M. 88-14 Recommendation: It is recommended that Council concur with tha Planning Commission and approve the attached map as both Attentive and Final Parcel Map, sub- ject to the foliowing conditions as amended at the Planning Commission meeting: 1. The driveway access to Armsby shall be limited to a 15' maximum width driveway located at least 10' towards Jackling from the center of the proposed lot or for Parcel G. Council may recall approving another division on this property. In May 1988, Council approved a land division creating three lots out of this one lot. The Town of Hillsborough would grant access onto Armsby for only one (1) lot. As a result, the applicant has had the attached map prepared for approval creating one lot, Parcel F(7,986 s.f. area), facing Vancouver with the same frontage as existing (65') and a second lot, Parcel G, with an area of 19,602 s. f. and a frontage of 125'. The developmental conditions attached include the same as the three lot split with others added as appropriate. Staff pointed out to the Commission that Hillsborough has other conditions of approval which the applicant will be required to adhere to. Meeting MEMO TO: FROM: SUBJECT: PLANNING CONIl�IISSION DEPARTMENT OF PUHLIC WORKS - CITY ENGINEER TWO PARCELS -DEEDED LANDS OF CC�LOMBO (VOL. 5706, PAGE 698) -1249 VANCOWER AVLNUE (APN 027-340-010) -P.M. 88-14 -TENTATIVE AND FINAL PARCEL MAP TO DIVIDE ONE PARCEL INTO This parcel map application is to divide an existing lot into two lots, Parcels F(7,986 S.F.) and G(19,602 S.F.). Parcel F will continue to front on Vancouver while Parcel G will front on Armsby Drive, Town of Hillsborough. This is a second subdivision application of 1249 Vancouver Avenue. The previous application was to divide existing lots into three lots and was approved at City Council's May 16, 1988 meeting; however, the Town of Hillsborough allowed access onto Armsby for only one lot. Staff Review This proposed land division is in the R-1 zone, with a required minimum lot size of 7,000 S.F. These two proposed parcels meet Burlingame's 7,000 S.F. minimum required lot area. Parcel G, however, does not meet Hillsborough's minimum 21,780 S.F. lot size. In the block containing this proposed land division, all lots have access and frontages on Vancouver Avenue. One lot, 1215 Vancouver, has access on both Vancouver and Armsby. All lots in this block are in Burlingame. Parcel F street frontage of 65' (55' average lot width) and Parcel G street frontage of 125' (135' average lot width) meet Zoning Ordi- nance requirements of a 55' (60' for Parcel G) minimum street frontage and an average width of 5C'. Parcel G faces on Armsby Drive and will require access through Town of Hillsborough-owned property. In Parcel F, the existing structures are to remain. The house front setback remains at about 40' with a side setback of 5' minimum and rear setback of 65'+. The garage structure is next to the side property line and is in the rear third of the proposed parcel. Parcel G has proposed 25' minimum front setback conforming to Hillsborough's 25' minimum. There is only one other "frontage" on the Burlingame side, 1215 Vancouver, which is about 10' from the Armsby property line. The side and rear setbacks on Parcel G are proposed to conform to City of Burlingame requirements based on the latest zoning code amendments, not Hillsborough requirements. � Page 2 � The Planning Department has reviewed this map and commented that new construction will have to meet the Declining Height Ordinance requirement. The Fire Marshal has no objection provided that the house be protected by a sprinkler system that meets NFC 13-D Stan- dard, and non-combustible roofing will be installed on the house. The Town of Hillsborough, at their July 11, 1988 City Council meeting, approved a 15' wide access off of Armsby Drive with the following conditions: 1. The easement will access one lot with a lot frontage of 125' and approximately 0.450 acres. No further subdivision will be allowed in the future. 2. Access will be located at the most southwesterly corner of the lot. 3. Construct a 5' Asphalt Concrete parking strip across the frontage of the lot behind the curb and gutter on Armsby Drive. 4. The strip of Hillsborough property between the parking strip and the right-of-way shall be maintained and properly land- scaped by the owners of the lot fronting this property. 5. The proposed dwelling shall be reviewed by the Architecture Design and Review Board of the Town of Hillsborough. Hillsborough's Engineering Department has approved a change in the driveway's location to 10' northerly of the middle of Parcel G to provide more sight distance on Armsby. The Subdivision Code, Section 26.24.050 provides four (4) review criteria that need to be addressed in the Commission's review of the proposed map. It states: "The commission shall make its decision upon such considera- tion as, but not limited to, the following: (a) Recommendations of the city engineer; (b) Compatibility of proposed lots to pattern of existing lots in the neighborhood; reverse corner lots or key lots shall not be introduced into a neighborhood where such lots do not now exist; (c) Accessibility to safety services. The commission may consider grade of access roads or easements and require that such grade is not excessive or beyond the capacity to traverse by safety equipment; Page 3 (d) Proposed grading and contours of the finished sites. The commission may require as a condition that the finished contour of the building site or sites reasonably conform with the neighborhood pattern where such �attern exists." From the standpoint of Items (�), (c) and (d) which includes site development, accessibility to safety services, easements, grading and contour of the sites conforming to the neighborhood, the City Engineer can recommend the Commission's approval of this land division based on a field review; review of pr.