such site work shall be required to comply with all the
regulations of the Bay Area Air Quality Management District;
7. that prior to issuance of a building permit for construction of the project, the project construction plans
shall be modified to include a cover sheet listing all conditions of approval adopted by the Planning
Commission, or City Council on appeal; which shall remain a part of all sets of approved plans
throughout the construction process. Compliance with all conditions of approval is required; the
conditions of approval shall not be modified or changed without the approval of the Planning
Commission, or City Council on appeal;
8. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination
and installed on the portions of the roof not visible from the street; and that these venting details shall be
included and approved in the construction plans before a Building permit is issued;
9. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan
and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall
require a demolition permit;
10. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2013
Edition, as amended by the City of Burlingame;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION PROCESS PRIOR
TO THE INSPECTIONS NOTED IN EACH CONDITION:
11. that prior to scheduling the framing inspection the applicant shall provide a certification by the project
architect or residential designer, or another architect or residential design professional, that
demonstrates that the project falls at or below the maximum approved floor area ratio for the property;
12. prior to scheduling the framing inspection the project architect or residential designer, or another
architect or residential design professional, shall provide an architectural certification that the
architectural details shown in the approved design which should be evident at framing, such as window
locations and bays, are built as shown on the approved plans; architectural certification documenting
framing compliance with approved design shall be submitted to the Building Division before the final
framing inspection shall be scheduled;
13. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof
ridge and provide certification of that height to the Building Division; and

14. that prior to final inspection, Planning Division staff will inspect and note compliance of the architectural
details (trim materials, window type, etc.) to verify that the project has been built according to the
approved Planning and Building plans.

There were two questions and one request at the Planning Commission meeting:
Is the board and batten siding on the front porch going to go away?
Yes, the existing porch and entry are being demolished for a new porch and entry.
Will the existing skylight over the front porch also be removed?
Yes the existing skylight will be removed and there are no proposed skylights
There will need to be a handrail on rear deck.
The exit at the rear of the house is composed of a landing and then 3 risers. According to the
building code a handrail is only required when there are four or more risers. The riser from the
dwelling to the landing is not counted as a riser for this calculation. However, with regard to
safety, we are going to add a wooden handrail which will be attached along the wall just to the
right side of the sliding door. This will be shown when applying for the building permit.

The following comments do not need to be addressed now, but you should be aware of them as
they will need to be addressed at time of building permit submittal.
1) This project will be considered a New Building because, according to the City of Burlingame
Municipal code, "when additions, alterations or repairs within any twelve-month period exceed
fifty percent of the current replacement value of an existing building or structure, as determined
by the building official, such building or structure shall be made in its entirety to conform with
the requirements for new buildings or structures." This building must comply with the 2013
California Building Code for new structures. BMC 18.07.020
Note: Any revisions to the plans approved by the Building Division must be submitted to, and
approved by, the Building Division prior to the implementation of �any work not specifically
shown on the plans. Significant delays can occur if changes made in the field, without City
approval, necessitate further review by City departments or the Planning Commission.
Inspections cannot be scheduled and will not be performed for work that is not shown on the
Approved plans.
2) Due to the extensive nature of this construction project the Certificate of Occupancy will be
rescinded once construction begins. A new Certificate of Occupancy will be issued after the
project has been final. No occupancy of the building is to occur until a new Certificate of
Occupancy has been issued.
3) When you submit your plans to the Building Division for plan review provide a completed
Supplemental Demolition Permit Application. NOTE: The Demolition Permit will not be
issued until a Building Permit is issued for the project.
4) On the plans show that all openings in exterior walls, both protected and unprotected, will
comply with 2013 CRC, Table 302.1(1). Provide a table or chart that specifies 1) the openings
allowed and; 2) the size and percentage of the openings proposed.
5) Provide guardrails at all landings. NOTE: All landings more than 30" in height at any point are
considered in calculating the allowable lot coverage. Consult the Planning Department for details
if your project entails landings more than 30" in height.
6) Provide lighting at all exterior landings.

