Summary: The applicant is requesting a side setback variance for an existing 3'-2" side setback
to the existing first floor along the right (west) side property line, where 4'-0" is required by
code. The first floor remodel, second floor addition and new two car garage will add 1,627 SF
to the existing 1,554 SF house and garage. The size of the proposed addition triggers the new
construction definition and requires the entire existing dwelling to meet current code. The
addition and remodel increases the two bedroom house to four bedrooms but does not change
or intensify the existing substandard side setback situation. The proposed remodel and addition,
as well as the new garage, meets all other zoning code requirements.

Staff comments: The Senior Building Official commented in his 7anuary 29, 1996 memo that
there shall be no openings in walls less than 3'-0" from property line. The City Engineer and
the Fire Marshal had no comments.

Findings for a Variance:
In order to grant a variance the Planning Commission must find that the following conditions
exist on the property (Code Section 25.54.020 a-d):
(a) there are exceptional or extraordinary circumstances or conditions applicable to the
property involved that do not apply generally to property in the same district;
(b) the granting of the application is necessary for the preservation and enjoyment of a
substantial property right of the applicant, and to prevent unreasonable property loss or
unnecessary hardship;
(c) the granting of the application will not be detrimental or injurious to property or
improvements in the vicinity and will not be detrimental to the public health, safety,
general welfare or convenience;
(d) that the use of the property will be compatible with the aesthetics, mass, bulk and
character of existing and potential uses of properties in the general vicinity.
Planning Commission Action:
The Planning Commission should hold a public hearing. Affirmative action should be by
resolution and should include findings made for the variance requested. Reasons for any action
should be clearly stated. At the public hearing the following conditions should be considered:
1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped 7anuary 25, 1996, Sheets 1,2,3,4,5 adn 6; and
2. that the project sha11 meet all Uniform Building and Uniform Fire Code requirements as
amended by the City.

a. Our home was built many years ago with a 3'-2" setback on the west side. This
may have been because of the wide driveway (13'-7" side setback) leading to the
garage which is located at the rear of the property.. Our hope is to keep the
existing 3'-2" setback on the west side. The e�sting house width of 33'-2" will not
increase with the proposed construction and will be much smaller than the 42'-0"
the current code would allow. These factors make aur house narrower than
many houses in the neighborhood.
b. The existing setback is a result of the original placement of the house on the lot
and the long wide driveway to the east. It would be unreasonable to remove a one
foot wide strip along the east side resulting in a very expensive situation that
would make a nanow house even more narrow. The second floor which is the
most visible portion of the dwelling is set back and conforms to the declining
height envelope. The larger setback on the east side more than of�sets the
decrease of setback along the west side.
c. Our proposal is to update and bring back to splendor the existing dwelling and
make it an asset to the neighborhood. With the side driveway retained the width
of the house as seen from the street will not increase. These factors will not be
detrimental or injurious to property or improvements in the vicinity.
d. The proposed project will keep the e�sting dwelling style, and will be compatible
with the existing neighborhood with regard to mass and bulk. The e�sting side
driveway is to be retained and the dwelling will not increase in width.

RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND SIDE SETBACK VARIANCE
RFSOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
variance for an existing side setback of 3'-2" where 4'-0" is the minimum rec�uired for new
construction at 1325 Vancouver Avenue, APN: 027-151-160 ;�roperty owner: Knowlton and Gloria
Kin�, 2441 Cai�lmont Drive. Belmont ; and
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
February 26. 1996 , at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that
the project set forth above will have a significant effect on the environment, and categorical exemption
Article 19. Section: 15303 - Existing Facilities, Class 3(a), Single-family residences not in conjunction
with the building of two or more such units. In urbanized areas, up to three single-family residences may
be constructed or converted under this exemption is hereby approved.
2. Said variance is approved subject to the conditions set forth in Exhibit "A" attached hereto.
Findings for such variance are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.
