ZONED R-1 Mr. Mendelson is requesting two special permits for a covered spa at the rear of the property. The permits are required for: 1) an accessory structure used for recreational purposes; and 2) the structure is similar to a lath house which exceeds 50 SF (CS 25.60.010- m& n). The structure will be 111 SF, located 10'-0" from the rear and side property lines, and constructed of redwood siding and roofing. Sliding "Shoji screens" will be used for privacy and ventilation. The electrical eguipment will be contained within the unit. There will be no plumbing extended to the structure (see revised drawing received Feb. 16, 1990). Staff Review The City staff have reviewed this request and the Chief Building Official expressed concern about the noise generated by the pumps. However, the structure was relocated 10'-0" from the property lines and thus meets all code requirements (CS 23.01.040 Swimming pools, Hot Tubs and Spa�). No other comments were received. The Planning Staff notes that this structure is located in the rear 30$ of the property. Therefore, the building is not required to meet the setback requirements except as necessary for construction safety and for the pool ordinance. Applicant's Letter The applicant notes that the structure will be located at the required distances from the property lines to meet sound require- ments. Also, no plumbing will be installed from the house and there will be proper drainage. Mr. Mendelson states that the Shoji house is specifically designed for spas and will provide privacy and protection from the weather. Study Ouestions This item was reviewed by the Planning Commission at the study meeting February 13, 1990 (PC Minutes Feb. 13, 1990). The foundation for the structure will be a 4" thick reinforced concrete exposed aggregate slab. The water line shown on the original drawings will not be installed (see plan supplement Feb. 16, 1990, attached to the staff report). This was a miscom- munication between the draftsperson and the owners. Finally, an 2 accessory structure may be placed anywhere within the rear 30� of the property. The staff review application has been corrected to reflect this requirement. However, the pool ordinance does require mechanical equipment to be located 10'-0" from the property line unless it is in a soundproofed enclosure. Findinas for a Special Permit In order to grant a Special Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable condi- tions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planninct Commission Action The Planning Commission should hold a public hearing. Affirma- tive action should be taken by resolution and reasons for any action clearly stated. At the public hearing the following conditions should be considered: 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped January 31, 1990 and amended February 16, 1990; and 2. that the project shall meet Uniform Building and Fire Codes as amended by the City. Please answer the following questions as they apply to your property to show how the findings can be made for your application request. A letter may also be submitted if you need additional space or if you wish to provide additional information for the Planning Commission to consider in their review of your application. Please write neatly in ink or type. 1. Explain why the proposed use at the proposed location will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience. We would like to enclose our Spa in a"Shoji" house specifically designed for spas. It's purpose is to provide more privacy as well as protecting the spa from the weather. 2. Discuss how the proposed use will be located and conducted in a manner in accord with the Burlingame General Plan and Zoning Ordinance. The enclosure will be located in the back yard within the approved distances from the fence. It will rest on a platform made of exposed aggregate with proper drainage. There will be no plumbing running from the house to the spa. The spa is filled with a garden hose. 3. Discuss how the proposed project will be compatible with the aesthetics, mass, bulk and character of the existing neighborhood and potential uses on adjoining properties in the general vicinity. Per Code Section 25.52.020 (3), the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of Title 25 (Zoning) in the operation of the use. The spa enclosure is in our back yard and is similar in size to our neighbor's greenhouse which doesn't bother us. ZT Lautenschlager reviewed details of the request, staff review, applicant's letter, study meeting questions. Two conditions were suggested for consideration at the public hearing. Responding to Commission questions staff advised the pool ordinance requires the spa be fully enclosed by a 6' fence; it also requires the spa be located 10' from property lines, the assumption is this will mitigate noise to the neighboring properties. Chm. Ellis opened the public hearing. Glenn Mendelson, applicant, was present. He advised no water service will come from the house, they will fill the spa with a garden hose. There were no audience comments and the public hearing was closed. C. Jacobs saw no reason not to approve this request, the structure will muffle some of the noise and be located 10' from property lines, it will not be detrimental to the neighbors. C. Jacobs moved for approval of the two special permits by resolution with the following conditions: (1) that the project shall be built as shown on the plans submitted to the Planning Department date stamped January 31, 1990 and amended February 16, 1990; and (2) that the project shall meet Uniform Building and Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Mink. In comment on the motion CP stated all neighbors within 300 feet of the site had been noticed. Motion was approved on a 6-0 roll call vote, C. Graham absent. Appeal procedures were advised.
