This project was approved by the Planning Commission at their August 25, 1997 meeting and became effective September 4, 1997. One of the conditions was to insure that all on-site drainage drain to the public street. This condition was to comply with Municipal Code Section 18.08.360. It states: "No storm waters, underground waters draining from any lot, building or paved area shall be allowed to drain to adjacent properties nor shall these waters be connected to the City's sanitary sewer system. These waters shall all drain to either artificial or natural storm drainage facilities by gravity or pumping regardless of the slope of the property" This requirement is to prevent roof water flows into the adjacent lot. In this particular case, if this lot remains sloping to the rear, it will still flow to Stanley Avenue through the property at the back. The Stanley Street drainage system goes into Burlingame Avenue. There is not any difference if this lot slope is to the front or to the rear, the rain water still contributes into the Burlingame Avenue system. From an engineering point of view, there will be no difference in total storm run off quantity contributed into this storm drain system since the ground surface will be fully saturated. The total water run off will be decided by the lot size rather than the expanded building footprint. During light to normal rain storms, the additional water run off from the expended building footprint is very insignificant compared to the total contributory area. The total contribution to Rollins/Burlingame system is about eight blocks with approximately 30.3 acres. This new home proposed 1,600 S.F. of building footprint compared to 1,200 S.F. of existing (assumed). There is only 400 S.F. of added footprint which will count for about 0.03 % increase. Also, the existing storm drainage system has enough capacity to handle the heavy rainfall if there is no high tide. However, when there is a high tide the water will accumulate in ±his area because of the low elevation. An expansive pump station would be needed to solve this problem. With a few houses affected by it, the City has no plan to install a pump station for this drainage system yet. Page 2... This letter is written with regard to the proposed dwelling at 315 Burlingame Avenue. This proposed tw�o-story residence with detatched twr�-car garage will ,j occupy the lot that had, prior to a fire approximately one year ago, been occupied by a single-story bungalow. My home is located in�diately next to � 315 Burlingame Avenue, at the corner of Stanley Road and Burlingame Avenue on the south-east corner. We were notified of a hearing to consider variances for this proposed new hat� concerning an increased height limitation of 12 feet, a modification of ` tne setback (front) regulation, and a detatched garage. We had no objections to these variances. However, there is a rr�tte.r we believe the city needs to consider with the construction of this new home which concerns the issue of drainage and flooding along this section of Burlingame Avenue. As you are aware, there are "flood warning" signs posted. along Rollins Road at the intersection of Burlingame Avenue. These signs indicate that during times of high tide the area in question is subject to flooding. You may recall there was marked flooding this past winter in the sub-street level parking ar'ea under the apartments at Burlingame Avenue and Rollins Road. Given that the proposed dwel.ling at 315 Burlingame Avenue will occupy a considerably- exPanded footprint fran the previous bungalow, we have serious questions with regard to the issue of flooding up Burlingame �lvenue. In the tw�enty-five years we have been in our home, there is a very facni.Iiar winter pattern along Burlingame Avenue. Typically, the first rains flood the gutters with eucalyptus leaves and debris, and debris from the other large ,:, trees lining Burlingame Avenue. This debris, added to the accumulation of =';�debris already in the storm drain system, effectively backs up the gutters along the Avenue, resultirig in a small "lake" at Burlingame Avenue and Stanley --.,-R^��• (I am sure this happens further east down the Avenue, but I am most familiar with t�ose oonditions involving our corner.) � Amy Thomas 240 Stanley Road Burlingame, C1� 94010 (650)342-3648 � �, �� C �� �� / ., . Page 2 If there is sufficient respite between storms, this water usually drains a�Y ��in 24-hours. However, last winter was particularly rainy and it was not unco�non for the water to migrate up the curb-cut on our corner; several times, the water came up far enough to flood a corner of our lot. Additionally, water has also risen to above the curb on Burlingame Avenue, pooling at the base of the five huge eucalyptus trees at the north end of our lot (city property). It is our understanding that the lot at 315 Burlingame Avenue will be graded so that surface water, that water that will fall on the part of the lot not covered by dwelling, will flcw to the street. In addit?on, we understand that watex from the gutters is to be directed to the street. Given the size of this project, with the considerable reduction of permeable land, we have strong concerns with regard to the amount of run-off that will now be diverted to the street and which will have to be handled by a"sewer" system that has, in the past, been taxed beyond its ability to function properly. Also, we have concerns with regard to the five seventy-five foot-plus eucalyptus trees adjacent to the north end of our property, These trees have never been maintained with an eye to bringing down their considerable height; when the city does maintain thgn, they are always tri�ied up from the bottan, never dawn from the top. Given the shallow-rooted nature of these trees and the high winds we frequently experience in this area of Burlingame, and with some previous wi.nter experiences of trees going down at the Recreation Center, the Royal Donut shop, and at Safeway along El Camino Real very fresh in our minds, we have serious concexns about the future safety of our hane and our family. Ingram, Jr. 315 Burlingame Avenue Burlingame CA 94010 Dear Mr. Ingram, Since there was no appeal to or suspension by the City Council, the August 25, 1997 Planning Commission approval of your front setback and height variances and special permit application became effective September 4, 1997. This application was to allow a new single family dwelling at 315 Burlingame Avenue, zoned R-1. The August 25, 1997 minutes of the Planning Commission state your application was approved with the following conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped July 31, 1997, Sheets 1 through 6 with a maximum roof ridge height of 31'-6" as measured from the average top of curb at the front of the house (130.045'), a maximum attic height of 9'-0" as measured from the attic floor to the bottom of the roof beam and an 18' wide garage door shall be placed and maintained in the detached garage; 2. that the construction for the single family dwelling and detached garage shall conform exactly to the height, setbacks, envelope, rooflines, and window placement as shown on the plans date stamped July 31, 1997, Sheets 1 through 6; any change to these features shall require amendment to this permit and a public hearing; 3. that the materials proposed for construction as detailed on the plans date stamped July 31, 1997, Sheets 1 through 6, shall be used in the construction of the new single family dwelling and garage; 4. that the height of the roof (31'-6") and the height of the attic space (9'-0") shall be established by a survey and accepted by the City Engineer prior to calling for the framing inspection; A a��e m rncyn�a aeoer Z 1 September 5, 1997 315 Burlingame Avenue page -2- 5. that the conditions of the City Engineer's and Chief Building Inspector's July 21, 1997 memos shall be met; 6. that the east wall of the garage adjacent to the side property line shall be finished with cement plaster; 7. that the grading plans shall be checked by the City Engineer to insure that all on site drainage is to the public street before a building permit is issued and that the elevations of the grading shall be confirmed on the site by the City Engineer before the construction of the foundation is begun; and 8. that this project shall meet all the requirements of the California Building and Fire Codes, 1995 Edition, as amended by the City of Burlingame. All site improvements and construction work will require separate application to the Building Department. This approval is valid for one year during which time a building permit must be issued. One extension of up to one year may be considered by the Planning Commission if application is made before the end of the first year. The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.