�,posed easements, grading and access; and subject to the normal developmental condi- tions recommended below. Item (b), compatibilitv of the ro osed lots to patterns of existing lots in the neighborhood, is the only issue which the Commission may wish to consider in some detail since the definition of both neigh- borhood and compatibility to the pattern of existing lots is not defined. In the block bounded by Vancouver Avenue, Jackling Drive, Armsby Drive and Broadway, there is a variety of lot sizes and frontages and patterns. Lot sizes range from 24,960 S.F. down to 6,050 S.F. Excluding 1249 Vancouver, there are 15 lots. Of these, six (6) lots, or 40%, have larger areas than the proposed Parcel F(7,990 S.F.). The frontage for Parcel F remains the same as it is now (65'). Across Vancouver, all street frontages are 50'; and lot areas are 6,000 S.F., except at Easton and Vancouver (13,000 S.F.). Parcel G fronts on Armsby Drive with a proposed area of 19,602 S.F. Only one lot, 1215 Vancouver, is larger in this block. On the Burlingame side of Armsby Avenue, only this proposed lot with a frontage of 125' and possibly the lot at 1215 Vancouver (frontage of 150') can be considered as fronting on Armsby Drive. On the Hills- borough side of Armsby Drive, facing this block, there is only one very long estate lot having an area of 5+ acres and a frontage of 550'+. Commission Questions At their October 24, 1988 study session, the Commission asked the following questions: 1. Number of driveways. Only one (1) driveway out of Parcel G is proposed. 2. The alternate upper driveway - is it an option? The Town of Hillsborough originally approved an upper driveway next to 1215 Vancouver. Sight distance is poor at this location (175' southbound and 90' northbound) and the appli- cant wishes to move the driveway to the center of Parcel G. Page 4 3. The center driveway location gives a good compromise (140' southbound and 125' northbound for sight distance). The desired minimum stopping sight distance is 150 feet at 25 m.p.h. per Caltrans standards. Since there is a somewhat steep grade, 9$ to 14%, in the braking area, the uphill traffic can stop faster than those going downhill. Staff recommends that this driveway be lowered down the hill at least ten feet (10') further than the center of Parcel G. This will provide all cases with a 20 to 25 mph stopping sight distance to an object in the road. Has Hillsborough reviewed the Map? The Town of Hillsborough has reviewed the Map and the proposed driveway location. Their staff has agreed to relocate the driveway from the southeasterly corner to 10' northerly from the center of Parcel G because of stopping sight distance concerns. Planning Commission Action The Planning Commission should hold a Public Hearing. Upon comple- tion of the hearing, the Commission must make a recommendation to Council indicating any reasons for the approval or denial recommenda- tion. Reasons should be tied directly to the Subdivision Ordinance Section 25.24.050 criteria. Staff also recommends the following conditions of approval of the division: l. The driveway access to Armsby shall be limited to a 15' maximum width driveway located at least 10' towards Jackling from the center of the proposed lot or for Parcel G. Parcel F will continue to front on Vancouver while Parcel G will front on Armsby Drive, Town of Hillsborough. This is a second subdivision application of 1249 Vancouver Avenue. The previous application was to divide existing lots into three lots and was approved at City Council's May 16, 1988 meeting; however, the Town of Hillsborough allowed access onto Armsby for only one lot. Staff Review This proposed land division is in the R-1 zone, with a required minimum lot size of 7,000 S.F. These two proposed parcels meet Burlingame's 7,000 S.F. minimum required lot area. Parcel G, however, does not meet Hillsborough's minimum 21,780 S.F. lot size. In the block containing this proposed land division, all lots have access and frontages on Vancouver Avenue. One lot, 1215 Vancouver, has access on both Vancouver and Armsby. All lots in this block are in Burlingame. Parcel F street frontage of 65' (55' average lot width) and Parcel G street frontage of 125' (135' average lot width) meet zoning Ordi- nance requirements of a 55' (60' for Parcel G) minimum street frontage and an average width of 50'. Parcel G faces on Armsby Drive and will require access through Town of Hillsborough-owned property. Parcel F, with existing structures, is proposed to remain. The house front setback remains at about 40' with a side setback of 5' minimum and rear setback of 65'+, The garage structure is next to the side property line and is in the rear third of the proposed parcel. Parcel G has proposed 25' minimum front setback conforming to Hillsborough's 25' minimum. There is only one other "frontage" on the Burlingame side, 1215 Vancouver, which is about 10' from the Armsby property line. The side and rear setbacks on Parcel G are proposed to conform to City of Burlingame requirements based on the latest zoning code amendments, not Hillsborough requirements. Page 2 The Planning Department has reviewed this map and commented that new construction will have to meet the Declining Height Ordinance requirement. The Fire Marshal has no objection provided that the house be protected by a sprinkler system that meets NFC 13-D Stan- dard, and non-combustible roofing will be installed on the house. The Town of Hillsborough, at their July 11, 1988 City Council meeting, approved a 15' wide access off of Armsby Drive with the following conditions: 1. The easement will access one lot with a lot frontage of 125' and approximately 0.450 acres. No further subdivision will be allowed in the future. 