RESOLUTION APPROVING CATEGORICAL EXEMPTION,
CONDITIONAL USE PERMIT AND PARHING VARIANCE
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
conditional use pernut and parking variance for a food establishment (bar� at 1327 Broadway,
zoned C=1 Broadwav Commercial Area, Bob Nerli, 1320 Marsten Rd. Bld� A, Burlingame,
CA, APN: 026-211-300;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
January 22, 2007, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and
� comments received and addressed by this commission, it is hereby found that there is no
substantial evidence that the project set forth above will have a significant effect on the
environment, and categorical exemption, per CEQA Article 19. Categorically Exempt per
Section: 15311 - Accessory structures, Class 11(a), Construction or placement of minor
structures accessory to (appurtenant to) existing commercial, industrial, or institutional
facilities, including but not limited to on-premise signs.
2. Said conditional use permit and parking variance are approved, subject to the conditions
set forth in Exhibit "A" attached hereto. Findings for such conditional use permit and
pazking variance are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

1. that the project shall be built as shown on the plans submitted to the Planning Department
date stamped January 9, 2007, sheets 1 and 2, as amended by the applicants response letter,
date stamped January 9, 2007, and that the 1,157 SF area of on-site seating of the food
establishment (bar) shall be enlarged or extended to any other areas within the tenant space
only by an amendment to this conditional use permit and parking variance;
2. that the conditions of the City Engineer's September 5, 2006 memo, the Chief Building
Official's August 31, 2006, memo, the Recycling Specialist's September 6, 2006 memo, the
Fire Marshal's September 5, 2006 memo and the NPDES Coordinator's September 5, 2006
memo shall be met;
3. that if there is a complaint from the neighboring residents concerning the use of the outdoor
patio area, the application for conditional use permit shall again be reviewed by the
Planning Commission at public hearing;
4. that the patio area shall only be open until 10:00 PM on the weekdays and 12:00 AM on the
weekends;
5. that the applicant shall submit to the Burlingame Police Department for review of their
amusement permit prior to scheduling a final inspection;
6. that the proposed exit to the public service alley shall only be used in case of an
emergency; the alley area shall not be used by patrons for entrance to the patio area;
7. that demolition or removal of the existing structures and any grading or earth moving on
the site shall not occur until a building permit has been issued and such site work shall be
required to comply with all the regulations of the Bay Area Air Quality Management
District;
8. that an amendment to this conditional use pernut shall be required for delivery of prepared
food from this premise;
9. that there shall be no food sales allowed at this location from a window or from any
opening within 10' of the property line;
10. that if this site is changed from any food establishment use to any retail or other use, a food
establishment shall not be replaced on this site and this conditional use permit shall become
void;
11. that the applicant shall provide daily litter control along all frontages of the business and
within fifty (50) feet of all frontages (front and rear) of the business;
12. that this food establishment shall provide trash receptacles as approved by the city

1) The plans as submitted are insufficient to determine whether code compliance can be
attained.
2) All construction must comply with the 2001 California Building Codes (CBC), the Burlingame
Municipal and Zoning Codes, and all other State and Federal requirements.
3) Provide fully dimensioned plans.
4) Provide existing and proposed elevations.
5) Provide a complete demolition plan that indicates the existing walls, walls to be demolished,
new walls, and a legend. NOTE: The Demolition Permit will not be issued until a Building
Permit is issued for the project.

