Date: Februa 23, 2007 Mar aret Monro , Ci Planner �� RESOLUTION APPROVING CATEGORICAL EXEMPTION AND CONDITIONAL USE PERMIT RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a conditional use permit for a full service food establishment at 1251 Broadway, zoned C-1, Broadway Commercial Area KJ Nickmeg LLC, c/o Jerry Lee, 456 Montgomery Street, Suite 700, San Francisco, CA, APN: 026-193-300; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on February 12, 2007, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19. Categorically Exempt per Section: 15301 - Existing facilities, Class 1(a), interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances. 2. Said conditional use permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such conditional use permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. � Chai I, , Secretary of the Planning Commission of the City of Burlingame, do here certify t at the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 12th day of February, 2007 by the following vote: � EXHIBIT "A" Conditions of approval for categorical exemption and conditional use permit. 1251 Broadway Effective February 22, 2007 l. that this business location to be occupied by a full service food establishment, with 530 SF of on-site seating, may change its food establishment classification only to a limited food service upon approval of a conditional use permit amendment for the establishment; the criteria for the new classification shall be met in order for a change to be approved; 2. that the project shall be built as shown on the plans submitted to the Planning Department date stamped January 24, 2007, floor plan and garbage room details, December 18, 2006, site plan and ceiling plan, and that the 530 SF area of on-site seating of the full service food establishment shall be enlarged or extended to any other areas within the tenant space only by an amendment to this conditional use permit; and that all planters shall be regularly maintained by a professional garden service contracted for by the business operator; 3. that the conditions of the City Engineer's January 29, 2007 and October 5, 2006 memos, the Chief Building Official's January 26, 2007, December 19, 2006 and October 6, 2006, memos, the Recycling Specialist's October 16, 2006 memo, the Fire Marshal's January 29, 2007, December 20, 2006 and October 2, 2006 memos and the NPDES Coordinator's January 29, 2007 and October 3, 2006 memos shall be met; 4. that proposed garbage room shall have a tile floor, washable walls 6' high, an exhaust fan to the roof and the floor drain in the garbage room shall be connected to a new grease trap before being discharged to the City's sewer line; 5. that demolition or removal of the existing structures and any grading or earth moving on the site shall not occur until a building permit has been issued and such site work shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 6. that prior to scheduling the framing inspection, the project architect, engineer or other licensed professional shall provide architectural certification that the architectural details such as window locations and bays are built as shown on the approved plans; if there is no licensed professional involved in the project, the property owner or contractor shall provide the certification under penalty of perjury. Certifications shall be submitted to the Building Department; 7. that this food establishment shall provide trash receptacle(s) as approved by the city consistent with the streetscape improvements and maintain all trash receptacle(s) at the entrances to the building and at any additional locations as approved by the City Engineer and Fire Department; 8. that the business shall provide litter control along all frontages of the business and within fifty (SO) feet of all frontages of the business; 9. that an amendment to this conditional use permit shall be required for delivery of prepared food from this premise; EXHIBIT "A" Conditions of approval for categorical exemption and conditional use permit. 1251 Broadway Effective February 22, 2007 10. that there shall be no food sales allowed at this location from a window or from any opening within 10' of the property line; 11. that this full service food establishment may be open seven days a week, from 7:00 a.m. to 10:00 p.m., with a maximum of 2 full-time employees and 3 part-time employees on site at any one time, including the business owner and manager; 12. that no banner shall be used per Title 22 Sign Code Section 22.48.080 and the applicant shall.obtain Planning and Building permits for all signage; 13. that if this site is changed from any food establishment use to any retail or other use, a food establishment shall not be replaced on this site and this conditional use permit shall become void; 14. that the project shall provide adequate filtering and venting to avoid dissemination of odors on neighboring properties; and 15. that the project shall meet all the requirements of the California Building Code and California Fire Code, 2001 edition, as amended by the City of Burlingame, and that failure to comply with these conditions or any change to the business or use on the site which would affect any of these conditions shall require an amendment to this use permit. Nickmey Llc propertv ownerL(67 noticed Proiect Planner: Erica Strohmeier Commissioner Deal noted that he lives within 500 feet of the project and will recuse himself from the proceedings. He left the chambers. Reference staff report dated January 22, 2007, with attachments. ZT Strohmeier presented the report, reviewed criteria and staff comments. Fifteen (15) conditions were suggested for consideration. Commission commented that the graffiti is still on the front of the building, thought it was to be removed before the proj ect came back. CP noted this might not have been clearly understood. There were no further questions of staff. C. Auran moved to continue the item until the graffiti has been removed from the building stating that the applicant and building owner have done nothing with the graffiti when all it takes is paint. The motion was seconded by C. Brownrigg. 2 City of Burlingame Planning Commission Unapproved Minutes January 22, 2007 Chair Brownrigg opened the public hearing and discussion of the motion. Hong Lily Li, 1251 Broadway, and Ken Toy, 1251 Broadway, represented the project. Commission commented: ■ Called attention to the graffiti on the phone booth and the building at the study meeting; the graffiti is a violation and should be removed immediately by the property owner or tenant; ■ There are requirements for certain types of wall finishes in a can wash area, what types of finishes will be used; could do a tile wall 4' high in area; issues are wall finishes, floor finishes and wall base; think that tile wall needs to be higher than 4'; a mop sink needs to be included; ■ The location of the garbage area is a matter of sanitation; not sanitary to be washing cans as shown; also will be issues with smell and ventilation; ■ Toyo company prepared plans, information needs to get from this hearing into the revisions on the plans; ■ Answers are inadequate in regards to the garbage area which has just been wedged into the exit area; information on how the garbage area is going to be detailed is not included on the plans; if the details are not called out on the plans they will get overlooked; this visible to the diners and not the type of design encouraged in Burlingame; ■ Think it is great that another garbage solution is being researched; want to have no problems with garbage and clean-up area; and ■ How much foot traffic will be going through this area? ■ Next submittal shall include interior elevations for the garbage can storage/wash area with egress addressed The applicant responded that they did not think they could remove the graffiti without a Building Permit; two sides of the garbage area are glass, and the other two sides are in the exit way to the restaurant and the second exit doorway from the restaurant; the finish on the walls will be waterproof with wall tiles or other materials; the fire department wants the area open for an exit path; and they thought the revised plans addressed the access to the gazbage area and rear exit. There were no further comments and the public hearing was closed. Commission commented: can support the motion to continue and resubmit after the removal of the graffiti and in order to resolve the garbage situation, maybe the architect could come to the next meeting and explain what is going on in the plans; design review provides a method to offer assistance to the applicant, staff responded that there was no assistance for interior improvements only; the applicant could come in and listen to the tapes; do not think applicant is allowed to remove the pay phone without the owner's consent to remove, uncomfortable asking the applicant to remove something without permission. Chair Brownrigg called for a voice vote on the motion to continue. The motion passed on a 6-0-1 (C. Deal abstaining). Appeal procedures were advised. This item concluded at 7:25 p.m. C.
