The undersi�ed owner proposes to erect a modern deluxe 50 unit apartment
building on th e south southwest corner of Marco Polo �{ Trousdale in the Mills
Fstate subdivision.

The building, as shawn from the Areliminary plans hereto attached, �nll be a
credit not only to the Mills �'state Development, but especially to the entire Cit�
of Rurlin�ame.
Due to the irregular shape of the lot, and to eliminate architectural and
funetional problems so as to enhance the tenent livability of the building, it
is necessarp to request a variance for the elimination of the side line setback
requirements to ena�le the building of carports along the southerly boundry of
the �roperty. This is necessary in order to nrovide proper ingress and egress
for the tenents of the buildin� in the narking of their automobiles.
The denial of this variance would result in undue property loss from the
standpoint of �ood design and usability of the property to its beat intrinsic
value and public use.
The plans herewith submitted are the result of several months architectural
study b,y Mogen Mo�enson, A.I.A. Many desi�n approaches to the development were
thorou�hl,y ana.lized by many preliminary architectural plans. Hence, the owner
can unequivicall,y st,ate that the plang herewith submitted w�ould result in the
best development and use of the z�ropert�, and to deny the variance ti+rould result
in the owner bein� unable to enjoy his ri�ht to the best development and use
of the nropert,y.
The �ranting of this variance would not be detrimental to the public
health safety or welfare in that not one law of th� State Housing Act is violated
by the variance.
The �rantin� of this variance would not be detrimental to the adjacent pro-
nerty owner, on whose nroperty an apartment house is now under construction,
and on whose northerly �roperty linc there are no apartments on the ground floor.
An,,y other propert,y owner in the area t�rould not be involved as they are not con-
tij?uous to any portion where the variance is reauested.
In closin�, the granting of this varia.nce wuuld not adversely effect the
zoning Alan of the Cit,y, as this is a speci�.l case on an irre;�ularly shaped corner
lot not following the usual lot pa.ttern.

The Fire Department has been asked for an opinion in regards
to fire safety concerning the proposed construction of carports
on the front two-thirds of the side line of an apartment to

DIVIDING THE CITY INTO DIS-
TRICTS BY RGCLASSIFYING LOTS
1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13,
14 AND 15, BLOCK 10, MILLS ES-
TATE MAP NO. 3, BURLINGAME,
CALIFORNIA, FROM A TIIIRD
COMMERCIAL DISTRICT (PRO-
FESSIONAL BUSINESS, C-3), TO
A THIRD RESIDENTIAL (MULTI-
FAMILY DWELLINGS, R-3) DIS-
TRICT.
The City (:ouncil of the City of
Burlingame does ordain as follows:
Section 1. 8ection 1904, Article 50,
Part X, of the Ordinance Code of the
City of Burlingame is hereby amended
by reclassifying the real property
hereinafter particularly d e s c r 1 b e d
frc,m a Th1rd Commercial District
(C-3) to a Third Residential District
(R-3).
The real property hereby reclassified

shown on that certain map enti-
tled "MAPS ESTATE MAP NO.
3, BURLINGAME, CALIFORNIA,"
whlch map was flled in the OYfice
of the Recorder of the County of
San Mateo, State of California, on
June 21, 1954, in Book 39 of Maps
at pages 13, 14 and 15.
Section 2. This ordinance shall be
published as required by law.
