Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15301, which states that existing facilities, consisting of the
operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private
structures, facilities, mechanical equipment or topographical features, involving negligible or no expansion of use
beyond that existing at the time of the lead agency's determination are exempt from environmental review.
Project History: A Special Permit (later changed to a Conditional Use Permit) for a leasing facility for new
automobiles and trucks was approved in 1971. In the original application the applicant estimated between 50-75
vehicles on-site, with between 15-20 employees. In 1983 an application was made to amend the original
approval to include auto rental in conjunction with the approved auto leasing. This application was approved
with the following conditions:
1. that the car rental fleet operated from this site be limited to a maximum of 30 vehicles and operated
beiween the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday;
2. that no off-loading or on-loading of vehicles from trucks take place on the street or public right-of-way;
3. that no parking of leased or rental vehicles be allowed on-street at any time; and
4. that there be no maintenance or washing of vehicles on the site until the drainage facilities meet the
requirements of the City Engineer.
The most recent application for this site, approved by the Planning Commission on May 13, 2002, allowed for an
increase in the rental fleet size to 60 vehicles, extended the hours of operation, and changed the operation to
eliminate the auto leasing facility component of the original application.
On November 5, 2010, the applicant, Payless Car Rental, submitted a letter to the Planning Division stating that
they will comply with all of the conditions of approval for a car rental business as outlined in the approval letter
from the Planning Division to Enterprise Rent-A-Car, dated May 21, 2002. On January 28, 2011, the applicant
then submitted an application for a Conditional Use Permit Amendment in order to expand the hours of operation
that were outlined in the conditions of approval from 2002.
Project Description: The applicant, Payless Car Rental, is requesting a Conditional Use PermitAmendmentto
increase the hours of operation for replacement of an existing auto rental business with a new operator at 1409
Rollins Road. The auto rental business currently has a condition of approval that states that "the car rental
business shall have regular business hours from 7:30 a.m. to 6:00 p.m. Monday through Friday and Saturday
from 9:00 a.m. to 12:00 p.m., closed on Sunda�'. The applicant would like to amend the condition (Condition #
3) in order to have the auto rental business open on 7 days a week from 6:00 am to 12:00 am.
The applicant is proposing no other changes to any of the conditions of approval. The amount of landscaping,
and the number of parking spaces on site will remain the same as the previous use. There are no exterior or
interior alterations proposed as part of this project. All other Zoning Code requirements have been met. The
applicant is requesting the following application:

Staff Comments: Planning Staff would note that because the applicant is only requesting an amendment to the
hours of operation, the application was placed directly on the action calendar. If the Commission feels there is a
need for more discussion, this item may be placed on a future action calendar for a second review and/or public
hearing with direction to the applicant. See attached 2002 memo from the City Engineer.
Findings for a Conditional Use Permit Amendment: In order to grant a Conditional Use Permit Amendment,
the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020,
a-c):

The proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or
convenience;
The proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) The planning commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general
vicinity.
Planning Commission Action: The Planning Commission should conduct a public hearing on the application,
and consider public testimony and the analysis contained within the staff report. Action should include specific
findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning
Commission. The reasons for any action should be stated clearly for the record. At the public hearing the
following conditions should be considered:
that the project shall be built and the site shall be configured as shown on the plans submitted to the
Planning Department and date stamped May 3, 2002, site plan and floor plan; and amended, date
stamped January 28, 2011, site plan and floor plan;
2. that the existing 1,830 SF of landscaping on-site (5.5%) shall be retained, automatic irrigation shall be
installed and it shall be maintained by the tenant regularly on a weekly basis;

3. that the car rental business shall have regular business hours from 6:00 a.m. to 12:00 a.m. seven days a
week;
4. that the car rental fleet operated from this site shall be limed to a maximum of 60 vehicles; all fleet
vehicles, employee and customers shall park on-site at 1409 Rollins Road; there shall be no parking of
fleet vehicles along Rollins Road or North Carolan;
5. that no off-loading or on-loading of vehicles from trucks shall take place on the public street or on any
public right-of-way;
6. that the applicant shall stripe the parking area on-site to accommodate all 60 rental fleet vehicles as well
as the 9 required parking spaces for the office and customer parking; and no employee or fleet vehicles
shall ever be parked on the public right-of-way or across the public sidewalks;
7. that there shall be no maintenance or washing of vehicles on the site unless approved by the City
Engineer;
8. that any on-site car-washing facility approved in the future by the City Engineer shall be equipped with a
sand/oil separator; and shall not encroach upon the on-site storage area for the 60 fleet vehicles or
employee or visitor/customer parking, or required landscaping or on on-site area used for loading or off-
loading rental vehicles;
9. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2010
Edition, as amended by the City of Burlingame;
10. that the conditions of the City Engineer's memo of February 11, 2002 shall be met; and
11. that crushed aggregate between 3/8" and 3/4" shall be laid over the existing dirt/gravel area at the rear of
the lot to address NPDES concerns and to allow stormwater filtration.

