Allowable Use: A Conditional Use Permit is required for changing from a specialty food shop to a full
service food establishment. Please note that once a specialty food shop changes to any
other food establishment classification, the site may not return to a specialty food shop
(C.S. 25.36.043 d, 4).
History of Food Establishment Use at 1251 Broadway: In April 1992, the City Council approved a
conditional use permit and parking variance for a food establishment (Coffee Stop) at 1249 A Broadway
(March 16 and April 6, 1992 C.C. Minutes). In November 1998, the Planning Commission approved a
conditional use permit to extend hours of operation for Lobos Taqueria at 1251 Broadway (new address, same
tenant space) (November 9, 1998 P.C. Minutes). On February 28, 2006, the Planning Commission approved
an amendment to a conditional use permit for a specialty food establishment at 1251 Broadway as required by
Ordinance 1619. The conditions of approval for that amended conditional use permit are included in the staff
report. �
On August 14, 2006, the Building Division issued a stop work order for the construction at 1251 Broadway
because no permit had been issued for the tenant improvements being made to the building. The applicant
applied to the Building Division for a building permit on September 9, 2006. No permit has been issued
because the project (new food establishment) requires a conditional use permit. No further improvements
except for the removal of graffiti and the phone booth have been made to the building since the stop work
order was issued.
Summary: The applicant is proposing to change the food establishment classification at 1251 Broadway
(Broadway Commercial Area) from specialty food establishment, Lobos Taqueria, to a full-service food
establishment, Big Joe's Cafe, which requires a conditional use permit. The site is located on the southeast
corner of Broadway and Paloma Avenue. The full service food establishment will have approximately 530 SF
of seating area, the same seating area approved for the previous specialty food establishment.
A full service food establishment is defined as a business which sells food prepared indoors on the premise
with a full menu and provides an indoor seating area of at least 250 SF. Operating criteria for a full service
food establishment include most or all of the following: served by waiters to seated customers and where
payment is made at the end of the meal; presence of a full commercial kitchen and commercial dishwasher;
and food is served on ceramic plates with metal flatware and cloth napkins.

The applicant notes that the proposed full service food establishment will serve meals all day including
breakfast, lunch and dinner. Tables, booths and counter seating will be provided. The business will have a
maximum of 2 full-time employees and 3 part-time employees on site at any one time (expectation in 5 years).
The applicant proj ects a total of 5 5 customers per day on weekdays and 65 customers per day on weekends. In
the future, the applicant anticipates a total of 65 customers per day on weekdays and 75 customers per day on
weekends. A maximum of 45 people are expected on site at any one time, including the owner, employees
and customers. The food establishment will be open seven days a week, from 7:00 a.m. to 10:00 p.m.
This site is nonconforming since it has no on-site parking (the existing building was built to lot line). The
proposed food establishment will be replacing an existing food establishment. No additional parking is
required as part of this application because there is no change or intensification of use on site and there is no
increase to the existing seating area (530 SF existing and proposed). An application for a conditional use
permit and parking variance for a food establishment was approved in April of 1992 for the Coffee Stop food
establishment. This parking variance stands with the existing and continued use on the property (food
establishment) which requires 1 parking space for every 200 SF of gross floor area. Staff would note that
public parking is available on the street and in neighboring public Lots P(27 stalls), Q(24 stalls), and R(34
stalls). The following applications are required:

Staff comments: See attached. This project is not subject to commercial design review because the repairs
proposed to the exterior of the building will not change more than 50% of either fa�ade.
January 22, 2007, Regular Action Meeting: At the January 22, 2007, Planning Commission regular action
meeting, the Commission had several concerns with the graffiti still existing on the exterior of the building,
with the removal of the existing payphone and with the revised garbage area inside the restaurant. The
Commission moved to continue this item until the comments raised have all been addressed and have been
reviewed by the Planning Department (January 22, 2006 P.C. Minutes).
On January 24, 2007, the applicant submitted revised plans to address the Commissions comments and
concerns. One set of these plans had been reviewed by the San Mateo County Health Department and
stamped with a"Conditional Approval Only" stamp. Those plans were routed around to the City various

