Request: Special permit for a satellite dish antenna located on the
roof (C.S. 18.18.020, b) at 1327 Broadway Avenue, zoned C-1
Broadway Commercial Area.

Proposed Use: Roof top satellite dish antenna
Allowable Use: Antennas with a special permit
Summary: The applicant is requesting a special permit for a roof
mounted satellite dish antenna at 1327 Broadway Avenue, Behan's
Irish Pub. Currently the satellite dish antenna is located on the
roof near the front of the building. The applicant is proposing to
move the antenna to the center of the roof area.
The antenna stands 9' -0" tall and has a diameter of 10' -0" . The
roof has a 6'-0" parapet which shields 6'-0" of the antenna,
leaving 3'-0" visible from the street. The proposed new location
moves the antenna further back from the street and out of sight
from the public right-of-way. The antenna has been in its current
location for 4 years without a building permit. No structural
changes or other tenant improvements are proposed for the building
or this use. This is a code enforcement item brought to staff
attention at the end of February by a citizen complaint.

Staff Comments: The Building Official states in his March 14, 1994
memo that a building permit is required for relocation of the
satellite dish antenna. There were no comments by the other staff
members.

1327 BROADWAY
Required Findinqs for a Special Permit:
In order to grant a Special Permit the Planning Commission must
find that the following conditions exist on the property (Code
Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be
detrimental or injurious to property or improvements in the
vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in
accord with the Burlingame general plan and the purposes of
this title;
(c) the Planning Commission may impose such reasonable conditions
or restrictions as it deems necessary to secure the purposes
of this title and to assure operation of the use in a manner
compatible with the aesthetics, mass, bulk and character of
existing and potential uses on adjoining properties in the
general vicinity.
Planning Commission Action: The Planning Commission should hold a
public hearing. Action should be taken and reasons for any action
clearly stated. At the public hearing the following condition
should be considered:
Conditions:
l. that the satellite dish antenna shall be installed as shown on
the plans submitted to the Planning Department and date
stamped March 10, 1994, General Roof Plan;
2. that the conditions of the Building Official's memo dated
March 14, 1994 shall be met: (that installation of this
satellite dish required a separate application to the
Building Department, with proper plans and calculations, as
required for a Building Permit);
3. that the dish antenna installed shall not have a diameter
greater than 10'-0", nor rise more than 9'-0" above the
surface of the roof and shall be painted with a non-reflective
paint to match the roof;
4. that the applicant or property owner shall be responsible for
an amendment to this use permit if future construction on any
adjacent property requires relocation of the dish antenna,
removal and reinstallation costs shall also be borne by the
applicant and/of property owner;
5. that the applicant shall permanently maintain the non-
reflective surface of the dish and its support structure, or
remove all of the equipment and support structure;
6. that the installed satellite dish antenna shall meet all the
requirements of the Uniform Building and Uniform Fire Codes as
amended by the city, including connections from the antenna
inside the building to the television equipment;

7. that the satellite dish antenna shall be removed at the time
this tenant leaves this premiss and if the new tenant wishes
to install any type of antenna the new tenant shall comply
with all the code requirements in effect at that time;
8. that the current antenna shall be removed from its proposed
location within 30 days of the approval date of this
application; and
9. that any modification to the antenna or its location shall
require an amendment to this use permit.
