History: The applicants are proposing to amend a previously approved couditional use pei-�1iit for an auto r�ntal
business at 1409 Rollins Road, zoned M-1. A special pennit for a leasing facility for new automobi les ancl trucics
was approved in 1971. In the original application the applicant estimated between 50-75 vehicles on-site, �vith
between 15-20 employees. In 1983 an application was made to amend the original approval to include auto rental
in conjunction with the approved auto leasing. This application was approved with the following conditions:
1) that the car rental fleet operated from this site be limited to a maximum of 3U vehicles and
operated between the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday;

that no off-loading or on-loading of vehicles fi-om trucks take place on the street or public ri�ht-
of-way;
that no parking of leased or rental vehicles be allowed on-street at any time; and
that there be no maintenance or washing of vehicles on the site until the drainage facilitics meet
the requireinents of the City Engineer.
Request: The applicant, Enterprise Rent-a-Car, is seeking 1) to extend the approved hours of operation to 7: �0
a.m. to 6:00 p.m. Monday through Friday and Saturday 9:00 a.m. to 12:00 p.in.; 2) to increasc tlie reiital fleet
fronl 30 to 60 vehicles; and 3) to have auto rental only, no leasing on the site.
The building envelope would not increase with this proposal and there are no site improvements proposed. The
applicant has obtained tenant improveme�lt perniits for interior rcinodel of the building as well as re-roofing. Tlle
former rental car facility on this site was Hyatt Rent-a-Car. Enterprise Rent-a-Car has officially occupied the site
for business operations since October. Enterprise has two other Burlingame locations at 1008 Carolan f�venue
and 821 Malcolm Road. The Carolan Avemie site serves the residential and auto dealers, while the Malcolm

Road site serves hotel customers. The applicant has stated that the intent of expanding this facility is to bett�r
serve the repair shops in Burlingame north of Broadway, to better seive the residents of north Burlinga�ne and
Millbrae, and to alleviate the general traffic concerns on Carolan Avenue.
The subject property is 33,086 SF in area. The lot fronts on Rollins Road, with street frontage and access fi-om
North Carolan Avenue as well. The majority of the site is paved, except a small portion along the western ed�e
of the property near North Carolan Avenue that is an unpaved dirt and gravel mix. There is adequate parking
provided toward the front of the site for the 60 fleet veliicles and the 9 required parking spaces for customel-s a�1d
the 2 employees that drive their personal vehicles to work. Extra parking is available, i f necessary, at the rc:ar ��f
dirt/gravel portion of the lot near the North Carolan driveway. There are currently 8 employees on-site, G rental
staff and 2 corporate/administrative support staf£ There would be an increase to 12 employees in tlie next t�vo to
five years. Currently approxiinately 8 clistomers visit the site each day. It is anticipated that there would l�e 13
customers per day in the next 2 years, and 22 customers per day in the next five years. The maximum number of
people (employees and customers) expected on-site at any given time is between 12-14.
The site would be accessed by customers and employees from either the Rollins Road orNorth Carolan entrance.
The applicant, Enterprise Rcnt-a-Car offers a free shuttle which takes customers to body shops, dealerships, and
their homes. This service reduces the amount of customer traffic to the site. Six of the existing employees at this
site use company (fleet) cars to get to and from work.
The building is non-conforming with regards to landscaping. The original approval was in 1970, before the City
adopted landscaping requirements for the M-1 district in 1975. The site currently has 1,830 SF (5.5"ro) uf
landscaped area where 10% (3,308SF) is required. Since this project does not include expanding the building
envelope or paved area, nor does it propose a change in use which would be more intense, �io aciciitional
landscaping is required.

stamped May 3, 2002, to the Planning Commission's comments. Each concern expressed by the Commission is

Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit the Ylamiing Commission
must find that the following conditions exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property ur
improvements in the vicinity, and will not be detriniental to the public health, safety, general wel fare, ur
convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to
secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics,
mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity.
Planning Commission Aetion: The Planning Commission should hold a public hearing. Affirmativc action should
be taken by resolution and should include findings. The reasons for any action should be clearly stated. At the
ptiblic hearing the followin� conditions should be considered:
that the project shall be built and the site shall be configured as shown on the plans submitted to the Plailning
Department and date stamped May 3, 2002, site plan and floor plan;
2. that the car rental business shall have regular business hours from 7:30 a.m. to 6:00 p.m. Monday throtigh
Friday, and Saturday from 9:00 a.m. to 12:00 p.ni., closed on Sunday;