departments for review. Based on additional comments made by the City Engineer, Chief Building Official,
Fire Marshall and NPDES Coordinator, the applicant submitted a response letter to the Planning Department
on January 31, 2007which addresses all Planning Commission and staff concerns. Included with the response
letter were two pictures of the building demonstrating that all graffiti and the phone booth have been removed,
as requested by the Commission.
The following is a list of all Commissioners questions and comments followed by the responses by the
applicant and by staff:
1. Called attention to the graffiti on the phone booth and the building at the study meeting; the graffiti is
a violation and should be removed immediately by the property owner or tenant;
The applicant responded that both the phone booth and all graffiti were removed on January 24,
2007, and noted that the phone booth panel will be painted to match the exterior wall color
during renovation of the property (response letter and photographs from applicant, date stamped
January 31, 2007).
Staff conducted a site inspection of the property on February 6, 2007 to confirm that all graffiti
and the pay phone had been removed.
2. There are requirements for certain types of wall finishes in a can wash area, what types of finishes
will be used; could do a tile wall 4' high in area; issues are wall finishes, floorfinishes and wall base;
think that tile wall needs to be higher than 4'; a mop sink needs to be included;
The applicant responded that the new garbage room will be finished with a floor drain, tile floor
with coved base, 6 foot high washable walls and an exhaust fan to the roof. It was also noted
that there is an existing mop sink in the existing kitchen area (see response letter from applicant,
date stamped January 31, 2007 and revised plan, sheet A-1, date stamped January 24, 2007,
including a"Garbage Room Details" diagram).
Staff would note that the NPDES Coordinator had a new comment requiring that the floor drain
in the garbage area should be routed to a grease trap. The applicant indicates that the new floor
drain will be connected to a new dedicated 30# grease trap, then discharged to the sewer line
(response letter from applicant, date stamped January 31, 2007).
3. The location of the garbage area is a matter ofsanitation; not sanitary to be washing cans as shown;
also will be issues with smell and ventilation;
Based on Planning Commission comment, the applicant has revised the plans to include the
garbage area in a closed closet location towards the rear exit door. The applicant has also
indicated that the new garbage room will be equipped with an exhaust fan to the roof to eliminate
smell.
4. Toyo company prepared plans, information rteeds to get from this hearing into the revisions on the
plans;
The applicant responded that all Planning Commission comments have been conveyed to the
proj ect designer, Mr. Clement Yen, via fax and in person and noted that all information included
in his response letter was added to the plans by the project architect (response letter from

applicant, date stamped January 31, 2007 and revised plans, sheet A-1, date stamped January 24,
2007).
■ Staffwould note that the Planning Department has advised the applicant that the project designer
should attend all Planning Commission Public Hearings.
5. Answers are inadequate in regards to the garbage area which has just been wedged into tlae e�it area;
information on how the garbage area is going to be detailed is not included on the plans; if the details
are not called out on the plans they will get overlooked; this will be visible to the diners and not the
type of design encouraged in Burlingame;
The applicant responded that the new design of the garbage area is an enclosed area located in
the rear of the cafe which is out of sight of the diners. He also noted that the garbage enclosure is
equipped with a door, washable walls, a tile floor, a floor drain and an exhaust fan (see response
letter from applicant, date stamped January 31, 2007 and revised plan, sheet A-1, date stamped
January 24, 2007, including a"Garbage Room Details" diagram).
6. Think it is great that another garbage solution is being researched; want to have no problems with
garbage and clean-up area;
The applicant responded that because this is a small and old establishment, there wasn't the
opportunity to pursue the best of the best, but did their best to seek solutions which address the
concerns of the Commission and avoid future problems (response letter from applicant, date
stamped January 31, 2007).
7. How much foot traffic will be going through the garbage room area?
The applicant responded that most customers will be going through the front entrance located at
the corner of Broadway and Paloma Avenue. He also noted that any foot traffic going past the
enclosed garbage room will be customers or staff inembers going to and from the restroom, and
staff inembers going to and from the dry storage room (response letter from applicant, date
stamped January 31, 2007, and revised floor plan, date stamped January 24, 2007).
8. Next submittal shall include interior elevations for the garbage can storage/wash area with egress
addressed.
The applicant added a new detail to the plans (titled "Garbage Room Details") that includes all
proposed materials in that space (revised plan, sheet A-1, including "Garbage Room Details",
date stamped January 24, 2007).
December 11, 2006, Regular Action Meeting: At the December 11, 2006, Planning Commission regular
action meeting, the Commission had several questions concerning the garbage area, improvements to the front
of the building and removal of an existing pay phone. The Commission moved to continue this item until the
questions raised have all been addressed and have been reviewed by the Planning Department (December 11,
2006 P.C. Minutes).
November 27, 2006, Study Meeting: At the November 27, 2006, Planning Commission study meeting, the
Commission had several questions and placed this item on the regular action calendar when all the
information had been submitted and reviewed by the Planning Department (November 27, 2006 P.C.

Minutes). A copy of the November 27, 2006 Planning Commission study hearing minutes and the response
letter from the applicant are included in the staff report packet.
Findings for a Conditional Use Permit: In order to grant a conditional use permit for a full service food
establishment, the Planning Commission must find that the following conditions exist on the property (Code
Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare,
or convemence;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame general
plan and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the
general vicinity.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action
should be taken by resolution and should include finding for the conditional use permit. The reasons for any
action should be clearly stated for the record. At the public hearing the following conditions should be
considered:
1. that this business location to be occupied by a full service food establishment, with 530 SF of on-site
seating, may change its food establishment classification only to a limited food service upon approval
of a conditional use permit amendment for the establishment; the criteria for the new classification
shall be met in order for a change to be approved;
2. that the project shall be built as shown on the plans submitted to the Planning Department date
stamped January 24, 2007, floor plan and garbage room details, December 18, 2006, site plan and
ceiling plan, and that the 530 SF area of on-site seating of the full service food establishment shall be
enlarged or extended to any other areas within the tenant space only by an amendment to this
conditional use permit; and that all planters shall be regularly maintained by a professional garden
service contracted for by the business operator;
3. that the conditions of the City Engineer's January 29, 2007 and October 5, 2006 memos, the Chief
Building Official's January 26, 2007, December 19, 2006 and October 6, 2006, memos, the Recycling
Specialist's October 16, 2006 memo, the Fire Marshal's January 29, 2007, December 20, 2006 and
October 2, 2006 memos and the NPDES Coordinator's January 29, 2007 and October 3, 2006 memos
shall be met;
4. that proposed garbage room shall have a tile floor, washable walls 6' high, an exhaust fan to the roof
and the floor drain in the garbage room shall be connected to a new grease trap before being
discharged to the City's sewer line;
5. that demolition or removal of the existing structures and any grading or earth moving on the site shall
not occur until a building permit has been issued and such site work shall be required to comply with
all the regulations of the Bay Area Air Quality Management District;
6. that prior to scheduling the framing inspection, the project architect, engineer or other licensed