Based on the scope of work, this is a"Type I" project that requires a Stormwater Construction
Pollution Prevention Permit. This permit is required prior to issuance of a Building Permit. An
initial field inspection is required prior to the start of any construction (on private property or in
the public right-of-way).
Sewer Backwater Protection Certification is required for the installation of any new sewer fixture
per Ordinance No. 1710. The Sewer Backwater Protection Certificate is required prior to the
issuance of Building Permit.
The sanitary sewer lateral (building sewer) shall be tested per ordinance code chapter 15.12.
Testing information is available at the Building department counter. A Sewer Lateral Test
encroachment permit is required.

Any construction project in the City, regardless of size, shall comply with the city's
stormwater NPDES permit to prevent construction activity stormwater pollution. Project

RESOLUTION APPROVING CATEGORICAL EXEMPTION AND DESIGN REVIEW
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a Categorical Exemption has been prepared and application has been made for Desiqn
Review for a first and second story addition to an existinq single family dwelling at 509 Burlinaame
Avenue, Zoned R-1. Brian Ament and Sara Ponzio, propertv owners, APN: 029-254-040;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
August 22, 2016, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this Commission, it is hereby found that there is no substantial evidence
that the project set forth above will have a significant effect on the environment, and categorical
exemption, per CEQA Section 15301 (e)(2), which states that additions to existing structures
are exempt from environmental review, provided the addition will not result in an increase of
more than 10,000 SF in areas where all public services and facilities are available and the area
in which the project is located is not environmentally sensitive, is hereby approved.
2. Said Design Review is approved subject to the conditions set forth in Exhibit "A" attached
hereto. Findings for such Design Review are set forth in the staff report, minutes, and recording
of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records of
the County of San Mateo.

that the project shall be built as shown on the plans submitted to the Planning Division date
stamped July 29, 2016, sheets A-1 through A-6 and L-1;
2. that any changes to building materials, exterior finishes, windows, architectural features, roof
height or pitch, and amount or type of hardscape materials shall be subject to Planning
Division or Planning Commission review (FYI or amendment to be determined by Planning
staffl;
3. that any changes to the size or envelope of the first or second floors, or garage, which would
include adding or enlarging a dormer(s), shall require an amendment to this permit;
4. that the conditions of the Building Division's July 5, 2016 memo, the Parks Division's July 7,
2016 memo, the Engineering Division's July 12, 2016 memo, and the Stormwater Division's
July 6, 2016 memo shall be met;
5. that any recycling containers, debris boxes or dumpsters for the construction project shall be
placed upon the private property, if feasible, as determined by the Community Development
Director;
6. that demolition or removal of the existing structures and any grading or earth moving on the
site shall not occur until a building permit has been issued and such site work shall be
required to comply with all the regulations of the Bay Area Air Quality Management District;
7. that prior to issuance of a building permit for construction of the project, the project
construction plans shall be modified to include a cover sheet listing all conditions of approval
adopted by the Planning Commission, or City Council on appeal; which shall remain a part of
all sets of approved plans throughout the construction process. Compliance with all
conditions of approval is required; the conditions of approval shall not be modified or
changed without the approval of the Planning Commission, or City Council on appeal;
8. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street; and that these
venting details shall be included and approved in the construction plans before a Building
permit is issued;
9. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to
submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;
10. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 2013 Edition, as amended by the City of Burlingame;

THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION
PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION:
11. that prior to scheduling the framing inspection the applicant shall provide a certification by the
project architect or residential designer, or another architect or residential design
professional, that demonstrates that the project falls at or below the maximum approved floor
area ratio for the property;
12. prior to scheduling the framing inspection the project architect or residential designer, or
another architect or residential design professional, shall provide an architectural certification
that the architectural details shown in the approved design which should be evident at
framing, such as window locations and bays, are built as shown on the approved plans;
architectural certification documenting framing compliance with approved design shall be
submitted to the Building Division before the final framing inspection shall be scheduled;
13. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of
the roof ridge and provide certification of that height to the Building Division; and
14. that prior to final inspection, Planning Division staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the project has been built
according to the approved Planning and Building plans.