4. that the applicant shall stripe the parking area on-site to accommodate all 60 rental fleet vehicles as well as
the 9 required parking spaces for the office and customer parking; and no employee or fleet vehicles sllall
ever be parked on the public right-of-way or across the public sidewalks;
5. that there shall be no maintenance or washing of vehicles on the site unless approved by the City Enyincer;
6. that any improvements for the use shall meet all California Building and Fire Codes, ] 998 Eciition as
amended by the City of Burlingame;

alcohol sales. CP Monroe explained that this request had been reviewed by the Police Department as a part

and staff comments. Four conditions were suggested for consideration. There were no questions of staff.
Chairman Vistica opened the public hearing. Brett and Sue Bottarini, property owners, were available to
answer questions. Commission had the following comments and questions for the applicant: where is the
boat currently stored; commission expressed concern with the plate height of the proposed garage and
asked the applicant if a 9 foot plate height was necessary; how tall is the boat; is it necessary to have 12
foot wide door; and is there going to be new paving in the driveway. Applicant stated that the boat is

Landscaping on the property will be maintained by a gardening service on a weekly
basis, once the initial cleanup is complete (in progress).Cleanup within the perimeter
of the grounds will be maintained so as to eliminate the small pockets of weeds. The
Rollins entrance side will be maintained as lawn with perennial flowers along the side
of the building (trees maintained as is).The Carolan entrance side will also be cleaned
up of the dill-weed that exists.

Since a majority of the business is based on the dealership (34%) and bodyshop
sectors (26%), where customers are picked up and dropped off at the
dealership/bodyshops, the service is used quite often. Retail customers (30%), almost
exclusively from Burlingame, Millbrae and Hillsborough, use the service 4 out of �
times. Overall, about 90% of customers use the free pickup and dropoff service. The
remainder usually constitute walk-in retail business of which the majority are people
who work in or around the Rollins area.

How will the proposed structure or use within the structure affect neighboring properties or structures on those properties? If
neighboring properties will not be affected, state why. Think about traffic, noise, lighting, paving, landscaping sunlight/shade, views

Public health includes such things as sanitation (garbage), air quality, discharges into sewer and stormwater systems, water supply
safety, and thing which have the potential to af%ct public health (i.e., underground storage tanks, storage of chemicals, situations which
encourage the spread of rodents, insects or communicable diseases).
Public safetv. How will the structure or use within the structure affect police or fire protection? Will alarm systems or sprinklers be
installed? Could the structure or use within the structure create a nuisance or need for police services (i.e., noise, unruly gatherings,

Ask the Planning Departrnent for the general plan designation and zoning district for the proposed project site. Also, ask for an
explanation of each. Once you have this information, you can compare your proposal with the stated designated use and zoning, then
explain why this proposal would fit accordingly.
3. How will the proposed project be compatible with the aesthetics, mass, bulk and
character of the existing and potential uses on adjoining properties in the general
vicinity? ^