professional shall provide architectural certification that the architectural details such as window
locations and bays are built as shown on the approved plans; if there is no licensed professional
involved in the proj ect, the property owner or contractor shall provide the certification under penalty
of perjury. Certifications shall be submitted to the Building Department;
7. that this food establishment shall provide trash receptacle(s) as approved by the city consistent with
the streetscape improvements and maintain all trash receptacle(s) at the entrances to the building and
at any additional locations as approved by the City Engineer and Fire Department;
that the business shall provide litter control along all frontages of the business and within fifty (50)
feet of all frontages of the business;
9. that an amendment to this conditional use permit shall be required for delivery of prepared food from
this premise;
10. that there shall be no food sales allowed at this location from a window or from any opening within 10'
of the property line;
11. that this full service food establishment may be open seven days a week, from 7:00 a.m. to 10:00 p.m.,
with a maximum of 2 full-time employees and 3 part-time employees on site at any one time,
including the business owner and manager;
12. that no banner shall be used per Title 22 Sign Code Section 22.48.080 and the applicant shall obtain
Planning and Building permits for all signage;
13. that if this site is changed from any food establishment use to any retail or other use, a food
establishment shall not be replaced on this site and this conditional use permit shall become void;
14. that the project shall provide adequate filtering and venting to avoid dissemination of odors on
neighboring properties; and
15. that the project shall meet all the requirements of the California Building Code and California Fire
Code, 2001 edition, as amended by the City of Burlingame, and that failure to comply with these
conditions or any change to the business or use on the site which would affect any of these conditions
shall require an amendment to this use permit.

This is to respond to the Planning Commission comments raised on 1/22/07 meeting
And NPDES comment dated 1/29/07.
Per the Planning Commission comments on the indoor garbage area in our facility,
we diligently re-designed our proposed plan to accommodate a garbage room with
necessities to avoid foreseeable problems.
1. The graffti on the phone booth.
Respond: The phone booth was removed along with the graffiti on 1/24/07.
(photo) The phone booth shade will be painted to match wall color
during renovation.
2. Garbage area finishes, washable wall higher than 4', mop sink.
Respond: The new garbage room will be finished with a floor drain, tile floor,
with coved base, 6'high FRP washable walls and a 160 CFM
exhaust fan to roof. (Detail l, A-1) There is an existing mop
sink in the close-by kitchen.
3. The location of the garbage area is a matter of sanitation, not sanitary to
be washing cans, also issues with smell and ventilation.
Respond: The garbage area design has been following the Planning Commission
comments, dated 11/11/06: " A garbage area should be included inside
this business equipped with hot water for cleaning the garbage cans
and a proper drain ". However, the new garbage room will be equipped
with a 160 CFM exhaust fan to roof to eliminate smell.

2) All construction must comply with the 2001 California Building Codes (CBC), the Burlingame
Municipal and Zoning Codes, and all other State and Federal requirements.
3) Provide fully dimensioned plans.
4) Provide a title block on the plans that includes the name of the owner(s) and the name,
address, and phone number of the project designer.
5) Provide a complete demolition plan that indicates the existing walls, walls to be demolished,
new walls, and a legend. NOTE: The Demolition Permit will not be issued until a Building
Permit is issued for the project.
6) Comply with the new, 2005 California Energy Efficiency Standards for low-rise non-residential
buildings. Go to http://www.energy.ca.qov/title24 for publications and details.
7) Provide guardrails at all landings. NOTE: All landings more than 30" in height at any point are
considered in calculating the allowable floor area. Consult the Planning Department for details
if your project entails landings more than 30" in height.
8) Provide handrails at all stairs where there are four or more risers.

