Applicant: Genesis Chen, Payless Car Rental Architect: Harvey Hacker Architects Property Owner: Howard Honerlah General Plan: Low Density Residential APN: 026-103-030 Lot Area: 33,105 SF Zoning: RR Environmental Review Status: The project is Categorically Exempt from review pursuant to the California Environmental Quality Act (CEQA), per Section 15301, which states that existing facilities, consisting of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment ortopographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination are exempt from environmental review. Project History: A Special Permit (later changed to a Conditional Use Permit) for a leasing facility for new automobiles and trucks was approved in 1971. In the original application the applicant estimated between 50-75 vehicles on-site, with between 15-20 employees. In 1983 an application was made to amend the original approval to include auto rental in conjunction with the approved auto leasing. This application was approved with the following conditions: 1. that the car rental fleet operated from this site be limited to a maximum of 30 vehicles and operated befinreen the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday; 2. that no off-loading or on-loading of vehicles from trucks take place on the street or public right-of-way; 3. that no parking of leased or rental vehicles be allowed on-street at any time; and 4. that there be no maintenance or washing of vehicles on the site until the drainage facilities meet the requirements of the City Engineer. On May 13, 2002, the Planning Commission approved an application for an increase in the rental fleet size to 60 vehicles, extended the hours of operation, and changed the operation to eliminate the auto leasing facility component of the original application. On November 5, 2010, the applicant, Payless Car Rental, submitted a letter to the Planning Division stating that they will comply with all of the conditions of approval for a car rental business as outlined in the approval letter from the Planning Division to Enterprise Rent-A-Car, dated May 21, 2002. Most recently, on February 14, 2011, the Planning Commission approved an application for a Conditional Use Permit Amendment in order to expand the hours of operation that were outlined in the conditions of approval from 2002 to be open 7 days a week from 6:00 am to 12:00 am. On March 25, 2011, the Code Compliance Office sent a letter to Payless Car Rental concerning complaints that were filed concerning the number of fleet vehicles stored on-site and concerning the off loading of vehicles from transport trucks on Rollins Road. Inspections were conducted bythe Code Compliance Officer and by the Police Department and it was noted on several occasions that more than the allowed 60 fleet vehicles were being stored on the property (on March 23, 2011 there were 121 vehicles stored on site). On June 16, 2011, the City Attorney sent a letter to Payless Car Rental that summarized all of the specific violations to the approved conditional use permit and that encouraged Payless Car Rental to seek alternatives to assist them with compliance to the use permit in order to avoid revocation of the use permit for their business at 1409 Rollins Road. On June 30, 2011, Genesis Chen, of Payless Car Rental, submitted an application for a Conditional Use Permit Conditional Use Permif Amendment 1409 Rollins Road Amendment at 1409 Rollins Road in order to bring his business operation into compliance with the number of cars stored on the site and with regards to the loading and unloading of vehicles on Rollins Road. Project Description: The applicant, Payless Car Rental, is requesting a Conditional Use PermitAmendmentto increase the number of allowed fleet vehicles on-site from 60 to 90 and to remove the condition of approval that restricts the on-loading and off-loading of vehicles from occurring within the public right-of-way at 1409 Rollins Road. Conditions # 4, 5 and 8, indicated a total of 60 fleet vehicles maximum to be stored on site and the applicant wishes to change all of those conditions to allow for 90 fleet vehicles maximum. Also, the auto rental business currently has a condition of approval that states that "no off-loading or on-loading of vehicles from trucks shall take place on the public street or on any public right-of-wa�'. The applicantwould like to remove this condition (Condition # 5) in order to be allowed to on-load and off-load their fleet vehicles along Rollins Road. The applicant is proposing no other changes to any of the conditions of approval. The amount of landscaping on site will remain the same as the previous use. There are no exterior or interior alterations proposed as part of this project. All other Zoning Code requirements have been met. Staff Comments: Planning Staff would note that because the applicant is only requesting an amendment to an existing Conditional Use Permit, the application was placed directly on the action calendar. If the Commission feels there is a need for more discussion, this item may be placed on a future action calendar for a second review and/or public hearing with direction to the applicant. See attached 2002 memo from the City Engineer. Findings for a Conditional Use Permit Amendment: In order to grant a Conditional Use Permit Amendment, the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020, a-c): (a) (b) The proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or convenience; The proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; Existing Automobile Rental Business a) 60 fleet vehicles b) Hours of operation 6 am to midnight (7 days a week)' -2- Conditional Use Permit Amendment 1409 Rollins Road (c) The planning commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planning Commission Action: The Planning Commission should conduct a public hearing on the application, and consider public testimony and the analysis contained within the staff report. Action should include specific findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any action should be stated clearly for the record. At the public hearing the following conditions should be considered: that the project shall be built and the site shall be configured as shown on the plans submitted to the Planning Department and date stamped May 3, 2002, site plan and floor plan; and amended, date stamped June 30, 2011, Site Plan, and date stamped January 28, 2011, Floor Plan; 2. that the existing 1,830 SF of landscaping on-site (5.5%) shall be retained, automatic irrigation shall be installed and it shall be maintained by the tenant regularly on a weekly basis; 3. that the car rental business