CONDITIONAL USE PERMIT APPLICATION
1. Explain why the proposed use at the proposed location will not be
detrimental or injurious to property or improvements in the
vicinity or to public health, safety, ge�eral welfare or convenience.
The proposed addendum to the use will not in anyway be detrimental to the surrounding
property in the vicinity. According to our proposed addendum, the fleet and all
intercompany traffic and vendors would be limited to the N. Carolan Avenue
entrance/exit gate. Any customer traffic would be limited to the entrance/exit gate on the
Rollins Road side of the property. Enterprise's added free service of picking up/taking
back customers to bodyshops, dealerships, homes, etc. will greatly diminish the flow of
customer traffic to the site via the Rollins entrance to the property.
As is, public health and safety will not be affected in any manner as Enterprise Rent a Car
services its vehicles through local body shops, repair shops and the nearest available
dealerships. For company liability reasons, on site mainteance and repair would not even
be considered. Water sanitation would stay consistent at the facility as per condition #4 of
the use permit specifies. Washing of vehicles would take place at either of the carwash
facilities in the Broadway/Carolan Avenue area (a tertiary option being the Shell Gas
Station/Carwash on Airport Boulevard).
The flexibility of having the potential to have up to sixty vehicles on site, has several
benefits both to the surrounding community and the tenant as well. Enterprise Rent a
Car's forecasted plans for the facility was mainly three-fold: A) To better service the
repair shops of Burlingame north of Broadway Avenue and B) To better service the
residents of northern Burlingame and Millbrae (Enterprise does not have a location in
Millbrae) and C) Alleviate the general traffic concerns on Carolan Avenue (which
extends north to south from Broadway down past Burlingame High School) as well as the
amount of customers who flow through our Carolan Avenue location, our primary office
that services the Burlingame community.
Enterprise Rent A Car, renown for its high quality of service and free pickups, would be
able to expand this level of service without stressing the situation at the Carolan location.
2. How will the proposed use be located and conducted in
accordance with the Burlingame General Plan and Zoning
Ordinance?
The demised site, located in the M-1 zoning district, is allowed to operate an
automobile rental business per the existing conditional use permit of 1983. The
proposal would ask for the extension of hours to Monday through Friday 7:30 AM to
6 PM, Saturdays 9 AM to 12PM and expand the potential fleet capacity to a potential
of sixty cars. This would coincide with the hours of operation of most repair shops
and allow for transistion periods for customers going through the repairshop// picking
up/returning rental car // going to work/going home cycle.
3. How will the proposed project be compatible with the aesthetics,
mass, bulk and character of the existing and potential uses on
adjoining properties in the general vicinity?
Aesthetics will not be affected as no physical changes to the structure and facility
would take place. Subsequently, the surrounding vicinity would not be impacted as all
vehicles would be secured on the existing facility which can more than handle the
proposed needs of the site. In general, since no changes would be made, the demised
property would stay consistent with the general vicinity.

Six employees are rental staff and two employees are corporate/administrative support
staff.
Existing floor plan will indicate 13 workstations of which we are at 61 % occupancy.
Of the eight employees on-site, we have one level three employee (Rental Sales Support
Manager), five level two employees and two level one employees. As a company perk,
all level two employees and above are allowed company-vehicle status. All level two and
above employees are on the test car program indicating that they do not have an assigned
vehicle and are allowed to drive home what is available at the end of the day
(occasionally borrowing from other branch location inventory). The sales support staff is
usually visiting dealerships, bodyshops and repairshops on a daily basis.

As an automobile rental business, we are allowed to operate on the Demised Premise
based on a Conditional Use Permit, which was approved by the City Council of
Burlingamc in 1983 (scc attachcd shcet for thc conditions).
Enterprise Rent a Car is submitting an Amendment to Use Permit Application so that
condition #1 can be moditied. Our proposal to the city would be to modify the hours of
operation to Monday through Friday, 7:30 AM to 6 PM and Saturdays from 9AM to
12PM. Our proposal would also request that the operating fleet be expanded to a
potential of sixty cars on site.
The application requires the property owner's signature to confirm that the owner is
informed of the proposal. I have included a photocopy of the application for your
records. I have also included a self-addressed, stamped envelope for you to return the

RESOLVED, by the Plamiing Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for conditional
use perniit amendinent to modify conditions of a�proval for a car rental business at 1409 Rollins Road, zo�led
M-1, Honerlah Trust, property owner, APN: 026-103-030;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on N1av
13, 2002, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comme�lts received
and addressed by this commission, it is hereby found that there is no substantial evidence that the pi-oject set
forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article
Article 19. Categorically Exempt per Section: 15301 - Existing Facilities, Class 1, consists of the operation,
repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private stnictures,
facilities, mechanical equipment or topographical features, involving negligible or no expansion of use bcyond
that existing at the time of the lead agency's determination.
2. Said conditional use permit amendment is approved, subject to the conditions set forth in
Exhibit "A" attached hereto. Findings for conditional use permit amendment are set forth in the minutes and
recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records oi�

that the car rental fleet operated from this site shall be limed to a maximum of 60 vehicles;
all fleet vehicles, employee and customers shall park on-site at 1409 Rollins Road; there shal I
be no parking of fleet vehicles along Rollins Road or North Carolan;
4. that the applicant shall stripe the parking area on-site to accommodate all 60 rental fleet
vehicles as well as the 9 required parking spaces for the office and customer parking; and no

public sidewalks;
5. that there shall be no inaintenance or washing of vehicles on the site unless approved by the
City Engineer;