Change "This door must remain unlocked during business hours" to "These doors to
remain unlocked whenever the building is occupied" for the main door. This sign
exception in lieu of allowing openable doors from the inside without the use of a key

Commissioner Deal noted that he lives within S00 feet of the project and will recuse himself from the
proceedings. He left the chambers.
Reference staff report dated January 22, 2007, with attachments. ZT Strohmeier presented the report,
reviewed criteria and staff comments. Fiftecn (15) conditions were suggested for consideration.
Commission commented that the graffiti is still on the front of the building, thought it was to be removed
before the project came back. CP noted this might not have been clearly understood. There were no further
questions of staff.

applicant and building owner have done nothing with the graffiti when all it takes is paint. The motion was

Chair Brownrigg opened the public hearing and discussion of the motion. Hong Lily Li, 1251 Broadway,
and Ken Toy, 1251 Broadway, represented the project. Commission commented:
■ Called attention to the graffiti on the phone booth and the building at the study meeting; the graffiti is
a violation and should be removed immediately by the property owner or tenant;
■ There are requirements for certain types of wall finishes in a can wash area, what types of finishes
will be used; could do a tile wall 4' high in area; issues are wall finishes, floor finishes and wall base;
think that tile wall needs to be higher than 4'; a mop sink needs to be included;
■ The location of the garbage area is a matter of sanitation; not sanitary to be washing cans as shown;
also will be issues with smell and ventilation;
■ Toyo company prepared plans, information needs to get from this hearing into the revisions on the
plans;
■ Answers are inadequate in regards to the garbage area which has j ust been wedged into the exit area;
information on how the garbage area is going to be detailed is not included on the plans; if the details
are not called out on the plans they will get overlooked; this visible to the diners and not the type of
design encouraged in Burlingame;
■ Think it is great that another garbage solution is being researched; want to have no problems with
garbage and clean-up area; and
■ How much foot traffic will be going through this area?
■ Next submittal shall include interior elevations for the garbage can storage/wash area with egress
addressed
The applicant responded that they did not think they could remove the graffiti without a Building Permit;
two sides of the garbage area are glass, and the other two sides are in the exit way to the restaurant and the
second exit doorway from the restaurant; the finish on the walls will be waterproof with wall tiles or other
materials; the fire department wants the area open for an exit path; and they thought the revised plans
addressed the access to the garbage area and rear exit. There were no further comments and the public
hearing was closed.
Commission commented: can support the motion to continue and resubmit after the removal of the graffiti
and in order to resolve the garbage situation, maybe the architect could come to the next meeting and explain
what is going on in the plans; design review provides a method to offer assistance to the applicant, staff
responded that there was no assistance for interior improvements only; the applicant could come in and listen
to the tapes; do not think applicant is allowed to remove the pay phone without the owner's consent to
remove, uncomfortable asking the applicant to remove something without permission.
Chair Brownrigg called for a voice vote on the motion to continue. The motion passed on a 6-0-1 (C. Deal
abstaining). Appeal procedures were advised. This item concluded at 7:25 p.m.

Applicant must schedule a site inspection with the Chief Building Official and the
Fire Marshal to review the exit plan for the building. Call 650-558-7270 to
schedule this inspection.
All construction must comply with the 2001 California Building Codes (CBC), the
Burlingame Municipal and Zoning Codes, and all other State and Federal
requirements.
Provide fully dimensioned plans.
Provide a title block on the plans that includes the name of the owner(s) and the
name, address, and phone number of the project designer.
Provide a complete demolition plan that indicates the existing walls, walls to be
demolished, new walls, and a legend. NOTE: The Demolition Permit will not
be issued until a Building Permit is issued for the project.
6) Comply with the new, 2005 California Energy Efficiency Standards for low-rise

about the legality of having the garbage pickup area mid-block from the restaurant, is that legal? Has the
city received any complaints about the graphite on the public phone booth? How does the applicant intend
to address the three weedy planting areas? Also it appears that the trellis on the building is full of dry rot,
how is the applicant intending to address its repair if they are not doing any work to the front of the building
besides painting? Staff suggested that these items be addressed by the applicant. There were no further
questions of staff.

Acting-Chair Cauchi opened the public hearing. Hong Li, applicant, represented the project. Applicant
noted she would answer questions. Commissioner noted concern about how the garbage would be handled,
where would it be stored, where would the cans be washed and cleaned? Applicant noted asked the
restaurant next door, they take their garbage to the easement down the street, the previous owner of this
business did the same for 7 years, walked the garbage down the street into the alley; cans are stored in the
alley, landlord says will let them use the hose from their kitchen to clean the cans. What do you intend to do
about the abandoned planters? Will put flowers in them. What will you do about the rotting trellis over the
window and the dry rot repairs to the exterior? We will fx the wood. What about the graphite on the public
phone? Do not know who owns the public phone. There were no further comments from the floor. The
public hearing was closed.
Commission comment: appears that this proposal is incomplete, need to address the garbage, the changes to
the exterior of the building which are a major concern and might result in the need for commercial design
review; need to see plans for the exterior planters and correction of wood rot, conditions should include the
requirement of a garden service to maintain the planters; it should be clear about how the graphite can be
removed or the pay phone can be removed before this comes back to the Commission; a garbage area should
be included inside this business equipped with hot water for cleaning the garbage cans and a proper drain, it
should be confirmed by the Health Department that it is appropriate to go through the seating area by Il
Piccolo to the easement for garbage deposit for pickup. Feel that the garbage disposal is a health issue and
of major concern, who owns the property where the cans are left for pick up, who is responsible for the
sanitation of the cans and of the area where they are stored, is it legal to take the garbage so far for pick up,
cannot act without this information. CA noted that the item can be continued to a date uncertain, will
renotice when all the information is provided.
C. Vistica moved to continue this item until the applicant has responded to all the questions, staff has
reviewed the application for completeness, and there is space on an agenda, this item will be renoticed at the
time it is placed on an agenda. The motion was seconded by C. Osterling.

