Sununary: The applicant, Alene Brisbane, is requesting a conditional use permit and take-out permit
amendment to allow a change in hours of operation and take-out service for a mexican grill to replace
The Coffee Stop at 1251 Broadway, zoned C-1, Broadway Commercial Area. In April, 1992 the City
Council approved a conditional use permit and parking variance for a food establishment at this location
(April 6, 1992 C.C. Minutes). This approval included a take-out permit (July 27, 1992 P.C. minutes).
Condition #3 of the April 6, 1992 conditional use permit and variance approval limits the hours of
operation to Monday through Friday 6:30 a.m. to 7:00 p.m. and Saturday and Sunday 7:00 a.m. to 5:00
p.m. (see attaclled action letter dated April 7, 1992). The applicant is proposing to amend the hours
of operation to 7:00 a.m. to 10:00 p.m. seven days a week.
The proposed mexican grill restaurant would occupy the 1724 SF space now occupied by The Coffee
Stop. The zoning code limits the number of food establishments in the Broadway Commercial Area to
those existing in 1985 or those which have a use permit for food establishment use. This location is an
existing food establish►nent wl�ich may be replaced by another food establishment.
The business will be open Monday through Sunday from 7:00 a.m. to 10:00 p.m. They will have 5
full-time employees before 5:00 p.m. and 3 full-time and 2 part-time employees after 5:00 p.m. on
weekdays. On weekends, there will be S fiill-time and 1 part-time employees before 5:00 p.m. and 3
full-time and 2 part-time employees after 5:00 p.m. The number of employees is expected to remain
the same in five years.

A maximum of 150 customers per day are expected before 5:00 p.m. on weekdays and on weekends.
After 5:00 p.m. between 50-100 customers per day are expected. In five years, these numbers are
expected to stay the same. The maximum number of customers and employees on site at any one time
is expected to be 35 people. Public parking is available in Lot P(26 metered stalls), Lot Q(24 metered
stalls), and Lot R(34 metered stalls) and in 1-hour metered stalls along Broadway.

This project meets all other zoning code requirements.
Staff Comments: The Fire Marshal notes (October 13, 1998 memo) that the kitchen is to be protected
by an automatic �re extinguishing system. The Chief Building Official and City Engineer had no
comment on this project. Planning staff would note that the "pizza prep table" listed on the floor plan
is a generic term and the table will be used for preparation of tacos and other mexican food. The
applicant currently operates the Taqueria Zapata at 1850 Collingwood (near Castro Street) in San
Francisco.
Required Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit the
Planning Commission must fnd that the following conditions exist on the property (Code Section
25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame
general plan and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems
necessary to secure the purposes of this title and to assure operation of the use in a manner
compatible with the aesthetics, mass, bulk and character of existing and potential uses on
adjoining properties in the general vicinity.

Conditional Use Permit and Take-out Per�nit An:endment
1251 Broadway
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution. The reasons for any action should be clearly stated for the record.
At the public hearing the following conditions should be considered:
1. that the restaurant shall be remodeled as shown on the plans submitted to the Planning
Department date stamped October 8, 1998, with 530 SF of seating area;
2. that the conditions of the Fire Marshal's October 13, 1998 memo shall be met;
3. that the business may not be open for business except during the hours of 7:00 a.m. to 10:00
p. m. daily;
4. that there shall be a maximum of seven employees, including the owner, on site at any one time;
5. that the project shall provide adequate filtering and venting to avoid dissemination of odors on
neighboring properties;
6. that an enclosed and ventilated garbage storage area shall be maintained at the rear of the site and
that garbage cans shall be kept in the storage area until such time garbage is picked up and upon
pick-up cans shall immediately be returned to the storage area;
7. that no banner signs shall be used per Title 22 Sign Code Section 22.48.080 and the applicant
shall obtain planning and building permits for all signage;
8. that this project shall meet all the requirements of the California Building and Uniform Fire
Codes, 1995 Edition, as amended by the City of Burlingame; and
9. that the project shall be reviewed for compliance with these conditions in six months (May,
1999) or upon complaint.

Dear Members of the Commission:
Please accept this additional letter-of-explanation in order to give further information as to the
proposed nature and use of the facility at 1251 Broadway. In summary, we are intending to run
a first-rate, high-value, neighborhood Mexican Grill that will serve authentic Mexican Food and
related items. Due to the nature of the proposed establishment, please allow us to explain the
need to change the hours of business and the impact of parking.
Hours of Operation: As the property is currently zoned as (and intended to be) a restaurant, the
purpose of tl�is Special Permit Application is to change the hours of business from it's current
definition (Monday through Friday 6:30am to 7:OOpm and Saturday and Sunday 7:OOam to
S:OOpm) to hours more appropriate for a Breakfast, Lunch, Dinner establishment as are the
surrounding restaurants. Our proposed hours are Monday through Sunday, 7:OOam to 10:00pm.
Parkin�: The impact of parking needed to cater to customers/visitors will be minimal. Our goal
is to be a high value neighborhood business which relies upon repeat customers from the area.
We do not expect to be a destination type restaurant. Rather, this will be the type of facility that
surrounding residents will walk to; retail shoppers will stop by during their shopping day; and
commuters walking to and fro►n the train station will visit to get a quick bite to cat. Retail shop
employees will also have another choice for their daily lunches. Therefore, it is expected that the
impact of additional parking will be minimal to none.
As the partners are native residents of the Peninsula, we are very familiar and excited with the
prospect of having a business in the City of Burlingame that will cater to the Burlingame
consumer as well as add an additional cuisine to the Cosmopolitan nature so identified with the
San Francisco Bay Area.

