Summary: Sandra Cole, property owner and applicant, is requesting a special permit to build a new detached two car garage at 1324 Vancouver Avenue, zoned R-l. The existing 14' x 18' detached garage would be demolished. The existing garage is located approximately 26' from the rear property line. The proposed garage would be located 1'-0" from the rear property line and would be 546 SF (21' x 26'). A toilet and sink are proposed within the garage which requires a special permit. The new garage is the iirst of a number of improvements proposed for the property, including an expansion of the existing residence, a new driveway, a new sewer line to the street, drainage to the street, removal of trees, and new brick steps at the front of the property. The existing house is one story and has 2 bedrooms and 1 bathroom. The Chief Building Official and Fire Marshal had no comments on this application (October 7& 8, 1996 memos). Required Findings for a Special Permit: In order to grant a Special Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; � • � SPECIAL PERMIT 1324 Vancouver Avenue (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution and should include iindings. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: Conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped November 4, 1996, Site Plan, Floor Plan and Building Elevations; 2. that the conditions of the City Engineer's October 7, 1996 memos shall be met; 3. that the plate line of the accessory structure shall be not more than eight (8) feet above grade; 4. that the accessory structure shall never be used for accessory living or sleeping purposes, shall never include a kitchen or sleeping area and shall not be used for any home occupation without an amendment to this special permit; and 5. that the use and any improvements for the use shall meet all the requirements of the municipal code and of the 1995 edition California Building and Fire Codes as amended by the City of Burlingame. Dear Sirs/Madams, The project we are proposing is the first stage of a general upgrading, remodeling and partial re-construction of existing improvements which have fallen into disrepai.r. We are requesting permission to install a toilet and hand wash sink in the proposed detached garage to enable personal use and clean-up from yard and mechanical repair work without having to enter the residence. This feature is especially desirable in that current planning ordinance prohibits the construction of a covered walkway between the detached garage and the house, forcing additional traffic into the house during inclement weather from work projects under way in the garage. We have no intention of ever using any portion of the garage for dwelling space as the ordinance is designed to prevent. Furthermore, use of the garage as a dwelling unit is highly unlikely for any subsequent owner for the following reasons: 1. No bathing or shower facility is proposed. 2. No heating or ventilation is being provided, no fuel gas or 220v. power required for heating is being proposed. 3. No kitchen or cooking area is proposed. 4. Windows cannot be installed on the south or east walls of the proposed garage as both sides require 1-hour construction because of proximity of the property line. For any of the above features to be provided, additional permit procedures would be required. For the above reasons, we do not believe that this proposal violates the intent of the ordinance. RESOLUTION APPROVING CATEGORICAL EXEMP'rION AND SPECIAL PERMIT FOR ACCESSORY STRUCTURE RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for special permit for an_accessory structure at 1324 Vancouver Avenue zoned R-1 APN: 026-064-200 ; Sandra Cole 178 West 37th Avenue San Mateo ro ert owner: WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on November 12. 1996 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMIIVED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption per Article 19. Categorically Exempt per Section 15303 -. construction and location of new, small facilities or structures -(e) accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences is hereby approved. 2. Said special permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such special permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo.