WHEREAS, a categorical exemption has been proposed and application has been made for a

NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is no
substantial evidence that the project set forth above will have a significant effect on the
environment, and categorical exemption, per CEQA Article 19. Categorically Exempt per
Section: 15301 - Existing facilities, Class 1(a), interior or exterior alterations involving
such things as interior partitions, plumbing, and electrical conveyances.

SF of on-site seating, may change its food establishment classification only to a limited
food service upon approval of a conditional use permit amendment for the establishment;
the criteria for the new classification shall be met in order for a change to be approved;

date stamped January 24, 2007, floor plan and garbage room details, December 18, 2006,
site plan and ceiling plan, and that the 530 SF area of on-site seating of the full service
food establishment shall be enlarged or extended to any other areas within the tenant
space only by an amendment to this conditional use permit; and that all planters shall be
regularly maintained by a professional garden service contracted for by the business
operator;
3. that the conditions of the City Engineer's January 29, 2007 and October 5, 2006 memos,
the Chief Building Official's January 26, 2007, December 19, 2006 and October 6, 2006,
memos, the Recycling Specialist's October 16, 2006 memo, the Fire Marshal's January
29, 2007, December 20, 2006 and October 2, 2006 memos and the NPDES Coordinator's
January 29, 2007 and October 3, 2006 memos shall be met;
4. that proposed garbage room shall have a tile floor, washable walls 6' high, an exhaust fan
to the roof and the floor drain in the garbage room shall be connected to a new grease trap
before being discharged to the City's sewer line;
5. that demolition or removal of the existing structures and any grading or carth moving on
the site shall not occur until a building permit has been issued and such site work shall be
required to comply with all the regulations of the Bay Area Air Quality Management
District;
6. that prior to scheduling the framing inspection, the project architect, engineer or other
licensed professional shall provide architectural certification that the architectural details
such as window locations and bays are built as shown on the approved plans; if there is
no licensed professional involved in the project, the property owner or contractor shall
provide the certification under penalty of perjury. Certifications shall be submitted to the
Building Department;
7. that this food establishment shall provide trash receptacle(s) as approved by the city
consistent with the streetscape improvements and maintain all trash receptacle(s) at the
entrances to the building and at any additional locations as approved by the City Engineer
and Fire Department;
that the business shall provide litter control along all frontages of the business and within

Allowable Use: A Conditional Use Permit is required for changing from a specialty food shop to a full

History of Food Establishment Use at 1251 Broadway: In April 1992, the City Council approved a
conditional use permit and parking variance for a food establishment (Coffee Stop) at 1249 A Broadway
(March 16 and April 6, 1992 C.C. Minutes). In November 1998, the Planning Commission approved a
conditional use permit to extend hours of operation for Lobos Taqueria at 1251 Broadway (new address, same
tenant space) (November 9, 1998 P.C. Minutes). On February 28, 2006, the Planning Commission approved
an amendment to a conditional use permit for a specialty food establishment at 1251 Broadway as required by
Ordinance 1619. The conditions of approval for that amended conditional use permit are included in the staff
report.
On August 14, 2006, the Building Division issued a stop work order for the construction at 1251 Broadway
because no permit had been issued for the tenant improvements being made to the building. The applicant
applied to the Building Division for a building permit on September 9, 2006. No permit has been issued
because the project (new food establishment) requires a conditional use permit. No further improvements
have been made to the building since the stop work order was issued.
Summary: The applicant is proposing to change the food establishment classification at 1251 Broadway
(Broadway Commercial Area) from specialty food establishment, Lobos Taqueria, to a full-service food
establishment, Big Joe's Cafe, which requires a conditional use permit. The site is located on the southeast
corner of Broadway and Paloma Avenue. The full service food establishment will have approximately 530 SF
of seating area, the same seating area approved for the previous specialty food establishment.
A full service food establishment is defined as a business which sells food prepared indoors on the premise
with a full menu and provides an indoor seating area of at least 250 SF. Operating criteria for a full service
food establishment include most or all of the following: served by waiters to seated customers and where
payment is made at the end of the meal; presence of a full commercial kitchen and commercial dishwasher;
and food is served on ceramic plates with metal flatware and cloth napkins.
Conrlitional Use Permit I251 Broadtivay
The applicant notes that the proposed full service food establishment will serve meals all day including
breakfast, lunch and dinner. Tables, booths and counter seating will be provided. The business will have a
maximum of 2 full-time employees and 3 part-time employees on site at any one time (expectation in 5 years).
The applicant projects a total of 55 customers per day on weekdays and 65 customers per day on weekends. In
the future, the applicant anticipates a total of 65 customers per day on weekdays and 75 customers per day on
weekends. A maximum of 45 people are expected on site at any one time, including the owner, employees
and customers. The food establishment will be open seven days a week, from 7:00 a.m. to 10:00 p.m.
This site is nonconforming since it has no on-site parking (the existing building was built to lot line). The
proposed food establishment will be replacing an existing food establishment. No additional parking is
required as part of this application because there is no change or intensification of use on site and there is no
increase to the existing seating area (530 SF existing and proposed). An application for a conditional use
permit and parking variance for a food establishment was approved in April of 1992 for the Coffee Stop food
establishment. This parking variance stands with the existing and continued use on the property ( food
establishment) which requires 1 parking space for every 200 SF of gross floor area. Staff would note that
public parking is available on the street and in neighboring public Lots P(27 stalls), Q(24 stalls), and R(34