A closed session regarding property acquisition and litigation
was called to order at 7:0o p.m. in Conference Room A at City
Hall. All council members were present.
CALL TO ORDER
A duly noticed regular meeting of the Burlingame City Council was
held on the above date in the City Hall Council Chambers. The
meetinq was called to order at 7:38 p.m. by Mayor Frank Paqliaro.

The minutes of the Regular Meeting of March 16, 1992 and the
S dy Meeting of March 18, 1992 were unanimously approved on
mot'on of Councilwoman O'Mahony, second by Councilman Harrison.
Mayor Pagli�o announced council had reached a decision after
several closed`sessions and a study session regarding parking on
Broadway and th urchase of property for a parking,.lot. Coun-
cilman Harrison no d there was mone in the

purchase of this pro rty; he moved the city archase 1133 Chula
Vista for the price of 630,000, that ther e no der�olition
until the city sells the arking lot on inette, and effective
July 1, 1992 the parking f d be abol' ed and henceforth parking

Councilwoman O Mahony.
Councilwoman Knight said she�uld ote against this proposal;
she agreed that any money s,pent on pa king should be in the
Broadway area, but with a� the other m'or capital projects
before the city she did�iot feel the cit hould spend the money
on this parking lot.,,/
Councilman Lembi aid the city is coming out o he recession,
and sales tax ' come is up; this purchase will be positive
addition to oadway and assist the merchants and re 'dents.
Mayor Pagl' ro commented council had pledged to help t mer-
chants o Broadway. Councilwoman O'Mahony was pleased to.,,support
this m ion, Broadway has been waiting too long for a parking
lot, is purchase will have 48 parking spaces, the Rhinette lot
onl has 26 and is not used; the parking fund has the money for
� s purchase. The motion carried 4-i on roll call vote, Coun-
ilwoman Knight voting no.
CONTINUED APPEAL FOR A SPECIAL PEZMIT AND PARKING VARIANCE FOR A

City Planner's memo of March 23 recommended council take action;
the public hearing was held on March 16 and council continued
action to tonight's meeting. The applicant, Steve I,ebb, and the
property owner, htiaok Leung and Chui Fonq Wong, are requesting a
special permit for an eating establishment and a three space
parking variance. The Planning Commission voted 3-3 for denial

of the request; under rules of the commission a tie votc is a
denial of a request. '
Councilwoman o�Mahony said she thought long and hard about this
project and decided it was a good project for Broadway. She
moved to grant the special permit and variance with conditions in
staff report. Councilman Harrison seconded the motion and com-
mented we would never solve the traffic circulation problems on
Broadway because of the location of the freeway access; this
project will enhance Broadway and would not be detrimental or
injurious; council has given other businesses larger parking
variances.
Councilwoman Knight, at the last meeting, had moved to deny this
request because the project would create more traffic and parking
problems; she thought it would be detrimental to the area and
could find no extraordinary circumstances to grant a variance.
Councilman Lembi said there was nothing that would alleviate the
traffic flow problems since Broadway was the access to freeway;
and if people can't park they will not stop. The motion carried
4-1 on roll call vote, Councilwoman Knight voting no.
May Pagliaro announced that council would hear protests abo�
the Ds but because this is a new proposal, council would 1' ten
to con erns and allow time to think about the proposal, co cil
would nqt take action until the meeting of April 20. He ted
council i`¢ neutral in this matter, this is a proposal fr m the
merchants'`associations. �
The City Attorney reviewed his memo of March 19 whicK recommended
council hold t,�wo separate public hearings on forma��on of the
districts. Bus,�ness improvement districts are fo� ed under •
Street and High�Says Code Section 36500 et seq. fiouncil can
determine to forill��both districts, or one, or ne�'ither; it can
revise the assessments, zones and purposes anc� can reduce the
area of the propose�"d districts. The only li�iit on action is that
a district cannot be`'c�formed if council rece,� ves written protests
from a majority of the� value of the assess�iients. He announced
that any more written rotests must be r�eived at the beginning
of the hearing; written withdrawals of rotests must be received
by the end of the hearin ,. /�
Councilman Harrison told tk`t audienc,�'�that another reason council
is not makinq a decision to 'ght islthat written protests handed
in toniqht will have to be co ntec�to determine if there is a
majority protest. Mayor Pagl'a.d had some questions on the
wording of the ordinances; won ed if the district would have to
get approval from council befo it could increase assessments;
asked about fines for unpaid � se �sments; City Attorney and
Finance Director reviewed ho�i busi ss license fines are collect-
ed; the city will incur exp�nses in ollecting these assessments,
would the city be repaid; �lection o the Board of these dis-
tricts; can the BID be el�minated by vote of council. Council-
man Lembi wondered who�ars appeals f�assessments, city
council or the Board o the district.