industrial, or institutional facilities, including but not limited to on-premise signs.
History: In May 1997, the Planning Commission reviewed a special permirt and parking variance for
expansion of a food establishment for outdoor patio seating at 1327 Broadway. After the study hearing,
due to discussions with the property owner, the application was withdrawn.
On April 4, 2000, the Planning Commission approved a conditional use permit for an existing food
establishment classified as a bar in the Broadway Commercial Area at 1327 Broadway as required by
Ordinance 1619. The conditions of approval for that conditional use permit are included in the staff report.
On October 21, 2002, the City Council approved an amusement permit for 1327 Broadway which allows
entertainers on Saturdays and recorded music on Sunday's with 12 conditions of approval. The conditions
of approval for that amusement permit are included in the staff report.
Summary: This application is for a conditional use permit amendment and parking variance for expansion
of seating area to an existing food establishment (bar) in the Broadway Commercial Area at 1327
Broadway. The current food establishment, Behan's Irish Pub, is classified as a Bar with 525 SF of on-site
seating, all of which is located in the existing building. The applicant is proposing to remove an existing
345 SF cooler and storage building located at the rear of the subject property in what is currently a
covered/uncovered storage area (855 SF total), and replace it with a new 223 SF storage and cooler
building and 632 SF of open patio and smoking area that will be used by patrons of the food establishment
(bar). The new patio and smoking area will be surrounded by a new fence on the left hand side and at the
rear, by the new storage and cooler buildings along the right hand side, and by the existing building.
Landscaping will be provided in the patio and smoking area in the way of planted shrubs and plants.
Because of the addition of the patio and smoking area at the rear of the building, there is an incremental
increase in the number of parking spaces required on site. This 855 SF area is currently used as both
covered and uncovered storage area which has a parking requirement of 1:1,000 and requires one parking
space. With the proposed changes, the applicant is proposing to use 632 SF of the existing storage area as
additional seating area (parking requirement of 1:200) and continue to use 223 SF of the space for storage
(parking requirement of 1:1,000). Therefore, the number of spaces required for this area would be 3.38
spaces, which rounds up to 4 spaces required, which creates an incremental increase of 3 parking spaces
required on site.
There currently is 1'/2 parking spaces on site and 2%z spaces on the adjacent parcel at 1301 Broadway that

shares a driveway with 1327 Broadway. In order to comply with current ADA requirements, the applicant
is proposing to modify the current parking plan to add loading/unloading area along the left hand side of
the parking space on their property. The existing parking plan is non-conforming because it can not be
exited in a forward direction. No other changes are proposed to the current parking plan. The applicant is
currently working with the Chief Building Official to comply with all ADA requirements. The following
applications are required:
• Conditional use permit amendment for expansion of seating area to an existing food establishment
(bar) in the Broadway commercial area (C.S. 25.36.041); and
• Parking variance for an incremental increase in the number of parking spaces required on site (3
additional spaces required, no new spaces provided) (C.S. 25.70.040).

Staff Comments: See attached.
Study Meeting: At the November 27, 2006, Planning Commission study meeting, the Commission had
several questions regarding the project and placed this item on the consent calendar when all the
information had been submitted and reviewed by the Planning Department (November 27, 2006 P.C.
Minutes). On January 9, 2007, the applicant submitted a response letter and revised plans to address the
Commissions questions and concerns. The following is a list of all Commissioners comments followed by
the responses by the applicant and by staf£
1. Would like some clarification from the ChiefBuilding Off cial about the two required exits from the
patio; is there enough separation? Is paving allowed in the service area and adjacent so that
patrons can safely exit into this area?
■ After a discussion with the Chief Building Official, and the City Engineer, the applicant
revised the plans to comply with egress requirements by adding paving, that is consistent
with the Broadway Streetscape Improvement Plan, to the service alley area along the west
side of the building; these improvements will be paid for by the property owner. The
property owner will also work with the City to modify the existing pavement and gate area

