Harvey Post Office Box 511 Burlingame, CA 94011 Dear Mr. Harvey: At their meeting of July 7, 1986 the City Council reviewed your special permit application to allow auto sales in the M-1 district at 1044-1060 Broadway. Following a public hearing Council approved your application with the following conditions: 1. that the conditions of the City Engineer's memo of May 9, 1986 sha11 be met; 2. that the project shall be built as shown on the plans submitted to the Planning llepartment and date stamped May 29, 1986 with 12' light standards each with 250 watt luminaires including appropriate shields to confine all light and glare on the properties of 1060- 1044 Broadway and the adjacent wall of 1070 Broadway and that the automobile sales lot shall be operated according to tfie terms of the Controller's letters dated May 19, 1986 and May 29, 1986; 3. that the driveway from this property to Broadway be limited to right turns only and the street channelization be installed before the project is finaled by the Building Department and the project include ingress from Whitethorn Way; and 4. that the properties at 1060-1044 Broadway be merged with the property at 1070 Broadway within 90 days of finaling project construction by the Building Department. All site improvements and construction work will require separate application to the Building Department. He thought that if the project has been r�vised ir. should �o back to thc Planning Commission, but if it is an at�ternative then Che council might review it. Dav'd Carr, attorney representing Sequoias, stated the developers are wil �ing to accept additional conditions reducing height of structure from�,�0.5 feet to 90 feet vith resulting reduction in number of resid ts, traffic and parking. He said this is a mitigation that was in the �IR and that Planning Commission has seen, He asked if council wishes �lanning Commission to review the change it direc[ the commissio.n to hear at its next meeting. Staff reviewed noticing requiremert�ts and the commission could not review before end of July. Cnuncil not the public expects the project to be reviewed by council nov. It can ecide at its next meeting whether the Planning Commission sho ld also review. Council requested%'press aid in notifying publi about this proposed change to Gfie project. The applicant, Dennis ; Kay, is requesting a special u�e permit to operate Ugly Duckling Rent- A-Car from 600 square feet o��o ice area at 1299 Bayshore. The project proposes to designa��e 10 n site parking spaces for the car rental use. The applicant,�will em loy 2.5 perso�fs and operate six days a week from 7 a.m. to� 6 p.m, e rental fleet will be 20 cars, employees will use fle�et/vehicles an pick up customers in these vehicles. There is ano�her car rental permit at this site, although ' it is not currently ackive, which has 2 designated parking spaces. �, With the relocation o�f the north bound f eway on ramp, access to this site will become mor'e difficult. ' Councilman Paglia o confirmed that they are questing more parking than is availabl�on the site due Co other use . / � Mayor Mangini �pened the public hearing. � Dennis Kay, �pplicant, reviewed that the car rental gency at the site with the current permit has not been operating for si months. He plans to st�art operation with ten cars and add two a m nth until he reaches ma�ximum number of 20 cars. Mayor Mahgini closed the public hear�ng. � Counci�lman Amstrup noted he had called this up for reviev b cause the build:ing in in such a poor location, Councilwoman Barton sa d that if the other car rental operation becomes active they vould be s�ort of p�rking. Counci7.man Lrmbi wondered i.f city could find out if the o[her vas acCually out of buslness. Cbuncilman Amstrup moved to reverse the Planning Commis.sion and deny the permit. Seconded by Councilwoman Barton, carried unanimously by roll call vote. PUALIC HGARING - REVI�W UF SPECIAL PERMIT FOR AUTO SALES AT 1044-1060 BROADWAY City Planner revieved her memo of June 9 in vhich she recommended council ho].d public hearing and take action. The applicant, Mike Harvey, is requesting a special permit for auto sales on tvo adjacent lots at 1044--1060 Broadway. In order to develop the auto sales lot, 2 the existing buil.dinys would have to be demolished. The office for employces working in this paved t�uto sales lot will be in [he adjacent Bekins building. The two parcels will 6e merged with the Bekins property at 1070 Broadway. Employee parking will be in the parking structure which will be built to serve the Bekins 6uilding. The