David Hinckle, 161+� Sanchez and owner of Earth eam Foods on
Broadway, reporte� the idea of a BID was presen d to the Broad-
way Merchants �sociation over a year ago, they cided to adopt
the proposal a requested help from the city in 'ring a consul-
tant; the mer ants held open meetings on this; see s the best
possible t�et od to effect real lasting change, make ong term
improvement , provide liaison with city and provide a nited
approach t improving Broadway; they propose to clean dewalks,
advertise�'and promote the area, provide for commercial cruit-
ment and ,retention of business and improve parking enforc ent.

Commission discussion: there appears to be three choices: no
improvements beyond maintenance without removing one unit; allow
expansion of floor area and footprint increase to the primary but not
the second unit; allow floor area and/or footprint to both units. A
key aspect of this is that some of these units are so advanced in age
that they need major rehabilitation which exceeds the narrow
interpretation of the code; there should be review of major remodels
in this situation, but there appears to be a need to allow something
beyond minor maintenance and repair; policy change should be reviewed
by the City Council, if done by ordinance change they would have to act
on it.
Commission directed the City Attorney and City Planner to develop a
change to the ordinance which would define the primary residential
structure on such a lot, would establish criteria to be used in this
determination, would require a special permit or commission review of
expansion of such a unit and would limit improvements to those as
defined in the UBC.

� clarify that the action on this permit had included take out sales.

A. CP Monroe reviewed the staff inemo, 7/27/92 with attachments, in
which it noted that at study the commission�had requested that this
applicant prepare a parking and traffic study to address the
intensification of use and expansion of floor area proposed by this
project in Subarea A of the Burlingame Avenue Commercial Area. The
applicant submitted a letter stating that they wished to move to
hearing before the co7nmission without preparing the study. The
commissioners noted that this was a big variance request and the
parking and traffic information would serve as another input in that
determination. The City Attorney noted that in these proceedings the
burden is on the applicant to present evidence. If the evidence is
insufficient because of the absence of the traffic and parking study,
it is not the City's responsibility. With that point clear, the
commission determined that the application could be brought forward
without the traffic and parking study.
- CP Monroe reviewed the City Council actions at its July 20, 1992
regular meeting.

At their meeting of March 16, 1992 the City Council held an appeal
hearing on your application for a special permit and parking variance

Commercial Area. Following the public hearing Council continued its
decision to the meeting of April 6, 1992 and at that time approved your
application with the following conditions:
1. that the proj ect shall be built as shown on the� plans submitted to
the Planning Department and date stamped December 26, 1991 Floor
Plan and Site Plan;
2. that the conditions of the Chief Building Inspector's December 27,
1991 memo (provide handicap restrooms) and the Fire Marshal's
January 6, 1992 memo (if building renovations exceed $50,000 the
building will require a sprinkler system) shall be met;
3. that this business shall operate Monday through Friday 6:30 A.M.
to 7:00 P.M. and Saturday and Sunday 7:00 A.M. to 5:00 P.M. with
a maximum of 10 employees, including the owner, on site at one
time;
4. that the project shall provide adequate filtering and venting to

RESOLUTION AFPROVING CATEGORICAL EXEMPTION
AND AMENDMENT TO CONDITIONAL USE AND TAK�OUT PERMITS
RESOLVED, by the Planning Commission of the City of Burlingame that:

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
November 9� 1998 , at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption, per
CEQA Article 19, Section 15301, existing facilities, operation of existing private structures involving
negligible or no expansion of use beyond that previously existing, is hereby approved.
2. Said amendment to conditional use and take-out permits is approved, subject to the
conditions set forth in Exhibit "A" attached hereto. Findings for such amendment to conditional use and
take-out permits are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

Conditions of approval
Categorical Exemption and Amendment to Conditional Use and Take-out Permits
1251 Broadway
effective NOVEMBER 16, 1998
1, that the restaurant shall be remodeled as shown on the plans submitted to the Planning
Department date stamped October 8, 1998, with 530 SF of seating area;
2. that the conditions of the Fire Marshal's October 13, 1998 memo shall be met;
3. that the business may not be open for business except during the hours of 7:00 a. m. to 10:00
p.m. daily;
4. that there shall be a maximum of seven employees, including the owner, on site at any one
time;
5. that the project shall provide adequate filtering and venting to avoid dissemination of odors
on neighboring properties;
6. that an enclosed and ventilated garbage storage area shall be maintained at the rear of the
site and that garbage cans shall be kept in the storage area until such time garbage is picked
up and upon pick-up cans shall immediately be returned to the storage area;
7. that no banner signs shall be used per Title 22 Sign Code Section 22.48.080 and the
applicant shall obtain planning and building permits for all signage;
8. that this project shall meet all the requirements of the California Building and Uniform Fire
Codes, 1995 Edition, as amended by the City of Burlingame; and
9. that the project shall be reviewed for compliance with these conditions in six months (May,
1999) or upon complaint.