in order to comply with egress requirements (response letter from applicant and revised
plans, date stamped January 9, 2007).
2. Some room should be left unpaved at the rear of the patio so that the planting can be done in the
ground to grow up the trellis; would like to see an irrigation system for planting at the rear and for
the potted Italian Cypress trees; like the addition of the landscaping to this area;
■ The applicant noted that the area in the rear of the patio is currently paved and that the
paving abuts a retaining wall, and that if paving were to be removed from this area then it
would compromise the integrity of the block retaining wall foundation. The applicant
revised the plans to include a planter box area at the rear of the patio along the existing
block retaining wall in which vines will be planted to grow along the trellis area. The
applicant also noted that the planter box area will be raised and on a drip irrigation system
installed (response letter from applicant and revised plans, date stamped January 9, 2007).
3. Is there a plan for making this the only place that people smoke so that people do not smoke on the
street in front?
■ The applicant responded that this will be the only smoking area on site and that "no
smoking" signs will be posted at the entrance to the bar (response letter from applicant, date
stamped January 9, 2007).
4. Concerned with people being outside on the patio area later in the evening; are there specific
hours that the patio is open? Does the inclusion of lhe patio area require a review of the
Amusement Permit? and
■ The applicant noted that the patio area would be open unti110:00 PM on the weekdays and
12:00 AM on the weekends (response letter from applicant, date stamped January 9, 2007).
Condition # 3 was added to restrict the open hours of the patio to 10:00 PM on the
weekdays and 12:00 AM on the weekends. Staff would note that after a discussion with
Michael Matteucci in the Police Department, it was determined that the Police Department
will need to review the amusement permit at this location due to the increase in seating area
and the new conditions attached to the project (see condition of approval # 5).
S. Because of the possible impact on the neighbors living nearby, this application should be reviewed
immediately upon complaint as well as after the first year.
■ Staff would note that a condition of approval was added to the proj ect that indicates if there
is ever to be a complaint about the use of the outdoor patio in this location, that the
conditional use permit will be reviewed by the Planning Commission at public hearing
(condition of approval # 3).
Required Findings for a Conditional Use Permit Amendment: In order to grant a Conditional Use
Permit the Planning Commission must find that the following conditions exist on the property (Code
Section 25.52.020 a-c):

(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare,
or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general
vicinity.
Findings for Conditional Use Permit Amendment: Based on the findings stated in the attached minutes
of the Planning Commission's November 27, 2006, study meeting; that the expansion of this use will not
be detrimental to the city's objective of promoting pedestrian oriented retail activity in this commercial
area and therefore will be in compliance with the general plan for the area; that the hours of operation for
the patio area are limited by the conditions of approval; and since the business shall be required to comply
with all the city regulations including providing trash receptacles and litter maintenance in the surrounding
area, signage, meeting building code requirements, and adhering to County health requirements, the
operation will be compatible with the public's health and safety as well as with the character of the
commercial area.
Required Findings for a Parking Variance: In order to grant parking variance, the Planning Commission
must find that the following conditions exist on the property (Code Section 25.54.020 a-d):
(a) there are exceptional or extraordinary circumstances or conditions applicable to the property involved
that do not apply generally to property in the same district;
(b) the granting of the application is necessary for the preservation and enjoyment of a substantial
property right of the applicant, and to prevent unreasonable property loss or unnecessary hardship;
(c) the granting of the application will not be detrimental or injurious to property or improvements in the
vicinity and will not be detrimental to the public health, safety, general welfare or convenience; and
(d) that the use of the property will be compatible with the aesthetics, mass, bulk and character of
existing and potential uses of properties in the general vicinity.
Findings for Parking Variance: Based on the findings stated in the attached minutes of the Planning
Commission's November 27, 2006, study meeting; that the existing building was originally built with only
one on-site parking space and with the existing structure, there is no additional space on the lot to add more
parking space; that the expansion of the seating area on the patio represents a minor increase in seating
area; that the existing parking space that exists on site is being reconfigured as to comply with accessibility
regulations; and that it is the City's policy to promote pedestrian activity in the Broadway Commercial
Area, the project is found to be compatible with the variance criteria listed above.

Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution and should include finding for the conditional use permit amendment
and parking variance. The reasons for any action should be clearly stated for the record. At the public
hearing the following conditions should be considered:
that the project shall be built as shown on the plans submitted to the Planning Department date
stamped January 9, 2007, sheets 1 and 2, as amended by the applicants response letter, date stamped
January 9, 2007, and that the 1,157 SF area of on-site seating of the food establishment (bar) shall be
enlarged or extended to any other areas within the tenant space only by an amendment to this
conditional use permit and parking variance;
2. that the conditions of the City Engineer's September 5, 2006 memo, the Chief Building Official's
August 31, 2006, memo, the Recycling Specialist's September 6, 2006 memo, the Fire Marshal's

BURLINGAME PLANNING COMMISSION
BEHAN'S IRISH PUB PATIO EXPANSION
On 11/27/06 an application for expansion of seating area for Behan's Irish Pub came
before the Burlingame Planning Commission as a study item. The Commission had a
few questions for clarification. Clarification is outlined below per the 11/27/06 meeting
minutes.
Issue 1: Clarification of two required egress separation and paving in the City

