MEMO TO: PLANNING COMMISSION

SiJBJECT: VARIANCE FOR AN ADDITION TO AN EXISTING GARAGE
AT 1452 VA�iCOUVER AVENUE
The applicants, Oriano and Patricia Simonetti, have applied for a
Variance to make a 130 SF addition to the rear of their garage which is
built to the side lot line (a 4' minimum side yard is required if the
structure is not entirely within the rear 30$ of the lot - Code Sec.
25.66.050). A Variance is required since the proposed addition is also
built to the property line, extending the nonconforming side yard
another 10' (Code Sec. 25.50.070). The result will be a 28'-6" deep
garage (outside dimensions). No partition walls or plumbing are shown
on the plans inside the structure. The proposal complies with other
zoning requirements for accessory structures.
Applicant's Letter
The applicant's architect, Paul Rush, explains in his December 23, 1985
letter that the addition is needed because the present garage is not
deep enough to park their car and "the selected ... location is the
only one that will provide proper cover ... to protect the vehicle."
(The existing garage door is in line with the addition; if the addition
were shifted to the other side of the garage, therefore providing a
side yard for the addition itself, they would have to park the car at
an angle inside the garage.) He states that the extraordinary
circumstances involve the present garage having been built on the
property line.
Staff Comments
The application was reviewed by staff. The Fire Department and Public
Works had no comments on the application. The Chief Building Inspector
(January 3, 1986 memo> is requiring a one hour wall on the property
line with no openings and all drainage is to be away from the property
line.
Commission Action
The Planning Commission should hold a public hearing. If findings can
be made to support the Variance, the following conditions should be
considered:
l. that the requirements of the Chief Building Inspector (January 3,
1986 memo) be met; and
2. that no portion

The subject property i.�roveznen.ts were built prior to existing set back requirements;
The existing garage was constructed on the South property line.
The Owners wish to secure a variance for garage addition ( 10' x 13' - see site plan ).
The addition is loca.ted to the rear of existing garage and on South property line - in
line with existing garage wall. The Owner can not park a vehicle within the 18' - 6"
(outside dim.) space and would result in an extren�e hardship , if vehicle were parked
off site or in open driveway ( vehicle is a new car ).
A study was made of the site by the Owner & Architect, the selected addition / location
is the vnly one tha.t will provide proper cover/enclosure to protect the vehicle. The
location is in an isolated position and provides the best function without interfering
with any proposed or existing functions.
There are exceptional and extraordinary circtIlnstances applicable to this property in
the district (existing garage naw set on property line and lot sizes).
The granting of this application is necessary for the preservation and enj oyment of a
substantial property right of this applicant, and to prevent unreasona.ble property loss
and tmnecessary hardship.
The granting of this application will not be detrimental or inj urious to property or
improvezrbent in the vicinity; and will not be detrimental to the public health, safety,
general welfare, canvenience, or the quiet enjoyment of other properties or improve-
ments.
The granting of such variance will not adversely affect the ccmnprehensive zoning plan
of the city ( 1941 code & 1944 added by Ord. 539: Jan 4, 1954 and amended by Ord.
1037 & 4( part ): April 21, 1975: Ord. 1078 & 18; July 6, 1976 ).
The design of this facility is in keeping with good design practice and will not de-
tract any aesthetic qua.lity fram the area..