Staff comments: See attached. This project is not subject to commercial design review because the exterior
of the existing building will not be altered, the building will be repainted with the same colors as existing.
Regular Action Meeting: At the December 11, 2006, Planning Commission regular action meeting, the
Commission had several questions concerning the garbage area, improvements to the front of the building and
removal of an existing pay phone. The Commission moved to continue this item until the questions raised
have all been addressed and have been reviewed by the Planning Department (December 11, 2006 P.C.
Minutes).
On December 18, 2006, the applicant submitted revised plans and a response letter to address the
Commission's questions and concerns. Those plans were routed around to the city various departments for
review. After additional comments were made by the Chief Building Official and Fire Marshall, the applicant
again revised the plans and their response letter and submitted them to the Planning Department on December

26, 2006. Included in the responses was a copy of the floor plan which had been reviewed by the San Mateo
County Health Department stamped with a"Conditional Approval Only" stamp. The floorplan included the
new indoor garbage area.
The following is a list of all Commissioners questions and comments followed by the responses by the
applicant and by staf£
1. What is the legality of having the garbage pickup area mid-block from the restaurant? Is it legal to
take the garbage so far for pickup? Where is garbage going to be stored? Where will garbage cans
be washed and cleaned? A garbage area should be included inside this business equipped with hot
water for cleaning the garbage cans and a proper drain; it should be confirmed by the Health
Departmerit that it is appropriate to go through the seating area by Il Piccolo to the easemerit for
garbage deposit for pickup. Who owns the property where the cans are left for pickup? Who is
responsible for the sunitation of the cans and of the area where they are stored?
■ The applicant revised the plans to address the Commissions concerns about the location of the
existing garbage area. The applicant added a garbage can area with a drain and a hot and cold
water faucet with a vacuum breaker inside the existing building towards the rear exit. This
area will be used to store and clean the garbage cans. The applicant also notes that this area
will be kept clear so it does not block the path of the fire exit. It is envisioned that the cans
will be wheeled out on a daily basis for curbside garbage pickup (response letter from
applicant, date stamped December 26, 2006, and revised plans, sheet A-1, date stamped
December 18, 2006).
■ Staff would note that the plans indicating the new indoor garbage storage location with the
drain and water faucet were reviewed by the Chief Building Official and Fire Marshall prior to
their January 2, 2007, inspection of the site. The applicant also submitted a copy of sheet A-1
that was reviewed and stamped for "conditional approval" of the proposed garbage area by the
County Health Department. After the site inspection and review of the plans stamped by the
County Health Department, the Chief Building Official stated that he had no further comments
about the project at this time; and that it could be scheduled on the Planning Commission
agenda.
2. How does the applicant intend to address the three weedy planter areas? It appears that the trellis on
the building is full of dry rot, how is the applicant intending to address its repair if they are not doing
any work to the front of the building besides painting? Need to see plans for the exterior planters and
correction of wood rot; conditions shoul�l include the requirement of a garden service to maintain the
planters.
■ The applicant revised the plans to indicate that all damaged trellis and planter areas will be
repaired to their original shape and color. The applicant also noted that a landscaping
company will be hired to clean out and replant the planting areas and that they will be
maintained by Big Joe's staff (response letter from applicant, date stamped December 26,
2006, and revised plans, sheet A-1, date stamped December 18, 2006). Staff would note that
the changes proposed to the planter and trellis areas are minor and do not require commercial
design review, and that a note was added to condition # 2 that requires the planters to be
maintained regularly by a professional garden service.