Response: The owner has met with the Burlingame Building Dept. and with Public
Works to determine that paving is necessary in the alley for egress. The
owner will pay for the paving to meet city standards. All paving will be in
conformance with the Broadway Streetscape Master Plan. The Owner will
work in conjunction with city officials in all aspects of the easement changes;
including pavement and gate modifications required for egress.
Issue 2: Should room be left unpaved at the rear of the patio for planting...
Response: No. The area in the rear of the patio is currently paved and the paving abuts a
retaining wall. If pavement is removed from this area, it will affect the
integrity of the block retaining wall foundation. The planter area will be
raised and on a drip irrigation system.
Issue 3: Is there a plan for making the patio the only area for smoking?
Response: Yes. "No- Smoking" signs will be posted at the entry.
Issue 4: Hours of operation and amusement permit status...
Response: No change is required to the amusement permit. The patio area will be open
until 10:00 P.M. on weekdays and 12:00 A.M. on weekends.

Permit a(lows: Entertainers on Saturdays and recorded music on Sundays from 9:30 p.m. to 1:00 a.m. with
the following conditions:
1. Admission shall be limited to adults 21 years of age or older.
2. The establishment shall be posted with a"Maximum Occupancy 49" sign.
3. Violations of the law or threatened violations shall be immediately reported to the police with full
cooperation from employees and management.
4. No variance from the permitted entertainment shall occur without amendment to the permit.
5. No part of the business shall be subleased without notification to the police.
6. The amusement permit is non-transferable.
7. All alcohol beverage control laws shall be strictly enforced.
8. Any fight, ejection of customer, thefts from customers, or any other criminal act occurring at the
establishment shall be reported to the Burlingame Police as soon as any employee is aware of such an
incident. •
9. Any request by anyone in the establishment for an employee to contact the Police shall be honored
immediately, without question.
10. Last call for alcohol service shall be 1:20 a.m. on nights when entertainment is offered.

application was for an existing food establishment classified as a Bar in the Broadway commercial area

The March 27, 2000 minutes of the Planning Commission state your application was approved with the
following conditions:
1. that this business location presently occupied by a bar, with 525 SF of on-site seating, may change
its food establishment classification only to a full service restaurant or a limited food service with

WHEREAS, a categorical exemption has been proposed and application has been made for a

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
January 22, 2007, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is no
substantial evidence that the project set forth above will have a significant effect on the

patio area, the application for conditional use permit shall again be reviewed by the
Planning Commission at public hearing;
4. that the patio area shall only be open until 10:00 PM on the weekdays and 12:00 AM on the
weekends;
5. that the applicant shall submit to the Burlingame Police Department for review of their
amusement permit prior to scheduling a final inspection;
6. that the proposed exit to the public service alley shall only be used in case of an
emergency; the alley area shall not be used by patrons for entrance to the patio area;
7. that demolition or removal of the existing structures and any grading or earth moving on
the site shall not occur until a building permit has been issued and such site work shall be
required to comply with all the regulations of the Bay Area Air Quality Management
District;
8. that an amendment to this conditional use permit shall be required for delivery of prepared
food from this premise;
9. that there shall be no food sales allowed at this location from a window or from any
opening within 10' of the property line;
10. that if this site is changed from any food establishment use to any retail or other use, a food
establishment shall not be replaced on this site and this conditional use permit shall become
void;
11. that the applicant shall provide daily litter control along all frontages of the business and
within fifty (50) feet of all frontages (front and rear) of the business;
12. that this food establishment shall provide trash receptacles as approved by the city
consistent with the streetscape improvements and maintain all trash receptacles at the

13. that this food establishment may be open seven days a week from 10 a.m. to 2:00 a.m., with
a maximum of three employees on site at any one time;
14. that Labor Code § 6404.5 regulating smoking shall be enforced at all times; and
15. that the project shall meet all the requirements of the California Building Code and
California Fire Code, 2001 edition, as amended by the City of Burlingame, and that failure
to comply with these conditions or any change to the business or use on the site which
would affect any of these conditions shall require an amendment to this use permit.