NOCAL RENTALS, INC, dba Payless Car Rental is writing you to consider amending
the conditional use permit of 1409 Rollins Road.
We are requesting an"Hours of operation" change to 6am — midnight 7 days a week.
The current demand for rental cars from the inbound traveler coming from the airport, the
business or leisure traveler staying at a nearby hotel or the local community traveler
needing a rental unit, dictates the necessity for expanded hours of operation. We are
currently restricted to closing at 6pm Monday — Friday, noon on Saturday and closed on
Sunday.
Many of the surrounding business are open and doing business while we are closed. We
would like to be a valuable member of the Burlingame community and feel by making
our extended services available that this will benefit everyone.
Please consider our request and ultimately grant the amendment to the existing
Conditional Use Permit.

Since there was no appeal to or suspension by the City Council, the May 13, 2002 Planning Commission
approval of your application for a conditional use pernut amendment became effective May 20, 2002. This
application was for extending the hours of operation, increasing the rental fleet size, and having solely auto
rental, with no leasing at 1409 Rollins Road, zoned M-1.
The May 13, 2002 minutes of the Planning Commission state your application was approved with the following
conditions:

that the project shall be built and the site shall be configured as shown on the plans submitted to the
Planning Department and date stamped May 3, 2002, site plan and floor plan;
that the existing 1,830 SF of landscaping on-site (5.5%) shall be retained, automatic irri�ation shall be
installed and it shall be maintained by the tenant regularly on a weekly basis;
that the car rental business shall have regular business hours from 7:30 a.m. to 6:00 p.m. Monday
through Friday, and Saturday from 9:00 a.m. to 12:00 p.m., closed on Sunday;
4) that the car rental fleet operated from this site shall be limed to a maximum of 60 vehicles; all fleet
vehicles, employee and customers shall park on-site at 1409 Rollins Road; there shall be no parking of
fleet vehicles along Rollins Road or North Carolan;
5) that no off-loading or on-loading of vehicles from trucks shall take place on the public street or on any
public right-of-way;
6) that the applicant shall stripe the parking area on-site to accommodate a1160 rental fleet vehicles as well
as the 9 required parking spaces for the office and customer parking; and no employee or fleet vehicles
shall ever be parked on the public right-of-way or across the public sidewalks;
7) that there shall be no maintenance or washing of vehicles on the site unless approved by the City
Engineer;
8) that any on-site car-washing facility approved in the future by the City Engineer shall be equipped with
a sand/oil separator; and shall not encroach upon the on-site storage area for the 60 fleet vehicles or
employee or visitor/customer parking, or required landscaping or on on-site area used for loading or off-
loading rental vehicles;
9) that any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition as
amended by the City of Burlingame;
10) that the conditions of the City Engineer's memo of February 11, 2002 shall be met; and
11) that crushed aggregate between 3�g" and 3/4" shall be laid over the existing dirt/gravel area at the rear of
the lot to address NPDES concerns and to allow stormwater filtration.
All site improveine:.=� and construction work will require separate application to the Building Department. This
approval is valid for one year during which time a building permit must be issued. One extension of up to one
year may be considered by the Plarming Commission if application is made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days
of the date of the decision unless a shorter time is required pursuant to state or federal law.

RESOLUTION APPROVING CATEGORICAL EXEMPTION AND
CONDITIONAL USE PERMIT AMENDMENT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for
Conditional Use Permit Amendment to increase the hours of operation for replacement of an
existinq auto rental business with a new operator at 1409 Rollins Road, zoned RR, Howard
Honerlah, 13190 Llagas Avenue, San Martin, CA 95046, property owner, APN: 026-103-030;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
February 14, 2011, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is
no substantial evidence that the project set forth above will have a significant effect on
the environment, and categorical exemption, per CEQA Article 19, Section 15301, which
states that existing facilities, consisting of the operation, repair, maintenance, permitting,
leasing, licensing or minor alteration of existing public or private structures, facilities,
mechanical equipment or topographical features, involving negligible or no expansion of
use beyond that existing at the time of the lead agency's determination are exempt from
environmental review.
2. Said Conditional Use Permit Amendment is approved subject to the conditions set forth
in Exhibit "A" attached hereto. Findings for such Conditional Use Permit Amendment are
set forth in the staff report, minutes, and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.