3. Has the Ciry received any complaints about the graffiti on the public phone booth? What will
applicant do about the graffiti on the public phone booth? It should be clear about how the graffiti
can be removed or the puy phone can be removed before this comes back to the Commission.
■ The applicant noted that they have contacted the Paciiic Pay Phone Company to remove the
public pay phone booth from the entrance to the property (response letter from applicant, date
stamped December 26, 2006). Staff would note that a condition regarding the timing of the
removal of the pay phone has been added.
Study Meeting: At the November 27, 2006, Planning Commission study meeting, the Commission had
several questions and placed this item on the regular action calendar when all the information had been
submitted and reviewed by the Planning Department (November 27, 2006 P.C. Minutes). On November 30,
2006, the applicant submitted a response letter, a diagram, some photographs and a sample menu to address
the Commissions questions and concerns. A copy of the November 27, 2006 Planning Commission study
hearing and the response letter from the applicant are included in the staff report packet.
Findings for a Conditional Use Permit: I�i order to grant a conditional use permit for a full service food
establishment, the Planning Commission must find that the following conditions exist on the property (Code
Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare,
or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame general
plan and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the
general vicinity.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action
should be taken by resolution and should include finding for the conditional use permit. The reasons for any
action should be clearly stated for the record. At the public hearing the following conditions should be
considered:
1. that this business location to be occupied by a full service food establishment, with 530 SF of on-site
seating, may change its food establishment classification only to a limited food service upon approval
of a conditional use permit amendment for the establishment; the criteria for the new classification
shall be met in order for a change to be approved;
2. that the project shall be built as shown on the plans submitted to the Planning Department date
stamped December 18, 2006, floor plans, site plan and ceiling plan, and that the 530 SF area of on-site
seating of the full service food establishment shall be enlarged or extended to any other areas within
the tenant space only by an amendment to this conditional use permit; and that all planters shall be
regularly maintained by a professional garden service contracted for by the business operator;
3. that the applicant shall have the pay phone located at the entrance to this business removed before a
final inspection is scheduled;

4. that the conditions of the City Engineer's October 5, 2006 memo, the Chief Building Official's
December 19, 2006 and October 6, 2006, memos, the Recycling Specialist's October 16, 2006 memo,
the Fire Marshal's December 20, 2006 and October 2, 2006 memos and the NPDES Coordinator's
October 3, 2006 memo shall be met;
5. that demolition or removal of the existing structures and any grading or earth moving on the site shall
not occur until a building permit has been issued and such site work shall be required to comply with
all the regulations of the Bay Area Air Quality Management District;
6. that prior to scheduling the framing inspection, the project architect, engineer or other licensed
professional shall provide architectural certification that the architectural details such as window
locations and bays are built as shown on the approved plans; if there is no licensed professional
involved in the project, the property owner or contractor shall provide the certification under penalty
of perjury. Certifications shall be submitted to the Building Department;
7. that this food establishment shall provide trash receptacle(s) as approved by the city consistent with
the streetscape improvements and maintain all trash receptacle(s) at the entrances to the building and
at any additional locations as approved by the City Engineer and Fire Department;
8. that the business shall provide litter control along all frontages of the business and within fifty (50)
feet of all frontages of the business;
9. that an amendment to this conditional use permit shall be required for delivery of prepared food from
this premise;
10. that there shall be no food sales allowed at this location from a window or from any opening within 10'
of the property line;
11. that this full service food establishment may be open seven days a week, from 7:00 a.m. to 10:00 p.m.,
with a maximum of 2 full-time employees and 3 part-time employees on site at any one time,
including the business owner and manager;
12. that no banner shall be used per Title 22 Sign Code Section 22.48.080 and the applicant shall obtain
Planning and Building permits for all signage;
13. that if this site is changed from any food establishment use to any retail or other use, a food
establishment shall not be replaced on this site and this conditional use permit shall become void;
14. that the project shall provide adequate filtering and venting to avoid dissemination of odors on
neighboring properties; and
15. that the project shall meet all the requirements of the California Building Code and California Fire
Code, 2001 edition, as amended by the City of Burlingame, and that failure to comply with these
conditions or any change to the business or use on the site which would affect any of these conditions
shall require an amendment to this use permit.

the review of the Building Permit, the Planning Department noted that a conditional use permit
was required for the change in food establishment classification. The application to the
Planning Commission was not submitted until September 29th, and all additional materials
were not submitted to the Planning Department until November 9, 2006.
S. Is the exterior of the builcling really going to be painted the same color as existing? Does this

■ The applicant explained that it is their intention to make the Burlingame location the flagship
of Big Joes Cafe and that they also intend to retain the existing look of the building by only
touching up the existing design and black and red color scheme ofthe outside. The applicant
also explained that this color scheme will be transferred to the San Carlos location within the
next 18 months (response letter from applicant, date stamped November 30, 2006).
6. YYhere is garbage going to be stored? Where will garbage cans be washed out? This should not take
place irt the public sidewalk. Where is the food establishment next door storing arad washing out their
cans?
The applicant noted that the garbage cans are stored and washed out in a designated area next
to the building which is shared by the neighboring stores and restaurants and which will
operate in the same fashion as Lobos Taqueria. They also noted that the bags of garbage will
be collected and carried to the garbage can in this designated area at the end of each shift
(response letter and diagram from applicant indicating common garbage storage area, date
stamped November 30, 2006).

