FL 33948. nroperty owner: WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on July 14, 1997, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and a Categorical Exemption per Article 19, Section: 15303 - Class 1- the operation repair, maintenance, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical fea.tures, involving negligible or no expansion of use beyond that previously existing including but not limited to (a) interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances is hereby approved. Said special permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such special permits are as set forth in the minutes and recording of said meeting. A special permit is also requested for one new skylight and two windows within 10'-0" of the property line located at 219 Bloomfield Road, zoned R-1 (CS 25.60.010(I), (j), & (m)). Applicant: Lenore Montgomery APN: 029-252-110 Architect/Designer: John Burrows Lot Area: 7,500 SF (50' x 150') General Plan: Low density residential Zoning: R-1 Adjacent Development: Single family residential CEQA Status: Article 19. Categorically Exempt per Section: 15303 - Class 1- the operation repair, maintenance, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that previously existing including but not limited to (a) interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances. Summary: The applicant is requesting three special permits for the remodel of an existing rear yard accessory structure (560 SF) which will be used as a recreation room which contains a bath and toilet and which has a skylight and windows within 10'-0" of the property line located at 219 Bloomfield Road, zoned R-1. The existing accessory structure (once used as a detached garage) measures 20'-0" wide and 28'-0" long (exterior dimensions), 560 SF. The existing lot coverage is 40.8 %(3,063 SF) and is not proposed to change. The existing detached accessory structure contains a full bath (shower, toilet and sink) and the interior is heated. The existing structure also contains windows within 3'-0" of the property line. The applicant is proposing to remodel the existing structure and bring the structure into compliance with the California Building Code by updating the existing electrical and plumbing service and by removing all of the existing windows on the north side elevation (which are not permitted because they are within 3'-0" of the property line). The existing bath area will be remodeled and will contain a bathtub, toilet and sink. The applicant has stated that she will use the structure as a"multi-purpose" room (office, study, hobby room, family room, or workshop). The applicant indicated that she does not intend to use the room for a home occupation, but rather as a home office for personal business. The following windows and skylights are within 10'-0" of the property line and need special permits: 1) one new skylight which measures 4-0" from the side property line; 2) one new window installed on the front elevation located 2'-0" from the right side property line (perpendicular to the side property line); and 3) an existing window and door located on the south elevation 1'-6" from the rear property line (perpendicular to the rear property line). A special permit is also required for accessory structure with a bath and toilet to be used for recreation purposes. The existing accessory structure once served as covered parking for the residence (in addition to the attached covered parking) and is located within the rear 30% of the lot and sits 0'-1" from the rear Special Permits for an Accessory Structure 219 Bloomfield Road property line and 1'-2" from the right side property line. At the time of original construction a two caz garage was added to the house. All parking requirements are met on the site. A one story accessory structure within 30% of the length of the lot line is exempt from rear and side yard setback requirements. The roof of the structure has a pitched roof on two sides and the plate height is 8'-1" (8'- 0" allowed with a 6" foundation). The height of the existing structure is 12'-2" measured from the adjacent natural grade (14'-0" allowed). The accessory structure is located 4'-8" from the main residence (4'-0" minimum separation required). The existing attached gazage measures 20'-6"W x 28'- 0" and by City Code definition (CS 25.70.030(ld)) it provides two off street parking spaces. One uncovered parking space is provided in the driveway which measures a minimum of 9'-0" x 20'-0". Discontinuing the parking use in the detached garage will not impact parking requirements for the site (the maximum number of parking spaces which must be provided for new construction or if the residence increases in size in the future is two covered parking spaces and one uncovered parking space) . History: The residence at 219 Bloomfield was constructed with one attached (20'-6" x 28'-0") and one detached garage (20'-0" x 28'-0") which was documented by the County Assessor in 1956. The applicant is proposing to use the existing detached garage as a"multi-purpose" room. The 1956 assessment records indicate that the detached garage had a concrete floor, stucco exterior, wood shingle roof and an overhead garage door. All other zoning requirements have been met. 2 Special Pernuts for an Accessory Structure 219 Bloomfield Road Staff Comments: The Chief Building Official reviewed this application and in his 7une 2, 1997 memo he addressed the following items: 1. No openings aze permitted on the north wall; � 2. The north wall must be of one-hour fire resistive construction; 3. Roof drainage must be collected and directed away from adjacent properties; 4. Skylights must be a minimum of 3'-0" from adjacent property lines; 5. Is this a heated space? (Note gas line serving unit); 6. If space is conditioned, the building must meet current state energy standards; and 7 Verify that moisture barrier exists under slab. The Fire Marshall reviewed the plans and indicated in his June 2, 1997 memo that openings (parallel to the property line) are not permitted within 3'-0" of the property line and that walls within the setback minimums to the property line must be a minimum of one-hour construction. The Senior Engineer indicated in his June 2, 1997 memo that the roof water must be drained to the street front. Planning staff would note that the applicant has indicated that the Commissioners are welcome to inspect the interior of the proposed multi-purpose room. She will leave the structure unlocked between the hours of 8:00 a. m. and 8:00 p. m. (see attached letter). This application was to allow you to improve an existing rear accessory structure (560 SF) to be usetl as a recreation purposes with a sink and toilet and have one window within 10'-0" of the property line located at 219 Bloomfield Road, zoned R-1. The 7uly 14, 1997 minutes of the Planning Commission state your application was approved with the following conditions: 1. that the project shall be built as shown on the revised plans submitted to the Planning Department date stamped June 27, 1997, sheet 1(plot and roof plan), sheet 2(floor plan), and sheet 3(exterior elevations); 2. that the conditions of the Chief Building Official, Fire Marshal, and Senior Engineer's 7une 2, 1997 memos shall be met; 3. that the 560 SF accessory structure shall be used as a multi-purpose room with a sink and toilet and the accessory structure shall not be expanded without another special permit; any change in use or facilities other than as a multi-purpose room shall require application to the Planning Commission for a special permit; 4. that there shall never be a kitchen area or cooking unit in the accessory structure; 5. that the accessory structure with full bath shall never be used, rented, or converted into a second dwelling unit; and 6. that the existing antennas on the accessory structure shall be removed; � �^��„�� t� .� 7. that the fiberglass canopy on the accessory structure and the fiberglass between the main structure and the accessory structure shall be removed; and 8. that the project shall meet all the requirements of the California building and Fire codes, 1995 edition, as amended by the City of Burlingame. All site improvements and construction work will require separate application to thE Building Department. This approval is valid for one year during which time a building permit must be issueri. One extension of up to one year may be considered by the Planning Commission if application is made before the end of the first year. The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.
