(650) 696-7200 September 28, 1998 Charles Schembri 1470 Vancouver Avenue Burlingame, CA 94010 Dear Mr. Schembri, Since there was no appeal to or suspension by the City Council, the September 14, 1998 Planning Commission approval of your front setback, side setback and parking variances application became effective September 23, 1998. This application was to allow a first floor revision and a second floor addition subject to design review at 1470 Vancouver Avenue, zoned R-1. The September 14, 1998 minutes of the Planning Commission state your application was approved with the following conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped August 21, 1998, Sheets A1, A3, A4, AS and A6; 2. that any changes to the size or envelope of the first or second floors, which would include expanding the footprint or floor area of the structure, replacing or relocating a window (s), adding a dormer (s) or changing the roof height or pitch, shall be subject to design review; and 3. that this project shall meet all the requirements of the California Building and Fire Codes, 1995 Edition, as amended by the City of Burlingame. Reimbursement of the unspent portion of your design review deposit has been processed and will be mailed to the property owner under separate cover. September 28, 1998 1470 Vancouver Avenue page -2- All site improvements and construction work will require separate application to the Building Department. This approval is valid for one year diiring which time a building permit must be issued. One extension of up to one year may be considered by the Planning Commission if application is made before the end of the first year. The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.