shall have regular business hours from 6:00 a.m. to 12:00 a.m. seven days a week; 4. that the car rental fleet operated from this site shall be limed to a maximum of 69 90 vehicles; all fleet vehicles, employee and customers shall park on-site at 1409 Rollins Road; there shall be no parking of fleet vehicles along Rollins Road or North Carolan; ; 6. that the applicant shall stripe the parking area on-site to accommodate all 69 90 rental fleet vehicles as well as the 9 required parking spaces for the office and customer parking; and no employee or fleet vehicles shall ever be parked on the public right-of-way or across the public sidewalks; 7. that there shall be no maintenance or washing of vehicles on the site unless approved by the City Engineer; 8. that any on-site car-washing facility approved in the future by the City Engineer shall be equipped with a sand/oil separator; and shall not encroach upon the on-site storage area for the 68 90 fleet vehicles or employee or visitor/customer parking, or required landscaping or on on-site area used for loading or off- loading rental vehicles; 9. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2010 Edition, as amended by the City of Burlingame; 10. that the conditions of the City Engineer's memo of February 11, 2002 shall be met; and 11. that crushed aggregate between 3/8" and 3/<" shall be laid over the existing dirt/gravel area at the rear of the lot to address NPDES concerns and to allow stormwater filtration. We are aggressively seeking solutions to solve the violation problems and sincerely request that you consider amending the conditional use permit of 1409 Rollins Road. We would like to request that the maximum number of fleet vehicles parked on-site be increased from the current 60 to 90. The property area is about 33,105 SF (square feet). The building is about 3,000 SF which leaves the lot space without the building to be about 30,000 SF. The submitted site plan alone with application shows that the property has enough space to accommodate the parking for 9 allowed and required parking space for customers and employees also for 90 fleet vehicles and 12 reserve parking. Due to airplanes schedules, we will have customers arriving at or departing from the San Francisco Airport almost always at the same time, which means our rental customers tend to pick up or return vehicles all at the same time as well. That is the reason that often time vehicles on the lot rapidly increase to exceed the maximum allowed number in a short period of time. Although our service people constantly move vehicles out of the lot so that we would not exceed the maximum number allowed, sometimes it is just not feasible because of business conditions. For this reason, we would like to request the maximum allowed number be increased from current 60 to 90 vehicles so that we would have a bigger buffer to afford us more time to move vehicles to overflow lot. Currently we have overflow lot in San Bruno. We are also looking for additional lot near our 1409 Rollins office. The additional lot is in Edward Ct, Burlingame. We are in the process to sign the lease agreement with the land lord. Edward Ct. has big lot space. It is big enough to do the vehicles loading and unloading and overflow parking for unused vehicles. We would like to be a valuable member of the Burlingame community and to provide our car rental service to the public that will benefit everyone. Please consider our request and ultimately grant the amendment to the existing conditional use permit. RESOLUTION APPROVING CATEGORICAL EXEMPTION AND CONDITIONAL USE PERMIT AMENDMENT RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for Amendment to Conditional Use Permit for changes to a previously approved automobile rental business at 1409 Rollins Road, zoned RR. Howard Honerlah, 13190 Llagas Avenue, San Martin, CA 95046, property owner, APN: 026-103-030; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on Auqust 8. 2011, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section 15301, which states that existing facilities, consisting of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination are exempt from environmental review. 2. Said Conditional Use Permit Amendment is approved subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such Conditional Use Permit Amendment are set forth in the staff report, minutes, and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. Chairman I, , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 8th day of August, 2011 by the following vote: Secretary EXHIBIT "A" Conditions of approval for Categorical Exemption and Conditional Use Permit Amendment. 1409 Rollins Road Effective August 18, 2011 1. that the project shall be built and the site shall be configured as shown on the plans submitted to the Planning Department and date stamped May 3, 2002, site plan and floor plan; and amended, date stamped June 30, 2011, Site Plan, and date stamped January 28, 2011, Floor Plan; 2. that the existing 1,830 SF of landscaping on-site (5.5%) shall be retained, automatic irrigation shall be installed and it shall be maintained by the tenant regularly on a weekly basis; 3. that the car rental business shall have regular business hours from 6:00 a.m. to 12:00 a.m. seven days a week; 4. that the car rental fleet operated from this site shall be limed to a maximum of 90 vehicles; all fleet vehicles, employee and customers shall park on-site at 1409 Rollins Road; there shall be no parking of fleet vehicles along Rollins Road or North Carolan; 5. that the applicant shall stripe the parking area on-site to accommodate all 90 rental fleet vehicles as well as the 9 required parking spaces for the office and customer parking; and no employee or fleet vehicles shall ever be parked on the public right-of-way or across the public sidewalks; 6. that there shall be no maintenance or washing of vehicles on the site unless approved by the City Engineer; 7. that any on-site car-washing facility approved in the future by the City Engineer shall be equipped with a sand/oil separator; and shall not encroach upon the on-site storage area for the 90 fleet vehicles or employee or visitor/customer parking, or required landscaping or on on-site area used for loading or off-loading rental vehicles; 8. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2010 Edition, as amended by the City of Burlingame; 9. that the conditions of the City Engineer's memo of February 11, 2002 shall be met; and 10. that crushed aggregate between 3/8" and 3/4" shall be laid over the existing dirt/gravel area at the rear of the lot to address NPDES concerns and to allow stormwater filtration. .