2. Access will be located at the most southwesterly corner of the lot. 3. Construct a 5' Asphalt Concrete parking strip across the frontage of the lot behind the curb and gutter on Armsby Drive. 4. The strip of Hillsborough property between the parking strip and the right-of-way shall be maintained and properly land- scaped by the owners of the lot fronting this property. 5. The proposed dwelling shall be reviewed by the Architecture Design and Review Board of the Town of Hillsborough. Hillsborough's Engineering Department has approved a change in the driveway's location to the middle of Parcel G to provide more sight distance on Armsby. The Subdivision Code, Section 26.24.050 provides four (4) review criteria that need to be addressed in the Commission's review of the proposed map. It states: "The commission shall make its decision upon such considera- tion as, but not limited to, the following: (a) Recommendations of the city engineer; (b) Compatibility of proposed lots to pattern of existing lots in the neighborhood; reverse corner lots or key lots shall not be introduced into a neighborhood where such lots do not now exist; (c) Accessibility to safety services. The commission may consider grade of access roads or easements and require that such grade is not excessive or beyond the capacity to traverse by safety equipment; Page 3 (d) Proposed grading and contours of the finished sites. The commission may require as a condition that the finished contour of the building site or sites reasonably conform with the neighborhood pattern where such pattern exists." From the standpoint of Items (a), (c) and (d) which includes site development, accessibility to safety services, easements, grading and contour of the sites conforming to the neighborhood, the City Engineer can recommend the Commission's approval of this land division based on a field review; review of proposed easements, grading and access; and subject to the normal developmental condi- tions recommended below. Item (b), compatibility of the proposed lots to patterns of existing lots in the neighborhood, is the only issue which the Commission may wish to consider in some detail since the definition of both neigh- borhood and compatibility to the pattern of existing lots is not defined. In the block bounded by Vancouver Avenue, Jackling Drive, Armsby Drive and Broadway, there is a variety of lot sizes and frontages and patterns. Lot sizes range from 24,960 S.F. down to 6,050 S.F. Excluding 1249 Vancouver, there are 15 lots. Of these, six (6) lots, or 40$, have larger areas than the proposed Parcel F(7,990 S.F.). The frontage for Parcel F remains the same as it is now (65'). Across Vancouver, all street frontages are 50'; and lot areas are 6,000 S.F., except at Easton and Vancouver (13,000 S.F.). Parcel G fronts on Armsby Drive with a proposed area of 19,602 S.F. Only one lot, 1215 Vancouver, is larger in this block. On the Burlingame side of Armsby Avenue, only this proposed lot with a frontage of 125' and possibly the lot at 1215 Vancouver (frontage of 150') can be considered as fronting on Armsby Drive. On the Hills- borough side of Armsby Drive, facing this block, there is only one very long estate lot having an area of 5+ acres and a frontage of 550'+. Commission Questions At their October 24, 1988 study session, the Commission asked the following questions: l. Number of driveways. Only one (1) driveway out of Parcel G is proposed. 2. The alternate upper driveway - is it an option? The Town of Hillsborough originally approved an upper driveway next to 1215 Vancouver. Sight distance is poor at this location (175' southbound and 90' northbound) and the appli- cant wishes to move the driveway to the center of Parcel G. � Page 4 The center driveway location gives a good compromise (140' southbound and 125' northbound for sight distance). The desired minimum stopping sight distance is 150 feet at 25 m.p.h. per Caltrans standards. Since there is a somewhat steep grade, 9% to 14%, in the braking area, the uphill traffic can stop faster than those going downhill. Staff recommends that this driveway be lowered down the hill at least ten feet (10') further than the center of Parcel G. This will provide all cases with a 20 to 25 mph stopping sight distance to an object in the road. 3. Has Hillsborough reviewed the Map? The Town of Hillsborough has reviewed the Map and the proposed driveway location. Their staff has agreed to relocate the driveway from the southeasterly corner to 10' northerly from the center of Parcel G because of stopping sight distance concerns. Planning Commission Action The Planning Commission should hold a Public Hearing. Upon comple- tion of the hearing, the Commission must make a recommendation to Council indicating any reasons for the approval or denial recommenda- tion. Reasons should be tied directly to the Subdivision Ordinance Section 25.24.050 criteria. Staff also recommends the following conditions of approval of the division: l. This easement will give ingress and egress easements to a property which is currently a one lot parcel located at 1249 Vancouver Avenue. The conditions for granting these access easements are as follows: 1. The easement will access one lot (parcel G and H as shown on the proposed tentative map combined) with a lot frontage of 125' and approximately 0.450 acres. No further subdivision will be allowed in the future. 2. Access will be located at the most south westerly corner of the lot. 3. Construct a 5' Asphalt Concrete parking strip across the frontage of the lot behind the curb and gutter on Armsby Drive. 4. The strip of Hillsborough property between the parking strip and the right-of-way shall be maintained and properly landscaped by the owners of the lot fronting this property. 5. The proposed dwelling shall be reviewed by the Architecture Design and Review Board of the Town of Hillsborough.