Findings for a Conditional Use Permit: In order to grant a conditional use permit for a full service food
establishment, the Planning Commission must find that the following conditions exist on the property (Code
Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare,
or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame general
plan and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the
general vicinity.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action
should be taken by resolution and should include finding for the conditional use permit. The reasons for any
action should be clearly stated for the record. At the public hearing the following conditions should be
considered:
1. that this business location to be occupied by a full service food establishment, with 530 SF of on-site
seating, may change its food establishment classification only to a limited food service upon approval
of a conditional use permit amendment for the establishment; the criteria for the new classification
shall be met in order for a change to be approved;
2. that the project shall be built as shown on the plans submitted to the Planning Department date
stamped September 29, 2006, sheets A-1 thru A-3, and that the 530 SF area of on-site seating of the
full service food establishment shall be enlarged or extended to any other areas within the tenant space
only by an amendment to this conditional use permit;
3. that the conditions of the City Engineer's October 5, 2006 memo, the Chief Building Official's
October 6, 2006, memo, the Recycling Specialist's October 16, 2006 memo, the Fire Marshal's
October 2, 2006 memo and the NPDES Coordinator's October 3, 2006 memo shall be met;
4. that demolition or removal of the existing structures and any grading or earth moving on the site shall
not occur until a building permit has been issued and such site work shall be required to comply with
all the regulations of the Bay Area Air Quality Management District;
5. that prior to scheduling the framing inspection, the project architect, engineer or other licensed
professional shall provide architectural certification that the architectural details such as window
locations and bays are built as shown on the approved plans; if there is no licensed professional
involved in the project, the property owner or contractor shall provide the certification under penalty
of perjury. Certifications shall be submitted to the Building Department;
6. that this food establishment shall provide trash receptacle(s) as approved by the city consistent with
the streetscape improvements and maintain all trash receptacle(s) at the entrances to the building and
at any additional locations as approved by the City Engineer and Fire Department;

10. that this full service food establishment may be open seven days a week, from 7:00 a.m. to 10:00 p.m.,
with a maximum of 2 full-time employees and 3 part-time employees on site at any one time,
including the business owner and manager;
11. that no banner shall be used per Title 22 Sign Code Section 22.48.080 and the applicant shall obtain
Planning and Building permits for all signage;
12. that if this site is changed from any food establishment use to any retail or other use, a food
establishment shall not be replaced on this site and this conditional use permit shall become void;
13. that the project shall provide adequate filtering and venting to avoid dissemination of odors on
neighboring properties; and

Allowable Use: A Conditional Use Permit is required for changing from a specialty food shop to a full
service food establishment. Please note that once a specialty food shop changes to any
other food establishinent classification, the site may not return to a specialty food shop
(C.S. 25.36.043 d, 4).
History: In April 1992, the City Council approved a conditional use permit and parking variance for a food
establishment (Coffee Ptop) at 1249 A Broadway (March 16 and April 6, 1992 C.C. Minutes). In November
1998, the Planning Commission approved a conditional use permit to extend hours of operation for Lobos
Taqueria at 1251 Broadway (new address, same tenant space) (November 9, 1998 P.C. Minutes). On February
28, 2006, the Planning Commission approved an amendment to a conditional use permit for a specialty food
establishment at 1251 Broadway as required by Ordinance 1619. The conditions of approval for that amended
conditional use permit are included in the staff report.
On August 14, 2006, the Building Division issued a stop work order at 1251 Broadway because no pernlit had
been issued for the tenant improvements being made to the building. The applicant applied to the Building
Division for a building permit on September 9, 2006, but no permit has been issued because this project
requires a conditional use permit. No further improvements have been made to the building since the stop
work order was issued.
Summary: The applicant is proposing to change the food establishment classification at 1251 Broadway
(Broadway Commercial Area)from specialty food establishment ,Lobos Taqueria, to a full-service food
establishment, Big Joe's Cafe, which requires a conditional use permit. The site is located on the southeast
corner of Broadway and Paloma Avenue. The full service food establishment will have approximately 530 SF
of seating area, the same seating area approved for the previous specialty food establishment.
A full service food establishment is defined as a business which sells food prepared indoors on the premise
with a full menu and provides an indoor seating area of at least 250 SF. Operating criteria for a full service
food establishment include most or all of the following: served by waiters to seated customers and where
payment is made at the end of the meal; presence of a full commercial kitchen and commercial dishwasher;
and food is served on ceramic plates with metal flatware and cloth napkins.
The applicant notes that the proposed full service food establishment will serve meals all day including

breakfast, lunch and dinner. Tables, booths and counter seating will be provided. The business will have a
maximum of 2 full-time employees and 3 part-time employees on site at any one time (expectation in 5 years).
The applicant projects a total of 55 customers per day on weekdays and 65 customers per day on weekends. In
the future, the applicant anticipates a total of 65 customers per day on weekdays and 75 customers per day on
weekends. A maximum of 45 people are expected on site at any one time, including the owner, employees
and customers. The food establishment will be open seven days a week, from 7:00 a.m. to 10:00 p.m.
This site is nonconforming since it has no on-site parking (the existing building was built to lot line). The
proposed food establishment will be replacing an existing food establishment. No additional parking is
required as part of this application because there is no change or intensification of use on site and there is no
increase to the existing seating area (530 SF existing and proposed). An application for a conditional use
permit and parking variance for a food establishment was approved in April of 1992 for the Coffee Stop food
establishment. This parking variance stands with the existing and continued use on the property ( food
establishment) which requires 1 parking space for every 200 SF of gross floor area. Staff would note that
public parking is available on the street and in neighboring public Lots P(27 stalls), Q(24 stalls), and R(34