Planning Commission approved this special permit for auto sales at its meeting of June 9, 1986. Council quesr_ioned whether alley adjacent belongs to these lots or the gas station. City Planner reviewed location of alleys on site, private street called Whitethorn Way at rear of site, applicant has easement whi.ch connects [o Whitethorn. City Planner said Harvey vas vorki.nR on Retting a legal opinion on whether he could change the one way dircc[io❑ of Whitethorn. Mayor Mangini opened the public hearing. Mike Harvey, applicant, reviewed that }ie is in process of purchasing this property. He had concerns about the proposed signal light at Carolan and Sroadway, his understanding was that he would contribute to its installation. Councilman Pagliaro noted this has nothing to do with the permit being revier+ed. Harvey had concerns about the requirement for combining properties before making improvements and his loan process. City Planner noted condition for combining lots could be met within certain time limit after improvements as council directs, she suggested 90 days. After some di.scussion, council determined to consider the review of this sit_e first and then discuss Che signal question'. Counci_lman F<�gliaro stated he had called this up for review because of his concern about traffic at the site. He wondered if Bekins plans would proceed without this auto sales lot. He questioned entrance amd exit from the auto lot. Harvey noted customers could enter from Broadway and exit at rear, he would prefer that customers could exit onto Rollins from Whitethorn, but Whitethorn is one way in direction of North Carolan. Director of Public Works [hought there might be danger if Whitethorn vere one way in other direcr�ion and traffie exited onto Rollins since many large trucks use Whitethorn and turning on Co Fol.lins would block several lanes. Harvey noted he is negotiating with owner, he believed he does have the right to use Whitethorn. Councilman Pagliaro was concerned about the possibility of egress/exit next to railroad onto Broadway; can council condition that Harvey use Whitethorn to exit lot; can council stipulate no use of exit on Bekins property next to railroad track; put signs for no exit at railroad; Harvey can come back to review signal at later date. Mayor.Mangini closed the publie hearing. Councilman Pagliaro moved to grant the permit with additional conditions that Harvey put up stop sign and left turn only sign at the point where his easement from 1044-1060 Broadway joins Whitethorn Way, and no exit be allowed from driveway next to the railroad track. Seconded by Councilman Amstrup. Harvey noted he has committed much time and money to this project, he did not want to be dependent on property controlled by someone else for exiting and then be boxed in at the site. He said he needs some affirmation from city on signal, it may be best for him to drop the project. C:ouncilman P�gliaro said he is trying to reduce traffic hazard, trying to help Harvey. Council noted it cannot commit ftself to a signal before the intersection studies are complete. Councilman Pagliaro withdrew his motion and Amstrup withdrev second. Director of Public Works reviewed for council the contract for study of this signal, he migh[ be able to expedite sooner. Earlier agreement for signal was that Harvey would pay 25 percent of cost for signalization and coordination up to $50,000. Motion died for lack of a second. Councilman Amstrup moved to uphold the Planning Commission action on the use permit�for an auto sales lot at 1044-1060 Broadway vith the staff recommended conditions and the addition to condition 4 that the lots be combined within 90 days of finaling the building permit and issuing an occupancy permit. Seconded by Councilman Lembi, carried 4-1 on a roll call vote, Councilman Pagliaro voting no. ANNEXATIO,�( REQUEST FOR 1215 VAN City Attqiney reviewed his memo of June 19 in hich he recommended council review this request from Dan Rosenbledt for deannexation of his pr perty at 1215 Vancouver. Council need ta e no action. Rosen edt's first move is to request this change before LAFCo. If LAFC�approves, then he would need approval from b th Burlingame and Hil�sboro�gh. Rosenbledt's property fronts on Arms Road in HiYlsborough.but has a mail address in Burlingame. Councilwoman Barton noted she would not approve of thi request as she felt it was spot zoning, Councilman Amstrup agreed. ... Rosenbledt noted his concerns about fire safety. His driv�way is too narrow for fire trucks, the Fire Chief does not objec[ to deannexation.
