SUBJECT: FENCE EXCEPTION TO REPLACE A 7' FENCE WITH A 7' FENCE
AT 481 BLOOMFIELD ROAD ZONED R-1
Arijs and Loretta Rakstins, property owners, are requesting a fence
exception in order to replace an existing 7' fence along their side
property line with a new 7� fence in the same location (maximum
height allowed 6') at the single family residence at 481 Bloomfield
Road, zoned R-1 (Code Sec. 25.78.030). The proposed 7� replacement
fence would not extend into the front setback. The existing 5'-6"
fence in the front setback would remain.
The replacement fence has a 52' run of 7� height in the area
between the two existing houses and drops to 5' -6" for 43' to the
rear and 20' to the front of the property. The proposed 7'
replacement fence would not extend into the front setback; the
existing 5'-6" fence would be retained in this area (5' maximum
allowed if being replaced).
Staff Review
City staff reviewed this request and had no comments. All new
construction is required to meet the standards of the Uniform
Building and Uniform Fire Codes and receive a building permit prior
to commencement.
Findinas for a Fence Exception
In order to grant an exception to fence height the following must
be shown by the project (Code Sec. 25.78.050 1-4):
1. that there are exceptional circumstances;
2, that there is no public hazard;
3. that neighboring properties will not be materially damaged;
and
4. that the regulations cause unnecessary hardship upon the
petitioner.
Studx uestions
The Planning Commission reviewed this item at study on June 26,
1989 and asked several questions (Planning Commission Minutes, June
26, 1989). The adjacent lot and lot where the project is are level
with one another. The existing fence is well weathered. Staff is
continuing to try to reach the applicant to discuss findings.
PlanninQ Commission Action
The Planning Commission should hold a public hearing. Affirmative
action should include findings. The reasons for any action should
be clearly stated. At the public hearing the following condition
should be considered:
