Applicant: Genesis Chen, Payless Car Rental Architect: Harvey Hacker Architects Property Owner: Howard Honerlah General Plan: Low Density Residential APN: 026-103-030 Lot Area: 33,105 SF Zoning: RR Environmental Review Status: The project is Categorically Exempt from review pursuant to the California Environmental Quality Act (CEQA), per Section 15301, which states that existing facilities, consisting of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination are exempt from environmental review. September 26, 2011, Regular Action Meeting: At the Planning Commission Regular Action Meeting on September 26, 2011, the Commission had many comments and concerns about the loading and off loading of vehicles in the street, the cleaning of vehicles on the site, the location of the awning and the congestion of cars parked along North Carolan Avenue, and voted to continue the application with direction to forward it to the Traffic, Safety and Parking Commission for recommendations on how to solve the traffic, parking and delivery issues discussed; and that prior to the application returning to the Planning Commission for review, it is expected that the applicant review the required setback regulations and a proposed alternative location for the awning so that a variance is not required (September 26, 2011 Planning Commission Minutes). After a discussion with the City's Transportation Engineer concerning the Planning Commissions request to forward the application to the Traffic, Safety and Parking Commission for recommendations, the Transportation Engineer decided that he would review the request and would make recommendations without forwarding it to the TSP Commission. He reviewed the applications, the site plan, the Planning Commission meeting minutes and made a site visit and wrote a memo with his recommendations to the Planning Commission on October 13, 2011. In summary, his memo indicates that due to the curve in Rollins Road adjacent to this property, he recommends that the restriction prohibiting loading and unloading of vehicles from commercial car carriers in the public right-of-way remain in place. After review of the Traffic Engineer's memo, the applicant submitted a response letter on November 2, 2011 that indicates that Payless Car Rental is no longer requesting to load and unload vehicles from car carriers within the public right-of-way and that they would like to keep the awning as it has been installed. No changes were made to the plans. Please refer to the copy of the September 26, 2011, Planning Commission minutes included in the staff report for the list of Planning Commission questions and comments. Project History: A Special Permit (later changed to a Conditional Use Permit) for a leasing facility for new automobiles and trucks was approved in 1971. In the original application the applicant estimated between 50-75 vehicles on-site, with between 15-20 employees. In 1983 an application was made to amend the original approval to include auto rental in conjunction with the approved auto leasing. This application was approved with the following conditions: 1. that the car rental fleet operated from this site be limited to a maximum of 30 vehicles and operated between the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday; 2. that no off-loading or on-loading of vehicles from trucks take place on the street or public right-of-way; 3. that no parking of leased or rental vehicles be allowed on-street at any time; and 4. that there be no maintenance or washing of vehicles on the site until the drainage facilities meet the requirements of the City Engineer. Conditional Use Permit Amendment and Variances 1409 Rollins Road On May 13, 2002, the Planning Commission approved an application for an increase in the rental fleet size to 60 vehicles, extended the hours of operation, and changed the operation to eliminate the auto leasing facility component of the original application. On November 5, 2010, the applicant, Payless Car Rental, submitted a letter to the Planning Division stating that they will comply with all of the conditions of approval for a car rental business as outlined in the approval letter from the Planning Division to Enterprise Rent-A-Car, dated May 21, 2002. Most recently, on February 14, 2011, the Planning Commission approved an application for a Conditional Use Permit Amendment in order to expand the hours of operation that were outlined in the conditions of approval from 2002 to be open 7 days a week from 6:00 am to 12:00 am. On March 25, 2011, the Code Compliance Office sent a letter to Payless Car Rental concerning complaints that were filed concerning the number of fleet vehicles stored on-site and concerning the off loading of vehicles from transport trucks on Rollins Road. Inspections were conducted by the Code Compliance Officer and by the Police Department and it was noted on several occasions that more than the allowed 60 fleet vehicles were being stored on the property (on March 23, 2011 there were 121 vehicles stored on site). On June 16, 2011, the City Attorney sent a letter to Payless Car Rental that summarized all of the specific violations to the approved conditional use permit and that encouraged Payless Car Rental to seek alternatives to assist them with compliance to the use permit in order to avoid revocation of the use permit for their business at 1409 Rollins Road. On June 30, 2011, Genesis Chen, of Payless Car Rental, submitted an application for a Conditional Use Permit Amendment at 1409 Rollins Road in order to bring his business operation into compliance with the number of cars stored on the site and with regards to the loading and unloading of vehicles on Rollins Road. The Planning Division scheduled this item on the Regular Action Calendar at the August 8, 2011, Planning Commission Agenda. On August 4, 2011, the Planning Division received information concerning the installation of a new 19' x 37' awning on the site which was not reviewed by the Planning Division prior to issuance of a building permit and which does not comply with applicabie zoning code regulations. Other items that were brought to the attention of the Planning Division upon a drive-by inspection of the property by staff included potential washing of the fleet vehicles under the newly completed awning and potentially an increased amount of impervious surface area at the rear of the lot due to recent repaving of the property. Based off of the additional code compliance issues detailed above, the Planning Division sent a letter to the project applicant detailing the information received and indicating that they would request that the Planning Commission delay consideration of the application for an Amendment to a Conditional Use Permit. The Planning Commission continued the item at theirAugust 8, 2011 Meeting to a date uncertain. On September 2, 2011, the applicant, Genesis Chen, submitted Variances for the as-built awning and submitted additional information concerning the work preformed under the awning, the off-site washing of all vehicles and the amount of paved area on the property. Project Description: The applicant, Payless Car Rental, is now requesting a Conditional Use Permit Amendment to increase the number of allowed fleet vehicles on-site from 60 to 90 and is also requesting Front and Side Setback Variances for a newly constructed awning at 1409 Rollins Road. Conditions # 4, 5 and 8, indicated a total of 60 fleet vehicles maximum to be stored on site and the applicant wishes to change all of those conditions to allow for 90 fleet vehicles maximum. On May 27, 2011, the Building Division issued a permit for a new 21' x 37'-22" awning along the right side of the building, although this permit was never routed to the Planning Division for their review and approval. This awning was finaled by the Building Division on June 20, 2011. When information about this awning was received by Planning Staff on August 4, 2011, it was noted that the newly constructed awning did not comply with either the front or side setback regulations; and that in order for the applicant to keep the awning as -2- Conditional Use Permit Amendment and Variances 1409 Rollins Road installed, Variances would need to be approved by the Planning Commission. The applicant submitted an application for both a Front Setback Variance (15'-10", as-built, to awning, where 20'-0" is the minimum required) and a Side Setback Variance (2'-10", as-built, to awning, where 10'-0" is the minimum required) (CS 25.44.075 c) to the Planning Division on September 2, 2011. The applicant is proposing no other changes to any of the conditions of approval. The amount of landscaping on site will remain the same as the previous use. There are no interior alterations proposed as part of this project. All other Zoning Code requirements have been met. Findings for a Conditional Use Permit Amendment: In order to grant a Conditional Use Permit Amendment, the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020, a-c): (a) The proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or convenience; -3- Conditional Use Permit Amendment and Variances 1409 Rollins Road (b) The proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) The planning commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Required Findings for Variance: In order to grant a variance the Planning Commission must find that the following conditions exist on the property (Code Section 25.54.020 a-d): (a) there are exceptional or extraordinary circumstances or conditions applicable to the property involved that do not apply generally to property in the same district; (b) the granting of the application is necessary for the preservation and enjoyment of a substantial property right of the applicant, and to prevent unreasonable property loss or unnecessary hardship; (c) the granting of the application will not be detrimental or injurious to property or improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or convenience; and (d) that the use of the property will be compatible with the aesthetics, mass, bulk and character of existing an potential uses of properties in the general vicinity. Planning Commission Action: The Planning Commission should conduct a public hearing on the application, and consider public testimony and the analysis contained within the staff report. Action should include specific findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any action should be stated clearly for the record. At the public hearing the following conditions should be considered: that the project shall be built and the site shall be configured as shown on the plans submitted to the Planning Department and date stamped May 3, 2002, site plan and floor plan; and amended, date stamped September 2, 2011, Site Plan, and date stamped January 28, 2011, Floor Plan; 2. that the existing 1,830 SF of landscaping on-site (5.5%) shall be retained, automatic irrigation shall be installed and it shall be maintained by the tenant regularly on a weekly basis; 3. that the car renta� business shall have regular business hours from 6:00 a.m. to 12:00 a.m. seven days a week; 4. that the car rental fleet operated from this site shall be limed to a maximum of 68 90 vehicles; all fleet vehicles, employee and customers shall park on-site at 1409 Rollins Road; there shall be no parking of fleet vehicles along Rollins Road or North Carolan; 5. that no off-loading or on-loading of vehicles from trucks shall take place on the public street or on any public right-of-way; 6. that the applicant shall stripe the parking area on-site to accommodate all 69 90 rental fleet vehicles as well as the 9 required parking spaces for the office and customer parking; and no employee or fleet vehicles shall ever be parked on the public right-of-way or across the public sidewalks; 7. that there shall be no maintenance or washing of vehicles on the site unless approved by the City Engineer; 8. that any on-site car-washing facility approved in the future by the City Engineer shall be equipped with a -4- Conditional Use Permit Amendment and Variances 1409 Rollins Road sand/oil separator; and shall not encroach upon the on-site storage area for the 69 90 fleet vehicles or employee or visitor/customer parking, or required landscaping or on on-site area used for loading or off- loading rental vehicles; 9. that if the structure is demolished or the envelope changed at a later date the Front and Side Setback Variances, as well as any other exceptions to the code granted here will become void; 10. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2010 Edition, as amended by the City of Burlingame; 11. that the conditions of the City Engineer's memo of February 11, 2002 shall be met; and 12. that crushed aggregate between 3/8" and 3/4" shall be laid over the existing dirt/gravel area at the rear of the lot to address NPDES concerns and to allow stormwater filtration. Thank you very much for the help of the traffic study for 1409 Rollins Road CUP amendment. Due to the geography the S curve of the safety concern, we respect the professional opinions. We agree not to pursue the commercial carrier vehicles loading and unloading on the public street on 1409 Rollins. Regarding the awning variance request on 1409 Rollins, we stiil hope that the Commission can consider this is work side safety improvement. Since the awning had been built, we would like to keep the awning in the same place and same structure. For the new application for acquiring the use permit for 1616 Rollins road, we like to request the Commission to remove the car carrier vehicles delivery restriction. 1616 Rollins road has no road deflection issue. 1616 Rollins road is in straight section with long sight visibility. The property is big enough to accommodate the commercial carrier loading and unloading vehicles. We like to request the carrier truck can do vehicles loading and unloading on site and on the street. We sincerely request that the Commission can consider our application and grant the amendment to the existing conditional use permits on 1409 Rollins and 1616 Rollins. Regarding the matter of prohibiting loading/unloading vehicles from commercial car carriers onto Rollins Road, it is recommended that the restriction remain in place for the following reasons: • This portion of Rollins Road has a significant horizontal road deflection ("S" curve) relative to the rest of the roadway. • This deflection, or curve, is in close proximity to 1409 Rollins Road. Whereas, the remainder of Rollins Road is relatively straight with long sight visibility. • There may be a high potential for collisions between southbound traffic and vehicles loading and unloading, via car carrier near the curve. • The curve and the business is also located immediately north of the Public Works Corporation Yard and Fire Station #36. While the fire station is no longer operational, Central Fire continues to use the facility to store fire vehicles. With the likelihood of heavy vehicles still exiting onto Rollins Road from both the Corp Yard and fire station, the potential for collisions is also high. Associate Planner Strohmeier presented the report, reviewed criteria and staff comments. Twelve (12) conditions were suggested for consideration. Questions of staff: ■ Was a traffic study conducted in the past to address safety concerns which resulted in the conditions of approval to prohibit unloading and loading vehicles on the public street? (Strohmeier- did not find any reference in the file to support this condition.) ■ Did staff visit the site to confirm car washing activities? (Strohmeier — the Chief Building Official visited the site and observed buckets used to clean windshields under the awning. Applicant provided receipts which document that vehicles are washed at a nearby car wash facility a corner of Broadway and Rollins Road.) ■ Do we know if there are other businesses on Rollins Road that are allowed to off-load on Rollins Road? (Strohmeier — other businesses in the area do use the public street to load and off-load goods, however loading and off-loading for those businesses is not limited because they are permitted uses which did not require a conditional use permit.) ■ The applicant applied for a building permit to install the awning but it was never routed to the Planning Division for review? As far as the applicant knew the awning was approved and legal since a building permit was issued. (Strohmeier— yes, that is correct. The applicant was informed that the awning did not comply with setback requirements after the awning was finaled.) Chair Yie opened the public hearing. Genesis Chen and Ron Barloff, 1409 Rollins Road, Burlingame; represented the applicant. Awning is needed for proper shelter for employees to clean vehicles outdoors; for protection of employees from sunlight and bad weather. Wasn't aware that awning was not reviewed by Planning Division. Property is large enough to accommodate 90 vehicles. Many customers arrive at same time to rent vehicles, need more vehicles to accommodate customers. Commission comments: ■ When staff spot checked the site there were 121 vehicles, so how can 90 vehicles be sufficient to support your business? (Chen — moved business from San Bruno to Burlingame and used the Rollins Road site for all of the vehicle parking. At that time had many new cars coming in without license plates, had to store cars until license plates were received.) ■ If unloading and loading of vehicles on the public street is denied, how would the business be affected? (Chen - unloading and loading would occur off-site at other locations and vehicle delivery process would change.) ■ Please describe cleaning of vehicles at this site. (Chen — when rental vehicles are returned, the interior is vacuumed and windows are cleaned in awning area, there is no washing of vehicles at this site, cars are washed at Valero gas station nearby.) ■ Why can't vehicle unloading occur on-site? (Chen — for safety reasons, to avoid conflict befinreen the truck and customers.) 11 CITY OF BURLINGAME PLANNING COMMISSION — Unapproved Minutes September 26, 2011 ■ Does this business require a conditional use permit because of its location on Rollins Road? (Strohmeier — a conditional use permit is required for rental car companies in this zoning district). • Don't think iYs safe to have truck off-loading on Rollins Road. ■ Concerned that applicant is asking to park more vehicles on site to accommodate fleet and as a result there is not enough room on-site to safely off-load vehicles; if there only 60 vehicles on-site then it would be more likely to safely off-load vehicles on-site away from the customers (Barloff — loading and unloading does not occur on a daily basis, it's seasonal and occurs when new fleet comes in and old fleet is taken off the inventory. Currently, rental car companies are reducing the fleet since the season is over; fleet will increase in February and March.) ■ Is there a way to restrict when fleet is increased and decreased? (Barloff — yes, this can be controlled.) ■ This lot may not be big enough for this business. ■ Unfortunate that awning was not routed to the Planning Division, but it doesn't mean that it is any more legal or allowable. ■ Why couldn't awning be built elsewhere on property to comply with setbacks so that a variance is not required? To put it elsewhere on the property means taking up more vehicle space. What is hardship on the property for granting a variance? ■ For this site to operate the way the applicant needs it to operation, the applicant is saying that he needs to intensify the use, but it is creating an impact on the neighbors. (Barloff - reason for increase is to accommodate vehicles coming in at different times of day and year, want to create a cushion just in case there are not enough employees on site to move vehicles; want to rent cars out, goal is not to keep cars on site; business is open longer hours which means customers are coming to the site at different times and business needs accommodate that.) ■ Don't have an issue with on occasion having 90 vehicles on-site, however concern is that more vehicles on the premise prohibits unloading of cars on site occasionally and places the awning in a location that requires a variance. (Barloff — will make other arrangements to unload vehicles. However, requesting that the Commission grant approval of 30 more vehicles on-site to safely and efficiently run business.) Conditional of approval prohibiting the loading and unloading of vehicles on the public street should remain. ■ Still need to evaluate setback variances for awning, what is exceptional circumstance? (Barloff — Enterprise Rent-A-Car previously had an outlet at the front corner of the building where the awning is; can't place it where the customers are and can't place it where the disabled-accessible spaces are located, best location on property is away from consumers and vehicles; this area was not previously covered because Enterprise was only open until 5 pm, Payless is open until 10 pm.) ■ Concerned that vacuum noise will impact adjacent property. (Barloff —awning helps to keep the noise down.) ■ What happens to returned rental cars that are damaged? (Barloff — damaged vehicles are picked up by a body shop for repairs.) Is that body shop located at 1379 N. Carolan Avenue? Saw 11 damaged vehicles on North Carolan, are they from Payless? Concerned that public street is being used to store damaged vehicles. (Barloff - no, Payless is not affiliated with that body shop in any way, believe that body shop provides repair services for other rental car companies.) ■ Concerned with vacuum noise, this is the reason for having setbacks; not convinced that awning is necessary; think there are other alternative locations on the lot. ■ Cannot support unloading or loading of vehicles on Rollins Road or Carolan Avenue; don't think this is the right lot size for this business. ■ Don't see a problem with unloading and loading of vehicles on Rollins Road since this is an industrial area, doesn't impact neighborhood. ■ North Carolan Avenue is severely impacted; concerned with increasing intensity of business. ■ Perhaps application should be referred to the Traffic, Safety & Parking Commission (TSP) for review and recommendation regarding impacts from this business on North Carolan Avenue. 12 CITY OF BURLINGAME PLANNING COMMISSION — Unapproved Minutes September 26, 2091 Public comments: None. Here are the reasons we sincerely request that the commission grant us the variance. 1. The size of awning #2 is 37 feet and 1%z inches in length and 21 feet and 0 inches in width. This awning cannot be accessed from the public area; it's only accessible to Payless employees. The building department already has approved this awning's size and structure. There is no public safety issue to the customers. This is the area Payless uses to clean and vacuum return rental vehicles. Awning protects our employees from the harm of the weather when they are working to clean the vehicles. As an employer, Payless has obligations to improve the work environment and provide shelter to the employees when they work outside of the building. As you are quite aware of the weather conditions in San Francisco; in the summer, there is strong sunlight and in the winter, it is cold and rains all the time. Studies have confirmed that for people who work under the Sun for a long period of time, they tend to have much higher risk of getting skin cancer. The attached article shows that the UV ultraviolet radiation's damage can result in: sunburn, increased rate of aging of the skin, and even skin cancer. Also, for those who work in the rain, they tend to have higher risk of getting sick and even pneumonia. For health and safety reasons, we sincerely request that you grant us the variance to keep the current size and structure of the awning in the same location. 3. Attached are the two satellite pictures showing the before and after images of the lot pavement. eecause we have cleaned up the dirt which covered the old pavement before, consequently, it looks like the total area of new pavement has been increased. Payless absolutely has not increased the pavement area. The lights in the back awning area have been removed after we checked with the Burlingame Building Department. Payless will follow the process to obtain a permit for the lights in the awning area. After we received the warning from the city of the violation on the Conditional Use Permit, we have been seeking all viable solutions to fix the problems to comply with the CUP permit. We have changed our vehicles delivery process; Rollins Office is no longer receiving new vehicles from trucking companies. In addition, we have been working with our realtor to acquire an overflow parking lot for our unused fleet vehicles. Since the very first day that we used this property, we have always purchased bulk of tokens to car wash our fleet vehicles. There is no car wash activity on this property. We are currently employing more than 25 people and provide them with stable jobs and steady income. And if we are able to increase our business, we can hire more people to help the economy of the community. We would like to apologize for any problems or inconveniences that we might have caused due to the fact that we are new to the community. The staffs of the Planning Department can be our witnesses that we are sincere and have acted very quickly and responsively to address any complaints we have received. The request for increasing the number of vehicles allowed on-site is to increase the buffer time for our employees to be able to move cars. From the site plan, you can see that this property is big enough to accommodate the on-site number of vehicles we have requested. How can I reduce the risk of skin cancer from sunliaht? Does sunlight cause skin cancer? There is convincing evidence that sunlight causes skin cancer. Skin cancer can be treated and cured without serious consequences. However, in some cases the condition can be life-threatening if not diagnosed in time. Skin cancer is an occupational concern for people who work under the sun. The risk however, may be reduced through awareness of the problem, and by taking measures to prevent exposure to sunlight. Are there different types of radiation in sunlight? Yes. The types of radiation include • visible light, which gives us the colours we see • infrared radiation which gives us the warmth we feel • ultraviolet (UV) radiation Except in extreme situations, neither visible light nor infrared radiation from sunlight causes health problems. However, ultraviolet (UV) radiation can cause harmful effects to the skin. There are three basic types of ultraviolet radiation: • UVA (long-wave UV) • UVB (sunburn UV) • UVC (short-wave UV) Table 1 summarizes the general features of each type. When ultraviolet radiation reaches the skin, some radiation is reflected away from the surface. The remaining radiation is scattered into the tissues just beneath the skin's surface. A fraction of this radiation is absorbed by the skin's living cells. Ultraviolet radiation absorbed by living cells damages sensitive substances that influence the skin's nom�al growth and appearance. Damage can result in: • sunbum • increased rate of aging of the skin • skin cancer Sunburn Sunburn is the most familiar and immediate effect of ultraviolet radiation on the skin. It is an inflarmiation caused by an increase in blood-flow beneath the skin. The reaction is not normally instantaneous, but reaches a bright red colour within 15 to 20 hours. The condition can be very painful and sometimes causes peeling of the skin. Brief intense exposure can cause severe sunbum in people who are not accustomed to strong sunlight. There is evidence that this type of exposure, as well as long-term exposures, might be linked to serious forms of skin cancer later in life. Increased Rate of Aging of the Skin Repeated exposure to the sun's ultraviolet radiation eventually causes skin damage similar to the aging process. Patches of skin become thin and less elastic, and develop blemishes, sun freckles, and wrinkles. These changes may take many years of exposure but when they occur, the damage is irreversible. Skin Cancer If exposure to sunlight continues for several years, the damaged skin has an increased chance of developing one of the forms of skin cancer. Exposure to ultraviolet radiation increases the risk of developing these cancers (although it may not be the only cause of the disease). While the exact relationship is not 100% defined, it appears that intermittent (occasional) exposure and exposure during childhood and adolescence are likely important predictors for basal cell carcinoma, and cutaneous malignant melanoma. High levels of chronic exposure, such as working outdoors, is more often associated with squamous cell tumours. The following facts also link sunlight exposure to skin cancer: • Most skin cancer occurs in areas of skin most heavily exposed to sunlight (ears� � F N� S �R< t� :� forehead, arms, etc). � � ` '�-' 6 -°° • Skin cancer among people who are sensitive to sunlight is more common in regions SEP - 2 2011 CI1�Y O� BURLIV ;F,r�"� CD�-P!ANNI,�dG D3V. � _ �i with stronger sunlight. • People with genetic diseases that make them more sensitive to sunlight have a greater chance of developing skin cancer. • Studies show that ultraviolet radiation similar to sunlight causes skin cancer in animals. What types of skin cancer are linked to sunlight exposure? Three different types of skin cancer are linked to sunlight exposure: • basal cell cancer • squamous cell cancer • malignant melanoma Basal Cell Cancer Basal cell cancer is the most common of all cancers in North America and Europe. It is usually found in areas of the skin exposed to sunlight, but sometimes occurs in other areas as well. This type of skin cancer appears as a raised, hard, red or red-grey, pearly wound often found on the forehead, eyelids, cheeks, nose, and lips. Although there is always a chance it could become serious, basal cell cancer usually does not spread. Most cases are easily treated and cured. Squamous Cell Cancer Squamous cell cancer occurs most frequently on the skin exposed to sunlight over long periods of time. As such, this type of skin cancer tends to develop where maximum exposure to radiation occurs - forehead, cheeks, nose, lower lip, and tops of the ears. It also usually develops in areas where the skin has been damaged by the sun - areas with blemishes or sun freckles. The blemishes develop into rough, scaly patches with small areas of open wound that do not heal. They eventually grow into larger wounds with crusts. This type of cancer can be removed with a good chance of total cure, if caught in time. It is most dangerous if it occurs on mucous membranes such as on the lip. Malignant Melanoma Malignant melanoma, although rarer, is the most serious of the skin cancers. It often shows itself as a mole or pigment spot that begins to bleed, grow, or change its colour, shape or texture. It usually spreads if not treated in the early stage. The exact nature of the relationship between malignant melanoma and sun light is not completely clear. However, brief intense exposure (intermittent exposure) to strong sunlight appears to increase the risk of malignant melanoma in people who are not used to strong sunlight. If caught early, malignant melanoma can be treated and cured. If treatment is delayed, it is often fatal. What factors affect a person's risk? Four main factors influence the risk of skin cancer: �"" �--� ��, � � � � l;`�. Ultraviolet radiation from sunlight affects everybody's skin to some extent, but the skin's response varies widely from person to person. Peoples' sensitivity to the sun varies according to the amount of pigment in the skin and the skin's ability to tan. Ultraviolet radiation causes tanning in two different ways: by irruriediate tanning and by delayed tanning. Imrriediate tanning causes the skin to darken in response to UVA. This darkening begins during the period of exposure, but fades within a few hours or days. The amount of tanning increases according to the skin's natural darkness and previous amount of tanning. Delayed tanning occurs two to three days after exposure to either UVA or UVB. It lasts from several weeks to months, and is maintained by repeated exposure to sunlight. With delayed tanning, the skin increases its production and distribution of dark pigment. The skin also becomes thicker. These changes can follow sunbuming or develop gradually over a long period of repeated brief exposures to sunlight. Some people bum easily after the first hour of sun exposure following winter or any period away from the sun. Other people, especially those with dark skin, never burn. This difference in reaction makes it possible to classify skin into one of six different types (see Table 2). Heredity For reasons not completely understood, people with Celtic heritage (Irish, Scottish or Northem European) have increased risk of skin cancer from the sun. Genetic diseases that affect the skin can also increase the risk. For example, albinism, a genetic condition which prevents the production of normal skin pigments, makes the skin sensitive to ultraviolet light. Exposure to Chemicals Exposure to certain chemicals can increase the skin's sensitivity to ultraviolet light through a process called photosensitization. The risk of skin cancer from the sun generally follows the same pattern. Darker skinned people have lower risk of sun-induced skin cancer. The person most prone to skin cancer caused by sunlight tans poorly and suffers sunbum easily. Frequent and/or intense sunbum in children with fair skin and freckles has been linked to malignant melanoma later in life. (PAHs) • certain printing chemicais used in photosensitive printing processes • certain drugs and antibiotics such as tetracyclines, sulfonamides, thiazide diuretics, chlorpromazine, oral contraceptives • chemicals called psoralens found naturally in certain plants, fruits and vegetables Antibiotics must be taken intemally before the skin becomes sensitive to sunlight. (Check with your physician or pharmacist is you suspect abnormal or severe reaction to sun exposure after taking new medication.) However, simple skin contact with psoralens, which are found in figs, parsnips, citrus plants, or mouldy celery, can make the skin more susceptible to sunburns in some individuals. Experimental studies show that chemicals called "promoters" can increase the cancer- causing ability of ultraviolet radiation. On the other hand, ultraviolet radiation itself can act as a promoter. In particular, ultraviolet radiation (UVR) can increase the cancer-causing ability of chemicals from coal tar and pitch. Amount of Exposure to Sunlight The damaging effects of ultraviolet radiation accumulate over the years. In general, the risk of developing skin cancer increases with the amount of time spent under the sun and the intensity of radiation. The intensity of radiation varies according to the season of the year, time of day, geographic location (latitude), elevation above sea level, reflection from surfaces (e.g., white sand or concrete, water, snow), stratospheric ozone, clouds, and air pollution. Recent studies have focused on the effects of intermittent (short-term, occasional) sun exposure in comparison to chronic (long-term) exposure. It appears that the type of exposure may influence the type of cancer that develops. For example, intemiittent solar exposure may be an important factor leading to the onset of basal cell carcinoma of the skin. Childhood sun exposure may also play an important part in the development of these cancers later in adult life. The pattem for cutaneous melanoma is similar to that for basal cell carcinorr►a. In contrast, the relationship between squamous cell carcinoma and solar UVR appears to be quite different. For squamous cell tumours, high levels of chronic occupational sunlight exposure, especially in the 10 years prior to diagnosis, results in an elevated risk for this cancer in the highest exposure group. What is the UV Index? In order to address the growing concem by Canadians regarding changes in UVR resulting from ozone depletion, Environment Canada rates the UV intensity as UV Index on a scale of 0(when there is no sunlight) to 11+ (extreme). It can go to the mid-teens at midday in the tropics. In Canada the UV Index is categorized into low (2 or less), moderate (between 3 and 5), high (between 6 and 7), very high (between 8 and 10) and extreme (greater than 11). The human health effects and precautions relating to the UV Index are summarized in the following table. However, the UV Index can reach 14 or more in the tropics and southern U.S. • Take full precautions. Unprotected skin will be damaged and can burn in minutes. All outdoor workers potentially exposed to the sun's ultraviolet radiation are at risk, including: • agricultural workers • fam�ers • horticultural workers • maintenance workers • pipeline workers • ranchers • athletes ��1 V' 1�(,� ' - 2 2011 CUU-PLqNNING DIV.E • fishermen • landscapers • military personnel • police • ski instructors • brick masons • gardeners • lifeguards • oilfield workers • postal carriers • sailors • construction workers • greenskeepers • loggers • open-pit miners • railroad track workers • surveyors How can I reduce the risk of skin cancer from sunlight? Skin cancer is the result of decades of exposure to the sun. It is important to be aware of the risks and take precautions while under the sun from as early in life as possible. Approaches to prevent skin cancer include: • reducing exposure to sunlight • wearing protective clothing • using sunscreens on exposed skin • examining the skin regularly for suspicious spots In the winter time, it may be advisable to the above precautions when exposed to sun for prolonged periods, especially in the presence of snow or at high altitudes. Reducing Exposure Workers should avoid unnecessary exposure to the sun, especially to the intense midday rays between 11:00 a.m. and 4:00 p.m. during the summer. If possible, people should plan outdoor work for early morning or late afternoon, and work in the shade as much as possible. Umbrellas, buildings, trees, canopies, etc., can protect against the direct rays from the sun. Work, and take breaks in the shade when ever possible. Set up shade structures when shade is not available. In addition, water, white sand or concrete, snow, and ice can reflect from around 10 percent to 85 percent of the sun's ultraviolet radiation. Skin may require extra protection against these indirect, reflected rays. Workplaces can also rotate workers between site locations to help reduce UV exposure. Wearing Protective Clothing and Sunglasses The use of wide brim hats and clothes made from close-knit