details of the request, staE£ review, applicant's letters, study
meeting questions. Four conditions were suggested for consideration at
the pub.lic hearing. C. Taylor did not partici�ate in this item due to
conflict of interest.
Discussion: city action and intention on approval of the Bekins project
with regard to signalization at Carolan and Broadway; CE's condition #1
in his May 9, 1986 memo concerning temporary asphalt concrete median;
ingress/egress for both properties; city will require the two
properties be merged.
Chm. Giomi �pened the public hea.ring. Michael R. Harvey, applicant,
addressed Commission: his impression when the Bekins project at 1070
Broadway was approved was that a signal at Broadway and Carolan had
been approved; staff's impr.ession appears to be that the matter would
be considered as a part of the Broadway/California intersection study
and Public Works has further stated siqnalization at Broadway and
Carolan may not be practical. Applicant requested clarification

of the city's position with respect to this signalization in advance of
closing escrow on the property at 1044-1060 Broadway. He stated he has
volunteered to merge the three properties. Staff pointed out the issue
this evening is a special pe.rmit for an auto sales lot; applicant
agreed to proceed this evening with the special permit but stressed he
must have the signal at Broadway and Carolan. He read a letter frbm
Chicago Title Company reviewing his easement to use Whitethorn Way,
there is still some clarification needed on this also.
There were no audience comments and the public hearing was closed.
Considerable Commission discussion followed regarding ingress/egress
for these two properties, the need for some access to Whitethorn Way
and the possibility of conditioning this permit for that. Applicant
felt it would be a mistake to condition the permit on ingress to
Whitethorn; he believed he could guarantee ingress but preferred to
wait for an attorn.ey's opinion.
C. Graham moved for approval of this special permit and for adoption of
Commission Resolution Approving Special Permits with the following
conditions: (1) that the conditions of the City Engineer's memo of May
9, 1986 shail be met; (2> that the project shall be built as shown on
the plans submitted to the Planning Department and date stamped May 29,
1986 with 12' light standards each with 250 watt luminaires including
appropriate shields to confine all light and glare on the properties of
1060-1044 Broadway and the adjacent wall of 1070 Broadway and that the
automobile sales lot shall be operated according to the terms of the
Controller's letters dated May 19, 1986 and May 29, 1986; (3) that the
driveway from this property to Broadway be limited to right turns only
and the street channelization be installed before the project is
finaled by the Building Department and the project include ingress from
Whitethorn Way; and (4) that properti�s at 1060-1044 Broadway be merged
with the property at 1070 Broadway before the project construction is
finaled by the Building Department. Second. C. Schwalm; motion
approved on a 4-2-1 roll call vote, Cers Jacobs and Giomi dissenting,
C. Taylor abstaining. Appeal procedures were advised.

Re: Proposed Used Car Lot Adjacent to Former Bekins
Building - Mike Harvey - 1044/1060 Broadway
We have reviwed this request. There are no major problems with proposal
in general. The following are questions or conditions that staff wi11
recommend once a formal request is submitted:
1. Thatapplicant constriact a temporary asphalt concrete median
from the Rollins Road median to Carolan Avenue to prohibit
left turns/turns to the site.
2. Driveway out of the proposed lot shall be restricted to right turn
only and signed and marked by the applicant.
3. The applicant shall either install required rest room facilities on
the used car site or merge this site with Bekins'site.
4. Access onto Whitethorn Way looks difficult if not impossible as
shown. Adjacent Parcel 9 has building close to property line at
the corner of Whitethorn Way. Access must be confirmed by map
research and survey of lot.
5. All lots on the used car site to be merged into one �ite if not
merged with old Bekins' site.
Other comments will be forthcoming once detailed plans are presented.

extension to July 7, 1988 was approved with all previous conditions.

action: "The law firm I work for represents the City of Burlingame in
litigation brought by Mr. Harvey against the city. To avoid any hint
of impropriety or conflict of interest, I will abstain from discussion
and action on this item."

present. Re�ponding to Commission questions, she adv�,a�ed the brickwork
facade is onl� an inch or so larger than the garage, she wished to
extend back 274 -6" instead of 26' because she would like to have as
much space as p ssible and cannot use the remaini rear yard, she has
stayed 1'-3" fr property line to make it more cceptable to
neighbors, one c` can be parked in the garage ow, there are no plans
to add cabinets t the rear portion of the gar�age, she could possibly
get two cars in th garage if present storag� were removed. In noting
letter in oppositio from Florence Cole, s�ff commented this letter
addressed other addi .ions and abuses of g ages in the neighborhood.

With the statement the '�ddition will m�'ke the garage more usable for
number of cars for some �,uture familye; it does give the applicant
storage, there is an ease ent and tY�erefore the structure is separated
from adjacent property, it will not�be detrimental, applicant has shown
concern in keeping with the°�rchi,�ecture of her property, C. Jacobs

SUBJECT; REQUEST FOR EXTENSION OF SPECIAL PERMIT FOR AUTO SALES
AT 1044-1060 BROADWAY, ZONED M-1
Michael Harvey is requesting (May 29, 1987 letter) a one year extension
of his permit to have auto sales at 1044-1060 Broadway (Code Sec. 25.
16.130). In July, 1986 Michael Harvey requested and received a special
permit to have an auto sales lot at 1044-1060 Broadway, zoned M-1 (Code
Sec. 25.42.030-g). The request was to demolish the existing buildings
on this site and pave and landscape the area as required by code for an
auto sales lot. The salesmen's offices and bathroom facilities would
be located in the adjacent Bekins building. The two lots at 1044-1060
and 1070 Broadway would be merged before the work on the Bekins
building was completed. The Planning Commission reviewed and approved
the on-site lighting plan for the car sales lot (Code Sec. 25.74.010-f)
along with the use permit. The lighting plan included six 12' high
light standards each with a 250 watt fixture. Each fixture would be
directed onto the lot and cutoff shields placed to prevent glare from
affecting traffic on Broadway.
City staff had no comments on this request for permit extension.
The application was passed by the Planning Commission on a 4-2-1 vote
(Commissioners Jacobs and Giomi dissenting, Commissioner Taylor
abstaining) (Planning Commission Minutes, June 9, 1986). City Council
called the item up for review. They upheld the Planning Commission on
a 4-1 vote (Councilman Pagliaro voting no) (City Council Minutes,
July 7, 1986).