fabric can protect the skin and scalp from ultraviolet radiation. Although long-sleeved shirts and long-legged pants may not be comfortable in extremely hot weather, they do help protect the skin. Not all clothing offers the same protection. For example, a white cotton T-shirt may have an SPF of 7 while a long-sleaved denim shirt has an estimated SPF of 1700. And some fabrics like cotton lose about 50% of their SPF rating when they get wet. Workers should be informed about different fabric characteristics that effect the transmission of sunlight. Also wear wrap- around sunglasses that absorb UVA and UVB radiation. Most sunscreens are colourless, invisibie, and cosmetically acceptable provided they do not stain clothing or produce adverse skin reactions. Sunscreens should be used in addition to, not instead of, working in shade and wearing suitable clothing, hats, and sunglasses. Sunscreens are not intended to extend the exposure time to sunlight, but rather to reduce the effects of sunlight when people have to be in the sun. The level of protection depends greatly on how the sunscreen is applied. A wide variety of sunscreens are available. They all contain chemical ingredients that weaken (but do not eliminate) the effects of ultraviolet radiation. The most widely used protective chemicals are PABA (para-aminobenzoic acid) and closely related chemicals such as cinnamates, salicylates, benzophenones, or anthranilates. Some sunscreens contain only one of these protective chemicals while others may have two or rr►ore for greater reliability. Products such as baby oil, cocoa butter, or skin oils that do not have protective chemicals, do not protect against sunburn, skin aging, or skin cancer. Manufacturers label sunscreens with a sun protection factor (SPF). The higher the factor, the greater the protection from the sun. * SPF 15 sunscreen may absorb more than 92 percent of UVB radiation. * SPF 30 sunscreen may absorb 96.7 percent. * SPF 40 sunscreen may absorb 97.5 percent of UVB radiation. People with skin sensitive to sunlight should use a sunscreen with a high SPF. A sunscreen's effectiveness also depends upon its ability to withstand heat, humidity and sweat. Most sunscreens are not water-resistant and people need to reapply them after perspiring or getting wet. Sunscreens should be applied 20 minutes before going outdoors, and reapplied every two hours, or more often if perspiring. It is important to try a variety of different types of sunscreen to find out which one best suits a particular skin type and activity. The Canadian Dermatology Association recorrmends using sunscreen products with a minimum SPF 30 or higher (UVA and UVB protection). Use a broad spectrum lip balm with an SPF of 30 or higher as well. Examining Skin Regularly People who work under the sun should examine their skin regularly for any unusual changes. The danger signs include any wound, sore, or patch of skin that won't heal or constantly scales. Also examine for any growing lump, particularly if brown or bluish in colour. It is important to get medical care for anything that looks suspicious rather than wait until the problem becomes untreatable. Staff is asking the Commission to pull the item from the agenda because information was provided to the Planning Division yesterday that the recent installation of a new 19' x 37' awning on the site was not reviewed by the Planning Division prior to issuance of a building permit and that it does not comply with applicable zoning code regulations. Without dimensions provided on the plans that were submitted to the Building Division, it appears that the location of the awning requires consideration of a variance from the minimum required side-yard setback (0' proposed, where 10' is the minimum requirement per CS 25.44.075 c, 2) and potentially a variance from the required front-yard setback (20' front setback required per CS 25.44.075 b, 1). Please note that if you wish to keep the awning as it exists on the property, you will need to apply for these variances with the Planning Division; they can be processed concurrently with your request for a conditional use permit amendment. Since Payless has leased this property there have been many changes to the property including, more paved area than before, an awning to detail cars on the north side of the property with electrical lights mounted on the canvas with conduct that is not water tight. They have also had over a hundred cars on site most of the time even after they have been warned by code enforcement. They have unloaded cars on Rollins and North Caroline against the regulations set forth in their current Use Permit. The current owner has only had this Use permit since Feb. 25, 2011. He has had no regard for the restrictions that were part of that use permit. They have installed an awning over the front door and also on the North side of the property extending to the property line with electrical lights that from the sidewalk look to be not watertight. This area, from the pictures I have attached show this to be for detailing of the rented cars. They off load on the street because of the difficulty of driving the car carriers on site, so if you allow them to have 90 rental cars on site you will make it impossible to bring the car carriers on site and assure us they off load on the streets. When they off load on the street, it is very dangerous as you can not see when pulling out of driveways near the off loading to gain access to Rollins Road. When they off load on North Caroline they block the entire road.
